The Ministry of Foreign Affairs of the Kingdom of the Netherlands presents its compliments to the Embassy of Switzerland and has the honour to propose that, since Switzerland is for the time being not a party to the Further Additional Protocol to the Agreement among the States Parties to the North Atlantic Treaty and the other States participating in the Partnership for Peace regarding the Status of their forces (done at Brussels, on 19 December 1997), the status of a liaison officer to be seconded by Switzerland to the Partnership for Peace Staff Element at Regional Headquarters Allied Forces North in the Netherlands, be agreed upon as follows:

1 Definitions

In this Agreement:

a)
``RHQ AFNORTH" means Regional Headquarters Allied Forces North;
b)
``Liaison Officer" means: a Partnership for Peace Programmes Staff Officer, who will be a member of the Partnership for Peace Staff Element at RHQ AFNORTH;
c)
``Host State authorities" means such state, municipal or other authorities of the Kingdom of the Netherlands as may be appropriate in the context of and in accordance with the laws and regulations of the Kingdom of the Netherlands;
d)
``Convention" means the Vienna Convention on Diplomatic Relations of 18 April 1961.

2 Object and Purpose

Switzerland may second Liaison Officers to the Partnership for Peace Staff Element at RHQ AFNORTH in the Netherlands.

3 Privileges and immunities

Subject to the provisions of this Agreement, a Liaison Officer and members of his family who form part of his household and do not possess Dutch nationality shall enjoy in and vis-à-vis the Netherlands the same privileges and immunities as are conferred on members of the administrative and technical staff by the Convention.

The immunities shall not extend to damages, including personal injury or death, arising from a traffic accident caused by a vehicle or other means of transport belonging to or driven by the Liaison Officer and members of his family, nor to traffic offences.

The protection, as referred to in Article 30, paragraph 1 of the Convention, shall not apply.

The obligations of Switzerland and its personnel that apply under the Convention to members of the administrative and technical staff, shall apply to the persons referred to in paragraph 1 of this Article. All necessary contacts with the authorities of Switzerland shall take place through the diplomatic mission of Switzerland in the Netherlands.

4 Entry, stay and departure

The Kingdom of the Netherlands shall facilitate, if necessary, the entry, stay and departure of the Liaison Officer and members of his family forming part of the household.

This Article shall not prevent the requirement of reasonable evidence to establish that persons claiming the treatment provided for under this Article come within the classes described in paragraph 1 of this Article.

Visas which may be required by persons referred to in this Article shall be granted without charge and as promptly as possible.

5 Notification

Switzerland shall promptly notify the Kingdom of the Netherlands of the name of the Liaison Officer, his arrival and his final departure or the termination of his secondment as well as the arrival and final departure of the members of his family forming part of the household and, where appropriate, the fact that a person has ceased to form part of the household.

The Kingdom of the Netherlands shall issue to the Liaison Officer and members of his family forming part of the household an identification card bearing the photographs of the holder. This card shall serve to identify the holder in relation to all Host State authorities.

6 Settlement of Disputes

Any dispute between Switzerland and the Kingdom of the Netherlands concerning the interpretation or application of this Agreement or any question affecting the Liaison Officer or the relationship between Switzerland and the Kingdom of the Netherlands shall be settled through consultations between the parties and shall not be referred to a national or international tribunal or other third party for settlement.

7 Territorial scope

With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.

If this proposal is acceptable to the Government of Switzerland, the Ministry of Foreign Affairs of the Kingdom of the Netherlands proposes that this note and the affirmative note of the Embassy of Switzerland shall constitute an Agreement between the Kingdom of the Netherlands and the Swiss Confederation, which shall be provisionally applied from the first day of the second month following the day on which the aforementioned affirmative note of the Embassy of Switzerland has been received by the Ministry and shall enter into force on the first day of the second month following the day on which the Kingdom of the Netherlands has informed the Swiss Confederation in writing that the legal requirements for entry into force have been complied with.

The Ministry of Foreign Affairs avails itself of this opportunity to renew to the Embassy of Switzerland the assurances of its highest consideration.

Het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden biedt zijn complimenten aan de Ambassade van Zwitserland aan en heeft de eer voor te stellen dat, aangezien Zwitserland vooralsnog geen partij is bij het (op 19 december 1997 te Brussel gesloten) Nader Aanvullend Protocol bij het Verdrag tussen de Staten die Partij zijn bij het Noord-Atlantisch Verdrag en de overige Staten die deelnemen aan het Partnerschap voor de Vrede nopens de rechtspositie van hun krijgsmachten, het volgende wordt overeengekomen inzake de status van een verbindingsofficier die door Zwitserland wordt gedetacheerd bij de Stafeenheid van het Partnerschap voor de Vrede bij het regionale NAVO-hoofdkwartier van de Allied Forces North in Nederland:

1 Begripsomschrijvingen

In dit verdrag wordt verstaan onder:

a.
„RHQ AFNORTH", het regionale Hoofdkwartier van de Allied Forces North;
b.
„verbindingsofficier", een Stafofficier bij Programma's van het Partnerschap voor de Vrede, die deel uitmaakt van de Stafeenheid van het Partnerschap voor de Vrede bij RHQ AFNORTH;
c.
„autoriteiten van het gastheerland", autoriteiten van de centrale of gemeentelijke overheid of andere autoriteiten van het Koninkrijk der Nederlanden, al naar gelang, en in overeenstemming met, de wetten en voorschriften van het Koninkrijk der Nederlanden;
d.
„Verdrag", het Verdrag van Wenen inzake Diplomatiek Verkeer van 18 april 1961.

