Overeenkomst tussen de Regering van het Koninkrijk der Nederlanden en de Verenigde Naties, de Internationale Arbeidsorganisatie, de Voedsel- en Landbouworganisatie van de Verenigde Naties, de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur, de Internationale Burgerluchtvaart Organisatie, de Wereldgezondheidsorganisatie, de Internationale Vereniging voor Verreberichtgeving, de Wereld Meteorologische Organisatie, de Internationale Organisatie voor Atoomenergie, de Wereldpostvereniging en de Intergouvernementele Maritieme Consultatieve Organisatie inzake technische hulp aan Suriname en de Nederlandse Antillen

The Organizations shall render technical assistance to the Government of Surinam or the Netherlands Antilles, subject to the availability of the necessary funds. The Organizations, acting jointly or separately, and the Government of Surinam or the Netherlands Antilles shall co-operate in arranging, on the basis of the requests received from the Government concerned and approved by the Organizations concerned, mutually agreeable programmes of operations for the carrying out of technical assistance activities.

The Government of the Kingdom assumes international responsibility for any arrangements concluded or undertakings entered into by the Government of Surinam or the Netherlands Antilles pursuant to the present Agreement, in the same manner as if they had been concluded or entered into in the name of the Government of the Kingdom.

Such technical assistance shall be furnished and received in accordance with the relevant resolutions and decisions of the assemblies, conferences and other organs of the Organizations; technical assistance rendered within the technical assistance sector of the United Nations Development Programme shall, in particular, be furnished and received in accordance with the Observations and Guiding Principles set forth in Annex I of Resolution 222 A (IX) of the Economic and Social Council of the United Nations of 15 August 1949, and in Resolution 2029 (XX) of 22 November 1965 of the General Assembly of the United Nations.

Such technical assistance may consist of:

• (a)

  making available the services of experts, in order to render advice and assistance to or through the Government of Surinam or the Netherlands Antilles;

• (b)

  organizing and conducting seminars, training programmes, demonstration projects, expert working groups, and related activities in such places as may be mutually agreed upon;

• (c)

  awarding scholarships and fellowships or making other arrangements, under which candidates nominated by the Government of Surinam or the Netherlands Antilles and approved by the Organizations concerned shall study or receive training outside the country;

• (d)

  preparing and executing pilot projects, tests, experiments or research in such places as may be mutually agreed upon;

• (e)

  providing any other form of technical assistance which may be agreed upon by the Organizations and the Government of Surinam or the Netherlands Antilles.

• (a)

  Experts who are to render advice and assistance to or through the Government of Surinam or the Netherlands Antilles shall be selected by the Organizations in consultation with that Government. They shall be responsible to the Organizations concerned.

• (b)

  In the performance of their duties, the experts shall act in close consultation with the Government of Surinam or the Netherlands Antilles and with persons or bodies so designated by the Government concerned, and shall comply with instructions from the Government concerned as may be appropriate to the nature of their duties and the assistance to be given and as may be mutually agreed upon between the Organizations concerned and the Government of Surinam or the Netherlands Antilles.

• (c)

  The experts shall, in the course of their advisory work, make every effort to instruct any technical staff the Government of Surinam or the Netherlands Antilles may associate with them, in their professional methods, techniques and practices, and in the principles on which these are based.

Any technical equipment or supplies which may be furnished by the Organizations shall remain their property unless and until such time as title may be transferred on terms and conditions mutually agreed upon between the Organizations concerned and the Government of Surinam or the Netherlands Antilles.

The Government of Surinam or the Netherlands Antilles shall be responsible for dealing with any claims which may be brought by third parties against the Organizations and their experts, agents or employees and shall hold harmless such Organizations and their experts, agents and employees in case of any claims or liabilities resulting from operations under this Agreement, except where it is agreed by the Government of Surinam or the Netherlands Antilles, the Administrator of the United Nations Development Programme, and the Organizations concerned that such claims or liabilities arise from the gross negligence or wilful misconduct of such experts, agents or employees.

