PREÁMBULO
Los que suscriben, Representantes Plenipotenciarios de los Gobiernos de los países o territorios miembros de la Unión Postal de las Américas, España y Portugal, en adelante Unión,
asumiendo su responsabilidad de asegurar, a toda persona, prestaciones postales de calidad, tanto en el servicio interno como en el internacional;
teniendo en cuenta que los países o territorios miembros deben asegurar prestaciones postales de calidad y asequibles, a través de los operadores que designen como proveedores del servicio postal universal;
advirtiendo que resulta imperioso que, además, dichos operadores actúen en todos los ámbitos del mercado postal como empresas dinámicas y eficientes;
conscientes de que, para lograr tales objetivos, resulta indispensable establecer y fortalecer acuerdos y compromisos a nivel gubernamental y empresarial, tanto en los aspectos regulatorios y técnicos, como en los comerciales;
adoptan, bajo reserva de ratificación, la presente Constitución.
Fortalecer la reforma, modernización e integración regional del sector postal, promoviendo un servicio de calidad accesible a todas las personas, a través de la cooperación, propiciando el desarrollo sostenible
Ser el Organismo Regional Intergubernamental líder del sector postal, que contribuya al desarrollo económico y social de sus miembros
La Unión tiene las siguientes finalidades:
promover la prestación del servicio postal universal, así como el desarrollo del sector postal en la región, mediante su reforma en los países o territorios miembros, transformando y modernizando sus organizaciones y capacitando a sus recursos humanos;
coordinar y fomentar una eficiente cooperación para el desarrollo postal de los países o territorios miembros;
coordinar y fomentar el intercambio de información y conocimiento en los ámbitos operativo, regulatorio y gubernamental;
mejorar la calidad de servicio, la interconexión y la seguridad de las redes, a través de la promoción y aplicación de las tecnologías de la información y de las comunicaciones que permita la medición del desempeño de los servicios postales así como una mayor fiabilidad en el intercambio de datos entre los países o territorios miembros, coadyuvando a satisfacer de esta forma las demandas de los usuarios y clientes;
garantizar la integración de sus acciones y estrategias en el marco de la Estrategia Postal Mundial adoptada por la Unión Postal Universal «UPU», favoreciendo la interacción, coordinación y comunicación con dicha Organización, las demás Uniones Restringidas, otros organismos internacionales y demás partes vinculadas al sector postal.
Son miembros de la Unión:
los Países que posean la calidad de miembros en la fecha de la puesta en vigor de la presente Constitución;
los Países que adquieran la calidad de miembros conforme al artículo 9.
Son miembros de la Unión:
los países o territorios que posean la calidad de miembros en la fecha de la puesta en vigor de la presente Constitución;
los países o territorios que adquieran la calidad de miembros conforme al artículo 10.
La Unión tiene en su ámbito:
los territorios de los países o territorios miembros;
los demás territorios que, sin ser miembros de la Unión, dependan – desde el punto de vista postal – de países o territorios miembros.
El idioma oficial de la Unión es el Español.
Todo País miembro, de acuerdo con su legislación interna, otorgará capacidad jurídica a la Unión Postal de las Américas, España y Portugal para el correcto ejercicio de sus funciones y la realización de sus propósitos.
Todo país o territorio miembro, de acuerdo con su legislación interna, otorgará capacidad jurídica a la Unión para el correcto ejercicio de sus funciones y la realización de sus propósitos.
La Unión gozará, en el territorio de cada uno de los países o territorios miembros, de los privilegios e inmunidades necesarios para la realización de su misión.
Los representantes de los países o territorios miembros y de las administraciones postales que formen parte de las delegaciones a las reuniones de los órganos de la Unión, o que cumplan misiones oficiales de la Organización, gozarán igualmente de los privilegios e inmunidades necesarios para el cumplimiento de sus actividades.
La Unión gozará, en el territorio de cada uno de los países o territorios miembros, de los privilegios e inmunidades necesarios para la realización de su misión.
Todo país o territorio tendrá derecho a retirarse de la Unión, renunciando a su calidad de miembro.
A solicitud de tres países o territorios miembros, por lo menos, y con el asentimiento de las dos terceras partes de los miembros con derecho de voto, se podrá celebrar un Congreso Extraordinario.
La Conferencia de los representantes de los países o territorios miembros es el órgano de la Unión que se reúne cuantas veces resulte necesario, con ocasión de celebrarse un Congreso de la Unión Postal Universal con objeto de:
examinar las proposiciones y asuntos de mayor interés para la Unión o para los países o territorios miembros;
determinar, en su caso, la acción conjunta a seguir en el Congreso para alcanzar los objetivos de la Unión y de sus países o territorios miembros.
El Consejo asegurará entre dos Congresos la continuidad de los trabajos de la Unión, mediante la aplicación del Plan de Acción anual de la Secretaría General, priorizando las líneas de acción de esta, conforme a la Estrategia aprobada por el Congreso y deberá efectuar estudios y emitir opinión sobre cuestiones que interesen o estén vinculadas a la actividad postal. Asimismo supervisará y controlará las actividades de la Secretaría General.
La Secretaría General, bajo el control del Consejo, es el Órgano Permanente de trabajo de la Unión para la ejecución del Plan Estratégico de la Unión, así como el enlace entre sus miembros. Desempeña la Secretaría del Congreso, del Consejo y su Comité de Gestión, y de los grupos de trabajo, a los cuales asiste en sus funciones.
La Constitución es el Acta fundamental de la Unión, define SU misión y contiene sus reglas orgánicas.
El Reglamento General contiene las disposiciones que aseguran la aplicación de la Constitución y el funcionamiento de la Unión. Será obligatorio para todos los países o territorios miembros.
Las Resoluciones expresarán la voluntad del Congreso y se referirán a la Estrategia, a las actividades de la Unión o a ciertos aspectos de la prestación de los servicios postales de la región.
Las Resoluciones que contengan un mandato tendrán carácter obligatorio, y deberán establecer, según el caso, el período de vigencia o el plazo para su cumplimiento.
Las Resoluciones serán anexadas a las Actas de la Unión.
Las Recomendaciones expresarán la opinión del Congreso respecto a iniciativas o mejores prácticas que se consideren aconsejables para el desarrollo de los servicios postales en los países o territorios miembros, que las aplicarán en la medida de lo posible.
Las Recomendaciones serán anexadas a las Actas de la Unión.
Cada Congreso fijará el importe máximo que podrán alcanzar:
el Presupuesto para cada año durante el período cuatrienal siguiente;
los gastos correspondientes a la reunión del Congreso siguiente.
Los gastos de la Unión serán sufragados en común por todos los países o territorios miembros, que a tales efectos se clasificarán en diferentes categorías de contribución. A estos fines, cada país o territorio miembro elegirá la categoría de contribución en que desea ser incluido. Las categorías de contribución están determinadas en el Reglamento General.
Los instrumentos de ratificación de la Constitución y, eventualmente, los de la aprobación de las demás Actas y de las Resoluciones se depositarán, en el más breve plazo, ante la Secretaría General de la Unión, la cual lo comunicará a los demás países o territorios miembros.
Las proposiciones modificativas de las Actas de la Unión, así como de las Resoluciones y Recomendaciones, podrán presentarse:
por la administración postal de un país o territorio miembro;
por el Consejo Consultivo y Ejecutivo, como consecuencia de los estudios que realice o de las actividades de la esfera de su competencia, así como en lo que afecten a la organización y funcionamiento de la Secretaría General.
Las proposiciones que modifiquen las Actas de la Unión, asi como las de Resoluciones y Recomendaciones, podrán presentarse:
por un país o territorio miembro;
por el Consejo, como consecuencia de los estudios que realice o de las actividades de la esfera de su competencia, así como en lo que afecten a la organización y funcionamiento de la Secretaría General.
Para ser adoptadas, las proposiciones sometidas al Congreso relativas a la presente Constitución deberán ser aprobadas por al menos dos tercios de los países o territorios miembros de la Unión, con derecho de voto.
Las modificaciones adoptadas por un Congreso serán objeto de un Protocolo Adicional y, salvo acuerdo en contrario de este Congreso, entrarán en vigor al mismo tiempo que las Actas revisadas en el curso del mismo Congreso.
Las modificaciones de la Constitución serán ratificadas lo antes posible por los países o territorios miembros y los instrumentos de esta ratificación se tratarán conforme a las disposiciones de los artículos 22 y 23.
El Reglamento General, así como las Resoluciones y Recomendaciones, podrán ser modificados por el Congreso, de acuerdo con las condiciones que se establezcan en dicho instrumento.
El presente Protocolo Adicional comenzará a regir el día primero de enero de dos mil ocho y permanecerá en vigor por tiempo indeterminado.
Los desacuerdos que se presentaren entre las administraciones postales de los países o territorios miembros sobre la interpretación o aplicación de las Actas y las Resoluciones de la Unión serán resueltos por arbitraje, de conformidad con lo establecido en el Reglamento General de la Unión Postal Universal.

En fe de lo cual los Representantes Plenipotenciarios de los Gobiernos de los Países miembros han firmado la presente Constitución en la ciudad de Santiago, capital de la República de Chile, a los veintiséis días del mes de Noviembre del año mil novecientos setenta y uno.
Preámbulo
Los que suscriben, Representantes Plenipotenciarios de los gobiernos de los países y territorios miembros de la Unión Postal de las Américas, España y Portugal, adoptan, de común acuerdo, el presente Reglamento General, en virtud de lo dispuesto en el artículo 18, párrafo 2 de la Constitución, con el fin de asegurar su aplicación y el funcionamiento de la Unión.
La nota de adhesión o la solicitud de admisión deberá dirigirse, por el gobierno del país o territorio interesado, a la Secretaría General, que la comunicará a los demás países o territorios miembros de la Unión.
Para ser admitido como miembro se requerirá que la solicitud del país o territorio interesado sea aprobada, como mínimo, por los dos tercios de los países y territorios miembros.
Se considerará que los países y territorios miembros aprueban la solicitud cuando no hubieren dado respuesta en el plazo de cuatro meses, a partir de la fecha en que se les haya comunicado.
Todo país o territorio miembro tendrá la facultad de retirarse de la Unión mediante denuncia de la Constitución, que deberá comunicarse a la Secretaría General y, por ésta, a los demás gobiernos de los países o territorios miembros.
Los representantes de los países y territorios miembros se reunirán en Congreso cada cuatro años, aproximadamente.
Cada Congreso designará al país o territorio miembro en el cual deberá reunirse el Congreso siguiente, siempre que mediare invitación, a tal efecto, del país o territorio designado. Si fuesen varios invitantes, la decisión tendrá lugar mediante votación secreta, según lo dispuesto en el artículo 111 del presente Reglamento.
Si no fuere posible la realización de un Congreso en el país o territorio elegido, la Secretaría General, con la urgencia del caso, realizará las gestiones necesarias para tratar de encontrar un país o territorio que esté dispuesto a ser sede del Congreso. El resultado de estas gestiones será sometido al Consejo, para su decisión.
Si al clausurar un Congreso no hubiese ningún país o territorio invitante para sede del próximo, la Secretaría General aplicará el mismo procedimiento establecido en el párrafo 3.
Cuando un Congreso deba ser reunido sin que haya un gobierno invitante, la Secretaría General, de acuerdo con el Consejo y con el gobierno de la República Oriental del Uruguay, adoptará las disposiciones necesarias para convocar y organizar el Congreso en el país sede de la Unión. En este caso, la Secretaría General ejercerá las funciones de gobierno invitante.
Previo acuerdo con la Secretaría General, el gobierno del país o territorio sede del Congreso fijará la fecha definitiva, así como el lugar donde deba reunirse el Congreso. En principio, un año antes de esta fecha el gobierno del país o territorio sede del Congreso enviará invitación al gobierno de cada país o territorio miembro, ya sea directamente o por conducto de la Secretaría General.
La Presidencia del Congreso se atribuye al país o territorio invitante. En el caso previsto en el párrafo 5 precedente, corresponderá al Consejo designar al país que deba desempeñar la Presidencia.
El país o territorio miembro sede del Congreso, en consulta con la Secretaría General, sugerirá la designación del Decano del mismo, que deberá ser un funcionario postal en actividad o jubilado de larga trayectoria en los Congresos de la Unión. El Consejo procederá a adoptar esta designación en el momento adecuado. A la apertura de la primera sesión plenaria, el Decano asumirá la Presidencia del Congreso hasta tanto sea nombrado el Presidente. El Decano propone al Congreso el Presidente y los Vicepresidentes del mismo, así como los de las Comisiones. Una de las Vicepresidencias del Congreso se atribuirá al país o territorio que desempeñó la Presidencia del Congreso anterior.
