The States Parties to this Convention
Have agreed as follows:
For the purpose of these articles, the term „continental shelf” is used as referring (a) to the seabed and subsoil of the submarine areas adjacent to the coast but outside the area of the territorial sea, to a depth of 200 metres or, beyond that limit, to where the depth of the superjacent waters admits of the exploitation of the natural resources of the said areas; (b) to the seabed and subsoil of similar submarine areas adjacent to the coasts of islands.
The coastal State exercises over the continental shelf sovereign rights for the purpose of exploring it and exploiting its natural resources.
The rights referred to in paragraph 1 of this article are exclusive in the sence that if the coastal State does not explore the continental shelf or exploit its natural resources, no one may undertake these activities, or make a claim to the continental shelf, without the express consent of the coastal State.
The rights of the coastal State over the continental shelf do not depend on occupation, effective or notional, or on any express proclamation.
The natural resources referred to in these articles consist of the mineral and other non-living resources of the seabed and subsoil together with living organisms belonging to sedentary species, that is to say, organisms which, at the harvestable stage, either are immobile on or under the seabed or are unable to move except in constant physical contact with the seabed or the subsoil.
The rights of the coastal State over the continental shelf do not affect the legal status of the superjacent waters as high seas, or that of the airspace above those waters.
Subject to its right to take reasonable measures for the exploration of the continental shelf and the exploitation of its natural resources, the coastal State may not impede the laying or maintenance of submarine cables or pipe lines on the continental shelf.
The exploration of the continental shelf and the exploitation of its natural resources must not result in any unjustifiable interference with navigation, fishing or the conservation of the living resources of the sea, nor result in any interference with fundamental oceanographic or other scientific research carried out with the intention of open publication.
Subject to the provisions of paragraphs 1 and 6 of this article, the coastal State is entitled to construct and maintain or operate on the continental shelf installations and other devices necessary for its exploration and the exploitation of its natural resources, and to establish safety zones around such installations and devices and to take in those zones measures necessary for their protection.
The safety zones referred to in paragraph 2 of this article may extend to a distance of 500 metres around the installations and other devices which have been erected, measured from each point of their outer edge. Ships of all nationalities must respect these safety zones.
Such installations and devices, though under the jurisdiction of the coastal State, do not possess the status of islands. They have no territorial sea of their own, and their presence does not affect the delimitation of the territorial sea of the coastal State.
Due notice must be given of the construction of any such installations, and permanent means for giving warning of their presence must be maintained. Any installations which are abandoned or disused must be entirely removed.
Neither the installations or devices, nor the safety zones around them, may be established where interference may be caused to the use of recognized sea lanes essential to international navigation.
The coastal State is obliged to undertake, in the safety zones, all appropriate measures for the protection of the living resources of the sea from harmful agents.
The consent of the coastal State shall be obtained in respect of any research concerning the continental shelf and undertaken there. Nevertheless the coastal State shall not normally withhold its consent if the request is submitted by a qualified institution with a view to purely scientific research into the physical or biological characteristics of the continental shelf, subject to the proviso that the coastal State shall have the right, if it so desires, to participate or to be represented in the research, and that in any event the results shall be published.
Where the same continental shelf is adjacent to the territories of two or more States whose coasts are opposite each other, the boundary of the continental shelf appertaining to such States shall be determined by agreement between them. In the absence of agreement, and unless another boundary line is justified by special circumstances, the boundary is the median line, every point of which is equidistant from the nearest points of the baselines from which the breadth of the territorial sea of each State is measured.
Where the same continental shelf is adjacent to the territories of two adjacent States, the boundary of the continental shelf shall be determined by agreement between them. In the absence of agreement, and unless another boundary line is justified by special circumstances, the boundary shall be determined by application of the principle of equidistance from the nearest points of the baselines from which the breadth of the territorial sea of each State is measured.
In delimiting the boundaries of the continental shelf, any lines which are drawn in accordance with the principles set out in paragraphs 1 and 2 of this article should be defined with reference to charts and geographical features as they exist at a particular date, and reference should be made to fixed permanent identifiable points on the land.
The provisions of these articles shall not prejudice the right of the coastal State to exploit the subsoil by means of tunnelling irrespective of the depth of water above the subsoil.
This Convention shall, until 31 October 1958, be open for signature by all States Members of the United Nations or of any of the specialized agencies, and by any other State invited by the General Assembly of the United Nations to become a Party to the Convention.
This Convention is subject to ratification. The instruments of ratification shall be deposited with the Secretary-General of the United Nations.
This Convention shall be open for accession by any States belonging to any of the categories mentioned in article 8. The instruments of accession shall be deposited with the Secretary-General of the United Nations.
After the expiration of a period of five years from the date on which this Convention shall enter into force, a request for the revision of this Convention may be made at any time by any Contracting Party by means of a notification in writing addressed to the Secretary-General of the United Nations.
