The States Parties to the present Protocol and to the Vienna Convention on Consular Relations, hereinafter referred to as “the Convention”, adopted by the United Nations Conference held at Vienna from 4 March to 22 April 1963,
Expressing their wish to establish rules between them concerning acquisition of nationality by members of the consular post and by members of their families forming part of their households,
Have agreed as follows:
For the purpose of the present Protocol, the expression “members of the consular post” shall have the meaning assigned to it in subparagraph (g) of paragraph 1 of Article 1 of the Convention, namely, “consular officers, consular employees and members of the service staff”.
Members of the consular post not being nationals of the receiving State, and members of their families forming part of their households, shall not, solely by the operation of the law of the receiving State, acquire the nationality of that State.
The present Protocol shall be open for signature by all States which may become Parties to the Convention, as follows: until 31 October 1963 at the Federal Ministry for Foreign Affairs of the Republic of Austria and, subsequently, until 31 March 1964, at the United Nations Headquarters in New York.
The present Protocol is subject to ratification. The instruments of ratification shall be deposited with the Secretary-General of the United Nations.
The present Protocol shall remain open for accession by all States which may become Parties to the Convention. The instruments of accession shall be deposited with the Secretary-General of the United Nations.
The present Protocol shall enter into force on the same day as the Convention or on the thirtieth day following the date of deposit of the second instrument of ratification of or accession to the Protocol with the Secretary-General of the United Nations, whichever date is the later.
The Secretary-General of the United Nations shall inform all States which may become Parties to the Convention:
of signatures to the present Protocol and of the deposit of instruments of ratification or accession, in accordance with Articles III, IV and V;
of the date on which the present Protocol will enter into force, in accordance with Article VI.
The original of the present Protocol, of which the Chinese, English, French, Russion and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations, who shall send certified copies thereof to all States referred to in Article III.
IN WITNESS WHEREOF the undersigned plenipotentiaries, being duly authorized thereto by their respective Governments, have signed the present Protocol.
DONE at Vienna, this twenty-fourth day of April, one thousand nine hundred and sixty-three.
De Staten die Partij zijn bij dit Protocol en bij het Verdrag van Wenen inzake consulaire betrekkingen, hierna te noemen „het Verdrag”, aanvaard tijdens de Conferentie van de Verenigde Naties, gehouden te Wenen van 4 maart tot 22 april 1963,
De wens te kennen gevend, onderling regels vast te stellen betreffende de verkrijging van nationaliteit door de leden van de consulaire post en door de bij hen inwonende gezinsleden,
Zijn overeengekomen als volgt:
Voor de toepassing van dit Protocol heeft de uitdrukking „leden van de consulaire post” de daaraan in alinea (g) van het eerste lid van artikel 1, van het Verdrag toegekende betekenis, namelijk „consulaire ambtenaren, consulaire beambten en leden van het bedienend personeel”.
Leden van de consulaire post die geen onderdaan zijn van de ontvangende Staat, alsmede inwonende gezinsleden, kunnen niet uitsluitend krachtens de wet van de Ontvangende Staat de nationaliteit van die Staat verkrijgen.
Dit Protocol staat open ter ondertekening door alle Staten die partij worden bij het Verdrag, en wel: tot 31 oktober 1963 bij het Bondsministerie van Buitenlandse Zaken van de Republiek Oostenrijk en na die datum, tot 31 maart 1964, bij de zetel van de Verenigde Naties te New York.
Dit Protocol dient te worden bekrachtigd. De akten van bekrachtiging worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.
Dit Protocol blijft open voor toetreding door elke Staat die partij wordt bij dit Verdrag. De akten van toetreding worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.
Dit Protocol treedt in werking op dezelfde dag als het Verdrag of op de dertigste dag die volgt op de datum van nederlegging van de tweede akte van bekrachtiging van of toetreding tot het Protocol bij de Secretaris-Generaal van de Verenigde Naties, al naar gelang welke van deze twee data de laatste is.
De Secretaris-Generaal van de Verenigde Naties stelt alle Staten die partij kunnen worden bij het Verdrag, in kennis van:
de ondertekeningen van dit Protocol en de nederlegging van akten van bekrachtiging of toetreding overeenkomstig de artikelen III, IV en V;
de datum waarop dit Protocol overeenkomstig artikel VI in werking zal treden.
Het origineel van dit Protocol, waarvan de Chinese, Engelse, Franse, Russische en Spaanse teksten gelijkelijk authentiek zijn, wordt nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die voor eensluidend gewaarmerkte afschriften ervan doet toekomen aan alle in artikel III bedoelde Staten.
TEN BLIJKE WAARVAN de ondergetekende gevolmachtigden, daartoe behoorlijk gemachtigd door hun onderscheiden Regeringen, dit Protocol hebben ondertekend.
