The Royal Netherlands Embassy presents its compliments to the Ministry of Foreign Affairs of the Republic of Hungary and has the honour to propose, with reference to the Co-operation Agreement between the Republic of Hungary and the European Police Office of 4 October, 2001 (hereinafter ``the Agreement"), and in view of Article 41, paragraph 2 of the Convention based on Article K.3 of the Treaty on European Union, on the establishment of a European Police Office (Europol Convention, 26 July 1995), that the privileges and immunities necessary for the proper performance of the tasks of the liaison officers at Europol referred to in Article 14, paragraph 1 and Annex 3 of the Agreement, be agreed upon as set out in the Attachment.

If this proposal is acceptable to the Ministry of Foreign Affairs of the Republic of Hungary, the Embassy proposes that this note and the affirmative note of the Ministry of Foreign Affairs shall constitute an Agreement between the Kingdom of the Netherlands and the Republic of Hungary, which shall enter into force on the day on which the Agreement enters into force, provided that the Kingdom of the Netherlands and the Republic of Hungary have notified each other that the formalities required for the entry into force have been complied with. In case the entry into force referred to in the previous sentence does not materialise, the present Agreement shall be provisionally applied from the date of the entry into force of the Agreement.

The Royal Netherlands Embassy avails itself of this opportunity to renew to the Ministry the assurances of its highest consideration.

Attachment

1 Definitions

In this Agreement:

a)
``Liaison officer" means: any official stationed at Europol in accordance with Article 14 of the Agreement;
b)
``Government" means the Government of the Kingdom of the Netherlands;
c)
``Host State authorities" means such State, municipal or other authorities of the Kingdom of the Netherlands as may be appropriate in the context of and in accordance with the laws and customs applicable in the Kingdom of the Netherlands;
d)
``Sending State" means the Kingdom of Hungary;
e)
``Archives of the liaison officer" means all records, correspondence, documents, manuscripts, computer and media data, photographs, films, video and sound recordings belonging to or held by the liaison officer, and any other similar material which in the unanimous opinion of the Sending State and the Government forms part of the archives of the liaison officer.

2 Privileges and immunities

Subject to the provisions of this Agreement, the liaison officer and members of his family who form part of his household and do not possess Dutch nationality, shall enjoy in and vis-à-vis the Kingdom of the Netherlands the same privileges and immunities as are conferred on members of the diplomatic staff by the Vienna Convention on Diplomatic Relations of 18 April 1961.

The immunity granted to persons mentioned in paragraph 1 of this Article shall not extend to either:

(i)
civil action by a third party for damages, including personal injury or death, arising from a traffic accident caused by any such person; or
(ii)
criminal and civil jurisdiction over acts performed outside the course of their official duties.

The obligations of Sending States and their personnel that apply under the Vienna Convention to members of the diplomatic staff, shall apply to the persons referred to in paragraph 1 of this Article.

3 Entry, stay and departure

The Government shall facilitate, if necessary, the entry, stay and departure of the liaison officer and members of his family forming part of the household.

This Article shall not prevent the requirement of reasonable evidence to establish that persons claiming the treatment provided for under this Article come within the classes described in paragraph 1 of this Article.

Visas which may be required by persons referred to in this Article shall be granted without charge and as promptly as possible.

4 Employment

Members of the family forming part of the household of the liaison officer not having the nationality of an EU State shall be exempt from the obligation to obtain working permits for the duration of the secondment of the liaison officer.

5 Inviolability of archives

The archives of the liaison officer wherever located and by whomsoever held shall be inviolable.

6 Personal Protection

The Host State authorities shall, if so requested by the Sending State, take all reasonable steps in accordance with their national laws to ensure the necessary safety and protection of the liaison officer, as well as members of his family who form part of his household, whose security is endangered due to the performance of the tasks of the liaison officer at Europol.

7 Facilities and immunities in respect of communication

The Government shall permit the liaison officer to communicate freely and without a need for special permission, for all official purposes, and shall protect the right of the liaison officer to do so. The liaison officer shall have the right to use codes and to dispatch and receive official correspondence and other official communications by courier or in sealed bags which shall be subject to the same privileges and immunities as diplomatic couriers and bags.

The liaison officer shall, as far as may be compatible with the International Telecommunications Convention of 6 November 1982, for his official communications enjoy treatment not less favourable than that accorded by the Kingdom of the Netherlands to any international organisation or government, in the matter of priorities for communication by mail, cable, telegraph, telex, radio, television, telephone, fax, satellite, or other means.