The Secretary-General of the United Nations shall inform all States Members of the United Nations and the other States referred to in article 8:
Of signatures to this Convention and of the deposit of instruments of ratification or accession, in accordance with articles 8, 9 and 10;
Of the date on which this Convention will come into force in accordance with article 11;
Of requests for revision in accordance with article 13;
Of reservations to this Convention, in accordance with article 12.
The original of this Convention, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, shall be deposited with the Secretary-General of the United Nations, who shall send certified copies thereof to all States referred to in article 8.
IN WITNESS WHEREOF the undersigned Plenipotentiaries, being duly authorized thereto by their respective Governments, have signed this Convention.

In deze artikelen wordt de uitdrukking „continentaal plateau” gebruikt ter aanduiding van: a. de zeebedding en de ondergrond van de onder water gelegen gebieden die aan de kust aansluiten doch buiten de territoriale wateren zijn gelegen, tot een diepte van 200 meter of, daar voorbij, tot waar de diepte van de bovengelegen wateren de exploitatie van de natuurlijke rijkdommen van die gebieden nog mogelijk maakt; b. de zeebedding en de ondergrond van soortgelijke onder water gelegen gebieden die aansluiten aan de kusten van eilanden.
De kuststaat oefent over het continentale plateau soevereine rechten uit ter exploratie en exploitatie van de natuurlijke rijkdommen van het plateau.
De in lid 1 van dit artikel bedoelde rechten zijn exclusief in die zin, dat, indien de kuststaat het continentale plateau niet exploreert of de natuurlijke rijkdommen ervan niet exploiteert, niemand deze werkzaamheden mag gaan verrichten of aanspraken op het continentale plateau mag maken dan met de uitdrukkelijke toestemming van de kuststaat.
De rechten van de kuststaat op het continentale plateau zijn niet afhankelijk van een daadwerkelijke of fictieve bezetting of van enige uitdrukkelijke proclamatie.
De in deze artikelen bedoelde natuurlijke rijkdommen bestaan uit de minerale en andere niet-levende rijkdommen van de zeebedding en de ondergrond, alsmede levende organismen die tot de sedentaire soort behoren, dat wil zeggen organismen die ten tijde dat ze geoogst kunnen worden, hetzij zich onbeweeglijk op of onder de zeebedding bevinden, hetzij zich niet kunnen verplaatsen dan in voortdurend fysiek contact met de zeebedding of de ondergrond.
De rechten van de kuststaat op het continentale plateau doen geen afbreuk aan de rechtstoestand van de bovengelegen wateren als volle zee of van het luchtruim boven die wateren.
Onder voorbehoud van zijn recht redelijke maatregelen te nemen voor de exploratie van het continentale plateau en de exploitatie van de natuurlijke rijkdommen daarvan, mag de kuststaat het leggen of het onderhoud van onderzeese kabels of pijpleidingen op het continentale plateau niet belemmeren.
De exploratie van het continentale plateau en de exploitatie van de natuurlijke rijkdommen van het plateau mogen niet tot gevolg hebben, dat op niet te rechtvaardigen wijze overlast wordt aangedaan aan de scheepvaart, de visserij of het instandhouden van de levende rijkdommen van de zee, noch dat overlast wordt aangedaan aan het fundamenteel oceanografisch of ander wetenschappelijk onderzoek, uitgevoerd met de bedoeling de resultaten ervan openbaar te maken.
Onder voorbehoud van de bepalingen van lid 1 en lid 6 van dit artikel, is het de kuststaat toegestaan op het continentale plateau installaties en andere inrichtingen voor de exploratie van het plateau en de exploitatie van de natuurlijke rijkdommen van het plateau op te richten en te onderhouden of te laten werken en veiligheidszones om deze installaties en inrichtingen in te stellen en binnen die zones de nodige maatregelen voor de bescherming van die installaties en inrichtingen te treffen.
De veiligheidszones bedoeld in lid 2 van dit artikel kunnen zich uitstrekken tot een afstand van 500 meter rond de installaties en andere inrichtingen, gemeten van elk punt van de buitengrens. Schepen van alle nationaliteiten dienen die veiligheidszones te eerbiedigen.
Dergelijke installaties en inrichtingen bezitten, alhoewel zij onder de rechtsmacht van de kuststaat vallen, niet de status van eilanden. Zij hebben geen eigen territoriale wateren en hun aanwezigheid is niet van invloed op de begrenzing van de territoriale zee van de kuststaat.
Van de oprichting van iedere zodanige installatie dient behoorlijk mededeling te worden gedaan en er dient een permanent waarschuwingssysteem in stand te worden gehouden ter aanduiding van de aanwezigheid van die installaties. Iedere installatie die wordt verlaten of die niet meer wordt gebruikt, dient geheel te worden verwijderd.
