Agreement concerning the voluntary contributions to be given for the execution of the project to save the temples of Philae

Considering that, as already proclaimed on several occasions by the General Conference of Unesco, the monuments of Nubia, now endangered by the construction of the Aswan High Dam which the United Arab Republic has undertaken in order to ensure the country's economic development and to promote the welfare of its peoples, form part of the cultural heritage of the entire human race,

Noting that the salvage project adopted by the Government of the United Arab Republic, involving the dismantling of the temples and their reconstruction on a small island close to the original site, has been subsequently recommended by the various competent technical committees, and accepted by the Executive Committee of the Campaign to Save the Monuments of Nubia,

Anxious to play a part in ensuring that the temples of Philae survive to be admired and treasured by future generations,

Responding to the appeals for international co-operation launched for this purpose by the United Nations Educational, Scientific and Cultural Organization,

The Contracting Member States and Associate Members of Unesco agree as follows:

The Director-General will communicate a periodical information report, at least every six months, to the Contracting Member States and Associate Members of Unesco concerning the implementation of this Agreement and the progress of the operations to save the temples of Philae.

Article

IV

The Agreement will bear the date of 19 December 1970 and will remain open to the signature of all the Member States and Associate Members of Unesco.

Article

V

This Agreement shall enter into force for each Contracting Member State or Associate Member of Unesco upon its signature or, if it is signed subject to ratification or acceptance, on the date of the deposit of an instrument of ratification or acceptance with the Director-General.

VI

The Director-General will hold at the disposal of Contracting Member States and Associate Members of Unesco the sums which the latter have contributed under this Agreement if the Government of the United Arab Republic does not conclude the contract for the work described in the specifications drawn up by the Minister of Culture (Salvage of the Temples of Philae).

VII

The Director-General shall inform the Member States and Associate Members of Unesco of the signature affixed to this Agreement, as well as of the deposit of the instruments of ratification or acceptance mentioned in Article V of this Agreement.

VIII

In accordance with Article 102 of the Charter of the United Nations, this Agreement will be registered at the United Nations Secretariat, at the request of the Director-General.

IX

This Agreement, except for its annex, is drawn up in Arabic, English, French, Russian and Spanish, all five texts being equally authentic.

DONE in Cairo this nineteenth day of December 1970 in a single copy, which will be deposited in the Archives of the United Nations Educational, Scientific and Cultural Organization and certified copies of which will be communicated to all signatory Member States and Associate Members, as well as to the United Nations.

The Government of Cyprus undertakes to pay the amount of £ 1,000 not later than 1 February 1971 as its contribution to the salvage of the monuments of Philae.

Agreement between the United Nations Educational, Scientific and Cultural Organization and the Government of the United Arab Republic concerning the salvage of the temples of Philae

Considering that the Constitution of the United Nations Educational, Scientific and Cultural Organization, hereinafter referred to as “the Organization”, assigns to it, among other functions, that of assuring the conservation and protection of the world's inheritance of works of art and monuments of history and science,

Considering that the General Conference of the Organization, by resolution 4. 421 adopted at its twelfth session, decided that “the Organization must continue international action with a view to ensuring, in so far as may be possible through voluntary means, the temple preservation and monument removal programme” and requested the Executive Committee of the Campaign to Save the Monuments of Nubia to take steps to ensure the continuance of this international action,

Considering that the Organization, having made a major contribution to the preservation of the Abu Simbel temples, has again appealed for international co-operation in order to save the temples of Philae endangered by the flooding due to the construction of the Aswan High Dam which the Government of the United Arab Republic has undertaken in order to ensure the country's economic development and to promote the welfare of its people,

Considering that the salvage project adopted by the Government of the United Arab Republic, involving the dismantling of the temples of Philae and their reconstruction on a small island close to their original site has been subsequently recommended by the various competent technical committees, and accepted by the Executive Committee of the Campaign to save the Monuments of Nubia,

