Los Países cuyos Gobiernos adopten la presente Constitución forman, bajo la denominación de Unión Postal de las Américas, España y Portugal, un solo territorio postal para el intercambio recíproco deenvíos comprendidos en las prestaciones públicas obligatorias y en las prestaciones facultativas, en condiciones iguales o más favorables para los clientes que las establecidas por la Unión Postal Universal.

En todo elterritorio de la Unión estará garantizada la libertad de tránsito.

La Unión tiene como objetivos esenciales:

• a)

  coordinar la regulación y orientación de la actividad postal en general entre los Países miembros, para asegurar el derecho de toda persona a disponer de prestaciones postales públicas de calidad;

• b)

  promover el desarrollo de Empresas Postales como Operadores del Servicio Público Nacional y establecer vínculos entre sí, a niveles técnico y comercial, que permitan asumir compromisos en cuanto a la definición de productos y a la elaboración de sistemas colectivos de control;

• c)

  favorecer una acción comercial colectiva y la elaboración de productos homogéneos, con alto contenido de valor agregado, precisando sus características y calidades, mediante estándares de compromiso;

• d)

  emprender acciones concretas para el mejoramiento del transporte postal internacional;

• e)

  procurar el establecimiento de redes informáticas y de aplicaciones nacionales, en particular en los Países en vías de desarrollo;

• f)

  facilitar la práctica de la actividad postal mediante una acción directa ante otras organizaciones de actividades conexas (aduanas, transporte, informática, etc.);

• g)

  y, en general, mejorar, desarrollar y modernizar los servicios postales de los Países miembros, mediante una estrecha coordinación y colaboración entre sus miembros.

Para lograr sus objetivos, la Unión empleará, entre otras, las siguientes estrategias:

• a)

  promover la cooperación técnica con los Operadores del Servicio Público Nacional para lograr, a través de una planificación eficiente de las actividades, la elevación de la capacidad profesional de los trabajadores de Correos y el desarrollo y mejoramiento de la gestión de los servicios postales y de los sistemas de trabajo y ejecutar, por sí misma, dicha cooperación, dentro de los límites financieros de los programas establecidos por el Congreso;

• b)

  desarrollar sistemas destinados a la operación postal, en particular aquéllos con alto contenido informático, para la aplicación colectiva en los Países miembros y, especialmente, en aquéllos en vías de desarrollo;

• c)

  establecer una acción capaz de representar eficazmente, en los Congresos y demás Reuniones de la Unión Postal Universal, así como de otros Organismos Internacionales, sus intereses comunes, y armonizar los esfuerzos de los Países miembros para el logro de esos objetivos;

• d)

  promover y facilitar la cooperación económica para el financiamiento de proyectos integrales de desarrollo de los Operadores de los Servicios Públicos Nacionales de la región y para la relación entre éstos y los organismos de crédito internacionales o con los demás Operadores del Servcio Público Nacional que deseen cooperar.

La Unión es independiente de cualquier otra organización y mantiene relaciones con la Unión Postal Universal y, bajo condiciones de reciprocidad, con las Uniones Postales restringidas. Cuando existan intereses comunes que así lo requieran, podrá sostener relaciones con otros organismos internacionales.

Ejerce sus actividades en el marco de las disposiciones de la Unión Postal Universal, a cuyo efecto mantiene su carácter de Unión restringida de acuerdo con lo establecido en el artículo 8 de la Constitución de la Unión Postal Universal.

La Unión gozará en el territorio de cada uno de los Países miembros de los privilegios e inmunidades necesarios para la realización de sus propósitos.

Los representantes de los Países miembros que participen en las reuniones de los Órganos de la Unión, los funcionarios de la misma y los funcionarios de las Administraciones Postales de los Países miembros, cuando cumplan funciones oficiales de la Organización, gozarán igualmente de los privilegios e inmunidades necesarios para el cumplimiento de sus actividades.

Los Países o territorios que estén ubicados en el Continente Americano o sus islas y que tengan la calidad de miembros de la Unión Postal Universal, siempre que no tengan ningún conflicto de soberanía con algún País miembro, podrán adherir a la Unión.

Todo País soberano de las Américas, que no sea miembro de la Unión Postal Universal, podrá solicitar su admisión en la Unión Postal de las Américas, España y Portugal.

La adhesión o la solicitud de admisión en la Unión deberá incluir una declaración formal de adhesión a la Constitución y a las otras disposiciones obligatorias de la Unión.

La Unión se estructura en los siguientes Organos:

• a)

  el Congreso;

• b)

  la Conferencia;

• c)

  el Consejo Consultivo y Ejecutivo;

• d)

  la Secretaría General.

Los Organos permanentes de la Unión son: el Consejo Consultivo y Ejecutivo y la Secretaría General.

El Congreso es el Organo supremo de la Unión.

El Congreso se compondrá de los representantes de los Países miembros.

El Consejo Consultivo y Ejecutivo asegurará, entre dos Congresos, la continuidad de los trabajos de la Unión conforme a las disposiciones de las Actas de la Unión, y deberá efectuar estudios y emitir opinión sobre cuestiones técnicas, económicas, do explotación y de cooperación técnica que interesen al servicio postal. Asimismo, supervisará y controlará las actividades de la Secretaría General.

Los miembros del Consejo Consultivo y Ejecutivo ejercerán sus funciones en el nombre y en el interés de la Unión.

La Secretaría General de la Unión Postal de las Américas, España y Portugal es el Organo permanente de enlace, información y consulta entre los miembros de la Unión y de cooperación con los mismos. Desempeñará la Secretaría del Congreso, de la Conferencia y del Consejo Consultivo y Ejecutivo, al que asistirá en sus funciones.

La Secretaría General funciona en la sede de la Unión, dirigida por un Secretario General y bajo la Alta Inspección de la Administración Postal de la República Oriental del Uruguay.

La Constitución es el Acta fundamental de la Unión y contiene sus reglas orgánicas.

El Reglamento General contiene las disposiciones que aseguran la aplicación de la Constitución y el funcionamiento de la Unión. Será obligatorio para todos los Países miembros.

Los Protocolos finales, anexados eventualmente a las Actas de la Unión, contienen las reservas a éstas.

Las disposiciones no contempladas en el Reglamento General, que se refieran al funcionamiento de la Unión, de sus Organos o a ciertos aspectos de la explotación postal, adoptarán la forma de Resolución y tendrán carácter obligatorio para todos sus miembros.

Las que afecten al funcionamiento de los servicios adoptarán la forma de recomendación y su aplicación por las Administraciones Postales de los Países miembros se llevará a cabo en la medida en que les sea posible.

El Protocolo final, anexado eventualmente a las Resoluciones del Congreso relativas a la explotación postal, contiene las reservas a éstas.

Cada Congreso fijará el importe máximo que podrán alcanzar:

• a)

  anualmente los gastos de la Unión;

• b)

  los gastos correspondientes a la reunión del Congreso siguiente.

Si las circunstancias lo exigen podrá superarse el importe máximo de los gastos previstos en el párrafo 1, siempre que se observen las disposiciones del Reglamento General relativas a los mismos.

Los gastos de la Unión serán sufragados en común por todos los Países miembros, que a tales efectos se clasificarán en diferentes categorías de contribución. A estos fines, cada País miembro elegirá la categoría de contribución en que desea ser incluido. Las categorías de contribución están determinadas en el Reglamento General.

En caso de adhesión o admisión a la Unión, el Gobierno del País interesado determinará, desde el punto de vista de la repartición de los gastos de la Unión, la categoría de contribución en la cual desea ser incluido.

La firma de las Actas y Resoluciones de la Unión, por tos Representantes Plenipotenciarios de los Países miembros, tendrá lugar al término del Congreso.

La Constitución será ratificada, tan pronto como sea posible, por los Países signatarios.

La aprobación del Reglamento General, de los Protocolos finales y de las Resoluciones se regirá por las reglas constitucionales de cada País signatario.

Sin perjuicio de lo señalado en los párrafos 2 y 3 precedentes, los Países signatarios podrán efectuar dicha ratificación o aprobación en forma provisional, dando aviso de ello por correspondencia a la Secretaría General de la Unión.

Si un País no ratificare la Constitución o no aprobare las otras Actas y Resoluciones, no dejarán de ser válidas, tanto unas como otras, para los que las hubieren ratificado o aprobado.

Las proposiciones modificativas de las Actas de la Unión, así como de las Resoluciones y Recomendaciones, podrán presentarse:

• a)

  por la Administración Postal de un País miembro;

• b)

  por el Consejo Consultivo y Ejecutivo, como consecuencia de los estudios que realice o de las actividades de la esfera de su competencia, así como en lo que afecten a la organización y funcionamiento de la Secretaría General.

Las proposiciones a las que se refiere el párrafo anterior deberán ser sometidas al Congreso.

Para ser adoptadas, las proposiciones sometidas al Congreso relativas a la presente Constitución deberán ser aprobadas por los dos tercios, al menos, de los Países miembros de la Unión.

Las modificaciones adoptadas por un Congreso serán objeto de un Protocolo Adicional y, salvo acuerdo en contrario de este Congreso, entrarán en vigor al mismo tiempo que las Actas revisadas en el curso del mismo Congreso.

Las modificaciones de la Constitución serán ratificadas lo antes posible por los Países miembros y los instrumentos de esta ratificación se tratarán conforme a las disposiciones de los artículos 20 y 21.

La nota de adhesión o la solicitud de admisión deberá dirigirse, por el gobierno del país interesado, a la Secretaría General, que la comunicará a los demás paises miembros de la Unión.

Para ser admitido como miembro se requerirá que la solicitud sea aprobada, como mínimo, por los dos tercios de los países miembros.

Se considerará que los países miembros aprueban la solicitud cuando no hubieren dado respuesta en el plazo de cuatro meses, a partir de la fecha en que se les haya comunicado.

La adhesión o admisión de un país en calidad de miembro será notificada por la Secretaría General a los gobiernos de todos los países miembros de la Unión.

Al país solicitante se la comunicará el resultado y, si fuere admitido, la fecha desde la cual se le considera miembro y demás datos relativos a su aceptación.

Los países miembros que no hayan suscrito las Actas y demás disposiciones obligatorias adoptadas por el Congreso, deberán adherir a ellas en el más breve plazo posible.

Los instrumentos de adhesión relativos a lois casos previstos en el artículo 22 de la Constitución y en el párrafo 1 del presente artículo se dirigirán a la Secretaría General, la cual notificará este depósito a los países miembros.

Todo país miembro tendrá la facultad de retirarse de la Unión mediante denuncia de la Constitución, que deberá comunicarse a la Secretaría General y, por ésta, a los demás gobiernos de los países miembros.

El retiro de la Unión será efectivo a la terminación del plazo de un año a partir del día de recepción por la Secretaría General de la denuncia prevista en el párrafo 1.

Todo país miembro que se retire deberá cumplir con todas las obligaciones que estipulan las Actas de la Unión, hasta el día en que se haga efectivo su retiro.

Los representantes de los países miembros se reunirán en Congreso cada cinco años, aproximadamente.

Cada Congreso designará en el cual deberá reunirse el Congreso siguiente, siempre que mediare invitación, a tal efecto, del país designado. Si fuesen varios los países invitantes, la decisión tendrá lugar mediante votación secreta.

Si no fuere posible la realización de un Congreso en el país elegido, la Secretaría General, con la urgencia del caso, realizará las gestiones necesarias para tratar de encontrar un país que esté dispuesto a ser sede del Congreso. El resultado de estas gestiones será sometido al Consejo Consultivo y Ejecutivo, para su decisión.

Si al clausurar un Congreso no hubiese ningún país invitante para sede del próximo, la Secretaría General aplicará el mismo procedimiento establecido en el párrafo 3.

