Overeenkomst tussen het Koninkrijk der Nederlanden en de Democratische Socialistische Republiek Sri Lanka inzake technische samenwerking

In connection with the projects, the Government of the Democratic Socialist Republic of Sri Lanka shall:

• a.

  exempt the Netherlands advisers, experts, technicians, agents or employees supplied by the Government of the Netherlands (hereinafter referred to as "The Netherlands personnel") under the terms of this Agreement from all taxes and other fiscal charges in respect of all remunerations paid to them by the Netherlands Government;

• b.

  facilitate the prompt clearance, free of customs duty, of professional equipment imported into Sri Lanka by the Netherlands personnel. This provision will also cover bonafide personal and household effects and one motor vehicle for each member of the Netherlands personnel brought into Sri Lanka within 6 months of arrival. The household effects and motor vehicles so imported under this clause shall be reexported from Sri Lanka at the time of departure or disposed of as directed by the Government of Sri Lanka;

• c.

  make provisions for the issue of entry-visas and work-permits, free of charge, to the Netherlands personnel employed or to be employed on a project by the Netherlands Government;

• d.

  grant the Netherlands personnel the most favourable exchange facilities, i.e. external accounts, for all their Netherlands remunerations;

• e.

  offer the Netherlands personnel and their families in Sri Lanka repatriation facilities in time of national or international crises;

• f.

  issue to the Netherlands personnel an identification document in which is stated the name of the holder, the post he holds and the name of the sending agency or organization;

• g.

  ensure that the Netherlands personnel and their families are accorded treatment of a manner no less favourable than that accorded to technical assistance personnel assigned to Sri Lanka by any other country or international organization.

For the follow up and evaluation of the cooperation under this Agreement the competent authorities shall, whenever needed, be available to each other for consultation and shall give each other such relevant information on the cooperation as may be reasonably requested.

The Government of Sri Lanka shall furthermore, whenever appropriate and practicable, enable representatives of the Government of the Netherlands to study the various activities supported by the Netherlands Government.

In verband met de projecten zal de Regering van de Democratische Socialistische Republiek Sri Lanka:

• a.

  de Nederlandse adviseurs, deskundigen, technici, vertegenwoordigers of employés, die door de Nederlandse Regering ter beschikking worden gesteld (hierna te noemen „het Nederlandse personeel”) krachtens de bepalingen van deze Overeenkomst vrijstellen van alle belastingen en andere fiscale heffingen ten aanzien van alle hun door de Nederlandse Regering betaalde vergoedingen;

• b.

  een snelle inklaring, vrij van invoerrechten, bevorderen van door het Nederlandse personeel in Sri Lanka ingevoerde beroepsuitrusting. Deze bepaling heeft ook betrekking op bonafide persoonlijke bezittingen en huisraad en één motorvoertuig voor elk lid van het Nederlandse personeel in Sri Lanka, ingevoerd binnen zes maanden na aankomst. Het krachtens deze bepaling ingevoerde huisraad en de ingevoerde motorvoertuigen dienen bij vertrek weer uit Sri Lanka te worden uitgevoerd of van de hand te worden gedaan op een wijze als door de Regering van Sri Lanka wordt bepaald;

• c.

  de kosteloze verschaffing van inreisvisa en werkvergunningen regelen aan het door de Nederlandse Regering bij een project te werk gestelde of te werk te stellen Nederlandse personeel;

• d.

  het Nederlandse personeel, wat alle Nederlandse vergoedingen betreft, de gunstigste wisselfaciliteiten verlenen, te weten rekeningen voor niet-ingezetenen;

• e.

  het Nederlandse personeel, alsmede de gezinnen daarvan, in Sri Lanka repatriëringsfaciliteiten bieden in tijden van nationale of internationale crises;

• f.

  het Nederlandse personeel een identificatiedocument verschaffen, waarin opgenomen de naam van de houder, de functie die hij bekleedt en de naam van de instelling of de organisatie die hem heeft uitgezonden;

• g.

  ervoor zorg dragen dat het Nederlandse personeel, alsmede de gezinnen daarvan, worden behandeld op een wijze die niet minder gunstig is dan die waarop door een ander land of een andere internationale organisatie aan Sri Lanka toegewezen personeel voor technische bijstand wordt behandeld.

Voor het vervolg op en de evaluatie van de samenwerking krachtens deze Overeenkomst zijn de bevoegde autoriteiten steeds wanneer zulks noodzakelijk is voor elkaar beschikbaar voor overleg en verschaffen zij elkaar al de ter zake dienende gegevens omtrent de samenwerking waarom redelijkerwijs kan worden verzocht.

De Regering van Sri Lanka stelt voorts, wanneer zulks passend en uitvoerbaar is, vertegenwoordigers van de Nederlandse Regering in staat een studie te maken van de diverse door de Nederlandse Regering gesteunde activiteiten.