8 Notification

The Sending State shall promptly notify the Government of the name of the liaison officer, his arrival and his final departure or the termination of his secondment as well as the arrival and final departure of the members of the family forming part of the household and, where appropriate, the fact that a person has ceased to form part of the household.

The Government shall issue to the liaison officer and members of his family forming part of the household, an identification card bearing the photograph of the holder. This card shall serve to identify the holder in relation to all Host State authorities.

9 Settlement of Disputes

Any dispute between the Sending State and the Government concerning the interpretation or application of this Agreement, or any question affecting the liaison officer or the relationship between the Sending State and the Government which is not settled amicably, shall be referred for final decision to a tribunal of three arbitrators, at the request of the Sending State or the Government. Each party shall appoint one arbitrator. The third, who shall be chairman of the tribunal, is to be chosen by the first two arbitrators.

If one of the parties fails to appoint an arbitrator within two months following a request from the other party to make such an appointment, the other party may request the President of the Court of Justice of the European Communities or in his absence the Vice-President, to make such an appointment.

Should the first two arbitrators fail to agree upon the third within two months following their appointment, either party may request the President of the Court of Justice of the European Communities, or in his absence the Vice-President, to make such appointment.

Unless the parties agree otherwise, the tribunal shall determine its own procedure.

The tribunal shall reach its decision by a majority of votes. The Chairman shall have a casting vote. The decision shall be final and binding on the Parties to the dispute.

10 Territorial scope

With respect to the Kingdom of the Netherlands, this Agreement shall apply to the part of the Kingdom in Europe only.

The Ministry of Foreign Affairs of the Republic of Hungary presents its compliments to the Embassy of the Kingdom of the Netherlands and has the honour to confirm receipt of Note of 7 February 2002 from the Embassy of the Kingdom of the Netherlands concerning a proposal for the Hungarian party to conclude an agreement between the Republic of Hungary and the Kingdom of the Netherlands, which reads as follows:

The Ministry of Foreign Affairs of the Republic of Hungary has the honour to inform the Embassy that the Government of the Republic of Hungary agrees to the contents of the above-quoted Note and its Attachment, and states that the Embassy's Note and this Note shall constitute an agreement between the Republic of Hungary and the Kingdom of the Netherlands. This agreement shall enter into force on the day on which the Agreement enters into force, provided that the Republic of Hungary and the Kingdom of the Netherlands have notified each other that the formalities required for the entry into force of this agreement have been complied with. De Ambassade van het Koninkrijk der Nederlanden biedt het Ministerie van Buitenlandse Zaken van de Republiek Hongarije haar complimenten aan en heeft de eer, met verwijzing naar de Samenwerkingsovereenkomst van 4 oktober 2001 tussen de Republiek Hongarije en de Europese Politiedienst (hierna te noemen „de Overeenkomst"), en met het oog op artikel 41, tweede lid, van de Overeenkomst op grond van artikel K.3 van het Verdrag betreffende de Europese Unie tot oprichting van een Europese Politiedienst (Europol-Overeenkomst, 26 juli 1995), voor te stellen dat ten aanzien van de voorrechten en immuniteiten benodigd voor de goede taakvervulling van de verbindingsofficieren bij Europol, bedoeld in artikel 14, eerste lid, en Bijlage 3 van de Overeenkomst, overeenstemming wordt bereikt zoals vervat in het Aanhangsel.

Indien dit voorstel aanvaardbaar is voor het Ministerie van Buitenlandse Zaken van de Republiek Hongarije, stelt de Ambassade voor dat deze nota en de bevestigende nota van het Ministerie van Buitenlandse Zaken een verdrag zullen vormen tussen het Koninkrijk der Nederlanden en de Republiek Hongarije, dat in werking zal treden op de dag waarop de Overeenkomst in werking treedt, mits het Koninkrijk der Nederlanden en de Republiek Hongarije elkaar hebben medegedeeld dat aan de procedures voor de inwerkingtreding is voldaan. In het geval dat de in de voorgaande volzin bedoelde inwerkingtreding niet plaatsvindt, wordt dit verdrag voorlopig toegepast vanaf de datum van inwerkingtreding van de Overeenkomst.

De Ambassade maakt van deze gelegenheid gebruik om het Ministerie opnieuw te verzekeren van haar zeer bijzondere hoogachting.

