The States concluding this Treaty, hereinafter referred to as the “Parties to the Treaty”,
Considering the devastation that would be visited upon all mankind by a nuclear war and the consequent need to make every effort to avert the danger of such a war and to take measures to safeguard the security of peoples,
Believing that the proliferation of nuclear weapons would seriously enhance the danger of nuclear war,
In conformity with resolutions of the United Nations General Assembly calling for the conclusion of an agreement on the prevention of wider dissemination of nuclear weapons,
Undertaking to co-operate in facilitating the application of International Atomic Energy Agency safeguards on peaceful nuclear activities,
Expressing their support for research, development and other efforts to further the application, within the framework of the International Atomic Energy Agency safeguards system, of the principle of safeguarding effectively the flow of source and special fissionable materials by use of instruments and other techniques at certain strategic points,
Affirming the principle that the benefits of peaceful applications of nuclear technology, including any technological by-products which may be derived by nuclear-weapon States from the development of nuclear explosive devices, should be available for peaceful purposes to all Parties to the Treaty, whether nuclear-weapon or non-nuclear-weapon States,
Convinced that, in furtherance of this principle, all Parties to the Treaty are entitled to participate in the fullest possible exchange of scientific information for, and to contribute alone or in cooperation with other States to, the further development of the applications of atomic energy for peaceful purposes,
Declaring their intention to achieve at the earliest possible date the cessation of the nuclear arms race and to undertake effective measures in the direction of nuclear disarmament,
Urging the co-operation of all States in the attainment of this objective,
Recalling the determination expressed by the Parties to the 1963 Treaty banning nuclear weapon tests in the atmosphere, in outer space and under water in its Preamble to seek to achieve the discontinuance of all test explosions of nuclear weapons for all time and to continue negotiations to this end,
Desiring to further the easing of international tension and the strengthening of trust between States in order to facilitate the cessation of the manufacture of nuclear weapons, the liquidation of all their existing stockpiles, and the elimination from national arsenals of nuclear weapons and the means of their delivery pursuant to a Treaty on general and complete disarmament under strict and effective international control,
Recalling that, in accordance with the Charter of the United Nations, States must refrain in their international relations from the threat or use of force against the territorial integrity or political independence of any State, or in any other manner inconsistent with the Purposes of the United Nations, and that the establishment and maintenance of international peace and security are to be promoted with the least diversion for armaments of the world's human and economic resources,
Have agreed as follows:
Each nuclear-weapon State Party to the Treaty undertakes not to transfer to any recipient whatsoever nuclear weapons or other nuclear explosive devices or control over such weapons or explosive devices directly, or indirectly; and not in any way to assist, encourage, or induce any non-nuclear-weapon State to manufacture or otherwise acquire nuclear weapons or other nuclear explosive devices, or control over such weapons or explosive devices.
Each non-nuclear-weapon State Party to the Treaty undertakes not to receive the transfer from any transferor whatsoever of nuclear weapons or other nuclear explosive devices or of control over such weapons or explosive devices directly, or indirectly; not to manufacture or otherwise acquire nuclear weapons or other nuclear explosive devices; and not to seek or receive any assistance in the manufacture of nuclear weapons or other nuclear explosive devices.
Each non-nuclear-weapon State Party to the Treaty undertakes to accept safeguards, as set forth in an agreement to be negotiated and concluded with the International Atomic Energy Agency in accordance with the Statute of the International Atomic Energy Agency and the Agency's safeguards system, for the exclusive purpose of verification of the fulfilment of its obligations assumed under this Treaty with a view to preventing diversion of nuclear energy from peaceful uses to nuclear weapons or other nuclear explosive devices. Procedures for the safeguards required by this Article shall be followed with respect to source or special fissionable material whether it is being produced, processed or used in any principal nuclear facility or is outside any such facility. The safeguards required by this Article shall be applied on all source or special fissionable material in all peaceful nuclear activities within the territory of such State, under its jurisdiction, or carried out under its control anywhere.
Each State Party to the Treaty undertakes not to provide: (a) source or special fissionable material, or (b) equipment or material especially designed or prepared for the processing, use or production of special fissionable material, to any non-nuclear-weapon State for peaceful purposes, unless the source or special fissionable material shall be subject to the safeguards required by this Article.