Cuando un Congreso deba ser reunido sin que haya un gobierno invitante, la Secretaría General, de acuerdo con el Consejo Consultivo y Ejecutivo y con el gobierno de la República Oriental del Uruguay, adoptará las disposiciones necesarias para convocar y organizar el Congreso en el país sede de la Unión. En este caso, la Secretaría General ejercerá las funciones de gobierno invitante.

Previo acuerdo con la Secretaría General, el gobierno del país sede del Congreso fijará la fecha definitiva, así como el lugar donde deba reunirse el Congreso. En principio, un año antes de este fecha el gobierno del país sede del Congreso enviará invitación al gobierno de cada país miembro, ya sea directamente o por conducto de la Secretaría General.

La Presidencia del Congreso se atribuye al país invitante. En el caso previsto en el párrafo 5 precedente, corresponderá al Consejo Consultivo y Ejecutivo designar al país que deba desempeñar la Presidencia.

La administración postal del país sede del Congreso, en consulta con la Secretaría General, sugerirá la designación del Decano del mismo, que deberá ser un funcionario postal en actividad o jubilado de larga trayectoria en los Congresos de la Unión. El Consejo Consultivo y Ejecutivo procederá a adoptar esta designación en el momento adecuado. A la apertura de la primera sesión plenaria, el Decano asumirá la Presidencia del Congreso hasta tanto sea nombrado el Presidente. El Decano propone al Congreso el Presidente y los Vicepresidentes del mismo, así como los de las Comisiones. Una de las Vicepresidencias del Congreso se atribuirá al país que desempeñó la Presidencia del Congreso anterior.

En la primera sesión, el Decano propondrá la constitución de la Mesa, que estará integrada por el Presidente del Congreso, los dos Vicepresidentes y el Secretario General de la Unión.

Las finalidades del Congresso son:

• a)

  revisar y completar, si fuere el caso, las Actas, Resoluciones y Recomendaciones de la Unión;

• b)

  fijar las prioridades de acción de la Unión para el período siguiente, y

• c)

  tratar cuantos asuntos se sometan a su consideración, relacionados con los fines de la Unión.

Cada país miembro se hará representar por uno o varios delegados o por la delegación de otro país. La delegación de un país no podrá representar más que a otro país además del suyo.

Todo país miembro tendrá derecho a formular reserves a las Actas de la Unión Resoluciones, relativas a la explotación postal, que adopte el Congreso en el momento de firmarlas.

El gobierno del país sede del Congreso notificará, a los gobiernos de los países miembros, las Actas y las Resoluciones que el Congreso adopte.

Por delegación se entiende la persona o conjunto de personas designadas como representantes por un país miembro para participar en el Congreso. Estará compuesta por un Jefe de delegación, un Jefe Adjunto, en su caso, de uno o varios delegados y, eventualmente, de uno o varios funcionarios agregados.

Los componentes de las delegaciones han de ser, en lo posible, funcionarios calificados de las administraciones postales de los países miembros.

Cuando un país no pueda participar en un Congreso, podrá hacerse representar por la delegación de otro. Si, participando en el Congreso, no pudiera asistir a una sesión, podrá igualmente hacerse representar por otra. En ambos casos, se comunicará al Presidente la decisión adoptada, teniendo en cuenta que cada país miembro sólo podrá ostentar la representación de otro.

Los delegados deberán estar acreditados por poderes firmados por el Jefe de Estado, por el Jefe de Gobierno o por el Ministro de Relaciones Exteriores del país interesado.

Los poderes deberán estar redactados en debida forma. Se considera a un delegado como representante plenipotenciario si sus poderes responden a uno de los criterios siguientes:

• a)

  si confieren plenos poderes;

• b)

  si autorizan a representar a su gobierno, sin restricciones;

• c)

  si otorgan los poderes necesarios para firmar las Actas.

Cualquiera de los tres casos incluye implícitamente el poder de tomar parte en las deliberaciones y votar.

Los poderes que no se ajusten a los criterios detallados en a), b) y c) de este párrafo, otorgarán solamente el derecho de tomar parte en las deliberaciones y votar.

Los poderes serán depositados tan pronto se inaugure el Congreso, ante la autoridad designada a ese efecto.

Los delegados que no hayan presentado sus poderes podrán tomar parte en las deliberaciones y en las votaciones, siempre que hubieren sido anunciados por sus gobiernos, al gobierno del país sede del Congreso. También podrán hacerlo aquellos delegados en cuyos poderes se haya constatado alguna insuficiencia o irregularidad. Ninguno de estos delegados podrá votar a partir del momento en que el Congreso haya aprobado el informe de la Comisión de Verificación de Poderes, en el cual se constate que no han presentado sus poderes o que éstos son insuficientes para votar y hasta tanto no se regularice tal situación.

Podrán participar en las deliberaciones del Congreso, en carácter de observadores y con derecho a voz:

• a)

  los representantes de administraciones postales de países no miembros de la Unión, que hubieren sido especialmente invitados por decisión del Consejo Consultivo y Ejecutivo;

• b)

  los representantes de la Unión Postal Universal;

• c)

  los representantes de las Uniones Postales restringidas que ofrezcan reciprocidad;

También se admitirán como observadores a los representantes de cualquier organismo calificado, que el Consejo Consultivo y Ejecutivo estime necesario asociar a los trabajos del Congreso.

El Presidente abre la sesión, dirige los debates, concede la palabra de acuerdo al orden en que se solicita, pone a votación los asuntos en los que no haya unanimidad de pareceres, decibe sobre las cuestiones de procedimiento que ocurran durante las deliberaciones y clausura el Congreso.

El Presidente firmará las Actas, las Resoluciones y Recomendaciones que adopte el Congreso, conjuntamente con el Secretario General.

En caso de impedimento, el Presidente será sustituido por el Vicepresidente perteneciente al país que desempeñó la Presidencia del Congreso anterior.

Las proposiciones presentadas dentro del plazo señalado en el artículo 125, párrafo 1, del presente Reglamento, servirán de base para las deliberaciones del Congreso. Fuera de ese plazo las proposiciones deberán venir apoyadas por otras dos administraciones como mínimo y deberán presentarse al menos cuarenta y ocho horas antes de la apertura del Congreso.

En principio, cada proposición deberá tener un solo objetivo y deberá contener sólo las modificaciones justificadas por dicho objetivo.

Sin embargo, podrán admitirse enmiendas en cualquier momento, bien por escrito o verbalmente, durante la discusión del tema de que se trate.

El Congreso determinará, en la sesión plenaria, la Comisión que habrá de examinar cada una de las proposiciones. A tal efecto, la Secretaría General elaborará el oportuno documento de base, en el que se indicarán las proposiciones que, a su juicio, deba estudiar cada Comisión o, en su caso, el propio Congreso.

Si una cuestión es objeto de varias proposiciones, el Presidente decidirá el orden de discusión, comenzando en principio por la que se aleje del texto de base, o que implique un cambio más radical.

Si una Proposición pudiera subdividirse en varias partes, cada una de ellas podrá, con el acuerdo del autor de la proposición o del Congreso, ser examinada y puesta a votación por separado.

Si una enmienda es aceptada por la delegación que presentó la proposición primitiva, será incorporada de inmediato al texto de ésta. Si la enmienda no fuera aceptada, se aplicará, para el orden de discusión, el criterio establecido en el párrafo 5.

El procedimiento descrito en el párrafo 7 también se aplicara cuando se presenten varias enmiendas a una misma proposición.

Cualquier proposición retirada en el Pleno o en Comisión puede ser retomada por otra delegación. Asimismo, toda proposición rechazada o adoptada en Comisión puede ser retomada en el Pleno, Además, si la enmienda a una proposición es aprobada y aceptada por el país de origen de la proposición, otro país miembro podrá retomar la proposición original no modificada.

Los participantes deberán ajustarse al tema en discusión, limitando su intervención a un tiempo no mayor de cinco minutos, salvo acuerdo en contrario, tomado por la mayoría simple de los miembros presentes y votantes. En caso de excederse del tiempo previsto en el uso de la palabra, el Presidente estará autorizado a interrumpir al orador.

Previa consulta al Congreso, con la aprobación de la mayoría simple de los miembros preserntes y votantes, el Presidente podrá:

• a)

  limitar el número de intervenciones de una delegación sobre una proposición o grupo de proposiciones determinado;

• b)

  limitar el número de intervenciones de distintas delegaciones sobre una misma proposición o grupo de proposiciones determinado, a cinco intervenciones a favor y cinco en contra del tema en discusión;

• c)

  declarar cerrada la lista de oradores, después de dar lectura a la misma, respetando el derecho de la delegación que hubiere presentado la proposición de responder a las intervenciones de otras delegaciones.

Durante la discusión de una cuestión o, incluso, dado el caso, después del cierre del debate, una delegación podrá presentar una moción de orden para pedir:

– aclaraciones sobre el desarrollo de los debates;

– el respeto de la Constitución o del Reglamento General;

– la modificación del orden de discusión de las proposiciones sugerido por el Presidente.

La moción de orden tendrá prioridad sobre todas las cuestiones, comprendidas las mociones de procedimiento mencionadas en el párrafo 3.

El Presidente hará inmediatamente las precisiones solicitadas o tomará la decisión que considere conveniente con respecto a la moción de orden. En caso de objeción, la decisión del Presidente se pondrá de inmediato a votación.

Además, durante la discusión de una cuestión, una delegación podrá introducir una moción de procedimiento que tenga por objeto proponer:

• a)

  la suspensión de la sesión;

• b)

  el levantamiento de la sesión;

• c)

  la clausura de la lista de oradores;

• d)

  el aplazamiento del debate sobre la cuestión en discusión;

• e)

  el cierre del debate sobre la cuestión en discusión.

Las mociones de procedimiento tendrán prioridad, en el orden arriba indicado, sobre todas las demás proposiciones, con excepción de las mociones de orden indicadas en el párrafo 1.

Las mociones tendentes a la suspensión o al levantamiento de la sesión no se discutirán, sino que se pondrán inmediatamente a votación.

Cuando una delegación proponga la clausura de la lista de oradores, la postergación o el cierre del debate sobre una cuestión en discusión, sólo se otorgará la palabra a dos oradores opuestos a la moción de procedimiento en cuestión, después de lo cual la moción se pondrá a votación.

La delegación que presente una moción de orden o de procedimiento no podrá tratar, en su intervención, el fondo de la cuestión en discusión. El autor de una moción de procedimiento podrá retirarla antes de que se ponga a votación y toda moción de este tipo, enmendada o no, que fuere retirada, podrá ser retomada por otra delegación.

Las cuestiones que no cuenten con el asentimiento general serán sometidas a votación. La validez del voto está subordinada a la presencia o representación de los dos tercios de los países miembros.

La votación, por regla general, se efectuará levantando la pancarta con el nombre del país. Sin embargo, a petición de una delegación o por decisión del Presidente se votará nominalmente, siguiendo el orden alfabético de países, previo sorteo para determinar la delegación que comenzará a votar.

A petición de una delegación, apoyada por otra, se efectuará votación secreta. En tal caso, la Presidencia adoptará las medidas necesarias para asegurar el secreto del voto. La petición de votación secreta, hecha de conformidad con este párrafo, predominará sobre la de votación nominal.

Cada país miembro tendrá derecho a un solo voto; además podrá votar por representación o por delegación, por otro país miembro.

Las actas de cada sesión se establecerán en lengua Española. Reproducirán sucintamente el desarrollo general de las sesiones, proposiciones formuladas, deliberaciones habidas y resultados obtenidos.

Cada delegado tendrá el derecho de solicitar la inserción integra en el acta de toda declaración que formule, a condición de que entregue el texto a la Secretaría General en el término de veinticuatro horas después de finalizada la sesión de que se trata.