En la primera sesión, el Decano propondrá la constitución de la Mesa, que estará integrada por el Presidente del Congreso, los dos Vicepresidentes y el Secretario General de la Unión.
Las finalidades del Congreso son:
revisar y completar, si fuere el caso, las Actas, Resoluciones y Recomendaciones de la Unión;
fijar las prioridades de acción de la Unión para el período siguiente con la aprobación de la Estrategia, que servirá de base para la redacción de los Planes anuales de Acción, y
tratar cuantos asuntos se sometan a su consideración, relacionados con los fines de la Unión.
El Congreso expresa su voluntad a través de Resoluciones y Recomendaciones, conforme lo dispuesto en el artículo 19 de la Constitución.
Cada país o territorio miembro se hará representar por uno o varios delegados o por la delegación de otro país o territorio miembro. La delegación de un país o territorio miembro no podrá representar más que a otro país o territorio además del suyo.
El Presidente abre la sesión, dirige los debates, concede la palabra de acuerdo al orden en que se solicita, pone a votación los asuntos en los que no haya unanimidad de pareceres, decide sobre las cuestiones de procedimiento que ocurran durante las deliberaciones y clausura el Congreso.
Por delegación se entiende la persona o conjunto de personas designadas como representantes por un país o territorio miembro para participar en el Congreso. Si la delegación está compuesta por varios delegados, se deberá designar un Jefe de delegación y en su caso un Jefe Adjunto.
Los integrantes de las delegaciones han de ser expertos con amplios conocimientos en las normas de la Unión y con responsabilidades específicas en lo que se refiere a la actividad postal en los países o territorios miembros.
Cuando un país o territorio miembro no pueda participar en un Congreso, podrá hacerse representar por la delegación de otro. Si, participando en el Congreso, no pudiera asistir a una sesión, podrá igualmente hacerse representar por otra delegación. En ambos casos, se comunicará al Presidente la decisión adoptada, teniendo en cuenta que cada país o territorio miembro sólo podrá ostentar la representación de otro.
Los delegados deberán estar acreditados por poderes firmados por el Jefe de Estado, por el Jefe de Gobierno o por el Ministro de Relaciones Exteriores de los países o territorios miembros.
Los poderes deberán estar redactados en debida forma. Se considera a un delegado como representante plenipotenciario si sus poderes responden a uno de los criterios siguientes:
si confieren plenos poderes;
si autorizan a representar a su gobierno, sin restricciones;
si otorgan los poderes necesarios para firmar las Actas.
Cualquiera de los tres casos incluye implícitamente el poder de tomar parte en las deliberaciones y votar.
Los poderes que no se ajusten a los criterios detallados en a), b) y c) de este párrafo, otorgarán solamente el derecho de tomar parte en las deliberaciones y votar.
Los poderes serán depositados tan pronto se inaugure el Congreso, ante la autoridad designada a ese efecto.
Los delegados que no hayan presentado sus poderes podrán tomar parte en las deliberaciones y en las votaciones, siempre que hubieren sido anunciados por sus gobiernos, al gobierno del país o territorio sede del Congreso. También podrán hacerlo aquellos delegados en cuyos poderes se haya constatado alguna insuficiencia o irregularidad. Ninguno de estos delegados podrá votar a partir del momento en que el Congreso haya aprobado el informe de la Comisión de Verificación de Poderes, en el cual se constate que no han presentado sus poderes o que éstos son insuficientes para votar y hasta tanto no se regularice tal situación.
Podrán participar en las deliberaciones del Congreso, con carácter de observadores, pudiendo tomar la palabra cuando sean autorizados por el Presidente del Congreso y sin derecho de voto:
los representantes de países no miembros de la Unión, que hayan sido especialmente invitados por decisión del Consejo, en los términos que se acuerden;
los representantes de la Unión Postal Universal;
los representantes de las Uniones Postales Restringidas que ofrezcan reciprocidad.
También podrán ser admitidos como observadores, en los términos que se acuerden, los representantes de organismos internacionales o cualquier organismo con interés o vinculado al sector, cuya participación sea considerada relevante para el desarrollo de los trabajos del Congreso, por el Consejo, el Comité de Gestión y la Secretaría General.
Las proposiciones presentadas conforme al artículo 125 del presente Reglamento, servirán de base para las deliberaciones del Congreso.
En principio, cada proposición deberá tener un solo objeto y contendrá únicamente las modificaciones referidas al mismo.
Sin embargo, podrán admitirse enmiendas en cualquier momento, bien por escrito o verbalmente, durante la discusión del tema de que se trate.
Si una cuestión es objeto de varias proposiciones, el Presidente decidirá el orden de discusión, comenzando en principio por la que se aleje del texto de base, o que implique un cambio más radical.
Si una proposición pudiera subdividirse en varias partes, cada una de ellas podrá, con el acuerdo del autor de la proposición o del Congreso, ser examinada y puesta a votación por separado.
Si una enmienda es aceptada por la delegación que presentó la proposición primitiva, será incorporada de inmediato al texto de ésta. Si la enmienda no fuera aceptada, se aplicará, para el orden de discusión, el criterio establecido en el párrafo 4.
El procedimiento descrito en el párrafo 6 también se aplicará cuando se presenten varias enmiendas a una misma proposición.
Cualquier proposición retirada en el Pleno puede ser retomada por otra delegación. Además, si la enmienda a una proposición es aprobada y aceptada por el país o territorio de origen de la proposición, otro país o territorio miembro podrá retomar la proposición original no modificada.
Los participantes deberán ajustarse al tema en discusión, limitando su intervención a un tiempo no mayor de cinco minutos, salvo acuerdo en contrario, tomado por la mayoría simple de los miembros presentes y votantes. En caso de excederse del tiempo previsto en el uso de la palabra, el Presidente estará autorizado a interrumpir al orador.
Previa consulta al Congreso, con la aprobación de la mayoría simple de los miembros con derecho de voto, presentes y representados, el Presidente podrá:
limitar el número de intervenciones de una delegación sobre una proposición o grupo de proposiciones determinado;
limitar el número de intervenciones de distintas delegaciones sobre una misma proposición o grupo de proposiciones determinado, a cinco intervenciones a favor y cinco en contra del tema en discusión;
declarar cerrada la lista de oradores, después de dar lectura a la misma, respetando el derecho de la delegación que hubiere presentado la proposición de responder a las intervenciones de otras delegaciones.
Durante la discusión de una cuestión o, incluso, dado el caso, después del cierre del debate, una delegación podrá presentar una moción de orden para pedir:
aclaraciones sobre el desarrollo de los debates;
el respeto de la Constitución o de los Reglamentos;
la modificación del orden de discusión de las proposiciones sugerido por el Presidente.
La moción de orden tendrá prioridad sobre todas las cuestiones, comprendidas las mociones de procedimiento mencionadas en el párrafo 3.
El Presidente hará inmediatamente las precisiones solicitadas o tomará la decisión que considere conveniente con respecto a la moción de orden. En caso de objeción, la decisión del Presidente se pondrá de inmediato a votación.
Además, durante la discusión de una cuestión, una delegación podrá introducir una moción de procedimiento que tenga por objeto proponer:
la suspensión de la sesión;
el levantamiento de la sesión;
la clausura de la lista de oradores;
el aplazamiento del debate sobre la cuestión en discusión;
el cierre del debate sobre la cuestión en discusión.
Las mociones de procedimiento tendrán prioridad, en el orden arriba indicado, sobre todas las demás proposiciones, con excepción de las mociones de orden indicadas en el párrafo 1.
Las mociones tendientes a la suspensión o al levantamiento de la sesión no se discutirán, sino que se pondrán inmediatamente a votación.
Cuando una delegación proponga la clausura de la lista de oradores, la postergación o el cierre del debate sobre una cuestión en discusión, sólo se otorgará la palabra a dos oradores opuestos a la moción de procedimiento en cuestión, después de lo cual la moción se pondrá a votación.
La delegación que presente una moción de orden o de procedimiento no podrá tratar, en su intervención, el fondo de la cuestión en discusión. El autor de una moción de procedimiento podrá retirarla antes de que se ponga a votación y toda moción de este tipo, enmendada o no, que fuere retirada, podrá ser retomada por otra delegación.
Las cuestiones que no cuenten con el asentimiento general serán sometidas a votación. La validez del voto está subordinada a la presencia o representación de los dos tercios de los países o territorios miembros con derecho de voto.
Bajo reserva del párrafo 1, se debe entender por países o territorios miembros con derecho de voto, aquellos que votan «a favor» o «en contra», no tomándose en cuenta las abstenciones para el recuento de los votos necesarios para formar la mayoría, al igual que los votos en blanco o anulados, en caso de votación secreta.
Cuando la cantidad de abstenciones y de votos en blanco o anulados excediere de la mitad del total de votos expresados (a favor, en contra o abstenciones), se postergará el examen del asunto hasta una sesión posterior, donde ya no se contarán las abstenciones ni los votos en blanco o anulados.
La votación, por regla general, se efectuará levantando la pancarta con el nombre del país o territorio miembro. Sin embargo, a petición de una delegación o por decisión del Presidente se votará nominalmente, siguiendo el orden alfabético de países o territorios, previo sorteo para determinar la delegación que comenzará a votar.
El informe de cada sesión se redactará en lengua Española. Se reproducirá sucintamente el desarrollo general de las sesiones, proposiciones formuladas, resumen de las deliberaciones habidas y resultados obtenidos.
Cada delegado tendrá el derecho de solicitar la inserción íntegra en el informe de toda declaración que formule, a condición de que entregue el texto a la Secretaría General, redactado en el idioma oficial de la Unión y en el término de veinticuatro horas después de finalizada la sesión de que se trata.
La Secretaría General confeccionará los informes de las sesiones en base a las grabaciones de las deliberaciones del Congreso y las enviará para su aprobación a las delegaciones de los países o territorios miembros que participaron en el Congreso. La Secretaría General tomará en consideración las observaciones que le lleguen dentro del plazo de 40 días a contar de la fecha de distribución de los informes a los países o territorios miembros que corresponda.
Los países y territorios miembros se reunirán en Congreso Extraordinario cuando la importancia y urgencia de los asuntos a tratar no permitan esperar la celebración de un Congreso Ordinario.
Los países y territorios miembros que lo promuevan señalarán, al mismo tiempo, cuál de ellos está dispuesto a ser la sede del Congreso Extraordinario, a fin de que la Secretaría General pueda recabar la conformidad de los demás países o territorios miembros.
El gobierno del país o territorio miembro designado como sede del Congreso Extraordinario enviará la oportuna invitación al gobierno de cada país o territorio miembro, al menos 6 meses antes de la fecha que se señale para el comienzo del Congreso Extraordinario, ya sea directamente o por conducto de la Secretaría General.
El Consejo estará compuesto por todos los países o territorios miembros de la Unión. El país sede del Congreso ejercerá la Presidencia del Órgano, debiendo ser ocupada por expertos en el manejo de cuerpos colegiados y amplio conocimiento de las normas de la Unión.
La reunión constitutiva de cada Consejo será convocada durante el Congreso por el Presidente de éste. En ella se elegirá un Primer y un Segundo Vicepresidente. Si el país o territorio a quien corresponde la Presidencia renunciase a ella, pasará a desempeñarla el Primer Vicepresidente. En tal caso, el Segundo Vicepresidente pasará a primero y se elegirá un nuevo Segundo Vicepresidente entre los miembros restantes.
En la misma reunión constitutiva el Consejo elegirá su Comité de Gestión, de acuerdo con el artículo 116, numeral 2, del presente Reglamento.
Convocado por su Presidente, por conducto de la Secretaría General, el Consejo celebrará una sesión anual en la sede de la Unión.
En casos excepcionales y sin que signifique mayor costo para la Unión, el Consejo podrá celebrar su reunión anual en otra ciudad de algún país o territorio miembro. En todas sus sesiones el Secretario General tomará parte en los debates sin derecho de voto.
El Consejo dictará el Reglamento Interno que norme su funcionamiento. Se aplicarán supletoriamente, y en lo que resulten compatibles, las normas previstas en los artículos anteriores y referidas al funcionamiento del Congreso, siendo el Presidente del Consejo o, en su caso, la Vicepresidencia, los responsables de su correcta interpretación y aplicación.