The safeguards required by this Article shall be implemented in a manner designed to comply with Article IV of this Treaty, and to avoid hampering the economic or technological development of the Parties or international co-operation in the field of peaceful nuclear activities, including the international exchange of nuclear material and equipment for the processing, use or production of nuclear material for peaceful purposes in accordance with the provisions of this Article and the principle of safeguarding set forth in the Preamble of the Treaty.
Non-nuclear-weapon States Party to the Treaty shall conclude agreements with the International Atomic Energy Agency to meet the requirements of this Article either individually or together with other States in accordance with the Statute of the International Atomic Energy Agency. Negotiation of such agreements shall commence within 180 days from the original entry into force of this Treaty. For States depositing their instruments of ratification or accession after the 180-day period, negotiation of such agreements shall commence not later than the date of such deposit. Such agreements shall enter into force not later than eighteen months after the date of initiation of negotiations.
Nothing in this Treaty shall be interpreted as affecting the inalienable right of all the Parties to the Treaty to develop research, production and use of nuclear energy for peaceful purposes without discrimination and in conformity with Articles I and II of this Treaty.
All the Parties to the Treaty undertake to facilitate, and have the right to participate in, the fullest possible exchange of equipment, materials and scientific and technological information for the peaceful uses of nuclear energy. Parties to the Treaty in a position to do so shall also co-operate in contributing alone or together with other States or international organizations to the further development of the applications of nuclear energy for peaceful purposes, especially in the territories of non-nuclear-weapon States Party to the Treaty, with due consideration for the needs of the developing areas of the world.
Each Party to the Treaty undertakes to take appropriate measures to ensure that, in accordance with this Treaty, under appropriate international observation and through appropriate international procedures, potential benefits from any peaceful applications of nuclear explosions will be made available to non-nuclear-weapon States Party to the Treaty on a non-discriminatory basis and that the charge to such Parties for the explosive devices used will be as low as possible and exclude any charge for research and development. Non-nuclear-weapon States Party to the Treaty shall be able to obtain such benefits, pursuant to a special international agreement or agreements, through an appropriate international body with adequate representation of non-nuclear-weapon States. Negotiations on this subject shall commence as soon as possible after the Treaty enters into force. Non-nuclear-weapon States Party to the Treaty so desiring may also obtain such benefits pursuant to bilateral agreements.
Each of the Parties to the Treaty undertakes to pursue negotiations in good faith on effective measures relating to cessation of the nuclear arms race at an early date and to nuclear disarmament, and on a treaty on general and complete disarmament under strict and effective international control.
Nothing in this Treaty affects the right of any group of States to conclude regional treaties in order to assure the total absence of nuclear weapons in their respective territories.
Any Party to the Treaty may propose amendments to this Treaty. The text of any proposed amendment shall be submitted to the Depositary Governments which shall circulate it to all Parties to the Treaty. Thereupon, if requested to do so by one-third or more of the Parties to the Treaty, the Depositary Governments shall convene a conference, to which they shall invite all the Parties to the Treaty, to consider such an amendment.
Any amendment to this Treaty must be approved by a majority of the votes of all the Parties to the Treaty, including the votes of all nuclear-weapon States Party to the Treaty and all other Parties which, on the date the amendment is circulated, are members of the Board of Governors of the International Atomic Energy Agency. The amendment shall enter into force for each Party that deposits its instrument of ratification of the amendment upon the deposit of such instruments of ratification by a majority of all the Parties, including the instruments of ratification of all nuclear-weapon States Party to the Treaty and all other Parties which, on the date the amendment is circulated, are members of the Board of Governors of the International Atomic Energy Agency. Thereafter, it shall enter into force for any other Party upon the deposit of its instrument of ratification of the amendment.
Five years after the entry into force of this Treaty, a conference of Parties to the Treaty shall be held in Geneva, Switzerland, in order to review the operation of this Treaty with a view to assuring that the purposes of the Preamble and the provisions of the Treaty are being realised. At intervals of five years thereafter, a majority of the Parties to the Treaty may obtain, by submitting a proposal to this effect to the Depositary Governments, the convening of further conferences with the same objective of reviewing the operation of the Treaty.
This Treaty shall be open to all States for signature. Any State which does not sign the Treaty before its entry into force in accordance with paragraph 3 of this Article may accede to it at any time.
This Treaty shall be subject to ratification by signatory States. Instruments of ratification and instruments of accession shall be deposited with the Governments of the United States of America, the United Kingdom of Great Britain and Northern Ireland and the Union of Soviet Socialist Republics, which are hereby designated the Depositary Governments.