Las actas de las sesiones se distribuirán a los delegados después de su reproducción y éstos dispondrán de un plazo de 24 horas para formular sus observaciones por escrito ante la Secretaría General. Como norma general, las actas deberán quedar aprobadas por el Congreso 48 horas después de su distribución. Las actas de las últimas sesiones plenarias que no se hubieren entregado a los delegados, al menos con 48 horas de antelación a la clausura del Congreso, serán aprobadas por el Presidente del Congreso. En este último caso, la Secretaría General tomará en consideración las observaciones que le lleguen dentro del plazo de 40 días a contar de la fecha de distribución de las actas a las delegaciones o de su envío a los países miembros que corresponda.

Los países miembros se reunirán en Congreso Extraordinario cuando la importancia y urgencia de los asuntos a tratar no permitan esperar la celebración de un Congreso Ordinario.

Los países miembros que lo promuevan señalarán, al mismo tiempo, cuál de ellos está dispuesto a ser la sede del Congreso Extraordinario, a fin de que la Secretaría General pueda recabar la conformidad con los demás países miembros.

El gobierno del país designado como sede del Congreso Extraordinario enviará la oportuna invitación al gobiermo de cada país miembro, al menos 6 meses antes de la fecha que se señale para el comienzo del Congreso Extraordinario, ya sea directamente o por conducto de la Secretaría General.

Son de aplicación, por analogía, los párrafos 11 y 13 del artículo 104.

Todo país tendrá derecho a formular reservas a las Actas de la Unión y a las Resoluciones relativas a la explotación postal que se adopten en un Congreso Extraordinario.

El Presidente del Consejo Consultivo y Ejecutivo convocará, por medio de la Secretaría General, a los representantes de los países miembros, para reunirse en Conferencia en a ciudad designada como sede del Congreso de la UPU. En ella se examinarán las proposiciones y asuntos de mayor interés para la Unión, a fin de determinar los procedimientos de acción conjunta a seguir. La Conferencia se reunirá a lo largo del Congreso Postal Universal cuantas veces se estime necesario. Cuando existan asuntos importantes a tratar, el Consejo Consultivo y Ejecutivo podrá convocar la reunión de la Conferencia para una fecha anterior al inicio del Congreso de la UPU, previo consentimiento de la mayoría de los países miembros.

El Presidente de la Conferencia, que será el del Consejo Consultivo y Ejecutivo, informará al Congreso de los resultados de los trabajos realizados con ocasión del correspondiente Congreso de la UPU y formulará propuestas tendentes a fijar la actuación que se juzgue más conveniente para el próximo Congreso.

La Conferencia designará al país que deba sustituir al Presidente de la misma, en caso de que éste no concurra a la reunión o se encuentre imposibilitado de asistir a alguna sesión.

Todo cuanto se señala en el presente Reglamento para el desarrollo de las sesiones del Congreso será de aplicación para la Conferencia.

El Consejo Consultivo y Ejecutivo estará compuesto por todos los países miembros de la Unión.

El país sede del Congreso ejercerá la Presidencia del Organo.

La primera reunión constitutiva de cada Consejo será convocada durante el Congreso por el Presidente de éste. En ella se elegirán un primer y un segundo Vicepresidentes. Si el país a quien corresponde la Presidencia renunciase a ella, pasará a desempeñarla el primer Vicepresidente. En tal caso, el segundo Vicepresidente pasará a primero y se elegirá un nuevo segundo Vicepresidente entre los miembros restantes.

En su reunión constitutiva el Consejo elegirá a dos países miembros titulares y a dos países suplentes, a los efectos de completar la conformación del Comité de Gestión.

La ausencia consecutiva de un país miembro a tres reuniones del Comité dará lugar a su sustituión por el primer país suplente. Si otro miembro no concurriera a tres reuniones consecutivas, éste será sustituido por el segundo país suplente. Esta disposición será aplicable únicamente a los países miembros elegidos por el CCE para completar el Comité de Gestión.

Cada administratión postal designará la representación de su país al Consejo Consultivo y Ejecutivo. Esta deberá estar encabezada por la máxima autoridad postal o su representante, quien podrá ser asistido por funcionarios calificados de su administración postal.

Convocado por su Presidente, por conducto de la Secretaría General, el Consejo celebrará una sesión anual en la sede de la Unión. En principio, el Consejo no deberá reunirse en el año de realización del Congreso de la Unión. En todas sus sesiones el Secretario General tomará parte en los debates sin derecho a voto. El Consejo dictará el Reglamento Interno que norme su funcionamiento.

En caso de necesidad, el Presidente, a propuesta de cualquier miembro y con el asentimiento de las dos terceras partes de los miembros del Consejo, convocará una reunión extraordinaria, en el plazo máximo de dos meses.

Las funciones de miembros del Consejo serán gratuitas. Los gastos de funcionamiento estarán a cargo de la Unión. Con excepción de las reuniones que se realicen durante el Congreso, los países miembros de la última categoría contributiva que no tengan posibilidad de utilizar sus fondos de Cooperación Técnica tendrán derecho al reembolso ya sea del precio de un único pasaje aéreo de ida y vuelta, clase económica, o del costo del viajer por cualquier otro medio, con la condición de que este importe no exceda el precio del pasaje por vía aérea, ida y vuelta, en clase económica. Esta disposición se aplica a condición de que la delegación sea unipersonal.

Serán invitados a participar como observadores:

• a)

  los representantes de la Unión Postal Universal;

• b)

  cualquier organismo calificado, siempre que el asunto a ser considerado esté relacionado con él;

• c)

  las administraciones de países que tengan interés en los asuntos a ser tratados y que se desee asociar a los trabajos del Consejo Consultivo y Ejecutivo.

La Secretaría General enviará invitaciones a los observadores mencionados en el párrafo anterior.

El Consejo Consultivo y Ejecutivo coordinará y supervisará las actividades de la Unión con las siguientes atribuciones en particular:

• a)

  mantener contacto con las administraciones postales de los países miembros, con los Organos de la Unión Postal Universal, con las Uniones postales restringidas y con cualquier otro organismo nacional o internacional;

• b)

  tomar iniciativas y realizar actividades destinadas a la defensa de los intereses comunes de las administraciones postales de los países miembros de la Unión, en lo que se refiere a los ervicios postales;

• c)

  actuar como contralos de las actividades de la Secretaría General;

• d)

  examinar y, en su caso, aprobar la Memoria anual formulada por la Secretaría General sobre las actividades de la Unión;

• e)

  autorizar el Presupuesto anual de la Unión dentro de los limites fijados por el Congreso. Estos límites solamente podrán ser sobrepasados a iniciativa del Consejo y con la aprobación de la mayoría de los países miembros;

• f)

  examinar y, en su caso, aprobar la rendición de cuentas del Presupuesto del año precedente;

• g)

  el Consejo Consultivo y Ejecutivo considerará, en su primera reunión posterior al Congreso Ordinario, el régimen salarial del personal de la Secretaría General;

• h)

  examinar y, en su caso, aprobar el plan anual de participación de la Secretaría General en las reuniones postales internacionales, así como el número de funcionarios que deberán asistir a cada una de ellas, con excepción de aquellos viajes de emergencia que resulten de interés para la Unión. Bajo el mismo procedimiento aprobará los demás viajes que deban efectuarse en representación de la Unión;

• i)

  examinar y autorizar, si procede, las solicitudes de trasposición entre programas y entre grupos de gastos de un mismo programa del Presupuesto autorizado para el año en curso, hechas por el Secretario General;

• j)

  realizar, por mandato o de por si, estudios con relación a los problemas administrativos, legislativos, jurídicos, técnicos, de explotación y económicos que presenten interés o que puedan afectar a las administraciones postales de los países miembros o a la Unión;

• k)

  favorecer la implantación de las escuelas postales en los países miembros y a solicitud de las administraciones gestionar, por intermedio de la Secretaría General, acciones de expertos y consultores para su organización, desarrollo y funcionamiento, de acuerdo a programas de cooperación técnica;

• l)

  designar al país sede del próximo Congreso en los casos previstos en el artículo 104, párrafos 3 y 4, previa votación si hubiere más de un candidato;

• ll)

  adoptar las disposiciones necesarias para designar al país que deba asumir la Presidencia del Congreso en el caso previsto en el artícolo 104, párrafo 7;

• m)

  presentar al Congreso proposiciones de modificación de las Actas y proyectos de Resoluciones y Recomendaciones que surjan de estudios realizados por mandato o de por si;

• n)

  decidir acerca de las administraciones de países no miembros y organismos calificados que deben ser invitados como observadores al Congreso, conforme a las disposiciones del artículo 107 de este Reglamento;

• ñ)

  informar, a las administraciones postales de los países miembros, sobre el resultado de estudios iniciados de por sí, cuando no corresponda la intervención del Congreso al que, sin embargo, dará conocimiento de ello por aplicación del párrafo 10;

• o)

  establecer normas acerca de los documentos que debe publicar y distribuir, gratuitamente o a precio de costo, la Secretaría General;

• p)

  redactar, con destino al Congreso, el proyecto de programa de trabajo del próximo Consejo, sobre la base de las sugerencias formuladas por la administraciones postales de la Unión;

• q)

  la organización y desarrollo de los cursos que eventualmente disponga la Unión serán supervisados por el Consejo Consultivo y Ejecutivo por intermedio de la Secretaría General;

• r)

  promover la cooperación internacional para facilitar, por todos los medios de que disponga, la cooperación técnica y económica a las administraciones postales de los países en desarrollo;

• s)

  actuar en instancia superior en las reclamaciones del personal de la Secretaría General contra las decisiones adoptadas por ésta y resueltas en primera instancia por la Autoridad de Alta Inspección;

• t)

  proceder a la elección del cargo o cargos que corresponda entre los candidatos propuestos, en el caso previsto en el párrafo 7 del artículo 119;

• u)

  las demás atribuciones necesarias para el debido cumplimiento del objeto del Consejo.

El Consejo Consultivo y Ejecutivo presentará, por lo menos con cuatro meses de anticipación al próximo Congreso, un informe sobre el conjunto de las actividades realizadas en el período entre uno y otro Congreso.

El Consejo Consultivo y Ejecutivo desarrollará sus trabajos con base en las políticas institucionales y los objetivos globales que le fije el Congreso. Podrá priorizar estos objetivos, introducirles modificaciones e incorporar otros que resulten necesarios como consecuencia de las situaciones cambiantes que se vayan produciendo en la actividad postal.

El Consejo Consultivo y Ejecutivo determinará los instrumentos y los medios con los cuales desarrollará sus propias actividades.

El Consejo Consultivo y Ejecutivo designará un Comité de Gestión, cuya finalidad será:

• – evaluar los planes estratégicos y las prioridades establecidas,

• – analizar el alcance de la nueva estructura y el logro de los objetivos de eficiencia y eficacia,

• – realizar el seguimiento de la ejecución del Presupuesto,

• – presentar al Consejo un informe resumen consolidado del alcance de su agenda.

El Comité estará integrado por cinco miembros: el Presidente del Consejo Consultivo y Ejecutivo, los dos Vicepresidentes y dos países miembros de la Unión, que serán elegidos por el Consejo en su reunión constitutiva. El Secretario General participará con voz y sin voto.

El costo de participación de los miembros del Comité no se cargará, bajo ningún concepto, a la UPAEP.