Considering that in addition to the World Food Program, which has promised to make a substantial contribution, many Member States and Associate Members of the Organization have responded to its appeal and that an Agreement concerning the voluntary contributions to be given for the execution of the Project to Save the Temples of Philae, hereinafter referred to as “the Agreement concerning voluntary contributions”, has been adopted by the Meeting of the Contributing Member States and Associate Members of the Organization held in Cairo on 19 December 1970,

Considering that this Agreement determines the contributions either in currency or in kind which, in order to save the temples of Philae, the contributing Member States and Associate Members of the Organization undertake to pay into the hands of the Director-General of the Organization, or to make available to him, and lays down the conditions, dates, currencies and terms of provision of such payments or contributions,

Desiring to define between themselves the terms and conditions under which the Organization will provide assistance to the Government of the United Arab Republic for saving the temples of Philae and the undertakings to be given by the Government of the United Arab Republic in this connexion,

The Organization, represented by its Director-General, Mr. René Maheu

and

The Government of the United Arab Republic, represented by Dr. Sarwat Okasha, Assistant to the President for Cultural Affaire have agreed as follows:

In addition to the information and documents foreseen in the Annex to this Agreement, the Government of the United Arab Republic shall supply the Director-General of the Organization, as expeditiously as possible, with the plans of operation, draft contracts and costs estimates concerning the salvage work of the temples of Philae together with all necessary information and documents on the progress of the work, in order to enable the Director-General of the Organization to keep the contributing Member States and Associate Members and the Executive Committee of the Campaign to Save the Monuments of Nubia fully and regularly informed of the work done.

IV

The Director-General of the Organization shall continue to appeal to governments and to public and private sources in order to assist the Government of the United Arab Republic in making up any difference between the total amount of contributions so far secured and the expected cost of the operation: about thirteen million three hundred thousand dollars of the United States of America.

Article

V

The Director-General of the Organization, in conformity with the resolutions of the General Conference, shall pursue the International Campaign to Save the Monuments of Nubia and, in particular, to save the temples of Philae. He shall submit the results of the Campaign to the General Conference at its next session.

VI

This Agreement shall enter into force upon signature.

IN FAITH WHEREOF the representatives of both contracting parties have signed this agreement.

Annex

relating to the establishment of the semi-annual plans of financial operations

At least two months before a session of the Executive Committee whose agenda will include consideration of the semi-annual plan of financial operations provided for in paragraph 2 of resolution II, adopted by the Executive Committee at the close of its fifth session the Government of the United Arab Republic shall send the Organization a report indicating, with reference to the clauses of the works contract and the progress of the operations, the payments it will have to meet during the semi-annual period in question. The Organization shall be entitled to request any further information it may consider necessary.

In the light of all the information so received and of the situation of the Trust Fund, taking into account the receipts expected during the semi-annual period in question, the Director-General shall establish the above-mentioned plan of financial operations indicating by type of currency, the proportion of the payments falling due under contract which can be met by the Trust Fund. This document shall be communicated as expeditiously as possible to the Government of the United Arab Republic for observations, and transmitted to the Executive Committee for approval.

The amounts provided for on the schedule of payments approved by the Executive Committee shall be placed at the disposal of the Government of the United Arab Republic fifteen days before the due date of each payment, in accordance with the practical arrangements agreed upon by the said Government and the Director-General.

Within three months after the expiry of each semi-annual period, the Government of the United Arab Republic shall send the Organization a financial report, reviewing both the work carried out and the payments made during the semi-annual period covered, and indicating any changes which may have been made in the initial estimates. After obtaining, where appropriate, any additional information that may be necessary, the Director-General shall transmit this report to the Executive Committee for consideration at its next session.

Within six months after the completion of the work of each stage of the project, the Government of the United Arab Republic shall forward to the Organization a technical report and a financial report covering all the work done and payments made which relate to that stage. These reports shall be transmitted by the Director-General to the Executive Committee in the same conditions as the semi-annual reports.