This Treaty shall enter into force after its ratification by the States, the Governments of which are designated Depositaries of the Treaty, and forty other States signatory to this Treaty and the deposit of their instruments of ratification. For the purposes of this Treaty, a nuclear-weapon State is one which has manufactured and exploded a nuclear weapon or other nuclear explosive device prior to January 1, 1967.
For States whose instruments of ratification or accession are deposited subsequent to the entry into force of this Treaty, it shall enter into force on the date of the deposit of their instruments of ratification or accession.
The Depositary Governments shall promptly inform all signatory and acceding States of the date of each signature, the date of deposit of each instrument of ratification or of accession, the date of the entry into force of this Treaty, and the date of receipt of any requests for convening a conference or other notices.
This Treaty shall be registered by the Depositary Governments pursuant to article 102 of the Charter of the United Nations.
Each Party shall in exercising its national sovereignty have the right to withdraw from the Treaty if it decides that extraordinary events, related to the subject matter of this Treaty, have jeopardized the supreme interests of its country. It shall give notice of such withdrawal to all other Parties to the Treaty and to the United Nations Security Council three months in advance. Such notice shall include a statement of the extraordinary events it regards as having jeopardized its supreme interests.
This Treaty, the English, Russian, French, Spanish and Chinese texts of which are equally authentic, shall be deposited in the archives of the Depositary Governments. Duly certified copies of this Treaty shall be transmitted by the Depositary Governments to the Governments of the signatory and acceding States.
IN WITNESS WHEREOF the undersigned, duly authorised, have signed this Treaty.

The General Assembly,
Recalling its resolutions 2346 A (XXII) of 19 December 1967, 2153 A (XXI) of 17 November 1966, 2149 (XXI) of 4 November 1966, 2028 (XX) of 19 November 1965 and 1665 (XVI) of 4 December 1961,
Convinced of the urgency and great importance of preventing the spread of nuclear weapons and of intensifying international cooperation in the development of peaceful applications of atomic energy,
Having considered the report of the Conference of the Eighteen-Nation Committee on Disarmament, dated 14 March 1968, and appreciative of the work of the Committee on the elaboration of the draft non-proliferation treaty, which is attached to that report,
Convinced that, pursuant to the provisions of the treaty, all signatories have the right to engage in research, production and use of nuclear energy for peaceful purposes and will be able to acquire source and special fissionable materials, as well as equipment for the processing, use and production of nuclear material for peaceful purposes,
Convinced further that an agreement to prevent the further proliferation of nuclear weapons must be followed as soon as possible by effective measures on the cessation of the nuclear arms race and on nuclear disarmament, and that the non-proliferation treaty will contribute to this aim,
Affirming that in the interest of international peace and security both nuclear-weapon and non-nuclear-weapon States carry the responsibility of acting in accordance with the principles of the Charter of the United Nations that the sovereign equality of all States shall be respected, that the threat or use of force in international relations shall be refrained from and that international disputes shall be settled by peaceful means,
Commends the Treaty on the Non-Proliferation of Nuclear Weapons, the text of which is annexed to the present resolution;
Requests the Depositary Governments to open the Treaty for signature and ratification at the earliest possible date;
Expresses the hope for the widest possible adherence to the Treaty by both nuclear-weapon and non-nuclear-weapon States;
Requests the Conference of the Eighteen-Nation Committee on Disarmament and the nuclear-weapon States urgently to pursue negotiations on effective measures relating to the cessation of the nuclear arms race at an early date and to nuclear disarmament, and on a treaty on general and complete disarmament under strict and effective international control;
Requests the Conference of the Eighteen-Nation Committee on Disarmament to report on the progress of its work to the General Assembly at its twenty-third session.