The Government of Surinam or the Netherlands Antilles shall do everything within its means to ensure the effective use of the technical assistance provided and, in particular, agrees to apply to the fullest possible extent the provisions set forth in Annex I to Resolution 222 A (IX) of the Economic and Social Council under the heading “Participation of Requesting Governments”.

The Government of Surinam or the Netherlands Antilles and the Organizations concerned shall consult together regarding the publication, as appropriate, of any findings and reports of experts that may prove of benefit to other countries and to the Organizations themselves.

In any case, the Government of Surinam or the Netherlands Antilles will, as far as practicable, make available to the Organizations concerned information on the actions taken as a consequence of the assistance rendered and on the results achieved, if requested by the Organizations.

The Government of Surinam or the Netherlands Antilles shall associate with the experts such technical staff as may be mutually agreed upon and as may be necessary to give full effect to the provision of Article I, paragraph 4 (c).

The Organizations shall defray, in full or in part, as may be mutually agreed upon, the costs necessary to the technical assistance which are payable outside Surinam or the Netherlands Antilles as follows:

• (a)

  The salaries of the experts;

• (b)

  The costs of transportation and subsistence of the experts during their travel to and from the point of entry into Surinam or the Netherlands Antilles;

• (c)

  The cost of any travel outside Surinam or the Netherlands Antilles;

• (d)

  Insurance of the experts;

• (e)

  Purchase and transport to and from the point of entry into Surinam or the Netherlands Antilles of any equipment or supplies provided by the Organizations;

• (f)

  Any other expenses outside Surinam or the Netherlands Antilles approved by the Organizations concerned.

The Organizations concerned shall defray such expenses in local currency of Surinam or the Netherlands Antilles as are not payable by the Government of Surinam or the Netherlands Antilles under Article IV, paragraphs 1 and 2 of this Agreement.

The Government of Surinam or the Netherlands Antilles shall contribute to the cost of technical assistance by paying for, or directly furnishing, the following facilities and services:

• (a)

  Local personnel services, technical and administrative, including the necessary local secretarial help, interpreter-translators, and related assistance;

• (b)

  The necessary office space and other premises;

• (c)

  Equipment and supplies produced within Surinam or the Netherlands Antilles;

• (d)

  Transportation of personnel, supplies and equipment for official purposes within Surinam or the Netherlands Antilles, including local transport;

• (e)

  Postage and telecommunications for official purposes;

• (f)

  Such medical services and facilities for technical assistance personnel as may be available to the civil servants of Surinam or the Netherlands Antilles.

• (a)

  The local allowances of experts shall be paid by the Organizations, but the Government of Surinam or the Netherlands Antilles shall contribute towards such local allowances an amount which shall be computed by the Administrator of the United Nations Development Programme in accordance with the relevant resolutions and decisions of the Economic and Social Council, the Governing Council of the United Nations Development Programme, and other governing bodies, concerning the technical assistance sector of the said Programme.

• (b)

  Before the beginning of each year or of a mutually agreed upon period of months, the Government of Surinam or the Netherlands Antilles shall pay an advance against its contribution in such amount as may be determined by the Administrator of the United Nations Development Programme under the resolutions and decisions referred to in the preceding paragraph. At the end of each such year or period the Government of Surinam or the Netherlands Antilles will pay or be credited with, as the case may be, the difference between the amount paid by it in advance and the full amount of its contribution payable in accordance with (a) above.

• (c)

  The contributions of the Government of Surinam or the Netherlands Antilles towards such local allowances shall be paid to such account as may be designated for this purpose by the Secretary-General of the United Nations, in accordance with such procedures as may be mutually agreed upon.

• (d)

  The term “expert” as used in this paragraph also includes any other technical assistance personnel assigned by the Organizations for service in Surinam or the Netherlands Antilles pursuant to this Agreement except any representative in the country of the United Nations Development Programme and his staff.