1 Begripsomschrijvingen

In dit verdrag wordt verstaan onder:

a.
„verbindingsofficier", elke functionaris die in overeenstemming met artikel 14 van de Overeenkomst bij Europol wordt geplaatst;
b.
„Regering", de Regering van het Koninkrijk der Nederlanden;
c.
„autoriteiten van de gaststaat", overheids-, gemeentelijke of andere autoriteiten van het Koninkrijk der Nederlanden, naar gelang het geval is in het kader van en in overeenstemming met de wetten en gebruiken die in het Koninkrijk der Nederlanden van toepassing zijn;
d.
„zendstaat", de Republiek Hongarije;
e.
„archief van de verbindingsofficier", alle dossiers, correspondentie, documenten, manuscripten, computer- en mediagegevens, foto's, films, video- en geluidsopnamen die toebehoren aan of in het bezit zijn van de verbindingsofficier, alsmede enig ander soortgelijk materiaal dat naar het unanieme oordeel van de zendstaat en de Regering deel uitmaakt van het archief van de verbindingsofficier.

2 Voorrechten en immuniteiten

Onverminderd de bepalingen van dit Verdrag genieten de verbindingsofficier en zijn gezinsleden die deel uitmaken van zijn huishouding en niet de Nederlandse nationaliteit bezitten, in en ten aanzien van het Koninkrijk der Nederlanden dezelfde voorrechten en immuniteiten als die welke worden verleend aan de leden van het diplomatieke personeel door het Verdrag van Wenen van 18 april 1961 inzake diplomatiek verkeer.

De immuniteit die aan de in het eerste lid van dit artikel genoemde personen wordt verleend, strekt zich niet uit tot:

i.
civiele vorderingen van derden wegens schade, met inbegrip van lichamelijk letsel of overlijden ten gevolge van verkeersongevallen die door deze personen zijn veroorzaakt; of
ii.
strafrechtelijke en civielrechtelijke rechtsmacht ten aanzien van handelingen verricht buiten de uitoefening van hun officiële taken.

De verplichtingen van zendstaten en hun personeel die krachtens het Verdrag van Wenen van toepassing zijn op diplomatieke personeel, zijn van toepassing op de in het eerste lid van dit artikel bedoelde personen.

3 Binnenkomst, verblijf en vertrek

Indien nodig vergemakkelijkt de Regering de binnenkomst, het verblijf en het vertrek van de verbindingsofficier en van zijn gezinsleden die deel uitmaken van de huishouding.

Dit artikel laat de mogelijkheid onverlet om te verlangen dat redelijk bewijs wordt geleverd waaruit blijkt dat de personen die zich op de in dit artikel bedoelde behandeling beroepen, onder de in het eerste lid van dit artikel genoemde categorieën vallen.

De eventueel benodigde visa voor de in dit artikel genoemde personen worden kosteloos en zo spoedig mogelijk verstrekt.

4 Tewerkstelling

Gezinsleden die deel uitmaken van de huishouding van de verbindingsofficier die niet de nationaliteit van een EU-staat hebben, zijn voor de duur van de detachering van de verbindingsofficier vrijgesteld van de verplichting een werkvergunning te verkrijgen.

5 Onschendbaarheid van het archief

De archieven van de verbindingsofficier, waar deze zich ook bevinden en wie deze ook onder zich heeft, zijn onschendbaar.

6 Persoonlijke bescherming

Indien de zendstaat daarom verzoekt, nemen de autoriteiten van de gaststaat in overeenstemming met hun nationale wetten alle doenlijke maatregelen om de nodige veiligheid en bescherming te waarborgen van de verbindingsofficier, alsmede van de leden van zijn gezin die deel uitmaken van zijn huishouding, wier veiligheid in het geding is als gevolg van de taakvervulling van de verbindingsofficier bij Europol.

7 Faciliteiten en immuniteiten met betrekking tot berichtenverkeer

De Regering staat de verbindingsofficier toe om vrijelijk en zonder het vereiste van bijzondere toestemming te communiceren voor alle officiële doeleinden, en beschermt dit recht van de verbindingsofficier. De verbindingsofficier is gerechtigd codes te gebruiken en zijn officiële correspondentie en andere officiële berichten te verzenden of te ontvangen per koerier of in verzegelde tassen, waarvoor dezelfde voorrechten en immuniteiten gelden als voor diplomatieke koeriers en tassen.