The Security Council,
Noting with appreciation the desire of a large number of States to subscribe to the Treaty on the Non-Proliferation of Nuclear Weapons, and thereby to undertake not to receive the transfer from any transferor whatsoever of nuclear weapons or other nuclear explosive devices or of control over such weapons or explosive devices directly, or indirectly; not to manufacture or otherwise acquire nuclear weapons or other nuclear explosive devices; and not to seek or receive any assistance in the manufacture of nuclear weapons or other nuclear explosive devices,
Taking into consideration the concern of certain of these States that, in conjunction with their adherence to the Treaty on the Non-Proliferation of Nuclear Weapons, appropriate measures be undertaken to safeguard their security,
Bearing in mind that any aggression accompanied by the use of nuclear weapons would endanger the peace and security of all States,
Recognizes that aggression with nuclear weapons or the threat of such aggression against a non-nuclear-weapon State would create a situation in which the Security Council, and above all its nuclear-weapon State permanent members, would have to act immediately in accordance with their obligations under the United Nations Charter;
Welcomes the intention expressed by certain States that they will provide or support immediate assistance, in accordance with the Charter, to any non-nuclear-weapon State Party to the Treaty of the Non-Proliferation of Nuclear Weapons that is a victim of an act or an object of a threat of aggression in which nuclear weapons are used;
Reaffirms in particular the inherent right, recognized under Article 51 of the Charter, of individual and collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security.
De Staten die dit Verdrag sluiten, hierna te noemen de partijen bij het Verdrag,
Overwegend de rampspoed, die over de gehele mensheid zou komen als gevolg van een nucleaire oorlog en de daaruit voortvloeiende noodzaak alles te doen om het gevaar van een zodanige oorlog af te wenden en maatregelen te treffen ter waarborging van de veiligheid der volkeren;
Van mening, dat de verspreiding van kernwapens de kans op een nucleaire oorlog ernstig zou vergroten;
In overeenstemming met resoluties van de Algemene Vergadering der Verenigde Naties, waarin wordt aangedrongen op het sluiten van een overeenkomst inzake het voorkomen van een verdere verspreiding van kernwapens;
Zich ertoe verbindend samen te werken bij het bevorderen van de toepassing van de waarborgen der Internationale Organisatie voor Atoomenergie voor vreedzame kernenergie-activiteiten;
Uitdrukking gevend aan hun steun aan het onderzoek, de ontwikkeling en andere activiteiten gericht op het bevorderen van de toepassing binnen het stelsel van waarborgen van de Internationale Organisatie voor Atoomenergie, van het beginsel van doeltreffende controle op de circulatie van basismaterialen en bijzondere splijtbare materialen door gebruikmaking van instrumenten en andere technieken op bepaalde strategische punten;
Bevestigend het beginsel, dat de voordelen van de vreedzame toepassingen van de nucleaire technologie, met inbegrip van alle technologische nevenprodukten verkregen door kernwapenstaten uit de ontwikkeling van nucleaire explosiemiddelen, voor vreedzame doeleinden ter beschikking dienen te staan aan alle partijen, zowel kernwapenstaten als niet-kernwapenstaten;
Overtuigd, dat ter bevordering van dit beginsel alle partijen bij dit Verdrag het recht hebben om deel te nemen aan een zo uitgebreid mogelijke uitwisseling van wetenschappelijke gegevens ten behoeve van, en om afzonderlijk dan wel in samenwerking met andere staten bij te dragen tot, de verdere ontwikkeling van de toepassingen van atoomenergie voor vreedzame doeleinden;
Verklarend dat zij voornemens zijn aan de kernbewapeningswedloop zo spoedig mogelijk een einde te maken en doeltreffende maatregelen te nemen in de richting van nucleaire ontwapening;
Aandringend op de medewerking van alle Staten ter verwezenlijking van dit doel;
Herinnerend aan de door de partijen bij het gedeeltelijk Kernstopverdrag van 1963 in de preambule van dat Verdrag tot uitdrukking gebrachte vastbeslotenheid om te streven naar de beëindiging voor altijd van alle proefexplosies van kernwapens en om tot dat doel de onderhandelingen voort te zetten;
Verlangend de internationale spanning te verminderen en het vertrouwen tussen de Staten te vergroten ten einde de mogelijkheden te verbeteren voor de stopzetting van de vervaardiging van kernwapens, de liquidatie van alle bestaande voorraden kernwapens en verwijdering van kernwapens en hun overbrengingsmiddelen uit de nationale arsenalen overeenkomstig een verdrag inzake algemene en volledige ontwapening onder strenge en doeltreffende internationale controle;
Eraan herinnerend dat Staten zich, in overeenstemming met het Handvest der Verenigde Naties, in hun internationale betrekkingen moeten onthouden van bedreiging met of gebruik van geweld tegen de territoriale integriteit of politieke onafhankelijkheid van enige Staat, of op enige andere wijze die onverenigbaar is met de doeleinden van de Verenigde Naties, en dat de totstandbrenging en handhaving van de internationale vrede en veiligheid dienen te worden bevorderd met een zo gering mogelijke aanwending van de menselijke en economische hulpbronnen van de wereld voor bewapening;
Zijn overeengekomen als volgt:
Iedere kernwapenstaat die partij is bij dit Verdrag verbindt zich, kernwapens of andere nucleaire explosiemiddelen, dan wel de beschikkingsmacht over zodanige wapens of explosiemiddelen noch direct noch indirect aan welke ontvanger dan ook over te dragen, noch een niet-kernwapenstaat op enigerlei wijze te helpen, aan te moedigen of te bewegen kernwapens of andere nucleaire explosiemiddelen te vervaardigen of anderszins te verwerven of de beschikkingsmacht over zodanige wapens of explosiemiddelen te verwerven.