• (e)

  The Government of Surinam or the Netherlands Antilles and the Organization concerned may agree on other arrangements for financing the local allowance of those experts whose services are made available under a technical assistance programme financed from the Regular budget of one of the Organizations.

In appropriate cases the Government of Surinam or the Netherlands Antilles shall put at the disposal of the Organizations such labour, equipment, supplies and other services or property as may be needed for the execution of the work of their experts and other officials, and as may be mutually agreed upon.

The Government of Surinam or the Netherlands Antilles shall defray such portion of the expenses to be paid outside Surinam or the Netherlands Antilles, as are not payable by the Organizations and as may be mutually agreed upon.

The Government of the Kingdom, and the Government of Surinam or the Netherlands Antilles, insofar as it is not already bound to do so, shall apply to the Organizations, their property, funds and assets, and to their officials, including technical assistance experts,

• (a)

  in respect of the United Nations, the Convention on the Privileges and Immunities of the United Nations;

• (b)

  in respect of the Specialized Agencies, the Convention on the Privileges and Immunities of the Specialized Agencies; and

• (c)

  in respect of the International Atomic Energy Agency, the Agreement on the Privileges and Immunities of the International Atomic Energy Agency.

The Government of the Kingdom, and the Government of Surinam or the Netherlands Antilles shall take all practical measures to facilitate the activities of the Organizations under this Agreement and to assist experts and other officials of the Organizations in obtaining such services and facilities as may be required to carry on these activities. When carrying out their responsibilities under this Agreement, the Organizations, their experts and other officials shall have the benefit of the most favourable legal rate of conversion of currency.

• (a)

  After the approval constitutionally required in the Kingdom of the Netherlands has been obtained, this Agreement shall enter into force on the date of receipt by the Administrator of the United Nations Development Programme of a relevant notification from the Government of the Kingdom.

• (b)

  Nevertheless, the Government of the Kingdom and the Organizations shall provisionally apply the provisions of the present Agreement for a period not exceeding one year from the date on which the Agreement is signed.

This Agreement shall replace the Agreement concluded at New York on 6 October 1954 between the United Nations, the International Labour Organization, the Food and Agriculture Organization of the United Nations, the United Nations Educational, Scientific and Cultural Organization, the International Civil Aviation Organization and the World Health Organization on the one hand, and the Government of the Kingdom of the Netherlands on the other hand, concerning technical assistance to the overseas parts of the Kingdom of the Netherlands for whose international relations the Government of the Kingdom is responsible.

The provisions of this Agreement shall not apply to technical assistance rendered to the Government of Surinam or the Netherlands Antilles by the Organizations under their regular programmes of technical assistance, where such regular programmes of technical assistance are governed by any agreement which the Government of the Kingdom and those Organizations may conclude relating thereto.

This Agreement may be modified by agreement between the Organizations concerned and the Government of the Kingdom. Any relevant matter for which no provision is made in this Agreement shall be settled by the Organizations concerned and by the Government of the Kingdom in keeping with the relevant resolutions and decisions of the assemblies, conferences, councils and other organs of the Organizations. Each party to this Agreement shall give full and sympathetic consideration to any proposal for such settlement advanced by the other party.

This Agreement may be terminated by all or any of the Organizations, so far as they are respectively concerned, or by the Government of the Kingdom, upon written notice to the other parties and shall terminate 60 days after receipt of such notice.

De Organisaties verlenen technische hulp aan de Regering van Suriname of van de Nederlandse Antillen, indien de daartoe benodigde gelden beschikbaar zijn. De Organisaties, die gezamenlijk of afzonderlijk optreden, en de Regering van Suriname of de Nederlandse Antillen werken samen, op basis van de van de betrokken Regering ontvangen en door de desbetreffende Organisaties goedgekeurde verzoeken, bij het opstellen van wederzijds aanvaardbare werkprogramma's voor het uitvoeren van werkzaamheden op het gebied van technische hulp.