En el marco de sus funciones generales, a la Secretaría General de la Unión le corresponde:

• a)

  reunir y distribuir los documentos e informaciones que interesen al servicio postal de la Unión;

• b)

  asegurar las funciones de intermediario en los procedimientos de adhesión, admisión y retiro de la Unión;

• c)

  realizar las encuestas o estudios que le encomiende el Congreso o el Consejo Consultivo y Ejecutivo;

• d)

  proporcionar las informaciones que le soliciten las administraciones postales, la Oficina Internacional de la UPU, las Uniones restringidas o los organismos internacionales que se ocupen de temas que interesan a los servicios de correos;

• e)

  intervenir y colaborar en los planes de cooperación técnica multilateral y representar a la Unión ante los correspondientes organismos internacionales o administraciones postales, que puedan facilitar su cooperación para el mejoramiento de los servicios de correos en los países miembros;

• f)

  emitir opinión sobre la interpretación de las normas de la Constitución y del Reglamento General, así como de las Resoluciones y Recomendaciones que se dictaren, cuando alguna administración lo solicite;

• g)

  emitir su opinión en cuestiones litigiosas a requerimiento de las partes interesadas;

• h)

  tener al día el estado del grado de cumplimiento de las Recomendaciones adoptadas por el Congreso y comunicar a los países miembros las modificaciones del mismo;

• i)

  mantener organizada la Sección Filatélica y la Biblioteca de la Secretaría General;

• j)

  formular anualmente la cuenta de gastos de la Unión;

• k)

  redactar y distribuir oportunamente una Memoria anual sobre los trabajos que realice, la que deberá ser aprobada por el Consejo Consultivo y Ejecutivo;

• l)

  determinar el monto de las cuotas contributivas que debe satisfacer anualmente cada país;

• ll)

  llevar a la práctica los programas de cooperación técnica y de asistencia para el desarrollo de la enseñanza postal a nivel regional de la Unión y realizar las tareas de supervisión y control de los cursos postales de la Unión, de acuerdo con las directrices trazadas por el Congreso y el Consejo Consultivo y Ejecutivo.

• m)

  Conducir los proyectos que le asigne el Consejo Consultivo y Ejecutivo.

En el marco de los Congresos, de la Conferencia y demás Reuniones de la Unión, a la Secretaría General le corresponde:

• a)

  intervenir en la organización y realización de los Congresos, de la Conferencia y demás reuniones determinadas por la Unión;

• b)

  cursar las consultas pertinentes, a cada uno de los países miembros, para la fijación de una nueva sede, en los casos previstos en los artículos 104, párrafo 3, y 114, párrafo 2. Luego hará conocer al Consejo Consultivo y Ejecutivo el resultado de la gestión y solicitará su pronunciamiento en favor de uno de los países invitantes. Comunicará entonces, a cada gobierno, el nombre del país que el Consejo Consultivo y Ejecutivo designó como sede del Congreso;

• c)

  distribuir oportunamente las proposiciones que las administraciones postales le remitan para la consideración de los Congresos, de la Conferencia y demás reuniones de la Unión;

• d)

  desempeñar la Secretaría de la Conferencia;

• e)

  elaborar un resumen de las decisiones adoptadas en las reuniones de la Conferencia;

• f)

  preparar la agenda para las reuniones del Consejo Consultivo y Ejecutivo y el informe sobre sus estudios y proposiciones, que presentará al Congreso;

• g)

  publicar los documentos de los Congresos, de la Conferencia y demás reuniones de la Unión.

En el marco de los Congresos de la Unión Postal Universal:

• a)

  gestionar, ante el país sede del Congreso, las salas de reunión y de oficinas que se precisen, respectivamente para la Conferencia y servicios administrativos;

• b)

  difundir, entre los países miembros, la convocatoria para la reunón de la Conferencia, de acuerdo con el Presidente del Consejo Consultivo y Ejecutivo;

• c)

  prestar su colaboración a las administraciones postales de los países miembros, en cuestiones relativas al desarrollo del Congreso Postal Universal.

La Secretaría General de la Unión estará dirigida y administrada por un Secretario General, asistido por un Consejero. Ambos serán elegidos en votación secreta por el Congreso entre los candidatos presentados al efecto. El Secretario General y el Consejero serán elegidos para un período y podrán ser reelegidos para otro período adicional. Se entiende por período el intervalo entre dos Congresos ordinarios consecutivos.

Para ser candidato al puest de Secretario General o de Consejero, se requiere:

• a)

  poseer una vasta experiencia en la organización y ejecución de los servicios postales, adquirida en la administración postal de un país miembro, y poseer la nacionalidad del país que presente su candidatura, o

• b)

  ocupar el cargo de Secretario General o de Consejero de la Unión.

Para la designación del Secretario General y del Consejero, se cumplirán las siguientes formalidades:

• a)

  ser presentados por los gobiernos de los países miembros, excepto si se trata de los funcionarios que ocupan esos cargos, los cuales podrán presentar su candidatura directamente. Ambos cargos no podrán ser ocupados por nacionales de un mismo país miembro;

• b)

  tres meses antes de la fecha de comienzo del Congreso, los gobiernos de los países miembros harán la presentación formal de sus candidaturas al gobierno del país sede de la Unión, acompañando los correspondientes curricula vitae;

• c)

  cuando el Secretario General o el Consejero desearen presentar sus candidaturas, las enviarán acompañadas igualmente de sus curricula vitae y en el mismo término al gobierno del país sede de la Unión;

• d)

  un mes antes, a más tardar, de la fecha de comienzo del Congreso, el país sede de la Unión hará saber, a los gobiernos de los restantes países miembros, la nómina de los candidatos presentados y el curriculum vitae de los mismos. Igual información hará llegar a la Secretaría General;

• e)

  la elección se hará mediante voto secreto y por mayoría simple de miembros presentes y votantes.

En caso de quedar vacante, la plaza de Secretario General será ocupada interinamente por el Consejero, con retención de sus responsabilidades.

En caso de quedar vacante la plaza de Consejero, el Secretario General se hará cargo de las tareas atribuidas a dicho funcionario.

En caso de vacante de ambos cargos, la Autoridad de Alta Inspección asumirá interinamente la dirección y administración de la Secretaría General.

Inmediatamente de producirse cualquiera de las eventualidades previstas en los párrafos 4 a 6, la Secretaría General cursará invitación a los países miembros de la Unión para presentar candidaturas al puesto o puestos que deberán cubrirse. Por excepción a la norma del párrafo 1, el Consejo Consultiv y Ejecutivo procederá a la elección del cargo o cargos que correspondan entre los candidatos propuestos, en la primera reunión que celebre el Organo con posterioridad a la fecha en que la o las vacantes se hayan producido. El mandata de los funcionarios elegidos se extenderá por el período que resta hasta el próximo Congreso; dicho período no será computado, dado el caso, a los efectos de la reelección prevista en el párrafo 1.

El procedimiento establecido en el párrafo anterior no será de aplicación cuando las vacantes se produjeren después de la última reunión ordinaria del Consejo Consultivo y Ejecutivo, en el período comprendido entre dos Congresos.

El Secretario General tendrá, además de las atribuciones que de forma expresa le confieren la Constitución y el presente Reglamento General, las siguientes:

• a)

  nombrar y destituir al personal de la Secretaría General, de acuerdo con el Reglamento que a tal efecto apruebe el Consejo Consultivo y Ejecutivo;

• b)

  concurrir a las reuniones del Congreso, del Consejo Consultivo y Ejecutivo, de la Conferencia y del Comité de Gestión del CCE, pudiendo tomar parte en las deliberaciones, con voz pero sin voto;

• c)

  asistir, en calidad de observador, a los Congresos de la Unión Postal Universal, así como a las reuniones del Consejo Ejecutivo y del Consejo Consultivo de Estudios Postales de la misma. En esta calidad informará a los países miembros de los asuntos de importancia para la Unión, tratados en las reuniones del Consejo Ejecutivo;

• d)

  organizar la Conferencia, así como las reuniones de los representantes de los países miembros de la Unión que asistan a las sesiones del Consejo Ejecutivo de la Unión Postal Universal;

• e)

  contratar préstamos, suscribir documentos de adeudo y constituir garantías que no superen los dos duodécimos del Presupuesto anual. Los documentos deberán ser suscritos mancomunadamente por el Secretario General y el Consejero;

• f)

  abrir cuentas bancarias;

• g)

  efectuar trasposiciones de partidas entre rubros y subrubros dentro del mismo grupo de un mismo programa, de acuerdo con las necesidades del servicio Asimismo, consultar y obtener el acuerdo del Presidente del Consejo Consultivo y Ejecutivo para efectuar las trasposiciones mayores previstas en el artículo 116, párrafo 10, inciso i) del Reglamento General, qua sean necesarias para solventar gastos importantes en situaciones de emergencia y, posteriormente, someter esas trasposiciones para confirmación al Consejo Consultivo y Ejecutivo en pleno, de acuerdo con lo dispuesto en dicho artículo, conjuntamente con cualquier otro gasto que refleje cambios importantes en los programas o grupo de gastos dentro de un mismo programa.

El Consejero asistirá al Secretario General y, en su ausencia, lo reemplazará en sus funciones, con sus mismas atribuciones y se ocupará fundamentalmente de:

• a)

  dirigir las tareas administrativas;

• b)

  confeccionar los proyectos de presupuestos de la Unión;

• c)

  establecer las cuentas anuales;

• d)

  colaborar con el Secretario General en las actividades de estudios y cooperación técnica.

Cumplir aquellas funciones que se señalan en el Reglamento de la Secretaría General.

El personal que presta sus servicios en la Secretaría General será de dos clases:

• a)

  de servicios profesionales;

• b)

  de servicios generales.

El Congreso, a propuesta del Secretario General, fijará, por Resolución, la plantilla de personal tanto de la categoría profesional como la de servicios generales.

El personal actual y futuro, elegido o contratado, residente o no residente, de la Secretaría General de la UPAEP, desde el 1° de abril de 1992 en adelante, no tiene derecho a jubilarse con cargo a la Unión. Sin embargo, tendrá derecho a recibir, al cesar en su cargo, ellos o sus causahabientes, una compensación por retiro integrada por la suma de todos los aportes realizados por el funcionario y por la Unión, más los intereses capitalizados a la tas real que dichos fondos devenguen en plaza.

Las jubilaciones del personal de la Secretaría General, reconocidas hasta el 31 de marzo de 1992 y las pensiones que por ese concepto se han derivado o se deriven, serán abonadas hasta su extinción, con cargo a un Programa especial del Presupuesto anual de la UPAEP. En el caso de que los fondos de dicho Programa resultaren insuficientes, las mismas serán pagadas con cargo al Fondo de Ejecución Presupuestario.

Las proposiciones se deben enviar a la Secretaría General con cuatro meses de anticipación a la apertura del Congreso.

La Secretaría General publicará las proposiciones y las distribuirá entre las administraciones postales de los países miembros, por lo menos tres meses antes de la fecha indicada para el comienzo de las sesiones.

Las proposiciones presentadas después del plazo indicado en el párrafo 1 se tomarán en considerción si fueren apoyadas por dos administraciones como mínimo. Se exceptúan las de orden redaccional, que deberán ostentar en el encabezamiento la letra «R», y que pasarán directamente a la Comisión de Redacción.

Para que tengan validez las proposiciones sometidas al Congreso y relativas al presente Reglamento General, a las Resoluciones y Recomendaciones, deberán ser aprobadas por la mayoría de los países miembros presentes y votantes. Los dos tercios, por lo menos, de los países miembros de la Unión deberán estar presentes o representados en el momento de la votación.

Se exceptúan de la regla precedente las proposiciones modificatorias del Reglamento General, relativas al funcionamiento del Congreso (arts. 104 a 114, inclusive) las que requerirán mayoría de los dos tercios de los países miembros de la Unión, representados en el Congreso. Estas proposiciones, de ser aprobadas, entrarán en vigencia de inmediato.

Cada Congreso fijará por Resolución el importe máximo del Presupuesto para cada año durante el período quinquenal siguiente al mismo, expresado en dólares de los Estados Unidos de América y tomando como base la presentación por programas y actividades hechas por la Secretaría General. Los Presupuestos aprobados regirán desde el 1° de enero al 31 de diciembre de cada año.