2 Voorwerp en doel

Zwitserland kan verbindingsofficieren detacheren bij de Stafeenheid van het Partnerschap voor de Vrede bij RHQ AFNORTH in Nederland.

3 Voorrechten en immuniteiten

Onverminderd de bepalingen van dit verdrag genieten een verbindingsofficier en zijn gezinsleden die deel uitmaken van zijn huishouding en niet de Nederlandse nationaliteit bezitten, in en ten aanzien van Nederland dezelfde voorrechten en immuniteiten als die welke door het Verdrag worden verleend aan de leden van het administratieve en technische personeel.

De immuniteiten strekken zich niet uit tot schade, met inbegrip van persoonlijk letsel of overlijden, als gevolg van een verkeersongeval veroorzaakt door een voertuig of ander vervoermiddel dat toebehoort aan of wordt bestuurd door de verbindingsofficier en leden van zijn gezin, noch tot verkeersovertredingen.

De in artikel 30, eerste lid, van het Verdrag bedoelde bescherming is niet van toepassing.

De verplichtingen van Zwitserland en zijn personeel die krachtens het Verdrag van toepassing zijn op leden van het administratieve en technische personeel, zijn van toepassing op de in het eerste lid van dit artikel bedoelde personen. Alle noodzakelijke contacten met de autoriteiten van Zwitserland vinden plaats via de diplomatieke missie van Zwitserland in Nederland.

4 Binnenkomst, verblijf en vertrek

Het Koninkrijk der Nederlanden vergemakkelijkt, indien nodig, de binnenkomst, het verblijf en het vertrek van de verbindingsofficier en van zijn gezinsleden die deel uitmaken van de huishouding.

Dit artikel vormt geen beletsel voor het vereiste van redelijk bewijs ter vaststelling van het feit dat personen die een beroep doen op de behandeling waarin dit artikel voorziet, vallen in de in het eerste lid omschreven categorieën.

De eventueel benodigde visa voor de in dit artikel bedoelde personen worden kosteloos en zo snel mogelijk verstrekt.

5 Kennisgeving

Zwitserland stelt het Koninkrijk der Nederlanden onverwijld in kennis van de naam van de verbindingsofficier, van zijn aankomst en van zijn definitieve vertrek of van de beëindiging van zijn detachering, alsmede van de aankomst en het definitieve vertrek van zijn gezinsleden die deel uitmaken van de huishouding en, indien van toepassing, van het feit dat een persoon niet langer deel uitmaakt van de huishouding.

Het Koninkrijk der Nederlanden verstrekt aan de verbindingsofficier en aan zijn gezinsleden die deel uitmaken van zijn huishouding een identiteitskaart voorzien van de foto's van de houder. Deze kaart dient ter identificatie van de houder ten overstaan van alle autoriteiten van de gastheerstaat.

6 Beslechting van geschillen

Elk geschil tussen Zwitserland en het Koninkrijk der Nederlanden betreffende de uitlegging of toepassing van dit verdrag of elk vraagstuk aangaande de verbindingsofficier of de betrekkingen tussen Zwitserland en het Koninkrijk der Nederlanden wordt geregeld door middel van overleg tussen de partijen en wordt niet ter beslechting voorgelegd aan een nationaal of internationaal scheidsgerecht of andere derde partij.

7 Territoriale reikwijdte

Wat het Koninkrijk der Nederlanden betreft, is dit verdrag slechts van toepassing op het deel van het Koninkrijk in Europa.

Indien dit voorstel voor de Regering van Zwitserland aanvaardbaar is, stelt het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden voor dat deze nota en de bevestigende nota van de Ambassade van Zwitserland een verdrag zullen vormen tussen het Koninkrijk der Nederlanden en de Zwitserse Bondsstaat, dat voorlopig zal worden toegepast vanaf de eerste dag van de tweede maand volgend op de dag waarop bovengenoemde bevestigende nota van de Ambassade van Zwitserland door het Ministerie is ontvangen, en dat in werking zal treden op de eerste dag van de tweede maand volgend op de dag waarop het Koninkrijk der Nederlanden de Zwitserse Bondsstaat schriftelijk heeft medegedeeld dat aan de wettelijke vereisten voor inwerkingtreding is voldaan.

Het Ministerie van Buitenlandse Zaken maakt van deze gelegenheid gebruik om de Ambassade van Zwitserland de hernieuwde verzekering van zijn zeer bijzondere hoogachting te geven.

AMBASSADE VAN ZWITSERLAND

De Ambassade van Zwitserland biedt haar complimenten aan het Ministerie van Buitenlandse Zaken van het Koninkrijk der Nederlanden aan en heeft de eer de ontvangst te bevestigen van de Nota van 3 juli 2001, die als volgt luidt:

De Ambassade van Zwitserland heeft voorts de eer te bevestigen dat het voorgaande voor de Regering van Zwitserland aanvaardbaar is en dat de Nota van het Ministerie en dit antwoord een verdrag zullen vormen tussen de Zwitserse Bondsstaat en het Koninkrijk der Nederlanden inzake deze aangelegenheid, dat voorlopig zal worden toegepast vanaf de eerste dag van de tweede maand volgend op de dag waarop deze bevestigende nota door het Ministerie is ontvangen, en dat in werking zal treden op de eerste dag van de tweede maand volgend op de dag waarop het Koninkrijk der Nederlanden de Zwitserse Bondsstaat schriftelijk heeft medegedeeld dat aan de wettelijke vereisten voor inwerkingtreding is voldaan.

De Ambassade van Zwitserland maakt van deze gelegenheid gebruik om het Ministerie van Buitenlandse Zaken de hernieuwde verzekering van haar zeer bijzondere hoogachting te geven.