De Regering van het Koninkrijk neemt de internationale verantwoordelijkheid op zich voor de overeenkomsten die de Regering van Suriname of de Nederlandse Antillen krachtens deze Overeenkomst heeft gesloten, alsook voor de verbintenissen die zij krachtens deze Overeenkomst heeft aangegaan, als waren deze namens de Regering van het Koninkrijk gesloten of aangegaan.

Zodanige technische hulp wordt verschaft en ontvangen overeenkomstig de daarop betrekking hebbende resoluties en besluiten van de vergaderingen, conferenties en andere organen van de Organisaties; in het bijzonder technische hulp die wordt verleend binnen de technische hulpsector van het Ontwikkelingsprogramma van de Verenigde Naties wordt verschaft en ontvangen overeenkomstig de Opmerkingen en Leidende Beginselen vermeld in bijlage I van resolutie 222 A (IX) van de Economische en Sociale Raad der Verenigde Naties van 15 augustus 1949 en in resolutie 2029 (XX) van 22 november 1965 van de Algemene Vergadering van de Verenigde Naties.

Zodanige technische hulp kan bestaan in:

• (a)

  het beschikbaar stellen van de diensten van deskundigen ten einde aan of door tussenkomst van de Regering van Suriname of de Nederlandse Antillen advies te geven en hulp te verlenen;

• (b)

  het organiseren en leiden van studiegroepen, opleidingsprogramma's, demonstratie-projecten, werkgroepen van deskundigen en daarmede verband houdende werkzaamheden, op in onderling overleg vast te stellen plaatsen;

• (c)

  het toekennen van „scholarships” en „fellowships” of het treffen van andere regelingen ingevolge welke door de Regering van Suriname of de Nederlandse Antillen aangewezen en door de betrokken Organisaties goedgekeurde kandidaten buiten het land gaan studeren of een opleiding gaan volgen;

• (d)

  het voorbereiden en uitvoeren van proef-projecten, proeven, experimenten of wetenschappelijke onderzoekingen op in onderling overleg vast te stellen plaatsen;

• (e)

  het verschaffen van technische hulp in enige andere vorm waaromtrent tussen de Organisaties en de Regering van Suriname of de Nederlandse Antillen overeenstemming is bereikt.

• (a)

  De deskundigen die aan of door tussenkomst van de Regering van Suriname of de Nederlandse Antillen advies moeten geven en hulp moeten verlenen, worden door de Organisaties gekozen in overleg met die Regering. Zij zijn verantwoording verschuldigd aan de betrokken Organisaties.

• (b)

  Bij de uitvoering van hun taak handelen de deskundigen in nauw overleg met de Regering van Suriname of de Nederlandse Antillen en met personen of lichamen die daartoe door de betrokken Regering zijn aangewezen; zij houden zich aan de van de betrokken Regering ontvangen instructies voor zover deze in overeenstemming zijn met de aard van hun taak en de te verstrekken hulp en waaromtrent tussen de betrokken Organisaties en de Regering van Suriname of de Nederlandse Antillen overeenstemming is bereikt.

• (c)

  Bij het verrichten van hun voorlichtingswerk pogen de deskundigen het technische personeel dat de Regering van Suriname of de Nederlandse Antillen hun eventueel zou toevoegen, onderricht te geven in de methoden, de techniek en de praktijk van hun beroep en in de beginselen waarop deze zijn gebaseerd.

De technische uitrusting en de voorraden die door de Organisaties ter beschikking worden gesteld, blijven hun eigendom, tenzij en tot op het ogenblik waarop het eigendomsrecht wordt overgedragen op tussen de betrokken Organisaties en de Regering van Suriname of de Nederlandse Antillen onderling overeen te komen voorwaarden.