Er mogen geen installaties of inrichtingen worden opgericht, noch veiligheidszones er omheen worden ingesteld, indien zulks het gebruik van erkende scheepvaartroutes die van wezenlijk belang zijn voor de internationale scheepvaart, zou belemmeren.
De kuststaat is verplicht binnen de veiligheidszones alle passende maatregelen te treffen voor de bescherming van de levende rijkdommen van de zee tegen schadelijke agentia.
Voor ieder onderzoek betreffende het continentale plateau en op het plateau uitgevoerd dient de goedkeuring van de kuststaat te worden verkregen. Niettemin mag de kuststaat in normale gevallen zijn goedkeuring niet weigeren, indien het verzoek wordt gedaan door een terzake bevoegde instelling met het oog op een zuiver wetenschappelijk onderzoek naar de fysieke of biologische gesteldheid van het continentale plateau, onder voorbehoud dat de kuststaat het recht zal hebben om, indien hij zulks wenst, deel te nemen aan of vertegenwoordigd te zijn bij het onderzoek en dat de resultaten in elk geval zullen worden gepubliceerd.
Indien hetzelfde continentale plateau grenst aan de grondgebieden van twee of meer staten wier kusten tegenover elkaar zijn gelegen, wordt de grens van het aan elk dezer staten toekomende deel van het continentale plateau vastgesteld bij overeenkomst tussen deze staten. Indien er geen overeenkomst bestaat en tenzij een andere grenslijn gerechtvaardigd wordt door bijzondere omstandigheden, is de grens de middellijn waarvan elk punt even ver is verwijderd van de dichtstbijgelegen punten van de basislijnen vanwaar af de breedte van de territoriale zee van elk der staten wordt gemeten.
Indien hetzelfde continentale plateau aan de grondgebieden van twee aangrenzende staten grenst, wordt de grens van het continentale plateau bij overeenkomst tussen die staten vastgesteld. Indien er geen overeenkomst bestaat of indien geen bijzondere omstandigheden een andere grenslijn rechtvaardigen, wordt de grenslijn bepaald door toepassing van het beginsel van de gelijke afstand van de dichtstbijgelegen punten van de basislijnen vanwaar af de breedte van de territoriale zee van elk der staten wordt gemeten.
Bij het vaststellen van de grens van het continentale plateau dienen de lijnen, getrokken overeenkomstig de in lid 1 en lid 2 van dit artikel neergelegde beginselen, te worden omschreven met verwijzing naar zeekaarten en geografische kenmerken zoals die op een bepaald ogenblik bestaan, terwijl melding dient te worden gemaakt van vaste herkenbare punten op het land.
De bepalingen van deze artikelen doen geen afbreuk aan het recht van de kuststaat de ondergrond te exploiteren door middel van het aanleggen van tunnels, ongeacht de diepte van het water boven de ondergrond.
Dit Verdrag staat tot 31 oktober 1958 open ter ondertekening door alle staten die Lid zijn van de Verenigde Naties of van een of meer der Gespecialiseerde Organisaties, en door iedere andere staat die door de Algemene Vergadering der Verenigde Naties wordt uitgenodigd partij te worden bij dit Verdrag.
Dit Verdrag dient te worden bekrachtigd. De akten van bekrachtiging zullen worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.
Dit Verdrag staat open voor toetreding door iedere staat die tot een der in artikel 8 genoemde categorieën behoort. De akten van toetreding zullen worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.
Na het verstrijken van een tijdvak van vijf jaar te rekenen van de datum waarop dit Verdrag in werking treedt af, kan iedere Verdragsluitende Partij te allen tijde door middel van een schriftelijke, tot de Secretaris-Generaal der Verenigde Naties gerichte mededeling om een herziening van dit Verdrag verzoeken.
De Secretaris-Generaal van de Verenigde Naties doet aan alle staten die Lid zijn van de Verenigde Naties en aan de andere in artikel 8 bedoelde staten mededeling van:
ondertekeningen van dit Verdrag en van de nederlegging van akten van bekrachtiging of toetreding, overeenkomstig de artikelen 8, 9 en 10;
de datum waarop dit Verdrag ingevolge artikel 11 in werking zal treden;
verzoeken om herziening overeenkomstig artikel 13;
voorbehouden op dit Verdrag, gemaakt overeenkomstig artikel 12.
Het origineel van dit Verdrag, waarvan de Chinese, Engelse, Franse, Russische en Spaanse teksten gelijkelijk authentiek zijn, zal worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die gewaarmerkte afschriften ervan zal doen toekomen aan alle in artikel 8 bedoelde staten.
TEN BLIJKE WAARVAN de ondergetekende gevolmachtigden, daartoe behoorlijk gemachtigd door hun onderscheidene Regeringen, dit Verdrag hebben ondertekend.