La Secretaría General someterá al Comité de Gestión y al Consejo Consultivo y Ejecutivo, el Presupuesto detallado del año siguiente, así como la cuenta de gastos habidos durante el año precedente juntamente con los justificativos para su examen, y dado el caso, su aprobación.

Al final de cada ejercicio económico, el total anual de los gastos, que deben sufragarse por el conjunto de los países miembros de la Unión, será incrementado en el porcentaje que acuerde cada Congreso. Su importe se destinará al Fondo de Ejecución Presupuestario.

Este fondo se aplicará, por la Secretaría General, para el cumplimiento de las obligaciones presupuestarias.

Si al finalizar un ejercicio económico, el Fondo de Ejecución Presupuestario fuese igual o superior al total de los gastos previstos para el ejercicio siguiente, ese año no será de aplicación el incremento previsto en el párrafo primero.

Los países miembros contribuirán, para cubrir los gastos de la Unión, según la categoría de contribución a la cual pertenezcan. Estas categorías son:

• – categoría de 12 unidades;

  – categoría de 11 unidades;

  – categoría de 10 unidades;

  – categoría de 9 unidades;

  – categoría de 8 unidades;

  – categoría de 7 unidades;

  – categoría de 6 unidades;

  – categoría de 5 unidades;

  – categoría de 4 unidades;

  – categoría de 3 unidades;

  – categoría de 2 unidades; y

  – categoría de 1 unidad.

Los países miembros pertenecerán a las siguientes categorías:

• a)

  de 12 unidades;

• b)

  de 11 unidades;

• c)

  de 10 unidades;

• d)

  de 9 unidades;

• e)

  de 8 unidades: Canadá - España - Estados Unidos de América y Portugal;

• f)

  de 7 unidades: República Federativa del Brasil y Uruguay;

• g)

  de 6 unidades: Argentina

• h)

  de 5 unidades;

• i)

  de 4 unidades: Colombia - Chile y Estados Unidos Mexicanos;

• j)

  de 3 unidades;

• k)

  de 2 unidades: Antillas Neerlandesas y Aruba - Panamá - Paraguay - Perú y República de Venezuela;

• l)

  de 1 unidad: Bolivia - Costa Rica - Cuba - Ecuador - El Salvador - Guatemala - Haití - Nicaragua - República Dominicana - República de Honduras y República de Suriname.

La categoría de contribución de un nuevo país que ingrese a la Unión deberá guardar relación con la importancia de su correo. La categoría de contribución inicial no podrá ser inferior a la de 2 unidades.

Los países miembros podrán cambiar de categoría de contribución, con la condición de que este cambio sea notificado a la Secretaría General antes de la apertura del Congreso. Esta notificación será comunicada al Congreso y el cambio de categoría se hará efectivo en la fecha de entrada en vigor de las disposiciones financieras aprobadas por el Congreso.

Los países miembros sólo podrán reducir una categoría de contribución por vez. Los países miembros que no dieren conocimiento de su deseo de reducir su categoría de contribución antes de la apertura del Congreso, serán mantenidos en la categoría a que pertenecían hasta entonces.

Los cambios hacia categorías superiores no tienen ninguna restricción.

El Presupuesto aprobado por el Consejo Consultivo y Ejecutivo será comunicado de inmediato a los países miembros, a los efectos de que éstos paguen la cuota-parte que les corresponda en dicho Presupuesto. Este pago debe ser hecho antes del 30 de junio del año al cual corresponde este Presupuesto. Si, en definitiva, no se gastase el monto total autorizado, los excedentes le serán acreditados al país respectivo y se imputarán a cuenta del Presupuesto siguiente.

Después de la fecha indicada en el párrafo anterior, las cantidades adeudadas, tanto respecto al Presupuesto como al fondo de ejecución presupuestario, devengarán interés a razón del 5% al año, a contar del día de la expiración de dicho plazo.

Los gastos que demande el servicio de interpretación correrán por cuenta de los países que solicite ese servicio, salvo cuando se trate de países incluidos en la última categoría contributiva.

The Union's mission is to coalesce the common goals and objectives of its member countries or territories in both postal and non-postal matters with a view to the modernization of basic postal services through the implementation of individual, bilateral and joint projects ensuring domestic integration, continuing improvements in quality and the development and modernization of administrative, operating and legal procedures by:

• a)

  promoting universal postal service and improving and stimulating the region-wide postal market by reforming postal sector structures in member countries or territories through the transformation and modernization of their organizational structures and the training of their human resources;

• b)

  fostering efficient cooperation for postal development in its member countries or territories and facilitating the sharing of information and expertise on operational, regulatory and governmental matters;

• c)

  improving quality of service, interoperability and network security through the promotion and application of information technology allowing for performance evaluations of postal services and improving the reliability of data exchanged by member countries or territories, in keeping with the demands of postal service users and customers;

• d)

  ensuring the unification of their activities and strategies under the UPU World Postal Strategy and promoting joint action, coordination and communication with the UPU, Restricted Unions, other international organizations and other postal stakeholders.

Member countries or territories adopting this Constitution shall form a single postal territory known as the Postal Union of the Americas, Spain and Portugal for reciprocal exchanges of postal items within the framework of both universal postal service and of other optional postal services under the same or more favorable conditions for their customers than those established by the Universal Postal Union.

To this end, freedom of transit shall be guaranteed throughout the PUASP area.

The Union is independent of all other organizations and maintains relations with the Universal Postal Union and other Restricted Postal Unions under conditions of reciprocity. It may also maintain relations with other international organizations as necessitated by common interests.

It operates within the framework of Universal Postal Union directives, to which effect it maintains the status of a Restricted Union under Article 8 of the Universal Postal Union Constitution.

The Union will enjoy all necessary privileges and immunities for the accomplishment of its mission within the territorial area of each member country or territory.

Likewise, representatives of member countries or territories and postal administrations forming part of delegations to meetings of Union bodies or on official Union business will enjoy all necessary privileges and immunities for the pursuit of their activities.

PUASP General Secretariat staff members on official business will also enjoy these same privileges.

Any American mainland or island nation or territory with membership status in the Universal Postal Union may accede to the Union provided it has no sovereignty dispute with any member country or territory.

Any sovereign American nation which is not a member of the Universal Postal Union may apply for admission to the Postal Union of the Americas, Spain and Portugal.

Instruments of accession or applications for admission to the Union must include a formal declaration of accession to the Constitution and other binding Union provisions.

The Union is composed of the following bodies:

• a)

  the Congress;

• b)

  the Conference;

• c)

  the Consultative and Executive Council and its Management Committee;

• d)

  the General Secretariat.

The Consultative and Executive Council and its Management Committee and the General Secretariat are permanent Union bodies.

The Congress is the Union's supreme body.

The Congress is an assembly of representatives of member countries or territories.

The Consultative and Executive Council will ensure the continuity of the Union's work in the interval between Congresses and will be required to perform studies and issue opinions on matters concerning or relating to postal activities. It will also supervise and monitor General Secretariat operations.

Consultative and Executive Council members will discharge their functions in the name and interests of the Union.

The General Secretariat, operating under the supervision of the Consultative and Executive Council, is the Union's permanent working body for the implementation of its policies and for liaising with its members. It serves as Secretariat for the Congress, the Conference and the Consultative and Executive Council and its Management Committee and various working groups, to which it provides assistance for the performance of their functions.

The General Secretariat is based at Union headquarters and is directed by a Secretary General operating under the supervision of the Eastern Republic of Uruguay.

The Constitution is the Union's fundamental act defining its mission and containing its organic rules.

The General Regulations contain provisions for implementing the Constitution and governing Union operations and are binding on all member countries or territories.

Any reservations with respect to the Union Acts are set forth in Final Protocols appended thereto.

Provisions not contemplated in the General Regulations referring to the operation of the Union or Union bodies or to matters concerning or relating to postal activities will be drafted in the form of Resolutions binding on all Union members.

Provisions referring to the operation of postal services will be drafted in the form of Recommendations to be implemented by the postal administrations of member countries or territories insofar as possible.

Any reservations with respect to Resolutions passed by the Congress referring to the operation of postal services are set forth in Final Protocols appended thereto.

Each Congress will set ceilings for:

• a)

  annual Union expenses;

• b)

  expenses connected with the following Congress.

Union expenses will be jointly defrayed by all member countries or territories, which will be classified in different contribution categories specifically for this purpose. To this end, each member country or territory will choose the contribution category in which it wishes to be classified. The contribution categories are established in the General Regulations.

The government of a country or territory acceding to the Union will select the contribution category in which it wishes to be classified for purposes of the apportionment of Union expenses.

The signature of Union Acts and Resolutions by the plenipotentiary representatives of member countries or territories will take place at the conclusion of the Congress.

The Constitution will be ratified by signatory countries or territories as quickly as possible.

3

The approval process for the General Regulations, Final Protocols and Resolutions will be governed by the constitutional rules of each signatory member country or territory.

4

Without prejudice to the provisions of paragraphs 2 and 3 above, signatory countries or territories may ratify or approve Union Acts and Resolutions on a provisional basis, with written notice to the PUASP General Secretariat.

5

The failure of any one member country or territory to ratify the Constitution or to approve other Acts and Resolutions will make them no less binding on those countries by which they have been ratified or approved.

Any member countries or territories which have not signed the Union Acts and other binding provisions adopted by the Congress must accede to them as quickly as possible.

Under the circumstances referred to in paragraph 1 above, corresponding instruments of accession are to be addressed to the General Secretariat, which will notify member countries or territories as to the deposit of such instruments.

Proposals amending Union Acts, Resolutions and Recommendations may be submitted:

• a)

  by the postal administration of any member country or territory;

• b)

  by the Consultative and Executive Council, as an outcome of studies or activities within its sphere of competence and with respect to matters affecting the organization and operation of the General Secretariat.

The proposals referred to in paragraph 1 above are to be submitted to the Congress.

The adoption of proposals submitted to the Congress with regard to the Constitution is subject to their approval by a minimum of two thirds of Union member countries or territories.

Amendments adopted by a given Congress will be set forth in an Additional Protocol and will enter into effect on the same date as the Acts amended in the course of the Congress in question, except as otherwise resolved by that Congress.

Constitutional amendments will be ratified by member countries or territories as quickly as possible, with corresponding ratification instruments governed by the provisions of Articles 21 and 22 above.

Governments of interested countries are to send notices of accession or applications for admission to the General Secretariat, which will notify the Union's other member countries or territories of their receipt.

2

Applications for admission to the Union must be approved by a minimum of two thirds of its member countries or territories.

3

Member countries or territories failing to respond within four months from the date of their notification of the receipt of an application for admission will be deemed to have given their approval.

4

The General Secretariat will inform the governments of all member countries or territories of the accession or admission of new members.

5

Applicant countries will be notified of the decision taken on their application and, if admitted, of the effective date of their admission and other relevant information.

Any member country or territory may withdraw from the Union by denouncing the Constitution in a notice to such effect addressed to the General Secretariat which, in turn, will inform the governments of the other member countries or territories.

A withdrawal from the Union will become effective one year from the date of receipt by the General Secretariat of the notice of denunciation referred to in paragraph 1 above.

Member countries or territories withdrawing from the Union must continue to fulfill their obligations under the Union Acts until the effective date of their withdrawal.

Representatives of member countries or territories will assemble at Union Congresses approximately every four years.

Each Congress will designate the host country or territory for the following Congress, subject to a corresponding offer from the country or territory so designated. In cases of more than one offer, the host will be decided by secret ballot.

3

In the event the Congress cannot be held in the designated host country or territory, the General Secretariat will take necessary emergency action to find a country or territory willing to host the Congress, presenting the results of its efforts to the Consultative and Executive Council for a decision.

The General Secretariat will follow the same procedure established in paragraph 3 above in cases where, by the end of a given Congress, no country or territory has offered to host the following Congress.