En caso de necesidad el Presidente a propuesta de cualquier miembro y con el asentimiento de las dos terceras partes de los miembros del Consejo con derecho de voto, convocará una reunión extraordinaria, en el plazo máximo de dos meses.
Las funciones de miembros del Consejo serán gratuitas. Los gastos de funcionamiento estarán a cargo de la Unión. Con excepción de las reuniones que se realicen durante el Congreso, los países y territorios miembros podrán solicitar el financiamiento para la participación de un delegado, con cargo a su alícuota de Cooperación Técnica, que consistirá en la provisión de un pasaje aéreo de ida y vuelta, clase económica, el pago del 80% del monto del viático estipulado por el PNUD para la sede del Consejo y la provisión de una tarjeta asistencial.
La participación de observadores en las reuniones del Consejo se regirá, por analogía, conforme lo dispuesto en el artículo 107 del presente Reglamento.
La Secretaría General en consulta con el Presidente del Consejo y con el Comité de Gestión analizará y procederá a realizar las invitaciones correspondientes en los términos que se acuerden.
Los observadores podrán tomar la palabra cuando sean autorizados por el Presidente del Consejo, pero no tendrán derecho de voto.
El Consejo dirigirá las actividades de la Unión con las siguientes atribuciones en particular:
mantener contacto con los países o territorios miembros, con los Órganos de la Unión Postal Universal, con las Uniones Postales Restringidas y con cualquier otro organismo nacional o internacional, a través del Presidente del Consejo;
presentar el proyecto de Plan Estratégico al Congreso, que contará con el informe previo del Comité de Gestión y con la participación y asesoramiento de la Secretaría General;
hacer seguimiento anual de la ejecución del Plan Estratégico y medición de resultados, con aprobación de posibles reajustes de prioridades;
tomar iniciativas y realizar acciones que interesen o estén vinculadas a la actividad postal de los países o territorios miembros de la Unión;
examinar y aprobar el proyecto de Plan de Acción elaborado por la Secretaría General;
ordenar y controlar la actividad de la Secretaría General y aprobar su Reglamento Interno;
examinar y, en su caso, aprobar la Memoria anual formulada por la Secretaría General sobre las actividades de la Unión;
autorizar el Presupuesto anual de la Unión dentro de los límites fijados por el Congreso;
examinar y, en su caso, aprobar la rendición de cuentas del Presupuesto del año precedente;
establecer en su primera reunión posterior al Congreso Ordinario, el régimen salarial del personal de la Secretaría General;
aprobar y/o modificar, en su caso, el Estatuto del Personal de la Secretaría General de la Unión;
aprobar y modificar el Manual de Cooperación Técnica, como instrumento para el cumplimiento de los objetivos de la Unión determinados en el Plan Estratégico aprobado;
examinar y, en su caso, aprobar el plan anual de participación de la Secretaría General en las reuniones postales internacionales, así como el número de funcionarios que deberán asistir a cada una de ellas, con excepción de aquellos viajes de emergencia que resulten de interés para la Unión. Bajo el mismo procedimiento aprobará los demás viajes que deban efectuarse en representación de la Unión;
examinar y autorizar, si procede, las solicitudes de trasposición entre programas y entre grupos de gastos de un mismo programa del Presupuesto autorizado para el año en curso, hechas por el Secretario General;
realizar estudios o emitir opinión sobre cuestiones que interesen o estén vinculadas a la actividad postal o que puedan afectar a los países o territorios miembros o a la Unión;
favorecer y supervisar la organización y desarrollo de actividades de capacitación, la implantación de las escuelas postales en los países o territorios miembros y a solicitud de éstos gestionar, por intermedio de la Secretaría General, acciones de expertos y consultores para su organización, desarrollo y funcionamiento, de acuerdo a programas de cooperación técnica;
designar al país sede del próximo Congreso en los casos previstos en el artículo 103, párrafos 3 y 4, previa votación si hubiere más de un candidato;
adoptar las disposiciones necesarias para designar al país o territorio que deba asumir la Presidencia del Congreso en el caso previsto en el artículo 103, párrafo 7;
presentar al Congreso proposiciones de modificación de las Actas y proyectos de Resoluciones y Recomendaciones que surjan de estudios realizados por mandato o de su propia iniciativa;
decidir sobre las solicitudes de invitación de observadores al Congreso, conforme a las disposiciones del artículo 107 de este Reglamento;
informar a los países y territorios miembros sobre el resultado de estudios iniciados;
establecer normas acerca de los documentos que debe publicar y distribuir, gratuitamente o a precio de costo, la Secretaría General;
promover la cooperación internacional para facilitar, por todos los medios de que disponga, la cooperación al desarrollo de los países o territorios de la Unión;
actuar en instancia superior en las reclamaciones del personal de la Secretaría General contra las decisiones adoptadas por ésta y resueltas en primera instancia por la Autoridad de Alta Inspección;
proceder a la elección del cargo de Secretario General entre los candidatos propuestos, en el caso previsto en el párrafo 5 del artículo 119;
aprobar aquellos proyectos con cargo a los Fondos de Cooperación Técnica que, según se establezca en el Reglamento de Cooperación Técnica, le sean presentados por la Secretaría General;
previa opinión favorable de la Secretaría General, decidir sobre la acumulación de más de 3 alícuotas para un país o territorio miembro.
las demás atribuciones necesarias para el debido cumplimiento del objeto del Consejo.
La presentación de proposiciones y/o asuntos por parte de los miembros del Consejo deberán ser remitidos a la Secretaría General al menos seis semanas antes de la apertura del período de sesiones en el cual deban ser examinados. Fuera de ese plazo las proposiciones y/o asuntos sólo podrán considerarse si el Consejo así lo decide por mayoría de miembros presentes y votantes.
La presentación y examen de proposiciones y/o asuntos se regirá conforme lo dispuesto en el artículo 108, numerales 2 a 10, del presente Reglamento.
La adopción de decisiones por el Consejo implica:
la verificación del quórum necesario, que debe corresponder a la mitad más uno de los países y territorios miembros presentes con derecho de voto;
el consenso o, cuando tal no sea posible, mayoría simple.
La adopción de decisiones por consulta a distancia, posterior a las sesiones del Consejo implica:
la consulta efectuada a los países y territorios miembros de la Unión con derecho de voto;
la verificación del quórum necesario para comprobar las respuestas, debe corresponder a la mitad más uno de los países y territorios miembros de la Unión con derecho de voto;
mayoría simple basada en ese quórum efectivo de respuestas.
El Consejo desarrollará sus trabajos fundamentado en el Plan Estratégico aprobado y en los encargos que fija el Congreso. Podrá priorizar objetivos que resulten necesarios como consecuencia de las situaciones cambiantes que se vayan produciendo en la actividad postal.
El Consejo determinará los instrumentos y los medios con los cuales desarrollará sus propias actividades.
El Consejo expresa su voluntad a través de Decisiones, conforme lo dispuesto en el Artículo 20 de la Constitución y demás disposiciones que al respecto dicte el propio Órgano.
El Comité de Gestión reporta al Consejo y lo asiste en el seguimiento, análisis y evaluación de la actividad de la Unión, con las siguientes atribuciones en particular:
informar sobre el seguimiento e indicadores del Plan Estratégico y el establecimiento de prioridades;
informar sobre el plan de acción de la Secretaría General y su ejecución;
informar sobre los indicadores de gestión propuestos por la Secretaría General para evaluar su eficiencia, incluyendo estructura y recursos, así como los resultados de medición obtenidos;
informar sobre la ejecución y cumplimiento de los proyectos de Cooperación Técnica y la evaluación que sobre ellos presente la Secretaría;
informar sobre el seguimiento de la ejecución del Presupuesto;
informar sobre el proyecto de Presupuesto, la Rendición de Cuentas, el Estado de Situación Patrimonial, el Estado de Resultados y la Memoria Anual a presentar por la Secretaría;
informar sobre los proyectos de Cooperación Técnica que deban ser sometidos a su consideración;
informar sobre otras funciones de asesoramiento o propuestas que le encomiende el Consejo;
presentar al Consejo un informe resumido de sus acciones y decisiones y sobre el alcance de su programa de trabajo. Este informe debe estar a disposición de los países o territorios miembros por parte de la Secretaría General por lo menos 30 (treinta) días antes de la fecha de la reunión del Consejo, excepto en casos donde las reuniones del Comité de Gestión y del Consejo se lleven a cabo en un lapso menor a 30 días. La Secretaría General, con una antelación de 15 días, trasladará a los países o territorios miembros de la Unión el Orden del Día de sus reuniones, y remitirá las Actas resumen de las mismas en el plazo de 15 días a contar desde su celebración.
poner a disposición de los países o territorios miembros de la Unión que así lo requieran, los documentos examinados y elaborados por el Comité.
El Comité de Gestión estará integrado por siete miembros: el Presidente del Consejo quien presidirá el Comité de Gestión, y seis países o territorios miembros de la Unión que serán elegidos mediante voto secreto por el Consejo en su reunión constitutiva.
De entre los seis miembros electos para integrar el Comité de Gestión, los dos países que obtuvieren el mayor número de votos ejercerán las funciones de Primer y Segundo Vicepresidente del Consejo, respectivamente.
Para ser válida la presentación de una candidatura al Comité de Gestión, esta deberá ser sometida por escrito a la Secretaria General hasta dos semanas antes de la fecha de la elección.
La elección de los miembros del Comité de Gestión se hará mediante voto secreto y serán elegidos los 6 países que obtengan el mayor número de votos.
Los miembros del Comité de Gestión elegidos continuarán siendo miembros hasta el Congreso Ordinario siguiente, a menos que el país o territorio miembro representado en el Comité de Gestión se retire voluntariamente. En tal caso, el país o territorio miembro que sigue con el mayor número de votos, si éste aún tiene interés, reemplazará al miembro que deja el Comité de Gestión.
El Secretario General participará con voz y sin voto.
El Comité de Gestión se reunirá al menos dos veces al año, procurando que dichas reuniones se celebren en fechas equidistantes.
Habrá quórum con la presencia de 5 (cinco) miembros o miembros representados.
Los miembros del Comité de Gestión pueden estar representados por poder en una reunión. Ningún miembro puede representar por poder a más de un miembro.
Se tomarán decisiones por mayoría simple.
En caso de que lo solicitaren, los países o territorios miembros podrán financiar la concurrencia de un delegado a las reuniones del Comité de Gestión que se realicen fuera del período del Consejo Consultivo y Ejecutivo, con cargo a su alícuota de Cooperación Técnica. El financiamiento consistirá en la provisión de un pasaje aéreo de ida y vuelta, clase económica, el pago del 80% del monto del viático estipulado por el PNUD para la sede del Comité y la provisión de una tarjeta asistencial.
En su reunión constitutiva, el Comité de Gestión puede asignar funciones específicas, dentro de sus atribuciones, a ciertos miembros para asegurar el funcionamiento eficiente del Comité.
Podrán participar en las reuniones del Comité de Gestión, en carácter de observadores sin derecho de voto:
los Presidentes de los Grupos de Trabajo del Consejo Consultivo y Ejecutivo, cuando el Comité de Gestión juzgue necesaria su participación;
los países y territorios miembros de la Unión, no miembros del Comité de Gestión, podrán participar en la reunión de éste, en carácter de observadores, sin derecho de voto, en un tema específico, cuando el Comité de Gestión juzgue necesaria su participación.
La Secretaría General, previa consulta con el Presidente del Consejo y los miembros del Comité de Gestión, procederá a cursar las invitaciones correspondientes, en los términos que se acuerden.
El Congreso o el Consejo constituirán los Grupos de Trabajo para el período siguiente y determinarán el ámbito y las atribuciones de los mismos.