Voor zover dit verenigbaar is met het Internationaal Verdrag betreffende de Telecommunicatie van 6 november 1982, geniet de verbindingsofficier voor zijn officiële berichtenverkeer een behandeling die niet minder gunstig is dan die welke door het Koninkrijk der Nederlanden aan een internationale organisatie of regering wordt toegekend, inzake prioriteiten voor poststukken, kabeltelegrammen, telegrammen, telexberichten, radiotelegrammen, televisie-, telefoon-, fax-, satelliet- of andere verbindingen.

8 Kennisgeving

De zendstaat stelt de Regering onverwijld in kennis van de naam van de verbindingsofficier, van zijn aankomst en van zijn definitieve vertrek of van de beëindiging van zijn detachering alsmede van de aankomst en het definitieve vertrek van de gezinsleden die deel uitmaken van zijn huishouding en, indien van toepassing, van het feit dat een persoon niet langer deel uitmaakt van de huishouding.

De Regering verstrekt aan de verbindingsofficier en aan de gezinsleden die deel uitmaken van zijn huishouding een identiteitskaart voorzien van de foto van de houder.Deze kaart dient ter identificatie van de houder ten overstaan van alle autoriteiten van de gaststaat.

9 Beslechting van geschillen

Elk geschil tussen de zendstaat en de Regering betreffende de interpretatie of toepassing van dit verdrag dat niet in der minne, of enige kwestie die betrekking heeft op de verbindingsofficier of op de verhouding tussen de zendstaat en de Regering die niet in der minne wordt geschikt, wordt, op verzoek van de zendstaat of van de Regering, ter onherroepelijke beslissing voorgelegd aan een scheidsgerecht bestaande uit drie scheidsrechters. Elke partij benoemt één scheidsrechter. De derde scheidsrechter, die voorzitter van het scheidsgerecht zal zijn, wordt gekozen door de eerste twee scheidsrechters.

Indien een van de partijen verzuimt een scheidsrechter te benoemen binnen twee maanden na een verzoek van de andere partij een dergelijke benoeming te verrichten, kan de andere partij de President van het Hof van Justitie van de Europese Gemeenschappen, of in zijn afwezigheid de Vice-President, verzoeken deze benoeming te verrichten.

Indien de eerste twee scheidsrechters binnen twee maanden na hun benoeming geen overeenstemming bereiken over de derde, kan elke partij de President van het Hof van Justitie van de Europese Gemeenschappen, of in zijn afwezigheid de Vice-President, verzoeken deze benoeming te verrichten.

Tenzij de partijen anders overeenkomen, stelt het scheidsgerecht zijn eigen procedure vast.

5

Het scheidsgerecht neemt zijn beslissing bij meerderheid van stemmen. De Voorzitter heeft een beslissende stem. De beslissing is onherroepelijk en bindend voor de partijen bij het geschil.

10 Territoriale reikwijdte

Wat het Koninkrijk der Nederlanden betreft, is dit verdrag slechts van toepassing op het deel van het Koninkrijk in Europa.

Ministerie van Buitenlandse Zaken

Het Ministerie van Buitenlandse Zaken van de Republiek Hongarije biedt zijn complimenten aan de Ambassade van het Koninkrijk der Nederlanden aan en heeft de eer de ontvangst te bevestigen van de Nota van de Ambassade van het Koninkrijk der Nederlanden van 7 februari 2002, betreffende een voorstel aan de Hongaarse partij een verdrag te sluiten tussen de Republiek Hongarije en het Koninkrijk der Nederlanden, dat als volgt luidt:

Het Ministerie van Buitenlandse Zaken van de Republiek Hongarije heeft de eer de Ambassade ervan op de hoogte te brengen dat de Regering van de Republiek Hongarije met de inhoud van bovengenoemde Nota en het Aanhangsel daarbij instemt, en verklaart dat de Nota van de Ambassade en deze Nota een verdrag zullen vormen tussen de Republiek Hongarije en het Koninkrijk der Nederlanden. Dit verdrag treedt in werking op de dag waarop de Overeenkomst in werking treedt, mits de Republiek Hongarije en het Koninkrijk der Nederlanden elkaar hebben medegedeeld dat aan de procedures voor de inwerkingtreding is voldaan. In het geval dat de in de voorgaande volzin bedoelde inwerkingtreding niet plaatsvindt, wordt dit Verdrag voorlopig toegepast vanaf de datum van inwerkingtreding van de Overeenkomst.

Het Ministerie maakt van deze gelegenheid gebruik om de Ambassade opnieuw te verzekeren van zijn zeer bijzondere hoogachting.