De Regering van Suriname of de Nederlandse Antillen is aansprakelijk voor alle vorderingen die door derden worden ingesteld tegen de Organisaties en hun deskundigen, agenten of functionarissen en vrijwaart die Organisaties en hun deskundigen, agenten en functionarissen in geval van enigerlei uit de krachtens deze Overeenkomst ondernomen werkzaamheden voortvloeiende vorderingen of verplichtingen, tenzij de Regering van Suriname of de Nederlandse Antillen, de Administrateur van het Ontwikkelingsprogramma van de Verenigde Naties en de betrokken Organisaties het erover eens zijn dat deze vorderingen of verplichtingen het gevolg zijn van grove nalatigheid of opzettelijk onjuist handelen van die deskundigen, agenten of functionarissen.

De Regering van Suriname of de Nederlandse Antillen doet alles wat in haar vermogen ligt om een doeltreffend gebruik te verzekeren van de verstrekte technische hulp en stemt in het bijzonder in met een zo ruim mogelijke toepassing van de in bijlage I bij resolutie 222 A (IX) van de Economische en Sociale Raad, onder het hoofd „Deelneming van Verzoekende Regeringen” vermelde bepalingen.

De Regering van Suriname of de Nederlandse Antillen en de betrokken Organisaties plegen onderling overleg over de publikatie, voor zover dit passend wordt geacht, van de bevindingen en de rapporten van deskundigen die van belang kunnen blijken te zijn voor andere landen en voor de Organisaties zelf.

In ieder geval verstrekt de Regering van Suriname of de Nederlandse Antillen, voor zover dat mogelijk is, de betrokken Organisaties op hun verzoek inlichtingen betreffende werkzaamheden die zijn verricht als gevolg van de verleende hulp en betreffende de bereikte resultaten.

De Regering van Suriname of de Nederlandse Antillen stelt de deskundigen een in onderling overleg samengestelde en voor de volledige uitvoering van het bepaalde in artikel I, lid 4 (c), noodzakelijk geachte technische staf ter beschikking.

De Organisaties betalen geheel of gedeeltelijk, naar gelang onderling wordt overeengekomen, de aan de technische hulp verbonden kosten, voor zover die betaald dienen te worden buiten Suriname of de Nederlandse Antillen, te weten:

• (a)

  De salarissen van de deskundigen;

• (b)

  De reis- en onderhoudskosten van de deskundigen tijdens hun reis naar en van het punt waar zij Suriname of de Nederlandse Antillen binnenkomen, onderscheidenlijk verlaten;

• (c)

  De kosten van reizen buiten Suriname of de Nederlandse Antillen;

• (d)

  De verzekering van de deskundigen;

• (e)

  De aankoop van door de Organisaties verschafte uitrusting en voorraden en het vervoer van deze uitrusting en voorraden naar en van het punt waar zij Suriname of de Nederlandse Antillen binnenkomen;

• (f)

  Alle andere buiten Suriname of de Nederlandse Antillen gemaakte kosten voor zover deze door de betrokken Organisaties zijn goedgekeurd.

De betrokken Organisaties betalen in de plaatselijke valuta van Suriname of de Nederlandse Antillen de onkosten welke niet door de Regering van Suriname of de Nederlandse Antillen dienen te worden betaald krachtens artikel IV, lid 1 en 2, van deze Overeenkomst.

De Regering van Suriname of de Nederlandse Antillen dragen bij in de kosten van de technische hulp door betaling van of door het rechtstreeks verschaffen van de volgende faciliteiten en diensten:

• (a)

  Technische en administratieve diensten van plaatselijk personeel, met inbegrip van plaatselijke kantoorhulpkrachten, tolken-vertalers en soortgelijke hulp;

• (b)

  De noodzakelijke kantoorruimte en andere gebouwen;

• (c)

  Uitrusting en voorraden geproduceerd in Suriname of de Nederlandse Antillen;

• (d)

  Vervoer van personeel, voorraden en uitrusting voor officiële doeleinden in Suriname of de Nederlandse Antillen, met inbegrip van plaatselijk vervoer;

• (e)

  Postverbindingen en verreberichtgevingsverbindingen voor officiële doeleinden;

• (f)

  Dezelfde medische diensten en faciliteiten ten behoeve van het bij de technische hulpverlening betrokken personeel als de overheidsambtenaren van Suriname of de Nederlandse Antillen ter beschikking staan.