Iedere niet-kernwapenstaat, die partij is bij dit Verdrag, verbindt zich, de overdracht door welke overdrager dan ook van kernwapens of andere nucleaire explosiemiddelen of van de beschikkingsmacht over zodanige wapens of explosiemiddelen noch direct noch indirect te aanvaarden, noch kernwapens of andere nucleaire explosiemiddelen te vervaardigen of anderszins te verwerven en evenmin te trachten hulp te verkrijgen bij de vervaardiging van kernwapens of andere nucleaire explosiemiddelen of zodanige hulp te aanvaarden.
Iedere niet-kernwapenstaat die partij is bij dit Verdrag verbindt zich tot aanvaarding van waarborgen, neergelegd in een Overeenkomst waarover zal worden onderhandeld en die zal worden gesloten met de Internationale Organisatie voor Atoomenergie in overeenstemming met het Statuut en het waarborgstelsel van die organisatie, welke waarborgen uitsluitend verificatie ten doel hebben van de naleving van de verplichtingen die hij ingevolge dit Verdrag op zich heeft genomen ten einde te voorkomen, dat kernenergie in plaats van voor vreedzame doeleinden wordt aangewend voor kernwapens of andere nucleaire explosiemiddelen. De procedures voor de op grond van dit artikel vereiste waarborgen worden in acht genomen ten aanzien van basismaterialen en bijzondere splijtbare materialen ongeacht of deze worden vervaardigd, verwerkt of gebruikt in een grote kernenergieinstallatie dan wel zich buiten een zodanige installatie bevinden. De op grond van dit artikel vereiste waarborgen zijn van toepassing op alle basismaterialen of bijzondere splijtbare materialen bij alle vreedzame nucleaire werkzaamheden op het grondgebied van die Staat, onder zijn jurisdictie, of te eniger plaatse onder zijn beschikkingsmacht verricht.
Iedere Staat die partij is bij dit Verdrag verbindt zich ertoe, a. basismaterialen of bijzondere splijtbare materialen, of b. uitrusting of materialen die in het bijzonder zijn ontworpen of gemaakt voor de verwerking, het gebruik of de vervaardiging van bijzondere splijtbare materialen niet te leveren aan niet-kernwapenstaten voor vreedzame doeleinden, tenzij de basismaterialen of bijzondere splijtbare materialen onderworpen zijn aan de op grond van dit artikel vereiste waarborgen.
De op grond van dit artikel vereiste waarborgen worden op zodanige wijze toegepast, dat wordt voldaan aan artikel IV van dit Verdrag en dat geen belemmering ontstaat van de economische en technologische ontwikkeling van de partijen of van de internationale samenwerking ten aanzien van werkzaamheden met betrekking tot het vreedzame gebruik van kernenergie, met inbegrip van de internationale uitwisseling van kernmaterialen en uitrusting voor de verwerking, het gebruik of de vervaardiging van kernmaterialen voor vreedzame doeleinden overeenkomstig het bepaalde in dit artikel en het in de preambule neergelegde beginsel van controle.
Overeenkomsten met de Internationale Organisatie voor Atoomenergie ten einde aan de in dit artikel gestelde eisen te voldoen worden door niet-kernwapenstaten die partij zijn bij dit Verdrag hetzij individueel, hetzij tezamen met andere Staten gesloten overeenkomstig het statuut van de Internationale Organisatie voor Atoomenergie. De onderhandelingen over die overeenkomsten dienen binnen 180 dagen na de oorspronkelijke inwerkingtreding van dit Verdrag te beginnen. Voor Staten die hun akten van bekrachtiging na deze periode van 180 dagen nederleggen, dienen de onderhandelingen over die Overeenkomsten uiterlijk op de datum van deze nederlegging te beginnen. De Overeenkomsten dienen uiterlijk achttien maanden na de datum waarop de onderhandelingen werden aangevangen in werking te treden.