Al servicio de los países o territorios miembros, a la Secretaría General le corresponde:
En cumplimiento de los fines estratégicos de la Unión:
gestionar el acopio de información que interese a la actividad postal de la Unión, proveniente de diversas fuentes sobre la explotación e implementación de nuevos servicios, tecnologías, tendencias y mercados, distribuyéndola periódicamente entre sus miembros. Mantendrá disponible dicha información en la página web de la Unión;
realizar las encuestas o estudios que le encomiende el Congreso o el Consejo;
proporcionar las informaciones que le soliciten los países o territorios miembros, la Oficina Internacional de la UPU, las Uniones Restringidas o los organismos internacionales que se ocupen de temas que interesen o que estén vinculados a la actividad postal;
intervenir y colaborar en los planes de cooperación técnica multilateral y representar a la Unión ante los correspondientes organismos internacionales o países o territorios miembros que puedan facilitar su cooperación para el mejoramiento de los servicios de correos en los países o territorios miembros;
emitir su opinión en cuestiones litigiosas a requerimiento de las partes interesadas;
tener al día el estado del grado de cumplimiento de las Recomendaciones adoptadas por el Congreso y comunicar a los países o territorios miembros;
mantener organizada la Sección Filatélica y la Biblioteca de la Secretaría General;
desarrollar, implementar y supervisar programas de cooperación técnica y de asistencia para el desarrollo de la enseñanza postal a nivel regional incluyendo programas y cursos de capitación presenciales y a distancia, conforme a las directrices trazadas por el Consejo;
autorizar el inicio de los proyectos catalogados como urgentes según las disposiciones del Reglamento de Cooperación Técnica;
coordinar con las partes interesadas los proyectos incluidos en el Plan de Acción;
divulgar los resultados y actualizar los informes de ejecución de los proyectos de Cooperación Técnica presentados por los países o territorios miembros;
brindar asesoría a distancia a los países y territorios miembros sobre temas relacionados con la organización y ejecución de la actividad postal en general y su seguimiento.
En cuanto a la administración y funcionamiento de la Unión:
gestionar los procedimientos de adhesión, admisión y retiro de la Unión por parte de países o territorios interesados;
desempeñar la Secretaría del Consejo, así como de su Comité de Gestión y Grupos de Trabajo, y elaborar los informes en colaboración con los presidentes de esos órganos, remitiendo a sus miembros los documentos a ser evaluados por lo menos 30 días antes de las fechas de realización de sus reuniones;
sin perjuicio de lo dispuesto en el artículo 124, literal a) del presente Reglamento, solicitar al término de la ejecución presupuestaria una auditoría externa sobre la situación económico-financiera de la Unión;
formular, anualmente, el proyecto de Presupuesto del año siguiente, incluyendo el presupuesto del Fondo de Disponibilidad, la cuenta de gastos de la Unión y la Memoria sobre los trabajos realizados, todo ello sujeto a consideración del Comité de Gestión y aprobación por parte del Consejo;
presentar al Consejo un estado de cuentas pormenorizado de los Fondos de Cooperación Técnica y de Ejecución Presupuestaria de la Unión;
administrar las Cuentas de Fondos de Terceros, a solicitud de los países o territorios miembros de la Unión;
emitir opinión sobre la interpretación de las normas de la Constitución y del Reglamento General, así como de las Resoluciones y Recomendaciones que se dictaren, cuando algún país o territorio miembro lo solicite. Dichas interpretaciones serán puestas en conocimiento de los demás países o territorios miembros y estarán sujetas a la aprobación del próximo Consejo;
mantener una edición actualizada de las Resoluciones, Recomendaciones y Decisiones del Congreso y del Consejo aún en vigor e incorporarlas a la página de Internet de la Unión;
administrar y mantener actualizada la página web de la Organización;
establecer un sistema de comunicación con los países o territorios miembros que asegure la difusión de la gestión de la Secretaría General.
En el marco de los Congresos, del Consejo y demás reuniones de la Unión:
intervenir en la organización y realización de los Congresos, del Consejo y demás reuniones determinadas por la Unión;
cursar las consultas pertinentes, a cada uno de los países o territorios miembros, para la fijación de una nueva sede, en los casos previstos en los artículos 103, párrafo 3, y 113, párrafo 2. Luego hará conocer al Consejo el resultado de la gestión y solicitará su pronunciamiento en favor de uno de los países invitantes. Comunicará entonces, a cada gobierno, el nombre del país que el Consejo designó como sede del Congreso;
distribuir oportunamente las proposiciones que los países o territorios miembros le remitan para la consideración de los Congresos, del Consejo y demás reuniones de la Unión;
preparar la agenda para las reuniones del Consejo y el informe sobre sus estudios y proposiciones, que presentará al Congreso;
publicar y distribuir los documentos de los Congresos, del Consejo y demás reuniones de la Unión;
informar a los países o territorios miembros sobre los procesos de ratificación y adhesión a las Actas de la Unión.
En el marco de los Congresos de la Unión Postal Universal:
gestionar, ante la sede del Congreso, las instalaciones necesarias para el desarrollo de las funciones propias de la Secretaría General;
asistir a los países o territorios miembros, en cuestiones relativas al desarrollo del Congreso Postal Universal;
desarrollar acciones para el establecimiento de alianzas con otras Uniones Restringidas, de forma tal de intercambiar apoyos y/o desarrollar estrategias que favorezcan los intereses y objetivos fijados por la mayoría de los países o territorios miembros, en el marco de los Órganos Permanentes y del Congreso Postal Universal.
La Secretaría General de la Unión estará dirigida y administrada por un Secretario General, que será elegido en votación secreta por el Congreso entre los candidatos presentados al efecto. El Secretario General será elegido para un período y podrá ser reelegido para otro período adicional. Se entiende por período el intervalo entre dos Congresos ordinarios consecutivos.
Para ser candidato al puesto de Secretario General, se requiere poseer una vasta experiencia en la organización y ejecución del sector postal de un país o territorio miembro, y poseer la nacionalidad del país o territorio que presente su candidatura.
Para la designación del Secretario General, se cumplirán las siguientes formalidades:
ser presentado por el gobierno de un país o territorio miembro.
hasta tres meses antes de la fecha de comienzo del Congreso, los países y territorios miembros harán la presentación formal de sus candidaturas tanto al Gobierno del país sede de la Unión, como a la Secretaría General, acompañándose los correspondientes curricula vitae. La Secretaría General notificará la o las candidaturas mencionadas a los demás países y territorios miembros, de forma inmediata;
la elección se hará mediante voto secreto y por mayoría simple de miembros presentes y votantes.
En caso de vacante del cargo de Secretario General, la Autoridad de Alta Inspección asumirá interinamente la dirección y administración de la Secretaría General.
Inmediatamente de producirse la vacante, la Secretaría General cursará invitación a los países y territorios miembros de la Unión para presentar candidaturas a la Secretaría General. Por excepción a la norma del párrafo 1, el Consejo procederá a la elección del cargo entre los candidatos propuestos, en la primera reunión que celebre el Órgano con posterioridad a la fecha en que la vacante se haya producido. El mandato del funcionario elegido se extenderá por el período que resta hasta el próximo Congreso, el cual no será computado a los efectos de la reelección prevista en el párrafo 1.
El procedimiento establecido en el párrafo anterior no será de aplicación cuando la vacante se produjera después de la última reunión ordinaria del Consejo previa a la realización del Congreso o se proceda a la convocatoria de un Congreso Extraordinario de acuerdo con el artículo 15 de la Constitución de la UPAEP.
El Secretario General tendrá, además de las atribuciones que de forma expresa le confieren la Constitución y el presente Reglamento General, las siguientes:
nombrar y destituir al personal de la Secretaría General, de acuerdo con el Reglamento que a tal efecto apruebe el Consejo;
concurrir a las reuniones del Congreso, del Consejo, su Comité de Gestión y sus Grupos de Trabajo, pudiendo tomar parte en las deliberaciones, con voz pero sin voto;
asistir, en calidad de observador, a los Congresos de la Unión Postal Universal, así como a las reuniones de los Consejos de la misma, e informar a los países y territorios miembros de los asuntos de importancia para la Unión, tratados en dichas reuniones;
intervenir en la organización de las reuniones de coordinación de los países o territorios miembros de la Unión que asistan al Congreso o a los Consejos de la Unión Postal Universal;
contratar préstamos, suscribir documentos de adeudo y constituir garantías que no superen los dos duodécimos del Presupuesto anual. Los documentos deberán ser suscritos mancomunadamente por el Secretario General y el Jefe de Finanzas y Contabilidad de la Unión;
abrir cuentas bancarias;
efectuar trasposiciones de partidas entre rubros y subrubros dentro del mismo grupo de un mismo programa, de acuerdo con las necesidades del servicio. Asimismo, consultar y obtener el acuerdo del Presidente del Consejo para efectuar las trasposiciones mayores previstas en el artículo 114, numeral 11.14) del Reglamento General, que sean necesarias para solventar gastos importantes en situaciones de emergencia y, posteriormente, someter esas trasposiciones para confirmación al Consejo en pleno, de acuerdo con lo dispuesto en dicho artículo, conjuntamente con cualquier otro gasto que refleje cambios importantes en los programas o grupo de gastos dentro de un mismo programa.
El Secretario General será asistido por los Jefes de Proyectos y el de Administración y Finanzas, y designará entre ellos al funcionario que lo supla en caso de ausencia temporal, la cual no podrá ser superior a dos meses.
Si se verificara tal extremo, se faculta al Consejo a examinar la situación y decidir sobre:
la pertinencia de ampliar el período de ausencia temporal por única vez, por un nuevo plazo de hasta 60 días, o
poner en marcha lo dispuesto en el numeral 4 del presente artículo con el procedimiento que describe el numeral 5, previsto para el caso de vacancia.
El personal actual y futuro, elegido o contratado, residente o no residente, de la Secretaría General de la UPAEP, desde el 1º de abril de 1992 en adelante, no tiene derecho a jubilarse con cargo a la Unión. Sin embargo, tendrá derecho a recibir, al cese de su cargo, el o sus causahabientes, una compensación por retiro integrada por la suma de todos los aportes realizados por el funcionario y por la Unión, más los intereses capitalizados a la tasa real que dichos fondos devenguen en plaza.
Las jubilaciones del personal de la Secretaría General, reconocidas hasta el 31 de marzo de 1992 y las pensiones que por ese concepto se han derivado o se deriven, serán abonadas hasta su extinción, con cargo a un Programa especial del Presupuesto anual de la Unión. En el caso de que los fondos de dicho Programa resultaren insuficientes, las mismas serán pagadas con cargo al Fondo de Ejecución Presupuestario.
Cuando la Secretaría General de la Unión requiera, en casos notoriamente justificados, expertos para colaborar en la realización de trabajos especiales, los países o territorios miembros podrán enviarlos por el tiempo estrictamente necesario.
Para facilitar el funcionamiento de la Secretaría General y de los otros Órganos de la Unión, el gobierno de la República Oriental del Uruguay:
otorgará los privilegios e inmunidades que establece el artículo 10 de la Constitución de la Unión;
adelantará los fondos necesarios para el funcionamiento de la Secretaría General;
adoptará toda otra medida necesaria para el cumplimiento de los cometidos de la Secretaría General.
A la República Oriental del Uruguay, en su carácter de Autoridad de Alta Inspección de la Secretaría General, le compete:
efectuar el control a posteriori de todas las contrataciones, gastos, movimientos de fondos, pagos, asientos contables, etc., de la Secretaría General, informando de su resultado al Consejo;
resolver, como primera instancia, los reclamos del personal de la Secretaría General, contra las decisiones que ésta dictare;
formular al Consejo las observaciones que estime procedentes en el cumplimiento de las funciones de Alta Inspección.
Las proposiciones se deben enviar a la Secretaría General con cuatro meses de anticipación a la apertura del Congreso.
La Secretaría General publicará las proposiciones y las distribuirá entre los países o territorios miembros, por lo menos tres meses antes de la fecha indicada para el comienzo de las sesiones del Congreso.
Las proposiciones presentadas después del plazo indicado en el párrafo 1 se tomarán en consideración si fueren apoyadas por dos países o territorios miembros como mínimo y deberán presentarse al menos tres semanas antes de la apertura del Congreso. Se exceptúan las proposiciones de enmienda a que se refiere el artículo 108 de este Reglamento y de orden redaccional. Estas últimas deberán ostentar en el encabezamiento la letra «R» y pasarán directamente a la Comisión de Redacción.
Para que tengan validez las proposiciones sometidas al Congreso y relativas al Reglamento General, Reglamento de Cooperación Técnica, y Resoluciones y Recomendaciones, deberán ser aprobadas por la mayoría simple de los países o territorios miembros presentes o representados y con derecho de voto. Los dos tercios, por lo menos, de los países o territorios miembros de la Unión deberán estar presentes o representados en el momento de la votación.
