The Government of the Kingdom of The Netherlands and the Government of Ireland,
Having resolved to conclude an Agreement concerning the exchange of stagiaires,
Have agreed on the following provisions:
This Agreement applies to stagiaires, that is to say, to nationals of either country who go to the other country for a limited period so as to improve their knowledge of the language and of industrial, commercial, professional or agricultural practices in that country, by means of holding employment there.
Stagiaires may be of either sex. As a general rule, they should have reached the age of eighteen and not be over thirty years of age.
The authorisation given to a stagiaire will normally be for one year. It may, in exceptional cases, be extended for six months.
Prospective employers of stagiaires must declare themselves willing to remunerate the stagiaires as soon as they give normal service, in accordance with the rates fixed by collective labour agreements, where such agreements exist, or, where they do not exist, in accordance with the normal current rates for the occupation in the district.
All regulations with regard to social security will be applied to stagiaires in the same way as to national workers.
The number of stagiaires who may be admitted to either country shall not exceed fifty per calendar year.
Stagiaires of either country who are already resident in the other country on the 1st January of any year will not be included in the quota of that year. In any year the quota of fifty stagiaires may be filled irrespective of the duration of the authorisations granted in the course of the previous year.
The quota may be modified later by agreement on the proposal of either Government by the 1st December, at the latest, in respect of the following year. If the quota has not been filled in the course of a year by stagiaires of one country, the Government of that country may not reduce the number of authorisations to be given to stagiaires of the other country for the following year and may not carry forward to the following year the unused portion of the quota.
A person wishing to avail himself of the provisions of this Agreement shall submit an application to that effect to the authority in his country charged with receiving such applications. He shall furnish any information required and in particular state the name and address of his future employer.
The Rijksarbeidsbureau at The Hague is the authority charged with receiving applications from Netherlands nationals. The Irish Committee for the Exchange of Stagiaires with Foreign Countries at the Department of Industry and Commerce in Dublin is the authority charged with receiving applications from Irish nationals.
The authority which is charged in either country with receiving applications shall also assist persons from the other country seeking positions as stagiaires. Persons may approach, through the authority in their own country, the authority in the country where they wish to obtain positions as stagiaires. No charge shall be imposed on a stagiaire for stamp duties with respect to his residence and labour permit or in connection with formalities for finding him an occupation.
This Agreement shall enter into force on the date of its signature and shall remain in force until the 31st December, 1959.
It shall be extended by tacit agreement from year to year, unless denounced by either Government before the 1st July of any year in respect of the end of that year.
IN WITNESS WHEREOF the undersigned representatives, duly authorised for that purpose, have signed the present Agreement.

De Regering van het Koninkrijk der Nederlanden en de Regering van Ierland,
Besloten hebbende tot het sluiten van een Overeenkomst betreffende de uitwisseling van stagiaires,
Hebben omtrent de volgende bepalingen overeenstemming bereikt:
Deze Overeenkomst is van toepassing op stagiaires, dat wil zeggen op onderdanen van een van beide landen, die zich voor een beperkte tijdsduur naar het andere land begeven teneinde hun kennis van de taal en hun vakkennis op het gebied van de industrie, de handel, de ambachten of de landbouw en veeteelt in dat land te verbeteren door het vervullen van een dienstbetrekking aldaar.
Met inachtneming van de wetten en voorschriften ten aanzien van de toelating, het tijdelijk verblijf, het verblijf en de tewerkstelling van vreemdelingen, zal het aan stagiaires onder de in de volgende artikelen vastgestelde voorwaarden zijn toegestaan arbeid te aanvaarden, onafhankelijk van de stand van de arbeidsmarkt in hun beroep.
Stagiaires kunnen van beiderlei kunne zijn. Als algemene regel zullen zij de leeftijd van achttien jaar moeten hebben bereikt en niet ouder moeten zijn dan dertig jaar.
De toestemming aan een stagiaire verleend zal gewoonlijk een jaar zijn. In bijzondere gevallen zal deze termijn met zes maanden kunnen worden verlengd.
Toekomstige werkgevers van stagiaires moeten zich bereid verklaren de stagiaires, zodra zij een volle arbeidsprestatie leveren, te betalen volgens de schalen vastgesteld bij collectieve arbeidsovereenkomsten waar deze bestaan of, waar deze niet bestaan, in overeenstemming met de plaatselijk geldende schalen voor een bepaald beroep.
Alle regelingen ten aanzien van sociale zekerheid zuilen voor stagiaires worden toegepast op gelijke wijze als voor de arbeiders van het eigen land.
Het aantal stagiaires dat in elk der beide landen zal kunnen worden toegelaten, zal niet meer zijn dan vijftig per kalenderjaar.
Stagiaires van elk der beide landen, die op 1 januari van een bepaald jaar reeds in het andere land verblijven, zullen niet in het quotum van dat jaar worden opgenomen. Per jaar zal het quotum van vijftig stagiaires worden toegestaan onafhankelijk van de duur van de toestemming gegeven aan stagiaires in de loop van het voorafgaande jaar.
Het quotum voor het volgende jaar kan later op voorstel van elk der beide Regeringen, bij wederzijds goedvinden, uiterlijk op 1 december worden gewijzigd. Indien het toegestane quotum in de loop van een jaar door de stagiaires van een land niet werd bereikt, mag de Regering van dat land het aantal toestemmingen voor stagiaires van het andere land voor het volgende jaar niet verminderen en het niet gebruikte deel van het quotum mag niet op het volgende jaar worden overgeschreven.
Een stagiaire die gebruik wenst te maken van de bepalingen van deze Overeenkomst, dient hiertoe een verzoek te richten tot de instantie van zijn land, die belast is met de behandeling van deze aanvragen. Hij dient alle verlangde inlichtingen te verstrekken en in het bijzonder de naam en het adres van zijn toekomstige werkgever te vermelden.
Het Rijksarbeidsbureau te 's-Gravenhage is de instantie belast met het ontvangen van aanvragen van Nederlandse onderdanen. Het „Irish Committee for the Exchange of Stagiaires with Foreign Countries” bij het „Department of Industry and Commerce” in Dublin is de instantie belast met het ontvangen van aanvragen van Ierse onderdanen.
De instantie die in elk der beide landen belast is met het ontvangen van aanvragen, zal ook onderdanen van het andere land, die plaatsing als stagiaire zoeken, daarbij behulpzaam zijn. Kandidaat-stagiaires kunnen door tussenkomst van de instantie van hun eigen land de instantie van het land waar zij plaatsing als stagiaire zoeken, om bemiddeling verzoeken. Voor verblijfsvergunning, werkvergunning of bemiddeling voor plaatsing zullen aan de stagiaires geen rechten of andere kosten in rekening worden gebracht.
Deze Overeenkomst zal in werking treden op de datum van haar ondertekening en van kracht blijven tot 31 december 1959.
Zij zal stilzwijgend van jaar tot jaar worden verlengd, tenzij zij door één der Regeringen vóór de 1e juli wordt opgezegd voor wat betreft het einde van dat jaar.
TEN BLIJKE WAARVAN de ondergetekende vertegenwoordigers, hiertoe behoorlijk gemachtigd, deze Overeenkomst hebben ondertekend.
