The liaison bodies in accordance with Article 24 of the Convention are:

• A)

  in Israel

  the National Insurance Institute, Jerusalem.

• B)

  in the Netherlands

  • a)

    for old-age and survivors pensions and for children's allowances: the Sociale Verzekeringsbank (Social Insurance Bank), Amstelveen;

  • b)

    in other cases: the Landelijk Instituut Sociale Verzekeringen (National Institute Social Security) c/o Gak Nederland BV, Amsterdam

The duties of the liaison bodies are stated in this Arrangement. For the application of the Convention, the liaison bodies may communicate directly with each other as well as with the persons concerned or their representatives.

They shall assist each other in the application of the Convention.

In the cases covered by Article 7, paragraph 1, Article 8, paragraph 2 and Article 9 of the Convention the institution designated in paragraph 2 of this Article, of the State whose legislation is applicable shall issue a certificate stating that the employee shall remain subject to that legislation.

The institutions according to paragraph 1 are:

• -

  in Israel, the National Insurance Institute, Jerusalem;

• -

  in the Netherlands, the Sociale Verzekeringsbank (Social Insurance Bank), Amstelveen.

In order to receive benefits an insured person who is present in the territory of the other State than the competent State shall submit his claim to the insurance institution of the State where he is present:

in Israel: to the National Insurance Institute;

in the Netherlands: Landelijk Instituut Sociale Verzekeringen (National Institute Social Security) c/o Gak Nederland BV, Amsterdam

If the claim has been submitted to the Israeli insurance institution it must be accompanied by a certificate of incapacity for work issued by the doctor providing treatment. This certificate shall indicate the initial date of the incapacity for work, diagnosis and the probable duration of the incapacity for work.

If the claim has been submitted to the Netherlands insurance institution, this institution shall immediately have the incapacity for work medically confirmed by its own doctor and the certificate referred to in the preceeding alinea drawn up.

The insurance institution which has received the claim shall as soon as possible notify the liaison body of the competent State the submitting of the claim for benefits, stating the date on which the claim has been submitted as well as the name and the address of the employer, if any, and send the certificate of incapacity for work which was annexed to the claim to the said liaison body.

At the request of the competent insurance institution the insurance institution of the place where the person concerned is present shall carry out any necessary administrative checks or medical examinations.

The costs of the medical examination shall be refunded by the insurance institution which has requested these examinations.

The competent insurance institution shall pay the benefits directly to the beneficiary by the appropriate method.

If a person in receipt of an invalidity benefit is residing or staying in the territory of a Contracting Party, other than the competent State, administrative checks and medical examinations shall be carried out, at the request of the competent insurance institution, by the insurance institution of the place of stay or residence of the recipient.

If it is established that the recipient referred to in paragraph 1 of this Article is employed or has means in excess of the prescribed limit while receiving benefits, the insurance institution of the place of stay or residence shall send a report to the insurance institution which has requested the check or examination. This report shall indicate in particular the nature of the employment, the amount of earnings or means which the person concerned has had during a reference period to be determinated by the competent insurance institution and, where appropriate, the opinion of a medical expert on the state of health of the person concerned.

The costs of the medical examinations, shall be borne by the insurance institution which has carried out the examination.

The competent insurance institutions shall inform each other as soon as possible of any claim for a pension to which Part III Chapter 4 and Article 28 of the Convention are applicable. This information shall be supplied on a special form which also contains all information necessary for the investigation of the claim by the competent insurance institution of the other State. This form shall take the place of supporting documents.

The competent insurance institutions shall furthermore inform each other of circumstances which are of importance when deciding on a pension.

The competent insurance institutions shall inform each other of decisions which are taken during the process of settling a pension claim.

The final decisions taken by the said institutions shall be simultaneously forwarded to the claimant by the insurance institution of the State in whose territory he resides.

Models of certificates and other documents for the application of this Arrangement shall be drawn up by the liaison bodies.

If it is not possible for a person concerned to submit a required certificate, the insurance institution requiring the certificate shall address itself to the liaison body of the other State in order to obtain the certificate.

Except where Article 30, paragraph I of the Convention is applied, pensions and other benefits shall be paid directly to the persons entitled thereto. In the cases where the said paragraph is applied the arrears have to be paid to the insurance institution that has paid a sum in excess of the pensions due.

All payments of pensions and other benefits to the recipients are free of postal and bank charges.

The liaison bodies and the insurance institutions shall correspond in English.

The liaison bodies shall where necessary, assist each other in translating claims and other documents, written in their respective official languages, into English.

De verbindingsorganen overeenkomstig artikel 24 van het Verdrag zijn:

• A.

  in Israël

  in Nederland

  • a)

    voor ouderdomspensioenen en pensioenen aan nagelaten betrekkingen en voor kinderbijslagen: de Sociale Verzekeringsbank, Amstelveen;

  • b)

    in overige gevallen: het Landelijk Instituut Sociale Verzekeringen (National Institute Social Security) p/a GAK Nederland bv, Amsterdam.

De taken van de verbindingsorganen zijn uiteengezet in dit Akkoord. Voor de toepassing van het Verdrag kunnen de verbindingsorganen zich zowel rechtstreeks met elkaar als met de betrokken personen of hun vertegenwoordigers in verbinding stellen.

Zij zijn elkaar bij de toepassing van het Verdrag behulpzaam.

In de in artikel 7, eerste lid, artikel 8, tweede lid, en artikel 9 van het Verdrag bedoelde gevallen verstrekt het in het tweede lid van dit artikel aangewezen orgaan van de Staat, waarvan de wetgeving van toepassing is, een bewijs waarin wordt verklaard dat de werknemer aan deze wetgeving onderworpen blijft.

