The Governments of the States of the Benelux (the Kingdom of Belgium, the Grand Duchy of Luxembourg and the Kingdom of the Netherlands)
and
the Government of the Republic of Serbia,
Here after referred to as “the Parties”,
On the basis of Article 19 of the Agreement between the European Community and the Republic of Serbia on the readmission of persons residing without authorisation, signed at Brussels on 18 September 2007,
Here after referred to as “the Agreement”,
Have agreed as follows:
The competent authorities for the implementation of the Agreement are listed in Annex 1 to this Protocol.
The Parties shall notify each other immediately directly and through diplomatic channels of any changes in the list of competent authorities mentioned in Annex 1 to this Protocol.
The border crossing points to be used for the application of the Agreement are listed in Annex 2 to this Protocol.
The competent authorities may agree on the use of other border crossing points for readmission on a case by case basis.
The Parties shall notify each other immediately directly and through diplomatic channels of any changes in the list of border crossing points mentioned in Annex 2 to this Protocol.
The readmission application mentioned in Article 7 of the Agreement contains the data enumerated in Annex 6 to the Agreement.
In accordance with Article 2, paragraph 1, Article 4, paragraph 1, and Article 8, paragraph 1, of the Agreement, the identity and the nationality of a person to be readmitted can be proven by the documents mentioned in Annex 1 to the Agreement.
In accordance with Article 2, paragraph 1, Article 4, paragraph 1, and Article 8, paragraph 2, of the Agreement, the identity and nationality of a person to be readmitted can be validly assumed by the documents mentioned in Annex 2 to the Agreement.
In case the person to be readmitted is in possession of a valid travel document, a readmission application for acceptance is not needed, pursuant to Article 6, paragraph 2, of the Agreement.
In all other cases a readmission application is needed. The readmission application shall enclose copies of the documents mentioned in Annex 1 or 2 to the Agreement, even if their validity has expired.
The response to the readmission application contains the data enumerated in Annex 3 to this Protocol.
The response to the readmission application shall be presented to the competent authorities of the Requesting Party. A positive response shall simultaneously be presented to the diplomatic consular representation of the Requested Party, after which the travel document shall be issued. There is no need for a signed application by the person to be readmitted. In case of a negative response the competent authorities of the Requested Party shall also indicate the reasons why the readmission application is refused.
In case the validity of an issued travel document for readmitting a person has expired due to the reasons quoted in Article 10, paragraph 5, of the Agreement a new travel document shall be issued in accordance with Article 2, paragraph 4, and Article 4, paragraph 4, of the Agreement.
If the validity of the renewed document mentioned in Article 3, paragraph 8, of this Protocol expires, the requesting Party can resubmit the readmission application by electronic means, stating only name and date of birth. The requested Party shall reply within one working day. In case of a positive response a new travel document shall be issued without delay.
After receiving the positive response on the readmission application, the competent authorities of the Requesting Party shall present the notification of transfer to the competent authorities of the Requested Party, in accordance with Annex 4 to this Protocol and as stated in Article 11, paragraph 1, of the Agreement.
If the Requesting Party is unable to present any of the documents listed in Annexes 1, 2 and 5 to the Agreement, in accordance with Article 8, paragraph 3, and Article 9, paragraph 6, of the Agreement an interview can be conducted to establish the nationality of the person to be readmitted.
An interview request can be indicated by the Requesting Party at the readmission application under F, attached as Annex 6 to the Agreement. The interview shall be conducted by the competent diplomatic mission or consular representation of the Requested Party without delay but no later than within three working days after the receipt of the readmission application.
If an accelerated procedure is indicated, it shall be conducted in accordance with Article 6, paragraph 3, and Article 10, paragraph 2, of the Agreement.
The readmission application for third-country nationals or stateless persons contains the data enumerated in Annex 6 to the Agreement.
If available, the data and the copies of documents relating to the identity and nationality of the person to be readmitted shall be enclosed with the readmission application.
In accordance with Article 3, paragraphs 1 and 3, Article 5, paragraphs 1 and 3, and Article 9, paragraphs 1 and 4, of the Agreement, data and documents that can prove the obligations for readmission and acceptance to the territory of the Requested Party are mentioned in Annex 3 to the Agreement.
In accordance with Article 3, paragraphs 1 and 3, Article 5, paragraphs 1 and 3, and Article 9, paragraphs 2 and 5, of the Agreement, data and documents on the basis of which the obligations for readmission and acceptance of third-country nationals or stateless persons to the territory of the Requested Party can be validly assumed are mentioned in the Annexes 4 and 5 to the Agreement.
The response to the readmission application contains the data enumerated in Annex 3 to this Protocol.
