Verdrag tussen het Koninkrijk der Nederlanden en Australië inzake de voortdurende aanwezigheid van Australisch overheidspersoneel in Nederland ten behoeve van de reactie op het neerhalen van vlucht MH17 van Malaysia Airlines

Australian Personnel shall respect the sovereignty, territorial integrity and political independence of the Kingdom of the Netherlands in accordance with the Charter of the United Nations.

Australian Personnel shall respect the laws of the Netherlands, and refrain from any action or activity incompatible with the purposes of this Treaty.

Each Party shall retain full national command and control over their respective personnel, as appropriate. Neither Party shall take any administrative or disciplinary action against the other Party’s personnel. Should it become necessary to take administrative or disciplinary action against a Party’s personnel during the Activity, the relevant national authorities shall take action in accordance with their national laws, regulations and policies.

Australian Personnel shall be accorded the status equivalent to that accorded to the administrative and technical staff of a diplomatic mission of a state that is a party to the VCDR. Should the Netherlands request the withdrawal of Australian Personnel from the Netherlands, Australia shall comply with this request.

Notwithstanding Paragraph 1, where a person who is Australian Personnel is also accredited as a diplomatic agent of the Australian Embassy to the Netherlands with the full privileges and immunities available to diplomatic agents under the VCDR, and where there is any inconsistency between the rights, protections and obligations accorded to that person under the VCDR and the rights, protections and obligations accorded to that person under this Treaty, the rights, protections and obligations accorded to that person under the VCDR shall prevail.

The Parties shall waive all claims against each other that may arise from the Activity except where such claims arise out of wilful misconduct, recklessness or gross negligence.

With respect to third party claims arising out of the acts or omissions of Australian Personnel and/or Dutch Personnel done in the course of the Activity that are not the responsibility of a third party, the following shall apply:

• i.

  Where the Parties mutually determine that responsibility for damage, loss, injury or death can be attributed to one Party, the cost of handling and settling the claim shall be the sole responsibility of that Party;

• ii.

  Where it is mutually determined that both Parties are responsible for the damage, loss, injury or death, the Parties shall enter into consultation to resolve the handling and settling of the claim, with each Party paying an apportioned share based on their degree of responsibility for the damage, loss, injury or death;

• iii.

  Where it is mutually determined that it is not possible to attribute responsibility for damage, loss, injury or death, the cost of handling and settling the claim shall be apportioned equally between the Parties; and

• iv.

  In the event that one Party receives notice of such claims, the receiving Party shall inform the other Party as soon as practicable. The Parties shall assist each other in the procurement of evidence related to such claims.

The Parties may share information in accordance with applicable bilateral agreements or arrangements, including those for the protection of classified information. Information shall be used only for the purposes for which it is provided and shall not be transferred to any third party, without the written consent of the originating Party.

Neither Party shall release any information relating to the other Party’s personnel or the victims of MH17, including personal details, names, injuries or deaths sustained, or any other information that may be sensitive, to any person or entity, without the prior written permission of the other Party to which the information relates.

Each Party shall inform the other by diplomatic note of the completion of domestic requirements for entry into force of this Treaty. This Treaty shall enter into force on the date of the later of these notes.

Should this Treaty enter into force before the termination of the Treaty between Australia and the Kingdom of the Netherlands on the Presence of Australian Personnel in the Netherlands for the Purpose of Responding to the Downing of Malaysia Airlines Flight MH17, signed on 1 August 2014, that Treaty shall cease to have effect on the date this Treaty enters into force.

The Parties may agree, in writing, to amend this Treaty and the Parties shall agree on the terms for entry into force of the amendment.

Any issue regarding the interpretation or application of this Treaty shall be resolved amicably and expeditiously through consultation between the Parties and shall not be referred to any third party, national or international court or tribunal for settlement.

Either Party may terminate this Treaty at any time by notice in writing to the other Party through diplomatic channels. Termination shall take effect six (6) months after the date of the notice.

Termination of this Treaty shall not affect rights and responsibilities regarding disputes, immunities, claims and information arising from actions that have taken place during the period in which this Treaty was in force.

Het Australisch overheidspersoneel eerbiedigt de soevereiniteit, territoriale integriteit en politieke onafhankelijkheid van het Koninkrijk der Nederlanden in overeenstemming met het Handvest van de Verenigde Naties.

Het Australisch overheidspersoneel eerbiedigt de Nederlandse wetgeving en onthoudt zich van elke actie of activiteit die onverenigbaar is met de doelen van dit Verdrag.

Elke partij behoudt het volledige nationale gezag en toezicht over het eigen overheidspersoneel, naargelang van toepassing. Geen van beide partijen neemt administratieve of disciplinaire maatregelen tegen het overheidspersoneel van de andere partij. Indien tijdens de Activiteit administratieve of disciplinaire maatregelen dienen te worden genomen tegen het overheidspersoneel van een partij, nemen de betrokken nationale autoriteiten maatregelen in overeenstemming met hun nationale wet- en regelgeving en beleid.