In the event of the need to hold a Congress in the absence of a host government, the General Secretariat will make necessary arrangements to convene and conduct the Congress in the PUASP headquarters country with the consent of the Consultative and Executive Council and the government of the Eastern Republic of Uruguay, in which case the General Secretariat will discharge the functions of the host government.

The host government will set the final date and location for the Congress in agreement with the General Secretariat. In principle, the host government will send invitations to the governments of all member countries or territories one year in advance, either directly or via the General Secretariat.

The chairmanship of each Congress will go to the host country or territory for that Congress. The Consultative and Executive Council will designate the country to serve as chairman under the circumstances described in paragraph 5 above.

The postal administration of the country or territory hosting the Congress will suggest the name of an actively employed or retired postal official with a long history of attendance of Union Congresses to serve as its Dean in consultation with the General Secretariat, with the Consultative and Executive Council confirming the appointment in due course. The Dean will temporarily preside over the first plenary session of the Congress until a permanent Chairman is appointed. The Dean will nominate candidates to serve as chairmen and vicechairmen of the Congress and its Committees. One Congress vicechairmanship will go to the country or territory having chaired the previous Congress.

The Dean will bring a motion before the first session of the Congress for the appointment of a General Committee consisting of the Congress Chairman, the two Vice Chairmen and the PUASP Secretary General.

The purposes of the Congress are:

• a)

  to amend and supplement Union Acts, Resolutions and Recommendations as necessary;

• b)

  to set priorities for Union activities during the ensuing period;

• c)

  to discuss all matters brought before it pertaining to the purposes of the Union.

Each member country or territory will arrange to be represented by one or more delegates or by the delegation of another country or territory. No delegation of any country or territory may represent more than one other country or territory.

Any member country or territory may formulate reservations to Union Acts and Resolutions adopted by the Congress with regard to postal or postal-related activities at the time of their signature.

The host government will inform the governments of all other countries or territories as to the Acts and Resolutions adopted by the Congress.

A delegation is defined as an individual or group of individuals designated by a member country or territory to represent it at the Congress. Delegations consisting of more than one delegate will need to appoint a head of delegation and, where applicable, a deputy head of delegation.

All members of delegations should be experts with an extensive knowledge of Union regulations and practices and specific postalrelated responsibilities in member countries or territories.

Member countries or territories unable to attend a Congress may arrange to be represented by another delegation. Likewise, those present at the Congress but unable to attend a particular session may arrange to be represented by another delegation. The Congress Chairman is to be informed of the decision taken in either of these cases, bearing in mind that no member country or territory may represent more than one other country or territory.

All delegates must bear credentials signed by the Chief of State, Head of Government or Minister of Foreign Affairs of the country or territory in question.

Such credentials must be drawn up in due and proper form. Delegates whose credentials meet any of the following criteria will be considered plenipotentiary representatives:

• a)

  They confer full powers;

• b)

  They grant the delegate unlimited authority to represent his government;

• c)

  They grant the delegate the necessary authority to sign Union Acts.

All three cases implicitly include the authority to take part in deliberations and vote.

Delegates whose credentials fail to meet the criteria outlined in subparagraphs (a), (b) and (c) above will only be qualified to take part in deliberations and to vote.

All credentials are to be deposited with the authority specifically designated for this purpose at the opening session of the Congress.

4

Delegates failing to present their credentials may take part in deliberations and voting processes provided their names have been submitted by their government to the government of the country or territory hosting the Congress. The same applies to delegates whose credentials are found to contain some defect or irregularity. These delegates may no longer vote once the Congress has approved the Credentials Committee report attesting to their failure to present credentials or to the inadequacy of their credentials for voting purposes until such time as their status has been regularized.

Only original, duly conferred credentials and proxies are admissible. However, communications by telegram or any other written telecommunications media in response to requests for information with respect to delegate credentials are acceptable.

The following individuals may take part in deliberations by the Congress as observers, with the right to speak where authorized by the Congress Chairman, but without the right to vote:

• a)

  Representatives of nonmember countries specifically invited by the Consultative and Executive Council, under mutually agreed-on conditions;

• b)

  Representatives of the Universal Postal Union;

• c)

  Representatives of Restricted Postal Unions extending reciprocal invitations.

Representatives of international organizations or of any organization with an interest in the postal sector whose participation is considered important to the work of the Congress by the Consultative and Executive Council, the Management Committee and the General Secretariat may also be admitted as observers under mutually agreed-on conditions.

The Chairman will open meetings, lead debates, recognize speakers in the order in which they ask to speak, put matters on which there is no unanimous agreement to a vote, rule on procedural questions arising in the course of the deliberations and close the Congress.

The Chairman will co-sign Acts, Resolutions and Recommendations adopted by the Congress with the Secretary General.

In his absence, the Chairman will be replaced by the Vice Chairman from the country having chaired the previous Congress.

Proposals presented by the deadline established in Article 125, paragraph 1, below will serve as the basis for deliberations by the Congress. Proposals presented after this deadline must be backed by a minimum of two other member countries or territories and received at least three weeks prior to the opening of the Congress.

In principle, all proposals are to have a single objective and are to be limited strictly to any changes justified by such objective.

3

However, amendments may be introduced verbally or in writing at any time during the discussion of a particular issue.

4

In cases of multiple proposals with regard to a single issue, the Chairman will determine the order of their discussion beginning, in principle, with the proposal furthest from the original text or entailing the most radical change.

In cases of proposals which can be subdivided into several parts, each part may be discussed and voted on separately with the consent of their authors or the Congress.

6

Amendments accepted by the delegation presenting the original proposal will be promptly incorporated into the text of the proposal. Any other amendments will be handled according to the rule established in paragraph 4 above as regards the order of their discussion.

The procedure described in paragraph 6 above is also applicable in the event of the presentation of several amendments to a single proposal.

Any proposal withdrawn at a plenary session may be resubmitted by another delegation. Moreover, in the event of the approval and acceptance of an amendment to a proposal by the country or territory submitting the original proposal, another member country or territory may resubmit the original unmodified version of that same proposal.

Speakers must confine themselves to the discussion topic, limiting their remarks to a maximum of five minutes, except as otherwise agreed by a simple majority of members present and entitled to vote. The Chairman has the authority to interrupt any speakers exceeding their allotted time.

Subject to consultation with the Congress and with the approval of a simple majority of members present, represented and entitled to vote, the Chairman may:

• a)

  limit the number of speeches by a single delegation on a particular proposal or group of proposals;

• b)

  limit the number of speeches by different delegations on a particular proposal or group of proposals to five in favor and five against the matter at issue;

• c)

  declare the list of speakers closed after reading it aloud, subject to the right of the delegation presenting the proposal to respond to the remarks of other delegations.

During the discussion of any issue and, where appropriate, even after the closure of corresponding deliberations, a delegation may submit a motion on a point of order for purposes of requesting:

• –

  clarifications on the conduct of the debate;

• –

  compliance with the Constitution or General Regulations;

• –

  a change in the order of discussion of corresponding proposals as suggested by the Chairman.

Motions on points of order take precedence over all other matters, including the procedural motions referred to in paragraph 3 below.

The Chairman will promptly make requested clarifications or what he considers to be a proper decision with respect to a motion on a point of order. In the event of an objection, the Chairman's ruling will immediately be put to a vote.

In addition, a delegation may introduce a procedural motion in the course of the discussion of any issue proposing:

• a)

  that the session be suspended;

• b)

  that the session be adjourned;

• c)

  that the list of speakers be declared closed;

• d)

  that the debate on the discussion issue be postponed;

• e)

  that the debate on the matter under discussion be declared closed.

Procedural motions take precedence over all other proposals with the exception of the motions on points of order referred to in paragraph 1, in the order outlined above.

Motions for the suspension or adjournment of a session of the Congress will be put to a vote immediately, without any discussion.

In cases where a particular delegation moves to close the list of speakers or to postpone or close the debate on a particular discussion issue, only two speakers opposed to the procedural motion in question will be given the floor, whereupon the motion will be put to a vote.

The delegation introducing a motion on a point of order or a procedural motion may not deal with the substance of the matter at issue in its corresponding presentation. The author of a procedural motion may withdraw such motion before it is put to a vote, and any withdrawn motion of this kind, amended or otherwise, may be reintroduced by another delegation.

Issues on which there is no general agreement will be put to a vote which, to be valid, will require the presence or representation of two thirds of all member countries or territories with the right to vote.

In general, votes will be cast by the raising of placards displaying the name of the member country or territory in question. However, roll call votes will be taken at the request of any delegation or upon a ruling to such effect by the Chairman, proceeding in alphabetical order according to the name of each country or territory, drawing lots to determine the delegation casting the first vote.

Votes will be cast by secret ballot at the request of any delegation, seconded by another delegation, in which case the Chairman will take all necessary steps to ensure secrecy. Motions for secret ballots made in accordance with this paragraph will take precedence over motions for roll call votes.

Each member country or territory will be entitled to cast a single vote and to vote on behalf of another member country or territory as its proxy or representative.

Reports of all meetings will be drawn up in Spanish. They will summarize the general business discussed and proposals presented at each meeting and recap the deliberations conducted and results achieved.

Delegates may request that any statements they make at a given meeting be recorded in the report verbatim, provided the text of their statements is submitted to the General Secretariat within twenty-four hours from the conclusion of the meeting in question.

The General Secretariat will draw up reports of all meetings based on recordings of deliberations by the Congress and forward them to the delegations of member countries or territories present at the Congress for approval. The General Secretariat will take into consideration all comments received within forty (40) days from the date of the distribution of such reports to interested member countries or territories.

Any delegation wishing to refer to a particular statement during the course of the Congress is to request a report on such statement from the General Secretariat based on recordings of corresponding deliberations.

An Extraordinary Congress of member countries or territories will be convened to deal with important matters urgently requiring action prior to the next regular Congress.

2

Member countries or territories calling for an Extraordinary Congress will simultaneously name the country or territory willing to serve as its host, to enable the General Secretariat to seek approval from the other member countries or territories.

The government of the member country or territory designated to host an Extraordinary Congress will send timely invitations to all member countries or territories at least six (6) months prior to the scheduled date of the Extraordinary Congress, either directly or via the General Secretariat.

Article 103, paragraphs 11 and 13, are applicable by analogy.

Any member country or territory may formulate reservations to Union Acts and Resolutions adopted by an Extraordinary Congress pertaining to postal service operations.

The Chairman of the Consultative and Executive Council will convene a Conference of representatives of member countries or territories in the city designated to host the UPU Congress through the intermediary of the General Secretariat to discuss proposals and matters of special importance to the Union for purposes of establishing appropriate procedures for taking joint action.

The Conference will meet as often as necessary during the course of the Universal Postal Union Congress. In the event of important matters to be discussed, the Consultative and Executive Council may convene a meeting of the Conference prior to the scheduled date of the UPU Congress with the consent of a majority of member countries or territories entitled to vote.

The Chairman of the Consultative and Executive Council, who will also serve as Conference Chairman, will inform the CEC of the results of the work accomplished during the Congress in question and formulate related proposals.

The Conference will designate a member country or territory to replace the Conference Chairman in the event of his absence or his inability to attend a particular session.

All provisions of the General Regulations governing the conduct of meetings of the Congress are also applicable to the Conference.

The Consultative and Executive Council consists of representatives of all Union member countries and territories and will be chaired by the country hosting the Congress, which position is to be occupied by experts in the management of collegiate bodies possessing an in-depth knowledge of Union regulations and practices.

The organizational meeting for each new session of the CEC will be convened during the course of the Congress by the Congress Chairman and will include elections for a First and Second Vice Chairman. In the event the country or territory designated to chair the Council chooses to waive its right to do so, this position will go to the First Vice Chairman, in which case the Second Vice Chairman will become First Vice Chairman and a new Second Vice Chairman will be elected from among the other Council members.

Each member country or territory will appoint a representative to the Consultative and Executive Council.