After receiving a positive response to the readmission application, the competent authorities of the Requesting Party shall issue a travel document in accordance with Article 3, paragraph 4, and Article 5, paragraph 4, of the Agreement and shall present the notification of transfer to the competent authorities of the Requested Party, in accordance with Annex 4 to this Protocol and as stated in Article 11, paragraph 1, of the Agreement.
The transit application for third-country nationals or stateless persons contains the data enumerated in Annex 7 to the Agreement and a declaration of the Requesting Party which guarantees the readmission to the final destination.
The application should be sent to the Requested Party, preferably no later than seven calendar days prior to the transit. The Requested Party shall respond without delay but within five calendar days.
The transit of third-country nationals or stateless persons shall be effectuated through the border crossing points mentioned in Annex 2 of this Protocol.
An escort is a person assigned by the Requesting Party to accompany the person to be readmitted, or who is in transit.
At the territory of the Requested Party, escorts guarding and assisting the readmittance or transit of the person concerned shall operate under the authority of the Requested Party.
The authority of escorts is limited to self-defence. In addition, in the absence of any officials of the Requested Party who are authorised to take the necessary action or in order to support such officials, the escorts may respond to an immediate and serious threat in a reasonable and proportionate manner in order to prevent the person concerned from escaping, injuring himself or third parties or causing damage to property.
The Parties shall communicate with one another in the English language.
Annexes 1 to 5 shall constitute an integral part of this Protocol.
Any amendments to the Protocol shall enter into force in accordance with the procedure laid down in Article 17, paragraphs 1 and 2.
This Protocol shall apply to the territory of the Republic of Serbia, to the territory of the Kingdom of Belgium, to the territory of the Grand Duchy of Luxembourg and to the territory of the Kingdom of the Netherlands in which the Treaty on the functioning of the European Union is applicable.
The Kingdom of Belgium is depositary of this Protocol. The depositary shall issue each Party with a true copy of the original.
The Parties shall inform each other, as well as the depositary, of the completion of their national legal procedures necessary for the entry into force of the Protocol.
This Protocol shall, in accordance with Article 19, paragraph 2, of the Agreement, enter into force on the first day of the second month after the Joint Readmission Committee has been notified by the depositary that all Parties have completed their respective internal procedures necessary therefore. A copy of this notification shall be distributed by the depositary among all Parties.
In accordance with Article 20 of the Agreement this Protocol shall, in relation between the Republic of Serbia and the States of the Benelux, take precedence over the provisions of the Agreement between the Government of the Kingdom of the Netherlands, the Government of the Kingdom of Belgium and the Government of the Grant Duchy of Luxembourg and the Federal Government of the Federal Republic of Yugoslavia on readmission and acceptance of persons that do not or no longer fulfil the conditions for entering or staying on the territory of the other Contracting State, done at Belgrade on 19 July 2002. The Agreement of 2002 shall remain in force between Curaçao, Sint Maarten and the Caribbean part of the Netherlands (the islands of Bonaire, Sint Eustatius and Saba) on the one hand and the Republic of Serbia on the other hand.
DONE at Brussels on 25 January 2013, in the English, French, Dutch and Serbian languages, each of the four texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.

De Regeringen van de Benelux-Staten (het Koninkrijk België, het Groothertogdom Luxemburg en het Koninkrijk der Nederlanden)

de Regering van de Republiek Servië,
Hierna genoemd: „de Partijen”,
Op grond van artikel 19 van de te Brussel op 18 september 2007 ondertekende Overeenkomst tussen de Republiek Servië en de Europese Gemeenschap betreffende de overname van personen die zonder vergunning op het grondgebied verblijven,
Hierna genoemd: „de Overeenkomst”,
Zijn het volgende overeengekomen:
De voor de uitvoering van de Overeenkomst bevoegde autoriteiten staan in Bijlage 1 bij dit Protocol vermeld.
De Partijen stellen elkaar rechtstreeks onverwijld en langs diplomatieke weg in kennis van iedere wijziging in de lijst van de in Bijlage 1 bij dit Protocol vermelde bevoegde autoriteiten.
De voor de toepassing van de Overeenkomst te gebruiken grensovergangen staan in Bijlage 2 bij dit Protocol vermeld.
De bevoegde autoriteiten kunnen van geval tot geval overeenkomen gebruik te maken van andere grensovergangen voor de overname.
De Partijen stellen elkaar rechtstreeks onverwijld en langs diplomatieke weg in kennis van iedere wijziging in de lijst van de in Bijlage 2 bij dit Protocol vermelde grensovergangen.
Het overnameverzoek genoemd in artikel 7 van de Overeenkomst bevat de in Bijlage 6 bij de Overeenkomst vermelde gegevens.
De identiteit en de nationaliteit van een over te nemen persoon kunnen overeenkomstig artikel 2, lid 1, artikel 4, lid 1, en artikel 8, lid 1, van de Overeenkomst worden bewezen door middel van de in Bijlage 1 bij de Overeenkomst genoemde documenten.