Se exceptúan de la regla precedente las proposiciones modificatorias del Reglamento General, relativas al funcionamiento del Congreso (arts. 103 a 113, inclusive), las que requerirán mayoría de los dos tercios de los países y territorios miembros de la Unión, quienes deberán estar presentes o representados y con derecho de voto en el Congreso. Estas proposiciones, de ser aprobadas, entrarán en vigencia de inmediato.
Cada Congreso fijará por Resolución el importe máximo del Presupuesto para cada año durante el período cuatrienal siguiente al mismo, expresado en dólares de los Estados Unidos de América y tomando como base las líneas estratégicas aprobadas por el Congreso. Los Presupuestos aprobados regirán desde el 1º de enero al 31 de diciembre de cada año.
El objetivo del Fondo de Ejecución Presupuestario es hacer frente a gastos que no estén presupuestados, pudiendo así la Secretaría General cumplir con las obligaciones imprevistas.
La Secretaría General deberá comunicar al Comité de Gestión y solicitar autorización al Consejo para los gastos que sean imputados al Fondo de Ejecución Presupuestario, salvo los gastos previamente autorizados. En caso de urgencia y necesidad, el Secretario General con la anuencia del Presidente del Consejo, podrá utilizar dicho fondo, rindiendo cuentas de los gastos al Consejo.
Los países o territorios miembros contribuirán, para cubrir los gastos de la Unión, según la categoría de contribución a la cual pertenezcan. Estas categorías son:
categoría de 8 unidades;
categoría de 7 unidades;
categoría de 6 unidades;
categoría de 5 unidades;
categoría de 4 unidades;
categoría de 3 unidades;
categoría de 2 unidades; y
categoría de 1,25 unidad.
El listado de categorías de contribución a la que pertenece cada país y territorio miembro se validará mediante Resolución del Congreso.
La categoría inicial de contribución no podrá ser inferior a la mínima establecida en el numeral 1 del presente artículo, pudiéndose elegir aportar una categoría superior.
Los países o territorios miembros podrán cambiar de categoría de contribución, con la condición de que este cambio sea notificado a la Secretaría General seis meses antes de la apertura del Congreso. Esta notificación será comunicada a los países y territorios miembros y al Congreso y el cambio de categoría se hará efectivo en la fecha de entrada en vigor de las disposiciones financieras aprobadas por el mismo.
Los países o territorios miembros sólo podrán reducir una categoría de contribución por vez. Los países o territorios miembros que no dieren conocimiento de su deseo de reducir su categoría de contribución seis meses antes de la apertura del Congreso, serán mantenidos en la categoría a que pertenecían hasta entonces. La Secretaría General comunicará a los países y territorios miembros las solicitudes referidas a la mencionada reducción.
Sin embargo, en circunstancias excepcionales, tales como catástrofes naturales, que hicieren necesaria la implementación de programas de ayuda internacional, el Congreso podrá aprobar una reducción temporal de una categoría de contribución cuando un país o territorio miembro así lo solicite y demuestre que no le es posible seguir manteniendo su nivel de contribución según la categoría en la que se encuentra clasificado.
El Consejo estará facultado, entre Congresos, a resolver sobre el descenso de categoría señalado en el punto precedente para países o territorios miembros que no pertenecen a la categoría de países o territorios menos adelantados. La decisión adoptada tendrá validez máxima de dos años o hasta el próximo Congreso, si éste se reúne antes de ese plazo, el que, en su caso, decidirá sobre limitar o ampliar el período de reducción.
El Gobierno del país sede de la Unión fiscalizará los gastos de la Secretaría General y asimismo hará los anticipos necesarios.
La Secretaría General formulará, anualmente, la Rendición de Cuentas del Presupuesto de la Unión, el Estado de Situación Patrimonial y el Estado de Resultados al fin del ejercicio, los que deberán ser verificados por la Autoridad de Alta Inspección y por la auditoría externa. Además, el Congreso, el Consejo y el Comité de Gestión, le podrán solicitar a la Secretaría General rendir cuentas sobre otros aspectos distintos al presupuesto o solicitarle informes preliminares.
Al término del ejercicio presupuestario se efectuará una auditoría externa sobre los estados contables de la Unión, según los principios de contabilidad/auditoría generalmente aceptados.
El informe de auditoría externa será puesto en conocimiento del Comité de Gestión y posteriormente elevado a la consideración del Consejo.
La auditoría externa tendrá la potestad de formular observaciones en relación con la eficacia de los procedimientos financieros, con respecto: al sistema contable; a los controles financieros internos; y, en general, a la administración y gestión.
El presupuesto aprobado por el Consejo será comunicado de inmediato a los países o territorios miembros, a los efectos de que éstos paguen la cuota-parte que les corresponda en dicho Presupuesto. Con antelación al 31 de diciembre del año anterior al que corresponde el Presupuesto, se deberá enviar la factura correspondiente acompañada de un ejemplar del Presupuesto aprobado. El pago deberá ser realizado antes del 30 de junio del año al cual corresponde este Presupuesto.
A los países o territorios miembros que estuvieran en deuda con la Unión por:
impago de dos ejercicios financieros, o
que no respeten las fechas del plan de pagos acordado, si lo hubiere,
y además no adopten alguna de las siguientes medidas:
cancelar la deuda mediante su abono o la cesión irrevocable a favor de la Unión de la totalidad o parte de los créditos que les adeudaran otros países o territorios miembros, o
aceptar un plan de amortización propuesto por la Secretaría General,
se les aplicará el sistema de sanciones automáticas.
De acuerdo con el párrafo anterior, dicho país o territorio miembro perderá automáticamente:
su derecho de voto durante el Congreso, el Consejo y el Comité de Gestión. Sin embargo, podrá participar en las deliberaciones;
la oportunidad de presentar candidaturas a cargos electivos de la Secretaría General;
la posibilidad de utilizar el Fondo de Alícuotas y el Fondo de Disponibilidad;
su derecho a acumular saldo en el Fondo de Alícuotas a partir de la aplicación de las sanciones de este artículo.
El saldo que habría de corresponderle desde que incurre en sanción, se imputará en su totalidad al Fondo de Disponibilidad.
su derecho a reintegro de pasajes y viáticos por asistencia al Consejo o a los Congresos de la UPU.
Los documentos de la Unión serán suministrados a los países y territorios miembros y sus operadores designados en lengua española. Sin embargo, para la correspondencia de servicio emitida por los países y territorios miembros y sus operadores designados cuya lengua no sea la española, podrán emplear la propia. Excepcionalmente, el Consejo podrá autorizar la traducción a las lenguas francesa, inglesa y portuguesa, de publicaciones que revistan interés especial para la ejecución de los servicios.
Para las deliberaciones de los Congresos y del Consejo, serán admitidos, además de la lengua española, el francés, el inglés y el portugués. Queda a criterio de los organizadores de la reunión y de la Secretaría General la elección del sistema de traducción a ser empleado.
Los gastos que demande el servicio de interpretación correrán por cuenta de los países o territorios que soliciten ese servicio, salvo cuando se trate de países o territorios incluidos en la última categoría contributiva.
El presente Reglamento General entrará en vigor el día primero de enero de dos mil catorce y permanecerá vigente hasta la puesta en ejecución de las Actas del próximo Congreso.
EN FE DE LO CUAL, los Representantes Plenipotenciarios de los gobiernos de los países miembros de la Unión firman el presente Reglamento General en la sede de la Unión, en la ciudad de Montevideo, capital de la República Oriental del Uruguay, el día dieciocho de marzo de mil novecientos noventa y ocho.
Preamble
The undersigned plenipotentiary representatives of the governments of member countries or territories of the Postal Union of the Americas, Spain and Portugal, hereinafter referred to as the Union,
shouldering their responsibility for guaranteeing high-quality universal domestic and international postal service;
taking into account the need for member countries or territories to ensure high-quality affordable postal services through service operators designated as universal postal service providers;
recognizing the pressing need for these operators to conduct business in all segments of the postal market as dynamic, efficient enterprises;
aware of the fact that, in order to achieve these objectives, it is imperative to establish and strengthen regulatory, technical and commercial agreements and commitments at the government and corporate levels;
adopt this Constitution, subject to ratification.
The mission of the Union shall be to strengthen by means of international cooperation the regional integration of the postal sector, and to ensure high-quality postal services for all persons, and the reform and modernization of the sector, in a manner that promotes sustainable development.
The Union shall have the following aims:
To promote the provision of a universal postal service and the development of the postal sector in the region, by reforming it in the member countries or territories, transforming and modernizing its organizations and training its human resources;
To coordinate and promote efficient cooperation for postal development in the member countries or territories;
To coordinate and promote the exchange of information and knowledge in the operational, regulatory and governmental spheres;
To improve the quality of service and the interconnection and security of the networks, by promoting and applying information and communications technology that will allow measurement of the performance of postal services as well as greater reliability in the exchange of data among member countries or territories, and thus help satisfy the needs of users and customers;
To guarantee the integration of its actions and strategies within the framework of the World Postal Strategy adopted by the Universal Postal Union (“UPU”), favouring interaction, coordination and communication with that organization, other Restricted Unions, other international organizations and other parties associated with the postal sector.
The Union is independent of all other organizations and maintains relations with the Universal Postal Union and other Restricted Postal Unions under conditions of reciprocity. It may also maintain relations with other international organizations as necessitated by common interests.
It operates within the framework of Universal Postal Union directives, to which effect it maintains the status of a Restricted Union under Article 8 of the Universal Postal Union Constitution.
Union members consist of:
countries or territories with membership status as of the effective date of this Constitution;
countries or territories acquiring membership status under Article 10 below.
The Union's jurisdiction encompasses:
the territorial area of member countries or territories;
other areas which, while not Union members per se, are dependent on member countries or territories from a postal standpoint.
The headquarters of the Union and its permanent bodies are located in Montevideo, capital of the Eastern Republic of Uruguay.
The official language of the Union is Spanish.
All member countries or territories shall grant the Union the legal capacity to properly discharge its functions and attain its purposes in accordance with their domestic legislation.
The Union will enjoy all necessary privileges and immunities for the accomplishment of its mission within the territorial area of each member country or territory.
The Union shall enjoy, in the territory of each of its member countries or territories, the privileges and immunities necessary for the fulfilment of its mission.
Any country or territory may withdraw from the Union by renouncing its membership status.
Extraordinary Congresses may be held at the request of a minimum of three member countries or territories, with the concurrence of two thirds of Union members with voting rights.
The Conference of representatives of member countries or territories will meet as often as necessary on the occasion of Universal Postal Union Congresses to:
examine proposals and matters of special interest to the Union or its member countries or territories;
where applicable, determine the forms of joint action to be taken at the Congress in furtherance of the objectives of the Union per se and its member countries or territories.
The Council shall ensure the continuity of Union work during the intervals between Congresses by applying the General Secretariat’s annual action plan and giving priority to the courses of action it lays down, in accordance with the strategy adopted by the Congress, and shall conduct studies and issue opinions on matters of interest to or connected with postal service. It shall also supervise and monitor General Secretariat activities.
The General Secretariat, under the control of the Council, is the permanent body for the work of the Union in implementing its strategic plan, as well as liaison between its members. It shall serve as the Secretary of the Congress, the Council and its Management Committee, and of the working groups, which it shall assist in discharging its functions.
The Constitution shall be the Union’s fundamental Act, defining its mission and containing its organic rules.
The General Regulations shall contain provisions for implementing the Constitution and for governing Union operations and shall be binding on all member countries or territories.
Resolutions shall express the will of the Congress and shall relate to the strategy or activities of the Union or certain aspects of the provision of postal services in the region.
Any Resolution containing an order shall be binding, and shall establish, as applicable, the period in which it shall be in effect or within which it should be implemented.
The Resolutions shall be appended to the Union Acts.
The Recommendations shall state the opinion of the Congress with respect to initiatives or practical improvements considered advisable for the development of postal services in the member countries or territories, which they shall apply to the extent possible.
The Recommendations shall be appended to the Union Acts.
Each Congress shall set the maximum amount of:
the total budget for each year of the following four-year period;
the expenditures to be disbursed for the organization of the next Congress.
The costs of the Union shall be borne by all the member countries and territories collectively, which shall be classified for this purpose in different contribution categories. To this end, each member country or territory shall choose the contribution category in which it wishes to be included. The contribution categories shall be established by the General Regulations.
Instruments ratifying the Constitution and, where applicable, approving other Union Acts and Resolutions are to be deposited with the PUASP General Secretariat as quickly as possible, which will notify the other member countries or territories as to their deposit.