The Council will hold annual meetings at Union headquarters convened by its Chairman through the intermediary of the General Secretariat. Under special circumstances, the Council may hold its annual meeting in another city of any member country or territory so long as there is no additional cost to the Union. The Secretary General will take part in deliberations at all Council meetings as a nonvoting member. The Council will issue Rules of Procedure governing its operation. Additionally, the Council will also be governed by the provisions of previous articles referring to the operation of the Congress, where compatible, whose due and proper interpretation and enforcement will be the responsibility of the Chairman of the CEC or, where applicable, its Vice Chairmen.

Where necessary, the Chairman will call an extraordinary meeting of the Council at the request of any member, with the consent of two thirds of all CEC members with the right to vote, to be held within a period of two months.

Council members will discharge their duties without compensation. Operating expenses will be borne by the Union. Except in the case of meetings held in conjunction with Union Congresses, member countries or territories in the lowest contribution category unable to use their technical cooperation funds will be entitled to reimbursement of the cost of a single round-trip economy-class airfare or of the cost of travel by any other means up to the equivalent cost of round-trip economy-class air travel. This provision applies only to single-person delegations.

Observers

• 7.1.

  The Universal Postal Union may attend Council meetings as an observer.

• 7.2.

  The following individuals may be invited to attend Council meetings as observers under mutually agreed-on conditions:

  • a)

    Representatives of international organizations or of any organization with an interest in the postal sector whose participation is considered important;

  • b)

    Representatives of non-member countries whose participation in the work of the Consultative and Executive Council is deemed to be of interest.

The General Secretariat will consider the matter and send out the invitations referred to in paragraph 7.2 above under mutually agreed-on conditions in consultation with the Chairman of the CEC and the Management Committee.

9

Observers may speak where authorized by the Chairman of the CEC, but will not be entitled to vote.

The Consultative and Executive Council will direct Union operations, with the following specific functions:

• a)

  Maintain contact with member countries or territories, Universal Postal Union bodies, Restricted Postal Unions and any other national or international organization via the CEC Chairman;

• b)

  Take action and implement activities concerning or relating to postal service operations in Union member countries or territories;

• c)

  Manage and oversee General Secretariat operations and approve its Internal Regulations;

• d)

  Examine and, where applicable, approve the annual report on Union operations drawn up by the General Secretariat;

• e)

  Authorize the annual Union budget subject to the ceilings set by the Congress;

• f)

  Examine and, where applicable, approve the financial statements for the previous year's budget;

• g)

  Establish the salary system for General Secretariat personnel at the first Council meeting following an ordinary Congress;

• h)

  Approve and, where applicable, amend the PUASP General Secretariat Staff Regulations;

• i)

  Approve and, where applicable, amend the Union's Technical Cooperation Regulations;

• j)

  Examine and, where applicable, approve the General Secretariat's annual schedule of attendance of international postal meetings, as well as the number of officials scheduled to attend each such meeting, with the exception of necessary emergency travel in the interests of the Union. This same procedure will be followed in approving other necessary travel on behalf of the Union;

• k)

  Examine and, where applicable, authorize requests by the Secretary General for transfers between programs and between cost groups within a single program under the authorized budget for the year in progress;

• l)

  Conduct studies or issue opinions on matters concerning or relating to postal activities or affecting the Union or its member countries or territories;

• ll)

• m)

  Designate the country to host the next Congress under the circumstances described in Article 103, paragraphs 3 and 4, above subject to a vote in the case of more than one offer;

• n)

  Make necessary arrangements to designate the country or territory to chair the Congress under the circumstances described in Article 103, paragraph 7, above;

• ñ)

• o)

  Make decisions on requests for invitations to attend the Congress as observers under Article 106 of these Regulations;

• p)

  Notify member countries or territories of the results of studies undertaken at its own initiative where action by the Congress is unnecessary, in any event informing the Congress of such studies in compliance with paragraph 10;

• q)

  Establish rules for documents to be published and distributed by the General Secretariat free of charge or at cost;

• r)

  Supervise the organization and conduct of any Unionsponsored courses through the intermediary of the General Secretariat;

• s)

  Promote international cooperation to provide technical and economic assistance for developing countries or territories through any and all means at its disposal;

• t)

  Conduct appellate reviews of appealable rulings by the Supervisory Authority on complaints lodged by General Secretariat personnel against decisions by the General Secretariat;

• u)

  Hold elections to fill vacancies from among corresponding nominees under the circumstances described in Article 119, paragraph 7, below;

• v)

  Discharge any and all other necessary functions for the due and proper attainment of its purposes.

The Consultative and Executive Council will present a comprehensive report on its activities in the interval between Congresses at least two months in advance of the next Congress.

The Consultative and Executive Council will conduct its work based on Union policies and general objectives set by the Congress. It may prioritize and modify these objectives and add other objectives which prove necessary as a result of changing circumstances in the postal sector.

The Consultative and Executive Council will establish the ways and means of conducting its own operations.

The Consultative and Executive Council will appoint a Management Committee.

Purpose and functions

The Management Committee reports to the Consultative and Executive Council and keeps it up to date. It assists the Consultative and Executive Council with the monitoring, examination and evaluation of Union activities, with the following specific functions:

• a)

  draw up reports on strategic plans and established priorities for submission to the CEC for approval;

• b)

  draw up reports on the General Secretariat's action plan and its implementation;

• c)

  draw up a report on the activity indicators proposed by the General Secretariat to evaluate the efficiency of its organizational structure and resources and resulting measurements;

• d)

  draw up a report on budget performance monitoring data;

• e)

  draw up a report on the financial statements and annual report to be presented by the General Secretariat;

• f)

  draw up reports on technical cooperation projects to be submitted for examination by the Management Committee;

• g)

  draw up reports on other advisory functions or proposals entrusted to it by the CEC;

• h)

  present the Council with a summary report on its operations and decisions and on the scope of its work program, which report is to be made available to member countries or territories by the General Secretariat at least thirty (30) days in advance of the CEC meeting, except in cases where the Management Committee and CEC meetings are held less than 30 days apart. The General Secretariat will provide PUASP member countries or territories with the agenda for CEC meetings two (2) weeks in advance and distribute summary proceedings of such meetings within 2 weeks from the date of their conclusion;

• i)

  All documents examined and drawn up by the Committee will be made available to member countries or territories at their request.

Composition

• a)

  The Management Committee will consist of seven (7) members: the Chairman of the Consultative and Executive Council, who will preside over the Management Committee, and representatives of six Union member countries or territories, to be elected by the CEC at its organizational meeting. Of the six members elected to fill seats on the Management Committee, the two countries getting the largest number of votes will serve as the First and Second Vice Chairmen of the CEC, respectively.

• b)

  The elected members of the Management Committee will hold their seats on the Committee until the next regular Congress unless one of the member countries or territories represented on the Management Committee should choose to resign voluntarily, in which case the member country or territory with the next largest number of votes will replace the outgoing member, assuming it is still interested in doing so.

• c)

  The Secretary General will attend Committee meetings with the right to speak, though without the right to vote.

Operation

• a)

  The Management Committee will meet at least twice a year, endeavoring to hold its meetings on equidistant dates.

• b)

  The presence of 5 (five) Committee members, either personally or through a representative, shall constitute a quorum.

• c)

  Management Committee members may be represented at a Committee meeting by proxy. No Committee member may represent more than one other member by proxy.

• d)

  Decisions will be adopted by a simple majority.

• e)

  Under no circumstances will the PUASP bear any costs incurred by Management Committee members in connection with the attendance of Committee meetings.

• f)

  The Management Committee may assign specific duties within the scope of its functions to certain Committee members at its organizational meeting to ensure its efficient operation.

The PUASP General Secretariat has the following functions in furtherance of the interests of member countries or territories:

• a)

  Assemble and distribute documents and information pertaining to Union postal activities, gather information from a wide variety of sources on postal service operations, the implementation of new services, new technology, trends and markets and regularly disseminate such information to its members and post it on the PUASP web site;

• b)

  Serve as intermediary in accession, admission and withdrawal formalities;

• c)

  Conduct studies or surveys as instructed by the Congress or the Consultative and Executive Council;

• d)

  Without prejudice to the provisions of Article 124(b) of these General Regulations, request an outside audit of the Union's economic/financial position at the end of the budget implementation period, ensuring that corresponding costs are within the Union's established budget ceilings;

• e)

  Serve as Secretariat for the Consultative and Executive Council as well as for its Management Committee and working groups and prepare reports in conjunction with the chairs of these same bodies, presenting their members with any documents scheduled to be discussed at least thirty (30) days in advance of the dates of corresponding meetings;

• f)

  Provide information requested by member countries of territories, the UPU International Bureau, Restricted Unions or international organizations on matters concerning or relating to postal activities;

• g)

  Participate and collaborate in multilateral technical cooperation plans and represent the Union in its dealings with international organizations or postal administrations regarded as potential sources of assistance for the improvement of postal services in member countries or territories;

• h)

  Issue opinions on interpretations of the Constitution, the General Regulations and ensuing Resolutions and Recommendations at the request of any member country or territory. Such interpretations are to be disclosed to all other member countries or territories and will be subject to approval by the next Consultative and Executive Council meeting;

• i)

  Issue an opinion on disputed matters at the request of the parties concerned;

• j)

  Keep up-to-date records on the implementation of Recommendations adopted by the Congress and notify member countries or territories of any change in the progress of their implementation;

• k)

  Keep the General Secretariat Library and Philatelic Section in order;

• l)

  Prepare annual statements of Union expenditures;

• ll)

• m)

  Establish the annual contributions payable by each member country or territory;

• n)

  Implement technical assistance and cooperation programs for the conduct of Union-sponsored regional postal training activities and supervise and oversee postal training courses offered by the Union in accordance with guidelines mapped out by the Congress and the Consultative and Executive Council;

• ñ)

• o)

  Present the CEC with itemized balance sheets for the Union's Technical Cooperation, Project Development and Working Capital Funds;

• p)

  Keep an up-to-date list of current Resolutions, Recommendations and Decisions by the Congress and the CEC and post them on the PUASP web site;

• q)

  Administer and update the organization's web site asestablished by the CEC;

• r)

  Establish a communications system with member countries or territories ensuring the regular dissemination of information on General Secretariat operations;

• s)

  Furnish distance consulting services to member countriesor territories on matters relating to the organization,implementation and monitoring of general postal service operations;

• t)

  Implement and conduct distance training programs using the most economical state-of-the-art methods.

The General Secretariat has the following functions within the framework of Congresses, Conferences and other Union meetings:

• a)

  Assist with the organization and conduct of Congresses, Conferences and other meetings called by the Union;

• b)

  Send pertinent inquiries to all member countries or territories for purposes of the selection of a new host for the Union Congress under the circumstances described in Article 103, paragraph 3, and Article 113, paragraph 2, above, inform the Consultative and Executive Council of the results of its efforts, request CEC approval of one of the offers and advise all member governments of the country designated by the Consultative and Executive Council to host the Congress;

• c)

  Distribute proposals submitted by postal administrations for consideration at Congresses, Conferences and other Union meetings in a timely fashion;

• d)

  Serve as secretariat for the Conference;

• e)

  Prepare a summary of the decisions taken at meetings of the Conference;

• f)

  Draw up the agenda for Consultative and Executive Council meetings and a report on its studies and proposals for submission to the Congress;

• g)

  Publish documents for Congresses, Conferences and other Union meetings.

The General Secretariat has the following functions with respect to Universal Postal Union Congresses:

• a)

  Make arrangements with the host location for the provision of meeting rooms for the Conference and of necessary office space for administrative services;

• b)

  Send notices of meetings of the Conference to member countries or territories with the approval of the Consultative and Executive Council Chairman;

• c)

  Assist the postal administrations of member countries or territories in matters pertaining to the conduct of the Universal Postal Union Congress;

• d)

  Take steps to form alliances with other Restricted Unions for mutual support and/or for developing strategies in furtherance of the interests and objectives of a majority of member countries or territories within the framework of standing UPU bodies and the Universal Postal Union Congress.