De identiteit en de nationaliteit van een over te nemen persoon kunnen overeenkomstig artikel 2, lid 1, artikel 4, lid 1, en artikel 8, lid 2, van de Overeenkomst kan aannemelijk worden gemaakt aan de hand van de in Bijlage 2 bij de Overeenkomst genoemde documenten.
Indien de over te nemen persoon in het bezit is van een geldig reisdocument, is geen formeel overnameverzoek vereist, overeenkomstig artikel 6, lid 2, van de Overeenkomst.
In alle andere gevallen is een overnameverzoek vereist. Afschriften van de in Bijlage 1 en 2 bij de Overeenkomst vermelde documenten dienen bij het verzoek te worden gevoegd, ook al is de geldigheid ervan verstreken.
Het antwoord op het overnameverzoek wordt ter kennis gebracht van de bevoegde autoriteiten van de verzoekende Partij. Een positief antwoord wordt tegelijkertijd ter kennis gebracht van de diplomatieke consulaire vertegenwoordiging van de aangezochte Partij, waarna het reisdocument wordt afgegeven. Een verzoek hoeft niet door de over te nemen persoon te worden ondertekend. In geval van een negatief antwoord doen de bevoegde autoriteiten van de aangezochte Partij tevens opgave van de redenen waarom het overnameverzoek is afgewezen.
Indien de geldigheid van een voor de overname van een persoon afgegeven reisdocument om de in artikel 10, lid 5, van de Overeenkomst genoemde redenen is verstreken, wordt een nieuw reisdocument afgegeven, overeenkomstig artikel 2, lid 4, en artikel 4, lid 4, van de Overeenkomst.
Indien de geldigheid van het nieuwe document als bedoeld in artikel 3, lid 8, van dit Protocol verstrijkt, kan de verzoekende Partij het overnameverzoek via elektronische middelen opnieuw indienen, waarbij enkel naam en geboortedatum worden medegedeeld. De aangezochte Partij antwoordt binnen één werkdag. In geval van een positief antwoord wordt onverwijld een nieuw reisdocument afgegeven.
Na ontvangst van het positieve antwoord op het overnameverzoek stellen de bevoegde autoriteiten van de verzoekende Partij de bevoegde autoriteiten van de aangezochte Partij, in kennis van de overdracht overeenkomstig Bijlage 4 bij dit Protocol en zoals bepaald in artikel 11, lid 1, van de Overeenkomst.
Indien de verzoekende Partij geen van de in de Bijlagen 1, 2 en 5 bij de Overeenkomst vermelde documenten kan overleggen, kan, overeenkomstig artikel 8, lid 3, en artikel 9, lid 6, van de Overeenkomst een ondervraging worden verricht teneinde de nationaliteit van de over te nemen persoon vast te stellen.
Een verzoek tot ondervraging kan door de verzoekende Partij in het overnameverzoek, onder F, gevoegd als Bijlage 6 bij de Overeenkomst, worden aangegeven. De ondervraging wordt onverwijld en uiterlijk binnen drie werkdagen na de ontvangst van het overnameverzoek verricht door de bevoegde diplomatieke missie of consulaire vertegenwoordiging van de aangezochte Partij.
Indien de versnelde procedure wordt aangegeven, wordt zij gevolgd overeenkomstig artikel 6, lid 3, en artikel 10, lid 2, bij de Overeenkomst.
Het overnameverzoek voor onderdanen van derde landen of staatloze personen bevat de in Bijlage 6 bij de Overeenkomst vermelde gegevens.
Indien beschikbaar dienen de gegevens en de afschriften van documenten met betrekking tot de identiteit en de nationaliteit van de over te nemen persoon bij het overnameverzoek te worden gevoegd.
De gegevens en documenten, aan de hand waarvan de verplichtingen tot overname op het grondgebied van de aangezochte Partij overeenkomstig artikel 3, lid 1 en 3, artikel 5, lid 1 en 3, en artikel 9, lid 1 en 4, van de Overeenkomst kunnen worden aangetoond, staan in Bijlage 3 bij de Overeenkomst vermeld.
De gegevens en documenten, aan de hand waarvan de verplichtingen tot overname van onderdanen van derde landen en staatloze personen op het grondgebied van de aangezochte Partij overeenkomstig artikel 3, lid 1 en 3, artikel 5, lid 1 en 3, en artikel 9, lid 2 en 5, van de Overeenkomst aannemelijk kunnen worden gemaakt, staan in Bijlage 4 en 5 bij de Overeenkomst vermeld.
Na ontvangst van het positieve antwoord op het overnameverzoek geven de bevoegde autoriteiten van de verzoekende Partij een reisdocument overeenkomstig artikel 3, lid 4, en artikel 5, lid 4, van de Overeenkomt af en stellen zij de bevoegde autoriteiten van de aangezochte Partij in kennis van de mededeling inzake de overdracht, overeenkomstig Bijlage 4 bij dit Protocol en zoals bepaald in artikel 11, lid 1, van de Overeenkomst.