Geen enkele bepaling in dit Verdrag mag worden uitgelegd als van invloed te zijn op het onvervreemdbare recht van alle partijen bij het Verdrag om het onderzoek met betrekking tot, en de produktie en het gebruik van, kernenergie voor vreedzame doeleinden zonder discriminatie en in overeenstemming met de artikelen I en II van dit Verdrag te ontwikkelen.
Alle partijen bij het Verdrag hebben het recht deel te nemen aan een zo uitgebreid mogelijke uitwisseling van uitrusting, materialen en wetenschappelijke en technologische gegevens ten behoeve van het vreedzame gebruik van kernenergie, en verbinden zich ertoe een zodanige uitwisseling te bevorderen. Partijen bij het Verdrag die zulks kunnen doen, zullen ook medewerken om afzonderlijk dan wel in samenwerking met andere staten of internationale organisaties bij te dragen tot de verdere ontwikkeling van de toepassingen van kernenergie voor vreedzame doeleinden, inzonderheid op het grondgebied van niet-kernwapenstaten die partij zijn bij het Verdrag, en zullen daarbij passende aandacht schenken aan de behoeften van de in ontwikkeling verkerende gebieden van de wereld.
Iedere partij bij dit Verdrag verbindt zich tot het treffen van passende maatregelen ten einde te verzekeren, dat eventuele voordelen van vreedzame toepassingen van kernexplosies in overeenstemming met dit Verdrag onder passend internationaal toezicht en door middel van passende internationale procedures op niet-discriminatoire basis ter beschikking zullen komen van niet-kernwapenstaten die partij zijn bij dit Verdrag, en dat de kosten die aan deze partijen voor de gebruikte explosiemiddelen in rekening worden gebracht zo laag mogelijk zullen zijn en dat daarin de kosten voor onderzoek en ontwikkeling niet begrepen zullen worden. Niet-kernwapenstaten die partij zijn bij dit Verdrag zullen die voordelen ingevolge een bijzondere internationale overeenkomst of overeenkomsten kunnen verkrijgen door bemiddeling van een passend internationaal orgaan waarin de niet-kernwapenstaten voldoende vertegenwoordigd zijn. Onderhandelingen over dit onderwerp zullen zo spoedig mogelijk na de in werkingtreding van het Verdrag aanvangen. Niet-kernwapenstaten die partij zijn bij dit Verdrag zullen, wanneer zij zulks wensen, die voordelen ook kunnen verkrijgen ingevolge bilaterale overeenkomsten.
Elk van de partijen bij dit Verdrag verbindt zich ertoe, te goeder trouw onderhandelingen te voeren omtrent doeltreffende maatregelen met betrekking tot spoedige beëindiging van de nucleaire bewapeningswedloop en tot nucleaire ontwapening en omtrent een verdrag; inzake algemene en volledige ontwapening onder strenge en doeltreffende internationale controle.
Geen enkele bepaling in dit Verdrag tast het recht van een groep staten aan, regionale verdragen te sluiten ten einde algehele afwezigheid van kernwapens op hun onderscheiden grondgebied te verzekeren.
Iedere partij bij dit Verdrag kan voorstellen doen tot wijziging van dit Verdrag. De tekst van iedere voorgestelde wijziging wordt overgelegd aan de depotregeringen, die deze aan alle partijen bij het Verdrag doen toekomen. Daarna roepen, indien ten minste een derde van de partijen bij het Verdrag zulks verzoekt, de depotregeringen ter bespreking van bedoelde wijziging een conferentie bijeen, waartoe zij alle partijen bij het Verdrag uitnodigen.
Iedere wijziging van dit Verdrag moet worden goedgekeurd met een meerderheid van de stemmen van alle partijen bij het Verdrag, daaronder begrepen de stemmen van alle kernwapenstaten die partij zijn bij dit Verdrag en van alle andere partijen die op het tijdstip, waarop de wijziging wordt toegezonden lid zijn van de Raad van Beheer van de Internationale Organisatie voor Atoomenergie. De wijziging wordt ten aanzien van elke partij die haar akte van bekrachtiging van de wijziging nederlegt van kracht na nederlegging van de akten van bekrachtiging door een meerderheid van alle partijen, daaronder begrepen de akten van bekrachtiging van alle kernwapenstaten die partij zijn bij dit Verdrag en van alle andere partijen die op het tijdstip waarop de wijziging wordt toegezonden, lid zijn van de Raad van Beheer van de Internationale Organisatie voor Atoomenergie. Daarna wordt zij ten aanzien van iedere andere partij van kracht op het ogenblik waarop deze haar akte van bekrachtiging van de wijziging nederlegt.