• (a)

  De plaatselijke vergoedingen voor de deskundigen worden betaald door de Organisaties, doch de Regering van Suriname of de Nederlandse Antillen draagt hierin een bedrag bij dat wordt berekend door de Administrateur van het Ontwikkelingsprogramma van de Verenigde Naties overeenkomstig de daarop betrekking hebbende resoluties en besluiten van de Economische en Sociale Raad, de beheersraad van het Ontwikkelingsprogramma van de Verenigde Naties en andere bestuurslichamen inzake de technische hulpsector van genoemd programma.

• (b)

  Voor het begin van ieder jaar of van een in onderling overleg overeengekomen tijdvak, uitgedrukt in maanden, betaalt de Regering van Suriname of de Nederlandse Antillen een voorschot op haar bijdrage tot een bedrag dat wordt vastgesteld door de Administrateur van het Ontwikkelingsprogramma van de Verenigde Naties krachtens de in het voorgaande lid bedoelde resoluties en besluiten. Aan het eind van ieder jaar of tijdvak betaalt de Regering van Suriname of de Nederlandse Antillen, of wordt zij gecrediteerd voor, al naar het geval zich voordoet, het verschil tussen het door haar vooruitbetaalde bedrag en het volle bedrag van de door haar overeenkomstig het bepaalde in lid (a) verschuldigde bijdrage.

• (c)

  De bijdragen van de Regering van Suriname of de Nederlandse Antillen in de bedoelde plaatselijke vergoedingen worden op een rekening gestort die daartoe door de Secretaris-Generaal van de Verenigde Naties wordt aangewezen, overeenkomstig in onderling overleg vastgestelde procedures.

• (d)

  De term „deskundige” als gebruikt in dit lid omvat eveneens het overige technische hulppersoneel dat door de Organisaties voor dienst in Suriname of de Nederlandse Antillen is aangewezen in overeenstemming met deze Overeenkomst, behalve eventueel de vertegenwoordiger van het Ontwikkelingsprogramma van de Verenigde Naties in het betrokken land en zijn staf.

• (e)

  De Regering van Suriname of de Nederlandse Antillen en de betrokken organisatie kunnen overeenstemming bereiken over andere regelingen voor het betalen van de plaatselijke vergoeding van de deskundigen wier diensten beschikbaar worden gesteld krachtens een programma voor technische hulp dat wordt bekostigd uit de normale begroting van een van de Organisaties.

In daarvoor in aanmerking komende gevallen stelt de Regering van Suriname of de Nederlandse Antillen arbeidskrachten, uitrusting, voorraden en andere diensten of eigendommen die noodzakelijk zijn voor de uitvoering van het werk van hun deskundigen en andere functionarissen, en ten aanzien waarvan onderling overeenstemming wordt bereikt, ter beschikking van de Organisaties.

De Regering van Suriname of de Nederlandse Antillen betaalt het deel van de kosten welke buiten Suriname of de Nederlandse Antillen betaald dienen te worden, dat niet door de Organisaties betaald behoeft te worden, en ten aanzien waarvan onderling overeenstemming wordt bereikt.