The General Secretariat will be directed and managed by a Secretary General, assisted by a Counselor. Both officials will be elected at the Congress by secret ballot from among corresponding nominees. The Secretary General and Counselor will be elected for a single term and may be re-elected for an additional term. For purposes of this paragraph, “term” refers to the interval between two consecutive regular Congresses.

Candidates for the post of Secretary General or Counselor must meet the following requirements:

• a)

  They must have extensive experience in the organization and operation of postal services acquired at the postal administration of a member country or territory and must be citizens of the country or territory presenting their candidacy; or

• b)

  They must already hold the position of Secretary General or Counselor.

The following formalities will be observed in electing the Secretary General and Counselor:

• a)

  Candidates for these positions must be nominated by the governments of member countries or territories, except for officials already serving in these posts, who may personally present their candidacies. Both positions may not be simultaneously held by citizens of the same member country or territory.

• b)

  The governments of member countries or territories will formally present their candidates to the government of the PUASP headquarters country three months prior to the scheduled date of the Congress, accompanied by corresponding curricula vitae.

• c)

  Any Secretary General or Counselor wishing to run for re-election will present his or her candidacy to the government of the PUASP headquarters country by this same deadline, accompanied by a curriculum vitae.

• d)

  The headquarters country will forward the list of candidates and accompanying curricula vitae to the governments of all other member countries or territories at least one month prior to the scheduled date of the Congress and will disclose this same information to the General Secretariat.

• e)

  The Secretary General and Counselor will be elected by secret ballot, by a simple majority of members present and entitled to vote.

In the event of a vacancy in the position of Secretary General, this post will be temporarily filled by the Counselor, who will simultaneously retain his own responsibilities.

In the event of a vacancy in the position of Counselor, the Secretary General will assume the duties of this official.

In the event of vacancies in both positions, the Supervisory Authority will temporarily assume responsibility for the direction and management of the General Secretariat.

Under any of the circumstances described in paragraphs 4 through 6 above, the General Secretariat will promptly invite member countries or territories to nominate candidates to fill the vacancy or vacancies in question. As an exception to the rule established in paragraph 1 above, the first meeting of the Consultative and Executive Council after the effective date of such vacancy or vacancies will hold an election to fill such vacancies from among corresponding nominees. The term of office of these elected officials will run up until the next meeting of the Congress, which interval will not be taken into account for purposes of their eventual re-election under paragraph 1 above.

The procedure established in the preceding paragraph will not apply to vacancies produced after the last regular meeting of the Consultative and Executive Council in the interval between two Congresses.

The Secretary General will have the following powers in addition to those expressly conferred on him by the Constitution and General Regulations:

• a)

  Appoint and dismiss General Secretariat personnel in accordance with corresponding regulations approved by the Consultative and Executive Council;

• b)

  Attend Congresses, Conferences, Consultative and Executive Council meetings and meetings of the CEC Management Committee, with the right to take part in deliberations, but without the right to vote;

• c)

  Attend Universal Postal Union Congresses and meetings of UPU Councils as an observer and inform member countries or territories of any matters discussed at these Council meetings of importance to the PUASP;

• d)

  Organize Conferences and meetings of representatives of member countries or territories attending Universal Postal Union Council meetings;

• e)

  Negotiate loans, sign debt instruments and furnish guarantees for up to two twelfths of the annual budget, all of which are to be cosigned by the Secretary General and Counselor;

• f)

  Open bank accounts;

• g)

  Transfer items between headings and subheadings within the same cost group under a given budget program in keeping with official Union needs and consult with and secure approval from the Consultative and Executive Council Chairman for major budget transfers under Article 115, paragraph 10(k), of these General Regulations as required to cover major emergency expenditures and subsequently submit such transfers for confirmation by a plenary session of the Consultative and Executive Council as provided in the aforesaid Article, together with any other expenditure entailing major changes in budget programs or in cost groupings under a given program.

In addition to assisting and replacing the Secretary General in his absence and assuming his duties, the Counselor has the following basic functions:

• a)

  Oversee administrative work;

• b)

  Frame Union budget proposals;

• c)

  Establish annual accounts;

• d)

  Work with the Secretary General on studies and technical cooperation activities.

Discharge the functions indicated in the Regulations for the General Secretariat.

General Secretariat staff members will be classified in one of the following two categories:

• a)

  Professional service personnel;

• b)

  General service personnel.

The Congress or the Consultative and Executive Council will pass a Resolution establishing staffing levels for both professional and general services personnel on a motion from the Secretary General.

Current and future resident and nonresident PUASP General Secretariat officials and employees elected or hired as of April 1, 1992 and thereafter no longer have pension benefits payable by the Union. However, upon their separation from service, they or their successors or assigns will be entitled to retirement pay in an amount equal to the sum of all contributions made by the employee and by the Union, plus compound interest at the real market rate earned by such funds.

General Secretariat staff pension rights recognized through March 31, 1992 and all corresponding past and present annuities payable under this concept will continue to be disbursed until such time as they may lapse under a special PUASP annual budget program. In the event of inadequate program funding, these benefits will be paid from the Working Capital Fund.

All proposals must be presented to the General Secretariat four (4) months prior to the opening session of the Congress.

The General Secretariat will publish and distribute proposals to member countries or territories at least three (3) months prior to the opening date of the Congress.

Proposals presented after the deadline indicated in paragraph 1 above will be considered if backed by at least two member countries or territories, with the exception of drafting proposals to be referred directly to the Drafting Committee, which must display a capital letter “R” as part of their heading.

The adoption of proposals submitted to the Congress with respect to the General Regulations, Resolutions and Recommendations requires approval by a simple majority of member countries or territories present or represented and entitled to vote. At least two thirds of Union member countries or territories must be present or represented during the voting process.

The preceding rule does not apply to proposals seeking to amend provisions of the General Regulations pertaining to the operation of the Congress (Articles 103 through 113 inclusive) requiring a two thirds majority vote by member countries or territories present or represented at the Congress and entitled to vote, which will enter into effective immediately upon their approval.

Each Congress will pass a Resolution setting the budget ceiling for each year of the ensuing four-year period expressed in United States dollars based on the General Secretariat budget presentation by program and activity. Approved budgets are effective from January 1st through December 31st of each year.

The General Secretariat will present the Management Committee and the Consultative and Executive Council with an itemized budget for the following year, along with a statement of expenditures for the previous year and corresponding supporting documents for examination and approval, where applicable.

At the end of each fiscal year, the aggregate value of annual Union expenses to be jointly defrayed by member countries or territories will be increased by a percentage agreed on by each Congress, earmarked for the working capital fund.

This fund will be used by the General Secretariat to discharge budget obligations.

The percentage increase referred to in paragraph 1 above will not be made in the event the working capital fund at the end of a given fiscal year is greater than or equal to total budgeted expenditures for the following fiscal year.

Member countries or territories will contribute to the defrayal of Union expenses according to their respective contribution category. The following contribution categories are hereby established:

Member countries are classified in the following contribution categories:

  Seven-unit category: Brazil and Portugal;

  Three-unit category: Argentina, Mexico and Uruguay;

• k)

  Two-unit category: Panama and Venezuela;

• l)

  Single-unit category: Netherlands Antilles – Aruba, Bolivia, Costa Rica, Cuba, Ecuador, El Salvador, Guatemala, Haiti, Nicaragua, Peru, Paraguay, Dominican Republic, Republic of Honduras and Republic of Suriname.

The contribution categories of new countries joining the Union will be commensurate with the size of their postal service. The lowest possible initial contribution category is the two-unit category.

Member countries or territories may change their contribution category subject to notification of the General Secretariat prior to the opening of the Congress. Such notices will be reported to the Congress, with the new contribution category prevailing as of the effective date of the financial provisions approved by the Congress.

Member countries or territories may lower their contribution category by only one category at a time. Those member countries or territories who fail to disclose their desire to lower their contribution category prior to the opening of the Congress will remain in their current category.

However, under special circumstances such as natural disasters requiring the implementation of international relief programs, the Congress may approve the request of a member country or territory to temporarily lower its contribution category where it can demonstrate its inability to maintain its contributions at the level corresponding to the category in which it is currently classified.

The Consultative and Executive Council will have the authority to make decisions on requests for reductions in contribution categories under the previous paragraph from member countries or territories other than those classified as least developed countries or territories in the interval between Congresses. Its decision will remain in effect for a maximum of two years or until the celebration of the next Congress, whichever comes first, which will decide whether to limit or extend the reduction period, where applicable.

Member countries or territories subject to a United Nations intervention will be exempt from paying their membership contributions for the duration of these special circumstances.

There are no restrictions on transfers to higher contribution categories.

The Union's financial statements will be subject to an outside audit at the end of the budget year based on generally accepted principles of accounting and auditing.

The outside auditor's report will be presented to the Management Committee prior to its submission to the Consultative and Executive Council for discussion purposes.

The outside auditor will have the authority to make observations on the efficiency of financial procedures relating to the accounting system, internal financial controls and the administration and management system in general.

The outside auditor will be completely independent and solely responsible for the performance of all auditing work.

The Management Committee and the Consultative and Executive Council may ask the outside auditor to conduct specific types of audits and submit separate reports on its findings.

Member countries or territories will be promptly notified of the budget approved by the Consultative and Executive Council for purposes of the payment of their respective contributions thereunder, which payments are due by June 30th of each budget year. In cases where final expenditures fall short of authorized aggregate expenses, corresponding surpluses will be credited to the appropriate country and applied to the following budget.

Any and all payments in arrears after the date indicated in paragraph 1 above with respect to the budget per se and the working capital fund will accrue interest at the rate of 5% per annum, effective as of the aforesaid deadline.

Any member countries or territories in debt to the Union for:

• a)

  nonpayment of their membership contributions for two fiscal years; or

• b)

  noncompliance with payment deadlines under agreed-on payment plans, if any;

which have not taken either of the following measures:

• a)

  settlement of their debt by paying off the outstanding balance or by making an irrevocable assignment to the Union of all or part of their own outstanding claims payable by other member countries or territories; or

• b)

  acceptance of a payment plan proposed by the General Secretariat;

will be subject to automatic sanctions.

In keeping with the previous paragraph, the member country or territory in question will automatically forfeit:

• a)

  its right to vote at meetings of the Congress, the Consultative and Executive Council and the Management Committee, though retaining its right to take part in deliberations;

• b)

  its right to nominate candidates for elective positions with the General Secretariat;

• c)

  its right to use the Technical Cooperation Fund and the Project Development Fund;

• d)

  its right to accrue Technical Cooperation Fund “alicuotas” during the years in question;

• e)

  its right to reimbursement of airfare and subsistence allowances for the attendance of CEC meetings or UPU Congresses.

The General Secretariat will report any Union member subject to automatic sanctions at the opening session of the Congress and the CEC meeting.

Automatic sanctions imposed on a member country or territory will be officially lifted, effective immediately, upon payment in full of all outstanding mandatory contributions due the Union or upon its signature of a debt payment plan and payment of the first installment due thereunder.

Union documents will be furnished to postal administrations in Spanish. However, official correspondence from postal administrations of non-Spanish speaking member countries or territories may be drafted in their native language. From time to time, the Consultative and Executive Council may authorize French, English and Portuguese translations of publications of particular interest for the operation of postal services.

Deliberations at Congresses, Conferences and Council meetings may be conducted in French, English and Portuguese in addition to Spanish, with the choice of translation system left up to the General Secretariat and the meeting organizers.

The cost of interpretation services will be borne by the countries or territories requesting such services, with the exception of those in the lowest contribution category.