Australisch overheidspersoneel krijgt de rechtspositie die overeenkomt met die van het administratieve en technische personeel van een diplomatieke zending van een staat die partij is bij het WVDV. Mocht Nederland om de terugtrekking van Australisch overheidspersoneel uit Nederland verzoeken, dan zal Australië aan dit verzoek voldoen.

Niettegenstaande het eerste lid prevaleren, indien een persoon die lid is van het Australisch overheidspersoneel eveneens is geaccrediteerd als diplomatiek ambtenaar van de Australische ambassade in Nederland met alle voorrechten en immuniteiten waarover diplomatieke ambtenaren krachtens het WVDV beschikken, en indien er sprake is van een tegenstrijdigheid tussen de rechten, de bescherming en de verplichtingen die krachtens het WVDV aan die persoon worden toegekend en de rechten, de bescherming en de verplichtingen die krachtens dit Verdrag aan die persoon worden toegekend, de rechten, de bescherming en de verplichtingen die krachtens het WVDV aan die persoon worden toegekend.

De partijen zien af van het instellen van alle vorderingen tegen elkaar die uit de Activiteit kunnen voortvloeien, tenzij er sprake is van opzettelijk wangedrag, roekeloosheid of grove nalatigheid.

Ten aanzien van vorderingen van derden die voortvloeien uit het handelen of nalaten van Australisch en/of Nederlands overheidspersoneel dat gedurende de Activiteit is verricht en dat niet onder de verantwoordelijkheid van een derde valt, geldt het volgende:

• i.

  Op het moment dat de partijen onderling bepalen dat de aansprakelijkheid voor schade, verlies, letsel of overlijden kan worden toegerekend aan één partij, komen de kosten van de behandeling en de afwikkeling van de vordering uitsluitend voor rekening van die partij;

• ii.

  Op het moment dat wederzijds wordt vastgesteld dat beide partijen verantwoordelijk zijn voor de schade, het verlies, het letsel of het overlijden, treden de partijen in overleg om een oplossing te vinden voor de behandeling en de afwikkeling van de vordering, waarbij elke partij dat deel betaalt dat past bij de mate waarin zij verantwoordelijk is voor de schade, het verlies, het letsel of het overlijden;

• iii.

  Op het moment dat wederzijds wordt vastgesteld dat het niet mogelijk is om de aansprakelijkheid voor schade, verlies, letsel of overlijden toe te rekenen, worden de kosten van de behandeling en de afwikkeling van de vordering gelijkelijk over de partijen verdeeld; en

• iv.

  In het geval dat één partij een kennisgeving van dergelijke vorderingen ontvangt, stelt de ontvangende partij de andere partij daarvan zo spoedig mogelijk in kennis. De partijen verlenen elkaar bijstand bij het verkrijgen van het bewijsmateriaal dat met dergelijke vorderingen verband houdt.

De partijen kunnen informatie uitwisselen overeenkomstig de toepasselijke bilaterale overeenkomsten of regelingen, met inbegrip van die ter bescherming van gerubriceerde informatie. Informatie wordt uitsluitend gebruikt voor de doeleinden waarvoor zij is verstrekt en wordt niet aan derden doorgegeven, zonder de schriftelijke toestemming van de partij van herkomst.

Geen van beide partijen geeft informatie vrij die betrekking heeft op het overheidspersoneel van de andere partij of de slachtoffers van MH17, met inbegrip van persoonsgegevens, namen, gewonden of doden, of andere informatie die gevoelig kan zijn, aan een persoon of entiteit zonder voorafgaande schriftelijke toestemming van de andere partij waarop de informatie betrekking heeft.

Elke partij stelt de andere partij met behulp van een diplomatieke nota in kennis van het feit dat aan de nationale vereisten voor de inwerkingtreding van dit Verdrag is voldaan. Dit Verdrag treedt in werking op de datum van de laatste van de twee nota’s.

Indien dit Verdrag in werking treedt voordat het Verdrag tussen het Koninkrijk der Nederlanden en Australië inzake de aanwezigheid van Australisch overheidspersoneel in Nederland ten behoeve van de reactie op het neerhalen van vlucht MH17 van Malaysia Airlines, ondertekend op 1 augustus 2014, buiten werking treedt, dan houdt dat Verdrag op van kracht te zijn op de datum dat dit Verdrag in werking treedt.

De partijen kunnen schriftelijk overeenkomen dit Verdrag te wijzigen en de partijen bereiken overeenstemming over de voorwaarden waaronder de wijziging in werking treedt.

Elk geschil betreffende de uitlegging of toepassing van dit Verdrag wordt in der minne en voortvarend geschikt door middel van overleg tussen de partijen en wordt niet ter beslechting voorgelegd aan een derde partij, een nationaal of internationaal hof of tribunaal.

Elke partij kan dit Verdrag beëindigen door de andere partij daarvan langs diplomatieke weg schriftelijk in kennis te stellen. De beëindiging wordt van kracht zes (6) maanden na de datum waarop deze kennisgeving wordt gedaan.

De beëindiging van dit Verdrag doet geen afbreuk aan de rechten en verantwoordelijkheden die betrekking hebben op geschillen, immuniteiten, vorderingen en informatie die voortvloeien uit acties die zijn ondernomen gedurende het tijdvak waarin dit Verdrag van kracht was.