De Regering van het Koninkrijk en de Regering van Suriname of de Nederlandse Antillen, voor zover zij daartoe niet reeds gehouden zijn, passen op de Organisaties, hun eigendommen, gelden en activa, alsmede op hun functionarissen met inbegrip van technische hulpdeskundigen, toe,

• (a)

  ten aanzien van de Verenigde Naties, het Verdrag nopens de voorrechten en immuniteiten van de Verenigde Naties;

• (b)

  ten aanzien van de gespecialiseerde organisaties, het Verdrag nopens de voorrechten en immuniteiten van de gespecialiseerde organisaties; en

• (c)

  ten aanzien van de Internationale Organisatie voor Atoomenergie, de Overeenkomst inzake de voorrechten en immuniteiten van de Internationale Organisatie voor Atoomenergie.

De Regering van het Koninkrijk en de Regering van Suriname of de Nederlandse Antillen nemen alle uitvoerbare maatregelen om de werkzaamheden van de Organisaties uit hoofde van deze Overeenkomst te vergemakkelijken en om de deskundigen en andere functionarissen van de Organisaties bij het zich verzekeren van diensten en faciliteiten welke noodzakelijk kunnen zijn voor de voortzetting van die werkzaamheden behulpzaam te zijn. Bij de uitvoering van hun taak krachtens deze Overeenkomst mogen de Organisaties, hun deskundigen en andere functionarissen gebruik maken van de gunstigste wettelijke valutakoers.

• (a)

  Nadat de in het Koninkrijk der Nederlanden grondwettelijk vereiste goedkeuring is verkregen, treedt deze Overeenkomst in werking op de datum waarop de Administrateur van het Ontwikkelingsprogramma van de Verenigde Naties van de Regering van het Koninkrijk een desbetreffende kennisgeving ontvangt.

• (b)

  De Regering van het Koninkrijk en de Organisaties passen evenwel de bepalingen van deze Overeenkomst voorlopig toe voor een tijdvak van niet langer dan een jaar te rekenen van de datum waarop de Overeenkomst wordt ondertekend.

Deze Overeenkomst treedt in de plaats van de op 6 oktober 1954 te New York gesloten Overeenkomst tussen de Verenigde Naties, de Internationale Arbeidsorganisatie, de Voedsel- en Landbouworganisatie van de Verenigde Naties, de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur, de Internationale Burgerluchtvaart Organisatie en de Wereldgezondheidsorganisatie, enerzijds, en de Regering van het Koninkrijk der Nederlanden, anderzijds, inzake technische hulp aan de overzeese delen van het Koninkrijk der Nederlanden, voor welker internationale betrekkingen de Regering van het Koninkrijk verantwoordelijk is.

De bepalingen van deze Overeenkomst zijn niet van toepassing op technische hulp die door de Organisaties, binnen het kader van hun gewone technische hulpprogramma's wordt verleend aan de Regering van Suriname of de Nederlandse Antillen, indien die gewone technische hulpprogramma's zijn gegrond op een overeenkomst die de Regering van het Koninkrijk en die Organisaties met dat doel zijn aangegaan.

Deze Overeenkomst kan worden gewijzigd nadat hieromtrent tussen de betrokken Organisaties en de Regering van het Koninkrijk overeenstemming is bereikt. Met deze Overeenkomst verband houdende aangelegenheden waarin deze zelf niet voorziet, worden door de betrokken Organisaties en de Regering van het Koninkrijk geregeld in overeenstemming met de desbetreffende resoluties en besluiten van de vergaderingen, conferenties, raden en andere organen van de Organisaties. Iedere Partij bij deze Overeenkomst neemt ieder voorstel voor een dergelijke regeling dat door de andere Partij wordt gedaan, in zorgvuldige en welwillende overweging.

Deze Overeenkomst kan worden beëindigd door een of meer van de Organisaties, voor zover zij er onderscheidenlijk bij zijn betrokken, of door de Regering van het Koninkrijk, nadat aan de andere Partijen schriftelijk mededeling is gedaan van de opzegging. De Overeenkomst eindigt zestig dagen na ontvangst van een zodanige mededeling.