Vijf jaar na de inwerkingtreding van dit Verdrag wordt er door de partijen bij het Verdrag te Genève, Zwitserland, een conferentie belegd, met het doel de werking van het Verdrag aan een onderzoek te onderwerpen ten einde te verzekeren dat de doeleinden van de preambule worden verwezenlijkt en dat de bepalingen van het Verdrag worden nagekomen. Daarna kan met tussenpozen van vijf jaar een meerderheid van de partijen bij het Verdrag, door indiening van een daartoe strekkend voorstel bij de depotregeringen, de bijeenroeping verkrijgen van verdere conferenties met hetzelfde doel van een onderzoek van de werking van het Verdrag.
Dit Verdrag staat voor alle Staten voor ondertekening open. Iedere Staat die het Verdrag niet vóór de datum van inwerkingtreding overeenkomstig lid 3 van dit artikel ondertekent, kan te allen tijde tot dit Verdrag toetreden.
Dit Verdrag dient te worden bekrachtigd door de ondertekenende Staten. De akten van bekrachtiging en de akten van toetreding worden nedergelegd bij de regering van de Verenigde Staten van Amerika, de regering van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland en de regering van de Unie van Sovjet Socialistische Republieken, die hierbij worden aangewezen als depotregeringen.
Dit Verdrag treedt in werking na bekrachtiging door de depotregeringen en veertig andere Staten die dit Verdrag hebben ondertekend, en de nederlegging van hun akten van bekrachtiging. Voor de toepassing van dit Verdrag wordt onder een kernwapenstaat verstaan een Staat die een kernwapen of ander nucleair explosiemiddel vóór 1 januari 1967 heeft vervaardigd en tot ontploffing heeft gebracht.
Ten aanzien van Staten wier akten van bekrachtiging of van toetreding na de inwerkingtreding van dit Verdrag worden nedergelegd, treedt het in werking op de datum van de nederlegging van hun akten van bekrachtiging of van toetreding.
De depotregeringen doen alle ondertekenende en toetredende Staten onverwijld mededeling van de datum van iedere ondertekening, de datum van de nederlegging van iedere akte van bekrachtiging of van toetreding, de datum van de inwerkingtreding van dit Verdrag, alsmede van de datum van ontvangst van elk verzoek een conferentie te beleggen of van elke andere kennisgeving.
Dit Verdrag wordt door de depotregeringen geregistreerd ingevolge artikel 102 van het Handvest der Verenigde Naties.
Iedere partij heeft, in de uitoefening van haar nationale soevereiniteit, het recht het Verdrag op te zeggen indien zij van mening is dat buitengewone gebeurtenissen die betrekking hebben op het onderwerp van dit Verdrag de hoogste belangen van het land in gevaar hebben gebracht. Zij stelt alle andere partijen bij het Verdrag, alsmede de Veiligheidsraad der Verenigde Naties, drie maanden van tevoren van deze opzegging in kennis. Deze kennisgeving dient een beschrijving te bevatten van de buitengewone gebeurtenissen die, naar haar oordeel, haar hoogste belangen in gevaar hebben gebracht.
Vijfentwintig jaar na de inwerkingtreding van het Verdrag wordt een conferentie belegd ten einde te beslissen of het Verdrag voor onbeperkte tijd van kracht zal blijven, dan wel of het voor één of meer nieuwe bepaalde perioden zal worden verlengd. Deze beslissing wordt genomen door een meerderheid van de partijen bij het Verdrag.
Dit Verdrag, waarvan de Engelse, de Russische, de Franse, de Spaanse en de Chinese tekst gelijkelijk authentiek zijn, wordt nedergelegd in de archieven van de depotregeringen, die daarvan voor eensluidend gewaarmerkte afschriften doen toekomen aan de regeringen der ondertekenende en toetredende staten.
TEN BIJKE WAARVAN de ondertekenenden, daartoe behoorlijk gemachtigd, dit Verdrag hebben ondertekend.