Het doorgeleidingsverzoek voor onderdanen van derde landen of staatloze personen bevat de in Bijlage 7 bij de Overeenkomst vermelde gegevens en een verklaring van de verzoekende Partij dat de overname tot de eindbestemming is verzekerd.
Het verzoek wordt bij voorkeur binnen zeven kalenderdagen voorafgaand aan de doorgeleiding, verzonden. De aangezochte Partij antwoordt onverwijld en uiterlijk binnen vijf kalenderdagen.
Het antwoord op het doorgeleidingsverzoek bevat de in Bijlage 5 bij dit Protocol vermelde gegevens.
De doorgeleiding van onderdanen van derde landen of staatloze personen vindt via de in Bijlage 2 bij dit Protocol vermelde grensovergangen plaats.
In geval van een verandering van datum of van andere praktische aspecten van de doorgeleiding die voorafgaand is meegedeeld aan en is toegestaan door de aangezochte Partij, dienen de bevoegde autoriteiten van de verzoekende Partij de aangezochte Partij daarvan naar behoren in kennis te stellen. Is zulks aanvaardbaar, dan zal de aangezochte Partij de doorgeleiding dienovereenkomstig toestaan.
Een begeleider is een door de verzoekende Partij aangewezen persoon belast met de begeleiding van de over te nemen of door te geleiden persoon.
Op het grondgebied van de aangezochte Partij staan de begeleiders bij de bewaking en bijstand bij de overname of doorgeleiding van de betrokkene onder het gezag van de aangezochte Partij.
De bevoegdheden van de begeleiders zijn beperkt tot zelfverdediging. Daarnaast kunnen de begeleiders, bij afwezigheid van de terzake bevoegde ambtenaren van de aangezochte Partij of ter ondersteuning van deze ambtenaren, bij een onmiddellijke en ernstige dreiging op redelijke en proportionele wijze optreden om te voorkomen dat de betrokkene vlucht, zichzelf of derden letsel toebrengt dan wel schade aan goederen veroorzaakt.
De Partijen communiceren met elkaar in de Engelse taal.
De Bijlagen 1 tot en met 5 vormen een integrerend onderdeeldeel van het Uitvoeringsprotocol.
Dit Protocol en zijn bijlagen kunnen in onderlinge overeenstemming tussen de Partijen worden gewijzigd.
Wijzigingen van het Protocol treden in werking in overeenstemming met de procedure vervat in artikel 17, eerste en tweede lid.
Dit Protocol is van toepassing op het grondgebied van de Republiek Servië, het grondgebied van het Koninkrijk België, het grondgebied van het Groothertogdom Luxemburg en het grondgebied van het Koninkrijk der Nederlanden waar het Verdrag betreffende de werking van de Europese Unie op dit grondgebied van toepassing is.
Het Koninkrijk België is depositaris van dit Protocol. De depositaris zal alle Partijen een voor eensluidend verklaard afschrift daarvan doen toekomen.
De Partijen stellen elkaar en de depositaris in kennis van de voltooiing van hun nationale wettelijke procedures voor de inwerkingtreding van het Protocol.
Dit Protocol treedt overeenkomstig artikel 19, lid 2, van de Overeenkomst in werking op de eerste dag van de tweede maand na kennisgeving door de depositaris aan het Gemengd Comité overname dat de daarvoor noodzakelijke interne procedures door alle Partijen zijn voltooid. Een afschrift van deze kennisgeving wordt door de depositaris aan iedere Partij verstrekt.
Overeenkomstig artikel 20 van de Overeenkomst heeft dit Protocol, in de relaties tussen de Republiek Servië en de Benelux-Staten, voorrang op de bepalingen van de op 19 juli 2002 te Belgrado tot stand gekomen Overeenkomst tussen de Regering van het Koninkrijk der Nederlanden, de Regering van het Koninkrijk België en de Regering van het Groothertogdom Luxemburg en de Federale Regering van de Federale Republiek Joegoslavië betreffende de terug- en overname van personen die niet of niet meer voldoen aan de voorwaarden voor binnenkomst of verblijf op het grondgebied van de andere overeenkomstsluitende staat. De Overeenkomst van 2002 blijft van kracht tussen Curaçao, Sint Maarten en het Caribische deel van Nederland (Bonaire, Sint Eustatius en Saba) enerzijds en de Republiek Servië anderzijds.
GEDAAN te Brussel op 25 januari 2013, in de Engelse, de Franse, de Nederlandse en de Servische taal, zijnde de vier teksten gelijkelijk authentiek. In geval van verschillen in interpretatie is de Engelse tekst doorslaggevend.