Proposals amending Union Acts, Resolutions and Recommendations may be submitted:
by the postal administration of any member country or territory;
by the Consultative and Executive Council, as an outcome of studies or activities within its sphere of competence and with respect to matters affecting the organization and operation of the General Secretariat.
The adoption of proposals submitted to the Congress in regard to this Constitution is subject to their approval by a minimum of two thirds of Union member countries or territories entitled to vote.
Amendments adopted by a Congress shall be set forth in an Additional Protocol and enter into force simultaneously with the Acts amended in the course of that Congress, except as otherwise resolved by that same Congress.
Constitutional amendments shall be ratified by member countries or territories as quickly as possible, with corresponding ratification instruments governed by the provisions of Articles 22 and 23 above.
The General Regulations, Resolutions and Recommendations may be amended by the Congress in accordance with the provisions of the General Regulations.
This Additional Protocol shall enter into force on January 1, 2008, and shall remain in force indefinitely.
Disputes arising between postal administrations of member countries or territories over the interpretation or enforcement of Union Acts and Resolutions will be settled by arbitration as prescribed by the General Regulations of the Universal Postal Union.
The Constitution shall enter into force on July 1, 1972 and shall remain in effect indefinitely.
In witness whereof, the plenipotentiary representatives of the governments of member countries and territories have signed this Constitution in Santiago, capital of the Republic of Chile, on this twenty-sixth day of November, nineteen hundred seventy-one.
Preamble
The undersigned plenipotentiary representatives of the governments of the member countries and territories of the Postal Union of the Americas, Spain and Portugal adopt these General Regulations by unanimous consent, pursuant to Article 18, paragraph 2 of the Constitution adopted in Montevideo in 2007, to ensure its enforcement and to govern Union operations.
Governments of interested countries or territories shall send notices of accession or applications for admission to the General Secretariat, which shall notify the other member countries or territories of their receipt.
Applications by an interested country or territory for admission to the Union must be approved by a minimum of two thirds of its member countries or territories.
Member countries or territories failing to respond within four months from the date of notification of an application for admission shall be deemed to have given their approval.
Any member country or territory may withdraw from the Union by denouncing the Constitution in a written notice to the General Secretariat, conveyed by the latter to the governments of the other member countries or territories.
Representatives of the member countries and territories shall meet at Congresses approximately every four years.
Each Congress shall designate the host country or territory for the following Congress, subject to a corresponding offer by the country or territory so designated. In the event of offers from more than one country or territory, the decision shall be made by secret ballot, in accordance with the provisions of Article 111 of these Regulations.
In cases where a Congress cannot be held in the designated host country or territory, the General Secretariat shall take the necessary emergency action to seek out a country or territory willing to host the Congress, submitting the results of its efforts to the Council for a decision.
The General Secretariat shall follow the procedure established in paragraph 3 above if, by the end of a Congress, no country or territory has offered to host the next Congress.
In cases where a Congress must be held despite the absence of a host government, the General Secretariat shall make the necessary arrangements to convene and organize the Congress in the country or territory in which the Union has its headquarters in agreement with the Council and the government of the Eastern Republic of Uruguay, in which case the General Secretariat shall discharge the functions of host government.
The government of the host country or territory shall set the final date and location for the Congress in agreement with the General Secretariat. In principle, the government of the country or territory hosting the Congress shall send invitations to the governments of all member countries or territories one year in advance, either directly or through the General Secretariat.
The chairmanship of the Congress shall be exercised by the host country or territory. The Council shall designate the country or territory to serve as chairman under the circumstances described in paragraph 5 above.
The member country or territory hosting the Congress shall, in consultation with the General Secretariat, suggest the name of an actively employed or retired postal official with a long history of attendance at Union Congresses to serve as its Doyen, with the Council confirming this appointment in due course. The Doyen shall temporarily chair the Congress at the opening of its first plenary session until a permanent Chairman is appointed. The Doyen shall nominate candidates for the chairmanship and vice-chairmanship of both the Congress and its Committees. One Congress vice-chairmanship shall go to the country or territory that chaired the previous Congress.
The Doyen shall bring a motion before the first session of the Congress for the appointment of the officers, consisting of the Congress Chairman, the two Vice-Chairmen and the Secretary General of the Union.
The Congress shall have the following purposes:
To amend and supplement Union Acts, Resolutions and Recommendations as necessary;
To set priorities for Union activities during the ensuing period by adopting the strategy, which will serve as the basis for drawing up the annual action plans; and
To discuss all matters brought before it, pertaining to the purposes of the Union.
The Congress shall express its will through Resolutions and Recommendations, in accordance with Article 19 of the Constitution.
Each member country or territory shall arrange to be represented by one or more delegates or by the delegation of another member country or territory. The delegation of a member country or territory may not represent more than one other country or territory in addition to its own.
The Chairman shall open meetings, lead debates, recognize speakers in the order they ask to speak, put matters which cannot be decided by unanimous consent to a vote, rule on procedural questions arising in the course of the debates and close the Congress.
A delegation is defined as the person or group of persons designated by a member country or territory to represent it at the Congress. If the delegation is composed of several delegates, a head of delegation and, if appropriate, a deputy head shall be designated.
Members of the delegations shall be experts with ample knowledge of Union rules, and with specific responsibilities related to postal operations in member countries or territories.
Countries or territories unable to attend a Congress may arrange to be represented by another delegation. Likewise, countries present at the Congress but unable to attend a particular session may arrange to be represented by another delegation. The Chairman shall be advised of the decisions made in either of these circumstances, bearing in mind that no member country or territory may represent more than one other country or territory.
All delegates must bear credentials signed by the Head of State, Head of Government or Minister of Foreign Affairs of the member countries or territories in question.
Delegate credentials must be drawn up in due and proper form. Delegates whose credentials meet one of the following criteria shall be considered plenipotentiary representatives:
They confer full powers;
They grant the delegate the authority to represent his government without restrictions;
They grant the delegate the necessary powers to sign Union Acts.
All three cases implicitly include the power to take part in debates and to vote.
Delegates whose credentials fail to meet the criteria of subparagraphs (a), (b) and (c) above shall be entitled only to take part in debates and vote.
All credentials shall be deposited with the authority specifically designated for this purpose at the opening of the Congress.
Delegates who have not presented their credentials may take part in debates and votes provided their names have been submitted by their government to the government of the country or territory hosting the Congress. The same applies to delegates whose credentials exhibit some defect or irregularity. These delegates may no longer vote once the Congress has approved the Credentials Committee report attesting to their failure to present credentials or to the inadequacy of their credentials for voting purposes, until such time as their status has been regularized.
The following may take part in Congress debates as observers, and may speak if authorized to do so by the Chairman of the Congress, but without voting rights:
Representatives of non-member countries who have been specially invited by decision of the Council, on the agreed terms;
Representatives of the Universal Postal Union;
Representatives of Restricted Postal Unions extending reciprocal invitations.
Representatives of international organizations or any organization having an interest in or related to the sector, whose participation is considered by the Council, the Management Committee and the General Secretariat to be significant for the performance of the work of the Congress, may also be admitted as observers, on the agreed terms.
Proposals submitted in accordance with Article 125 of these Regulations shall serve as the basis for Congress debates.
In principle, each proposal shall have a single purpose and shall contain only amendments related thereto.
However, amendments may be introduced orally or in writing at any time during the discussion of a particular issue.
In cases of multiple proposals in regard to a single issue, the Chairman shall determine the order of discussion, starting, in principle, with the proposal that departs furthest from the original text or that entails the most radical change.
If a proposal can be subdivided into several parts, each part may be considered and voted on separately with the consent of the orginator or the Congress.
Amendments accepted by the delegation presenting the original proposal shall be immediately incorporated into the text of the proposal. Amendments that are not accepted shall be handled according to the rule established in paragraph 4 above as regards the order of their discussion.
The procedure described in paragraph 6 above shall also apply in cases of several amendments presented in connection with a single proposal.
Any proposal withdrawn at a plenary session may be resubmitted by another delegation. Moreover, in the event of the approval and acceptance of an amendment to a proposal by the country or territory submitting the original proposal, another member country or territory may resubmit the original version of the proposal.
If a proposal has been accepted or rejected by the Congress, it may be re-examined by the same Congress only if the motion for reconsideration is supported by at least three delegations and approved by two thirds of the member countries or territories present and voting.
Any proposal that could entail substantial expenditures by the Union must be accompanied by an estimate of its financial consequences, prepared in consultation with the General Secretariat by the member country or territory that has drafted it, for the purpose of determining the financial resources needed for its implementation.
Speakers must confine themselves to the pending issue, limiting their speeches to a maximum of five minutes, except as otherwise agreed by a simple majority of the members present and voting. The Chairman shall be authorized to interrupt any speakers exceeding their allotted time.
Subject to consultation with the Congress and approval by a simple majority of members present and entitled to vote, the Chairman may:
limit the number of speeches by a single delegation on a particular proposal or group of proposals;
limit the number of speeches by different delegations on a particular proposal or group of proposals to five in favour and five against the pending issue;
declare the list of speakers closed after reading it aloud, subject to the right of the delegation presenting the proposal to respond to speeches by other delegations.
During the discussion of any question and even, where appropriate, after the closure of the debate, a delegation may submit a motion on a point of order, for the purposes of requesting:
clarifications on the conduct of the debates;
observance of the Constitution or the Regulations;
a change in the order of discussion of proposals suggested by the Chairman.
The motion on a point of order shall take precedence over all other questions, including the procedural motions referred to in paragraph 3 below.
The Chairman shall immediately give the desired clarifications or take the decision which he considers advisable on the subject of the motion on a point of order. In the event of an objection, the Chairman’s decision shall be put to the vote forthwith.
In addition, during the discussion of a question, a delegation may introduce a procedural motion with a view to proposing:
the suspension of the meeting;
the closure of the meeting;
the closure of the list of speakers;
the adjournment of the debate on the question under discussion;
the closure of the debate on the question under discussion.
Procedural motions shall take precedence, in the order set out above, over all other proposals except the motions on points of order referred to in paragraph 1 above.
Motions for the suspension or closure of the meeting shall not be discussed, but shall be put to the vote immediately.
When a delegation moves to close the list of speakers or to postpone or close the debate on a question under discussion, only two speakers against the procedural motion in question may speak, after which the motion shall be put to the vote.
A delegation which submits a motion on a point of order or a procedural motion may not, in its submission, deal with the substance of the question under discussion. The proposer of a procedural motion may withdraw it before it has been put to the vote, and any motion of this kind, whether amended or not, that is withdrawn may be reintroduced by another delegation.
Issues on which there is no general agreement will be put to a vote which, to be valid, shall require the presence or representation of two thirds of all member countries or territories entitled to vote.
Subject to the provisions of paragraph 1 above, member countries or territories entitled to vote shall mean those that vote “for” or “against”, and abstentions shall not be taken into account in determining the number of votes needed to form a majority, nor will blank ballots or invalid ballots in the case of voting by secret ballot.
If the number of abstentions and blank or invalid ballots exceeds half of the total votes cast (for, against and abstentions), the discussion of the matter shall be postponed to a subsequent meeting, at which abstentions, blank ballots and invalid ballots shall no longer be counted.
In general, votes shall be cast by the raising of placards displaying the name of the member country or territory. However, roll call votes shall be taken at the request of any delegation or by decision of the Chairman, following the alphabetical order of the countries or territories, after drawing lots to determine the delegation to begin the voting.
Votes shall be taken by secret ballot at the request of any delegation, seconded by another delegation, in which case the Chairman shall take all necessary steps to ensure the secrecy of the vote. Motions for secret ballots made in accordance with this paragraph shall take precedence over motions for roll call votes.
Reports of all meetings shall be drawn up in Spanish in the form of a summary record of the general course of each meeting and the proposals presented, and a summary of the debates conducted and their outcomes.
Delegates may request that any statements that they make be recorded in the report verbatim, provided that the text is submitted to the General Secretariat, in the official language of the Union, within twenty-four hours from the conclusion of the meeting in question.
The General Secretariat shall prepare reports of the meetings based on recordings of the debates of the Congress, and shall distribute them to the delegations of the member countries or territories that participated in the Congress for their approval. The General Secretariat shall take into consideration all comments submitted to it within forty days from the date of the distribution of the reports to these member countries or territories.
Extraordinary Congresses of member countries and territories shall be held to deal with important matters urgently requiring action before the next regular Congress.