Overwegende dat, zoals reeds verscheidene malen door de Algemene Conferentie van de Unesco is verklaard, de monumenten van Nubië, die worden bedreigd door de bouw van de Hoge Aswandam, die de Verenigde Arabische Republiek ter hand heeft genomen ter verzekering van de economische ontwikkeling van het land en ter bevordering van het welzijn van haar bevolking, behoren tot het culturele erfgoed van de gehele mensheid,

Erop gelet dat het door de Regering van de Verenigde Arabische Republiek aanvaarde project tot behoud van deze tempels, dat voorziet in het afbreken en herbouwen daarvan op een klein eilandje dicht bij de plaats waar ze oorspronkelijk stonden, nadien is aanbevolen door de verschillende bevoegde technische commissies en de goedkeuring heeft verworven van de Uitvoerende Commissie van de Actie tot behoud van de monumenten in Nubië,

Verlangende bij te dragen tot het behoud van de tempels van Philae, zodat deze ook door komende generaties kunnen worden bewonderd en gewaardeerd.

Gehoor gevende aan de te dien einde door de Organisatie voor Onderwijs, Wetenschap en Cultuur van de Verenigde Naties verzonden oproepen tot internationale samenwerking op dit gebied,

Zijn de Overeenkomstsluitende Lid-Staten en geassocieerde leden van de Unesco als volgt overeengekomen:

De Directeur-Generaal brengt regelmatig, maar ten minste eenmaal in de zes maanden, aan de Overeenkomstsluitende Lid-Staten en geassocieerde leden van de Unesco verslag uit omtrent de toepassing van deze Overeenkomst, alsmede over de voortgang van de werkzaamheden tot behoud van de tempels van Philae.

Deze Overeenkomst is gedagtekend 19 december 1970 en staat ter ondertekening open voor alle Lid-Staten en geassocieerde leden van de Unesco.

V

Deze Overeenkomst treedt voor iedere Overeenkomstsluitende Lid-Staat of ieder Overeenkomstsluitend geassocieerd lid van de Unesco onmiddellijk na de ondertekening in werking of, indien de ondertekening is geschied onder voorbehoud van bekrachtiging of aanvaarding, op de datum van de nederlegging van een akte van bekrachtiging of van aanvaarding bij de Directeur-Generaal.

De Directeur-Generaal houdt de bedragen die de Overeenkomstsluitende Lid-Staten en geassocieerde leden van de Unesco gestort hebben ter uitvoering van deze Overeenkomst te hunner beschikking in geval de Regering van de Verenigde Arabische Republiek de overeenkomst betreffende de werkzaamheden omschreven in het door het Ministerie van Cultuur opgemaakte bestek (Behoud van de tempels van Philae) niet mocht sluiten.

De Directeur-Generaal doet de Lid-Staten en de geassocieerde leden van de Unesco mededeling van alle ondertekeningen van deze Overeenkomst, alsmede van de nederlegging van de akten van bekrachtiging of van aanvaarding bedoeld in artikel V van deze Overeenkomst.

VIII

Overeenkomstig artikel 102 van het Handvest der Verenigde Naties wordt deze Overeenkomst op verzoek van de Directeur-Generaal geregistreerd bij het Secretariaat van de Verenigde Naties.

Deze Overeenkomst is, met uitzondering van de Bijlage, opgesteld in de Arabische, de Engelse, de Franse, de Russische en de Spaanse taal, zijnde deze vijf teksten gelijkelijk authentiek.

GEDAAN te Kaïro, de 19de december 1970, in een enkel exemplaar, dat zal worden nedergelegd in het archief van de Organisatie voor Onderwijs, Wetenschap en Cultuur van de Verenigde Naties en waarvan voor eensluidend gewaarmerkte afschriften zullen worden toegezonden aan alle ondertekenende Lid-Staten en geassocieerde leden, alsmede aan de Verenigde Naties.

TEN BLIJKE WAARVAN de ondertekenende vertegenwoordigers, daartoe behoorlijk gemachtigd, deze Overeenkomst hebben ondertekend.