De organen, bedoeld in het eerste lid zijn:

• -

  in Israël, het Nationaal Verzekeringsinstituut, Jeruzalem;

• -

  in Nederland, de Sociale Verzekeringsbank (Social Insurance Bank), Amstelveen.

Om in aanmerking te komen voor uitkeringen moet een verzekerde die zich op het grondgebied van de andere dan de bevoegde Staat bevindt, zijn aanvraag indienen bij het verzekeringsorgaan van de Staat waar hij zich bevindt:

in Israël: bij het Nationaal Verzekeringsinstituut;

in Nederland: Landelijk Instituut Sociale Verzekeringen (National Institute Social Security) p/a GAK Nederland bv, Amsterdam dat voor de Nieuwe Algemene Bedrijfsvereniging optreedt.

Indien de aanvraag is ingediend bij het Israëlische yerzekeringsorgaan dient een verklaring inzake arbeidsongeschiktheid te zijn bijgevoegd, die is afgegeven door de behandelende geneesheer. Deze verklaring vermeldt de aanvangsdatum van de arbeidsongeschiktheid, de diagnose en de vermoedelijke duur van de arbeidsongeschiktheid.

Indien de aanvraag is ingediend bij het Nederlandse verzekeringsorgaan, laat dit orgaan de arbeidsongeschiktheid onmiddellijk door zijn eigen geneeskundige vaststellen en de in de voorgaande alinea bedoelde verklaring opmaken.

Het verzekeringsorgaan dat de aanvraag heeft ontvangen stelt het verbindingsorgaan van de bevoegde Staat zo spoedig mogelijk in kennis van de indiening van de aanvraag om uitkeringen, onder vermelding van de datum waarop de aanvraag is ingediend, alsmede van de naam en het adres van de werkgever, indien aanwezig, en zendt de verklaring inzake arbeidsongeschiktheid dat bij de aanvraag was gevoegd, aan bedoeld verbindingsorgaan.

Op verzoek van het bevoegde verzekeringsorgaan oefent het verzekeringsorgaan van de plaats waar de betrokkene zich bevindt, zonodig de administratieve of medische controle uit.

De kosten van de medische controle worden vergoed door het verzekeringsorgaan dat om deze controle heeft verzocht.

Het bevoegde verzekeringsorgaan betaalt de uitkeringen rechtstreeks aan de rechthebbende, op de daartoe aangewezen wijze, uit.

Indien een persoon die in het genot is van een invaliditeitsuitkering, op het grondgebied van een andere Verdragsluitende Partij dan de bevoegde Staat woont of verblijft, oefent het verzekeringsorgaan van de verblijf- of woonplaats van de rechthebbende, op verzoek van het bevoegde verzekeringsorgaan, de administratieve en medische controle uit.

Indien wordt vastgesteld dat de in het eerste lid van dit artikel bedoelde rechthebbende werkzaamheden verricht of inkomsten heeft welke de vastgestelde grens overschrijden, terwijl hij uitkeringen geniet, zendt het verzekeringsorgaan van de verblijf- of woonplaats een rapport aan het verzekeringsorgaan dat de controle heeft verzocht. Dit rapport vermeldt in het bijzonder de aard van de verrichte werkzaamheden, het bedrag van de verdiensten of inkomsten welke betrokkene gedurende een door het bevoegde verzekeringsorgaan vast te stellen wachttijd genoot, alsmede in voorkomend geval, het oordeel van een medisch deskundige omtrent de gezondheidstoestand van de betrokkene.

De kosten van de medische controle komen ten laste van het verzekeringsorgaan dat de controle heeft uitgeoefend.

De bevoegde verzekeringsorganen stellen elkaar zo spoedig mogelijk in kennis van iedere aanvraag om pensioen waarop Deel III, Hoofdstuk 4 en artikel 28 van het Verdrag van toepassing zijn. Deze kennisgeving wordt gedaan op een speciaal formulier, dat tevens alle gegevens bevat welke voor de behandeling van de aanvraag door het bevoegde verzekeringsorgaan van de andere Staat nodig zijn. Dit formulier geldt bovendien als bewijsstuk.

De bevoegde verzekeringsorganen stellen elkaar voorts in kennis van omstandigheden welke voor de vaststelling van een pensioen van belang zijn.

De bevoegde verzekeringsorganen stellen elkaar in kennis van beslissingen welke gedurende de behandeling van een pensioenaanvraag worden genomen.

De door bedoelde organen genomen definitieve beslissingen worden gelijktijdig aan de aanvrager gezonden door het verzekeringsorgaan van de Staat op het grondgebied waarvan hij woont.

De modellen van de verklaringen en andere documenten welke voor de toepassing van dit Akkoord nodig zijn, worden door de verbindingsorganen vastgesteld.

Indien de betrokkene de vereiste verklaring niet kan overleggen, stelt het verzekeringsorgaan dat de verklaring verlangt, zich in verbinding met het verbindingsorgaan van de andere Staat teneinde deze verklaring te verkrijgen.

Tenzij artikel 30, eerste lid, van het Verdrag wordt toegepast, worden pensioenen en andere uitkeringen rechtstreeks aan de rechthebbenden uitbetaald. Ingeval genoemd lid wordt toegepast moeten de achterstallige termijnen worden betaald aan het verzekeringsorgaan dat een hoger bedrag dan de verschuldigde pensioenen heeft uitbetaald.

Alle pensioenen en andere uitkeringen worden aan de rechthebbenden uitbetaald zonder aftrek van porti of bankkosten.

De verbindingsorganen zijn elkaar zo nodig behulpzaam bij het vertalen in het Engels van aanvragen en andere documenten welke in hun onderscheiden officiële talen zijn gesteld.