Member countries or territories calling an Extraordinary Congress shall, at the same time, indicate which of them is willing to serve as its host, to enable the General Secretariat to seek approval from the other member countries or territories.
The government of the country or territory designated to host an Extraordinary Congress shall send the appropriate invitation to the government of each member country or territory at least six months prior to the date scheduled for the opening of the Extraordinary Congress, either directly or through the General Secretariat.
The Council shall be composed of all member countries or territories of the Union. The host country of the Congress shall serve as Chairman of the Council, which position shall be held by experts in the management of collegiate bodies with a thorough knowledge of Union rules.
The first meeting of each Council shall be called during the course of the Congress by the Chairman to elect a First and Second Vice-Chairman. In the event that the country or territory designated as Chairman should waive its right to this position, it shall be filled by the First Vice-Chairman, in which case the Second Vice-Chairman shall become First Vice-Chairman and a new Second Vice-Chairman shall be elected from among the other Council members.
This same first meeting of the Council shall elect its Management Committee, in accordance with Article 116, paragraph 2.
The Council shall hold annual meetings at Union headquarters, called by its Chairman, through the General Secretariat. In exceptional cases, and without additional cost to the Union, the Council may hold its annual meeting in another city of any member country or territory. The Secretary General shall take part in debates at all Council meetings as a nonvoting member.
The Council shall issue Rules of Procedure governing its operation. The rules set forth in the preceding articles pertaining to the functioning of the Congress shall also be applicable to the Council to the extent they are suitable, and the Chairman of the Congress or, if applicable, the Vice-Chairman, shall be responsible for their correct interpretation and application.
When necessary, the Chairman shall call an extraordinary meeting at the request of any member, with the consent of two thirds of all Council members entitled to vote, to be held within two months.
Council members shall perform their duties without compensation. Operating expenses shall be borne by the Union. With the exception of meetings held during the Congress, member countries or territories in the lowest contribution category unable to use their pro rata funds shall be entitled to reimbursement of the cost of one single round-trip economy-class airfare or of the cost of travel by any other means up to the equivalent of a round-trip economy-class airfare. This provision applies only in the case of single-person delegations.
Observers. Participation by observers at meetings of the Council shall be governed, by analogy, by the provisions of Article 107 of these Regulations.
The General Secretariat, in consultation with the Chairman of the Council and the Management Committee, shall analyze and issue these invitations on the agreed terms.
The Council shall direct Union activities, with the following specific duties:
To maintain contact with member countries or territories, Universal Postal Union bodies, Restricted Postal Unions and any other national or international organization, through the Chairman of the Council;
To submit the draft strategic plan to the Congress, which shall consider it in the light of the previous report from the Management Committee and with the participation and advice of the General Secretariat;
To monitor each year the implementation of the strategic plan, assess its results and approve any readjustment of priorities that may be appropriate;
To take initiatives and implement activities in the interest of, or related to, the postal services of the member countries or territories of the Union;
To examine and adopt the draft action plan drawn up by the General Secretariat, which entails the task of avoiding unnecessary expenditure;
To regulate and oversee General Secretariat activities and approve its internal rules;
To examine and, if appropriate, approve the Annual Report on the work of the Union prepared by the General Secretariat;
To authorize the annual Union budget, subject to the ceilings set by the Congress;
To examine and, if appropriate, approve the financial statements in regard to the previous year’s Budget;
To establish the salary schedules of the General Secretariat staff, at the first Council meeting following an ordinary Congress;
To approve and/or amend, if appropriate, the Personnel Statutes of the General Secretariat of the Union;
To approve and amend the Technical Cooperation Manual, as an instrument for achieving the Union objectives laid down in the strategic plan that has been adopted;
To examine and, if appropriate, approve the General Secretariat’s annual schedule of attendance at international postal meetings, as well as the number of officials scheduled to attend each meeting, with the exception of necessary emergency travel in the interests of the Union. This same procedure shall be followed for other necessary travel on behalf of the Union;
To examine and, if appropriate, approve requests by the Secretary General for transfers between programs and between cost groups within a single program of the budget approved for the current year;
To conduct studies or express opinions on any questions involving or related to postal services or that might affect member countries or territories of the Union;
To promote and supervise the organization and conduct of training activities and the establishment of postal schools in member countries or territories and, at their request, arrange expert and consultant missions through the General Secretariat to assist in their organization, development and operation under technical cooperation programs;
To designate the country or territory to host the next Congress under the circumstances described in Article 103, paragraphs 3 and 4 above, subject to a vote if there is more than one candidate;
To make necessary arrangements to designate the country or territory to chair the Congress in the circumstances described in Article 103, paragraph 7;
To present the Congress with proposed amendments to Union Acts and with draft Resolutions and Recommendations emerging from studies conducted acting on instructions or on its own initiative;
To make decisions on requests for invitations to attend the Congress as observers, in accordance with Article 107 of these Regulations;
To notify member countries and territories of the results of studies undertaken;
To establish rules for documents to be published and distributed by the General Secretariat free of charge or at cost;
To promote international cooperation to facilitate, by any means at its disposal, development cooperation in the countries or territories of the Union;
To conduct appellate reviews of appealable rulings by the Supervisory Authority on complaints lodged by General Secretariat personnel against decisions by the General Secretariat;
To hold elections to fill vacancies from among the proposed nominees for the Secretary General and/or Counsellor, under the circumstances described in Article 119, paragraph 7 below;
To approve any projects to be paid from the Technical Cooperation Funds that are submitted to it by the General Secretariat in accordance with the provisions of the Technical Cooperation Regulations;
In the event that the General Secretariat is in favour, to decide whether a member country or territory may use its pro rata funds more than three times;
Any and all other functions necessary for the due and proper attainment of its purposes.
Proposals and/or matters should be submitted by Council members to the General Secretariat at least six weeks prior to the opening of the session in which they are to be considered. Proposals and/or matters submitted outside of this period may be considered only if the Council so decides by a majority of the members present and voting.
The submission and consideration of proposals and/or matters shall be governed by the provisions of Article 108, paragraphs 2 to 10 of these Regulations.
The adoption of decisions by the Council shall require:
verification of the necessary quorum, which shall be one half plus one of the member countries or territories present and entitled to vote;
consensus, or if that is not possible, a simple majority.
The adoption of decisions by long-distance consultation, subsequent to Council meetings, shall require:
consultation with member countries and territories of the Union entitled to vote;
verification of the quorum necessary to validate responses, which shall be one half plus one of the member countries or territories of the Union entitled to vote;
a simple majority of responses based on this quorum.
The Council shall conduct its work on the basis of the approved strategic plan and mandates set by the Congress. It may prioritize the Union’s objectives where necessary as a result of changes to postal operations.
The Council shall express its will through Decisions, in accordance with Article 20 of the Constitution and other rules adopted by the Council itself on this subject.
The Management Committee shall report to the Council and assist it in monitoring, analyzing and evaluating the Union’s work, with the following specific duties:
To review the monitoring and indicators of the implementation of the strategic plan and the setting of priorities;
To review the General Secretariat’s action plan and its execution;
To review the management indicators proposed by the General Secretariat for evaluating its efficiency, including structure and costs, as well as its quantitative results;
To review the implementation and realisation of Technical Cooperation projects and the evaluation of them submitted by the Secretariat;
To review the monitoring of the implementation of the Budget;
To review the draft Budget, financial statements, balance sheet, income statement and Annual Report to be presented by the Secretariat;
To review any Technical Cooperation projects that should be submitted to it for consideration;
To review any other advisory functions or proposals referred to it by the Council;
To submit to the Council a summary report of its actions and decisions and on the scope of its work program. This report shall be made available to member countries or territories by the Secretariat at least 30 (thirty) days prior to the date of the Council meeting, except in cases where meetings of the Management Committee and the Council are held within less than 30 days of one another. The General Secretariat shall provide member countries or territories of the Union with the agenda of its meetings at least 15 days in advance, and shall provide them with summary Acts adopted at such within 15 days after the meetings are held;
To make any documents considered and drafted by the Committee available to any member countries or territories of the Union that so request.
The Management Committee shall be composed of seven members: the Chairman of the Council, who shall chair the Management Committee, and six member countries or territories of the Union, to be elected by the Council at its first meeting. The two countries that receive the most votes among the six members elected to form the Management Committee shall serve as First and Second Vice-Chairman of the Council, respectively.
The elected members of the Management Committee shall continue to serve as members until the next regular Congress, unless the member country or territory represented on the Management Committee voluntarily resigns. In this event, the next member country or territory with the largest number of votes shall, if it is interested in doing so, replace the member leaving the Management Committee.
The General Secretariat shall have the right to speak, but not the right to vote at meetings.
The Management Committee shall meet at least twice a year, and shall attempt to ensure that such meetings are held at equal intervals.
The presence of 5 (five) members or represented members shall constitute a quorum.
The members of the Management Committee may be represented by proxy at a meeting. No member may represent more than one member by proxy.
Decisions shall be taken by a simple majority.
Expenses incurred by members for their participation in Committee meetings shall under no circumstances be charged to the Union.
At its first meeting, the Management Committee may assign specific duties, from among its own duties, to certain members in order to ensure the efficient operation of the Committee.
The Congress or the Council shall form Working Groups for the ensuing period and shall determine their scope and duties.
In the service of the member countries or territories, the General Secretariat shall have the following general functions:
in fulfilment of the Union’s strategic purposes:
managing the collection of information from various sources pertaining to Union postal services, regarding the operation and implementation of new services, technology, trends and markets, periodically distributing this information to its members, and keeping this information available on the Union's website;
conducting studies or surveys as instructed by the Congress or Council;
providing information requested from it by member countries or territories, the UPU International Bureau, Restricted Unions or international organizations dealing with matters of interest or related to postal services;
participating and collaborating in multilateral technical cooperation plans and representing the Union to the appropriate international organizations or member countries or territories as potential sources of assistance for the improvement of postal services in member countries or territories;
issuing an opinion on disputed issues at the request of the parties concerned;
keeping up-to-date records on the extent of compliance with Recommendations adopted by the Congress and notifying member countries or territories of changes in their status;
keeping the General Secretariat Library and Philatelic Section properly organized;
developing, implementing and supervising technical cooperation and assistance programs for the conduct of regional postal training activities, including on-site and distance training programs and courses, in accordance with the guidelines established by the Congress;
authorizing the launching of projects classified as urgent under the provisions of the Technical Cooperation Regulations;
coordinating with the parties concerned the projects included in the action plan;
disseminating the results and updating the reports on the implementation of the Technical Cooperation projects presented by member countries or territories;
providing long-distance consulting services to member countries and territories on matters related to the organization and execution of postal services in general and their monitoring.
With regard to the administration and operation of the Union:
managing procedures for the accession and admission to and withdrawal from the Union by countries or territories concerned;
serving as Secretariat to the Council, its Management Committee and Working Groups, and preparing reports in collaboration with the chairmen of such bodies, providing members with the documents to be evaluated at least 30 days prior to the dates on which their meetings will be held;
without prejudice to the provisions of Article 124, paragraph (a) of these Regulations, requesting an independent audit of the Union's economic and financial position at the end of the fiscal year;
drafting each year the proposed budget for the following year, including the budget of the Availability Fund, statements of Union expenditures and the Annual Report on work performed, all subject to consideration by the Management Committee and approval by the Council;
submitting to the Council a detailed account statement of the Technical Cooperation Funds and the implementation of the Union’s budget;
administering the Third-Party Fund accounts, upon request by Union member countries or territories;
issuing an opinion on the interpretation of the rules set forth in the Constitution, General Regulations, and subsequent Resolutions and Recommendations, at the request of any member country or territory. Such interpretations shall be brought to the attention of the other member countries or territories and shall be subject to approval at the next Council meeting;
maintaining an up-to-date compilation of the Resolutions, Recommendations and Decisions of the Congress and Council that are still in force and posting them on the Union’s website;
administering the Union’s website and keeping it current;
establishing a system of communication with member countries or territories that will ensure dissemination of information on the General Secretariat’s activities.
