Agreement on the Status of Missions and Representatives of Third States to the North Atlantic Treaty Organization

Considering the Declaration on Peace and Cooperation issued by the Heads of State and Government participating in the meeting of the North Atlantic Council in Rome on 7th and 8th November 1991 calling for the establishment of a North Atlantic Cooperation Council and the North Atlantic Cooperation Council Statement on Dialogue, Partnership and Cooperation of 20th December 1991;

Noting the Partnership for Peace invitation issued and signed by the Heads of State and Government of the Member States of the North Atlantic Treaty Organization at the Meeting of the North Atlantic Council in Brussels on 10th January 1994;

Recognizing the need to determine the status of the missions and representatives of Third States to the Organization;

Considering that the purpose of immunities and privileges contained in the present Agreement is not to benefit individuals but to ensure the efficient performance of their functions in connection with the Organization;

The Parties to the present Agreement have agreed as follows:

Article

1

For the purpose of the present Agreement:

“Organization” means:

The North Atlantic Treaty Organization;

“Member State” means:

A State party to the North Atlantic Treaty done in Washington on 4th April 1949;

“Third State” means:

A State which is not a party to the North Atlantic Treaty done in Washington on 4th April 1949, and which has accepted the invitation to the Partnership for Peace and subscribed to the Partnership for Peace Framework Document, is a Member State of the North Atlantic Cooperation Council or is any other State invited by the North Atlantic Council to establish a mission to the Organization.

Article

2

a)

The Member State in whose territory the Organization has its Headquarters shall accord to the missions of Third States to the Organization and the members of their staff the immunities and privileges accorded to diplomatic missions and their staff;

b)

In addition, the Member State in whose territory the Organization has its Headquarters shall accord the customary immunities and privileges to the representatives of Third States, on temporary mission, who are not covered by paragraph (a) of the present Article, while present in its territory for the purpose of ensuring the representation of Third States in relation to the proceedings of the Organization.

Article

a)

The present Agreement shall be open for signature by Member States and shall be subject to ratification, acceptance or approval. Instruments of ratification, acceptance or approval shall be deposited with the Government of the Kingdom of Belgium which shall notify all signatory States of the deposit of each such instrument;

b)

As soon as two or more signatory States, including the Member State in whose territory the Organization has its Headquarters, have deposited their instruments of ratification, acceptance or approval, the present Agreement shall come into force in respect of those States. It shall come into force in respect of each other signatory State on the date of the deposit of its instrument.

Article

4

a)

The present Agreement may be denounced by any contracting State by giving written notification of denunciation to the Government of the Kingdom of Belgium which shall notify all signatory States of each such notification;

b)

The denunciation shall take effect one year after the receipt of the notification by the Government of the Kingdom of Belgium.

IN WITNESS WHEREOF the undersigned, being duly authorised by their respective Governments, have signed the present Agreement of which the English and French texts are equally authentic.

Verdrag inzake de Status van Zendingen en Vertegenwoordigers van derde Staten bij de Noordatlantische Verdragsorganisatie

Gelet op de Verklaring inzake vrede en samenwerking, afgelegd door de staatshoofden en regeringsleiders die hebben deelgenomen aan de vergadering van de Noordatlantische Raad in Rome op 7 en 8 november 1991, waarin wordt aangedrongen op de oprichting van een Noordatlantische Samenwerkingsraad, en gelet op de Verklaring van de Noordatlantische Samenwerkingsraad inzake dialoog, partnerschap en samenwerking van 20 december 1991;

Wijzend op de uitnodiging tot het Partnerschap voor de vrede, uitgegaan van en ondertekend door de staatshoofden en regeringsleiders van de lidstaten van de Noordatlantische Verdragsorganisatie tijdens de vergadering van de Noordatlantische Raad in Brussel op 10 januari 1994;

Beseffend de noodzaak de status van de zendingen en vertegenwoordigers van derde Staten bij de Organisatie nader te bepalen;

Overwegend dat het doel van de voorrechten en immuniteiten vervat in dit Verdrag niet is personen te bevoorrechten, doch te verzekeren dat zij doelmatig functioneren in verband met de Organisatie;

Zijn de Partijen bij dit Verdrag het onderstaande overeengekomen:

Artikel

1

Voor de toepassing van dit Verdrag wordt verstaan onder:

„Organisatie”: de Noordatlantische Verdragsorganisatie;

„lidstaat”: een Staat die Partij is bij het Noordatlantisch Verdrag, ondertekend te Washington op 4 april 1949;

„derde Staat”: een Staat die geen Partij is bij het Noordatlantische Verdrag, ondertekend te Washington op 4 april 1949, die de uitnodiging tot het Partnerschap voor de vrede heeft aanvaard en het Raamwerkdocument voor het Partnerschap voor de vrede heeft onderschreven, lidstaat is van de Noordatlantische Samenwerkingsraad dan wel een andere Staat is die door de Noordatlantische Raad is uitgenodigd een zending bij de Organisatie te vestigen.

Artikel

2

a

De lidstaat op wiens grondgebied de Organisatie haar zetel heeft, verleent de zendingen van derde Staten bij de Organisatie en hun personeelsleden de voorrechten en immuniteiten die aan diplomatieke zendingen en hun personeelsleden worden verleend;

b

Daarnaast verleent de lidstaat op wiens grondgebied de Organisatie haar zetel heeft de gebruikelijke voorrechten en immuniteiten aan de vertegenwoordigers van derde Staten met een tijdelijke zending, die niet vallen onder letter a van dit artikel, wanneer zij zich op zijn grondgebied bevinden met het oog op de vertegenwoordiging van derde Staten in verband met de werkzaamheden van de Organisatie.

Artikel

a

Dit Verdrag staat open voor ondertekening door de lidstaten en behoeft bekrachtiging, aanvaarding of goedkeuring. De akten van bekrachtiging, aanvaarding of goedkeuring dienen te worden nedergelegd bij de Regering van het Koninkrijk België, die alle ondertekenende Staten in kennis stelt van de nederlegging van elke akte;

b

Zodra twee of meer ondertekenende Staten, waaronder de lidstaat op wiens grondgebied de Organisatie haar zetel heeft, hun akten van bekrachtiging, aanvaarding of goedkeuring hebben nedergelegd, treedt dit Verdrag in werking voor die Staten. Het treedt voor elke andere ondertekenende Staat in werking op de datum van nederlegging van zijn akte.

Artikel

4

a

Dit Verdrag kan door een Verdragsluitende Staat worden opgezegd door middel van een daartoe strekkende schriftelijke kennisgeving aan de Regering van het Koninkrijk België, die alle ondertekenende Staten van deze kennisgeving in kennis stelt.

b

De opzegging wordt van kracht één jaar na ontvangst van de kennisgeving door de Regering van het Koninkrijk België.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd door hun onderscheiden Regeringen, hun handtekening hebben geplaatst onder dit Verdrag, waarvan de Engelse en de Franse tekst gelijkelijk authentiek zijn.