Within the framework of Congresses, the Council and other Union meetings:
assisting in the organization and conduct of Congresses, Council meetings and other meetings called by the Union;
sending pertinent inquiries to all member countries or territories to select a new host, in the circumstances described in Article 103, paragraph 3 and Article 113, paragraph 2 above, informing the Council of the results of its efforts and requesting its approval of one of the offers, and subsequently advising all member governments of the name of the country designated by the Council to host the Congress;
duly distributing proposals submitted by member countries or territories for consideration at Congresses, Council meetings and other Union meetings;
preparing the agenda for Council meetings and the report on its studies and proposals for submission to the Congress;
publishing and distributing the documents of Congresses, Council meetings and other Union meetings;
reporting to member countries or territories on the procedures for ratifying and acceding to Union Acts.
With regard to Universal Postal Union Congresses:
making arrangements with the Congress host for the provision of the facilities required for performing the duties of the General Secretariat;
assisting member countries or territories in matters pertaining to the conduct of the Universal Postal Congress;
taking action to establish alliances with other Restricted Unions, so as to exchange support and/or develop strategies that will promote the interests and objectives established by the majority of member countries or territories, within the framework of the permanent bodies and the Universal Postal Congress.
The General Secretariat of the Union shall be directed and managed by a Secretary General, assisted by a Counsellor. Both officials shall be elected by the Congress by secret ballot from among the candidates nominated. The Secretary General and Counsellor shall be elected for a single term and may be reelected for an additional term. For purposes of this paragraph, “term” means the interval between two consecutive Regular Congresses.
Candidates for the post of Secretary General or Counsellor must satisfy the following requirements:
They must have extensive experience in the organization and operation of postal services, acquired in a member country or territory, and must be citizens of the country or territory presenting their candidacy; or
They must hold the position of Secretary General or Counsellor of the Union.
The following formalities shall be observed in electing the Secretary General and Counsellor:
Candidates for these positions must be nominated by the governments of member countries or territories. Both positions may not be held simultaneously by citizens of the same member country or territory.
The member countries and territories shall formally present their candidates, both to the Government of the country in which the Union has its headquarters and to the General Secretariat, at least three months prior to the scheduled date of the Congress, accompanied by their curricula vitae. The General Secretariat will immediately inform the other member countries and territories of this candidacy or these candidacies.
Any Secretary General or Counsellor wishing to run for reelection shall present his or her candidacy to the government of the country in which the Union has its headquarters by this same deadline, accompanied by his or her curriculum vitae.
The election shall be by secret ballot, by a simple majority of members present and entitled to vote.
In the event of a vacancy in the position of Secretary General, this post shall be temporarily filled by the Counsellor, who shall retain his own responsibilities.
In the event of a vacancy in the position of Counsellor, the Secretary General shall assume the duties of this official.
In the event of vacancies in both positions, the Supervisory Authority shall temporarily assume responsibility for the management and direction of the General Secretariat.
In the event of any of the circumstances described in paragraphs 4 through 6 above, the General Secretariat shall promptly invite member countries and territories of the Union to nominate candidates to the General Secretariat. As an exception to the rule in paragraph 1 above, the Council shall hold the election for the position or positions involved from among the candidates nominated, at the first meeting held by the Council after the date on which the vacancy occurs. The term of office of the official elected in this manner shall run for the duration of the interval until the next Congress, which shall not be taken into account for the purposes of reelection under paragraph 1 above.
The procedure established in the preceding paragraph shall not apply to vacancies occurring after the last regular meeting of the Council in the interval between two consecutive Congresses.
The Secretary General shall have the following functions in addition to those expressly assigned by the Constitution and these General Regulations:
appointing and dismissing General Secretariat personnel in accordance with the regulations approved by the Council;
attending meetings of the Congress, the Council, its Management Committee and its Working Groups, with a right to take parts in debates, but without the right to vote;
attending Universal Postal Union Congresses and meetings of its Councils as an observer and informing member countries or territories on issues discussed at these meetings of importance to the Union;
participating in the organization of coordination meetings for the member countries or territories of the Union that attend Universal Postal Union Congress or Council meetings;
negotiating loans, signing debt instruments and furnishing guarantees for up to two twelfths of the annual budget, all of which shall be cosigned by the Secretary General and Counsellor;
opening bank accounts;
transfering items between headings and subheadings within the same group in the same program in accordance with operating requirements; consulting and securing approval from the Chairman of the Council to make major budget transfers under Article 114, paragraph 11.14 of these General Regulations as required to cover major emergency expenditures, and subsequently submitting these transfers for confirmation by a plenary session of the Council as provided in the aforesaid Article, together with any other expenditure entailing major changes in budget programs or in cost groups within the same program.
The Counsellor, who shall assist and replace the Secretary General in his absence and assume his duties, shall have the following basic functions:
overseeing administrative tasks;
formulating Union budget proposals;
preparing annual accounts;
collaborating with the Secretary General in studies and technical cooperation activities.
Effective as of April 1, 1992 and thereafter, present and future PUASP General Secretariat personnel, elected or hired, resident or non-resident, shall not have the right to retire at Union expense. However, upon their separation from service, they or their successors or assigns shall be entitled to severance pay in an amount equal to the sum of all contributions made by the employee and the Union, plus compound interest at the real market rate earned by such funds locally.
The retirement benefits of General Secretariat staff recognized through March 31, 1992 and all corresponding present and future pension benefits payable under this heading shall continue to be paid until such time as they may lapse under a special annual budget program of the Union. In the event of inadequate program funding, these pensions shall be paid from the Working Capital Fund.
Member countries or territories may assign experts to the General Secretariat at its request to assist with special tasks for the strictly necessary period of time under clearly warranted circumstances.
To facilitate the operations of the General Secretariat and other Union bodies, the government of the Eastern Republic of Uruguay shall:
grant the privileges and immunities established in Article 10 of the Union Constitution;
advance the funds necessary for General Secretariat operations;
take any and all other necessary measures to enable the General Secretariat to discharge its responsibilities.
As Supervisory Authority for the General Secretariat, the Eastern Republic of Uruguay shall be responsible for:
conducting post-audits of all General Secretariat contracts, spending, transactions, payments, accounting entries, etc., and reporting the results to the Council;
deciding at first instance on complaints by General Secretariat staff against decisions by the General Secretariat;
making appropriate comments to the Council as necessary to fulfil its task as Supervisory Authority.
Proposals must be sent to the General Secretariat four months prior to the opening of the Congress.
The General Secretariat shall publish and distribute proposals to the member countries or territories at least three months prior to the date scheduled for the opening of the Congress.
Proposals presented after the deadline indicated in paragraph 1 above shall be considered if they are submitted at least three weeks prior to the opening of the Congress and are supported by at least two member countries or territories, with the exception of proposals containing amendments as referred to in Article 108 of these Regulations and of drafting proposals. These latter proposals must display a capital letter “R” as part of their heading, and shall be referred directly to the Drafting Committee.
The adoption of proposals submitted to the Congress in regard to the General Regulations, Technical Cooperation Regulations, Resolutions and Recommendations is subject to their approval by a simple majority of member countries or territories present or represented and entitled to vote. At least two thirds of Union member countries or territories must be present or represented during the voting process.
The preceding rule shall not apply to proposals to amend provisions of the General Regulations pertaining to the operation of the Congress (Articles 103 to 113 inclusive), which shall require a two thirds majority vote by member countries and territories present or represented at the Congress and entitled to vote. These proposals shall enter into force immediately upon their approval.
The purpose of the Working Capital Fund is to cover unbudgeted expenses, so that the General Secretariat can satisfy unforeseen obligations.
The Working Capital Fund may with the approval of the Congress be used to cover budgeted expenses, whose amount should be set by a resolution of the Congress.
The General Secretariat shall notify the Management Committee and request approval by the Council for any expenses charged to the Working Capital Fund, except for previously-approved expenses. In the event of urgency and need, the Secretary General may, with the consent of the Chairman of the Council, draw on this fund, subsequently rendering an accounting of the expenditures to the Council.
Member countries or territories shall contribute to the defrayal of Union expenses according to their respective contribution category. The following contribution categories are hereby established:
eight-unit category;
seven-unit category;
six-unit category;
five-unit category;
four-unit category;
three-unit category;
two-unit category; and
single-unit category.
In addition to the contribution categories listed in paragraph 1, any member country or territory may choose to contribute a number of units greater than the number corresponding to the contribution category to which it belongs, for at least the period equivalent to the interval between two Congresses. At the end of that interval the member country or territory in question shall be reincorporated into its initial contribution category, unless it decides to continue paying a higher number of contribution units.
Member countries or territories shall be classified in the following contribution categories:
eight-unit: Canada and Spain;
seven-unit: United States of America;
six-unit: Brazil and Portugal;
five-unit;
four-unit: Chile and Colombia;
three-unit: Argentina, Mexico and Uruguay;
two-unit: Panama and the Bolivarian Republic of Venezuela;
single-unit: Aruba, Bolivia, Costa Rica, Cuba, Dominican Republic, Ecuador, El Salvador, Guatemala, Haiti, Netherlands Antilles, Nicaragua, Paraguay, Peru, Republic of Honduras and Republic of Suriname.
The contribution categories of new countries joining the Union shall be determined in accordance with the size of their postal administration. The lowest possible initial contribution category shall be the two-unit category.
Member countries or territories may change their contribution category subject to notification of the General Secretariat two months before the opening of the Congress. This notice shall be transmitted to the member countries and territories and to the Congress, with the new contribution category taking effect on the effective date of the financial provisions approved by the Congress.
Member countries or territories may lower their contribution category by only one category at a time. Member countries or territories failing to announce their desire to lower their contribution category two months before the opening of the Congress shall remain in their current category. The General Secretariat will communicate such requests for lower contributions to the member countries and territories.
However, in exceptional circumstances such as natural disasters that require the implementation of international aid programs, the Congress may approve a temporary reduction of a contribution category if a member country or territory so requests and shows that it cannot maintain its level of contribution in the category in which it is classified.
The Council shall be authorized between Congresses to rule on the reduction of category referred to in the preceding point for member countries or territories that do not belong to the category of more advanced countries or territories. The decision thus adopted shall remain in force for a maximum of two years or until the next Congress if it meets before the end of this period, at which time it may decide to limit or extend the period of reduction.
The Government of the country in which the Union has its headquarters shall audit General Secretariat expenses and make necessary advances.
The General Secretariat shall annually prepare a statement of accounts for the Union Budget, a balance sheet and a statement of performance at fiscal year end, which shall be audited by the Supervisory Authority and by external auditors. In addition, the Congress, the Council and the Management Committee may request the General Secretariat to render an accounting with respect to matters other than the budget or ask it to provide preliminary reports.
Upon the conclusion of the fiscal year, an external audit shall be conducted of the Union's financial statements, in accordance with generally accepted accounting/auditing principles.
The report by the external auditors shall be provided to the Management Committee and subsequently referred to the Council for consideration.
Member countries or territories shall be promptly notified of the budget approved by the Council for purposes of the payment of their respective contributions under this budget. The invoice for these contributions shall be sent before December 31 of the year prior to the year of the budget, accompanied by a copy of the approved budget. Payment shall be made before June 30 of the year to which the budget applies.
Any member countries or territories that are in debt to the Union for:
non-payment for two fiscal years, or
failure to meet the dates of an agreed payment plan,
and also fail to take one of the following actions:
pay off the debt by paying it in full or by irrevocably assigning to the Union all or part of its claims against other member countries or territories, or
accept a debt recovery plan proposed by the General Secretariat,
shall be subject to the application of the automatic penalty system.
Under the preceding paragraph, this member country or territory shall automatically lose:
its right to vote in the Congress, the Council or the Management Committee. However, it may participate in the debates;
the ability to nominate candidates for elected positions in the General Secretariat;
the possibility of using the Pro Rata Fund and the Availability Fund;
its right to accumulate any balance in the Pro Rata Fund during the years in question;
its right to the reimbursement of fares and travel expenses for attending the UPU Council or Congresses.
Union documents shall be furnished to the member countries and territories and their designated postal enterprises in Spanish. However, official correspondence from non-Spanish speaking member countries and territories and their designated postal enterprises may be drafted in their native language. From time to time, the Council may authorize French, English and Portuguese translations of publications of special interest for the operation of postal services.
Debates at Congresses and Council meetings may be conducted in French, English and Portuguese, in addition to Spanish, with the choice of translation system left to the meeting organizers and the General Secretariat.
These General Regulations shall enter into force on January 1, 2010, and shall remain in force until the effective date of the Acts of the next Congress.
In witness whereof, the plenipotentiary representatives of the governments of Union member countries have signed these General Regulations in Rio de Janeiro, Brazil, this sixteenth day of August, two thousand five.
