Preamble

The Government of the Kingdom of the Netherlands

and

the Government of the Republic of India, hereafter referred to as the Contracting Parties,

Considering the importance of accurate assessment of customs duties and of ensuring proper enforcement by their customs administrations of prohibitions, restrictions and measures of control in respect of specific goods;

Considering that offences against customs law are prejudicial to the economic, commercial, fiscal, social, environmental, public health, public security and cultural interests of the Contracting Parties;

Considering that illegal cross-border trafficking in weapons, explosives, chemical, biological and nuclear substances, endangered species, hazardous goods as well as in narcotic drugs, psychotropic substances and precursors constitutes a danger to society;

Recognising the need for international co-operation in matters related to the application and enforcement of their customs laws;

Convinced that action against customs offences can be made more effective by close co-operation between their customs administrations based on mutually agreed legal provisions;

Having regard to relevant international conventions and recommendations of the World Customs Organization encouraging mutual administrative assistance between customs administrations and the relevant articles of the Trade Facilitation Agreement of the World Trade Organization;

Having regard to the wide range of international conventions containing prohibitions, restrictions and special measures of control in respect of specific goods;

Have agreed as follows:

CHAPTER

I

DEFINITIONS

Definitions

For the purposes of this Agreement:

  • a)

    “customs administration” shall mean:

    • for the Kingdom of the Netherlands, the central administration responsible for the implementation of customs law;

    • for the Republic of India, the Central Board of Indirect Taxes and Customs;

  • b)

    “customs duties” shall mean all duties, taxes, fees or any other charges which are levied, as well as any reimbursement of refunds or export subsidies which is demanded, in the territories of the Contracting Parties in application of customs law, but not including fees or other charges for services rendered;

  • c)

    “customs law” shall mean any legal and administrative provisions applicable or enforceable by either customs administration in connection with the importation, exportation, transshipment, transit, storage and movement of goods, including legal and administrative provisions relating to measures of prohibition, restriction and control in respect of specific goods;

  • d)

    “customs offence” shall mean any violation or attempted violation of customs law;

  • e)

    “information” shall mean any data, whether or not processed or analysed, and documents, reports, and other communications in any format, including electronic, or certified or authenticated copies thereof;

  • f)

    “international trade supply chain” shall mean all processes involved in the cross-border movement of goods from the place of origin to the place of final destination;

  • g)

    “official” shall mean any customs officer or other government agent designated by either customs administration;

  • h)

    “person” shall mean both natural or legal persons unless the context otherwise requires;

  • i)

    “personal data” shall mean any data concerning an identified or identifiable natural person;

  • j)

    “requested administration” shall mean the customs administration from which assistance is requested;

  • k)

    “requesting administration” shall mean the customs administration which requests assistance;

  • l)

    “requested Party” shall mean the Contracting Party whose customs administration is requested to provide assistance;

  • m)

    “requesting Party” shall mean the Contracting Party whose customs administration requests assistance.

On request, the requested administration shall provide the requesting administration with information on:

  • a)

    whether goods exported from the territory of the requesting Party have been lawfully imported into the territory of the requested Party, and the customs procedure, if any, under which the goods have been placed;

  • b)

    whether goods imported into the territory of the requesting Party have been lawfully exported from the territory of the requested Party.

Automatic transmission of information

The customs administrations may, by mutual arrangement in accordance with Article 19 of this Agreement, transmit to one another any information covered by this Agreement on an automatic basis.

The customs administrations may, by mutual arrangement in accordance with Article 19 of this Agreement, transmit specific information to one another in advance of the arrival of consignments in the territory of the other Contracting Party.

Presence of officials in the territory of the other Contracting Party

On request, officials designated by the requesting administration may, with the authorisation of the requested administration and subject to conditions the latter may impose, for the purpose of investigating a customs offence:

  • a)

    examine, in the offices of the requested administration, documents and any other information in respect of that customs offence, and be supplied with copies thereof;

  • b)

    be present during an inquiry conducted by the requested administration in the territory of the requested Party, which is relevant to the requesting administration; these officials shall only have an advisory role.

Where the requested administration considers it appropriate for officials of the requesting Party to be present when measures of assistance are carried out pursuant to a request, the requested administration may invite the participation of officials of the requesting Party subject to any terms and conditions it may specify.

IMPLEMENTATION AND APPLICATION OF THE AGREEMENT

Implementation and application of the Agreement

The Contracting Parties shall, through their customs administrations, be responsible for the implementation of the Agreement. They shall, inter alia:

  • a)

    designate points of contact to ensure the proper functioning of the Agreement.

  • b)

    enable the customs officials responsible for investigating or combating customs offences to maintain direct communications with one another; and

  • c)

    mutually decide on detailed arrangements to facilitate the implementation of this Agreement.

  • d)

    mutually endeavour to resolve any problems or questions arising from the interpretation or application of this Agreement.

This Agreement shall enter into force on the first day of the second month following the date on which both Contracting Parties have notified each other in writing, through diplomatic channels, that their respective constitutional or internal requirements for the entry into force of this Agreement have been completed.

Preambule

De Regering van het Koninkrijk der Nederlanden

en

de Regering van de Republiek India, hierna te noemen de “verdragsluitende partijen”,

Overwegend het belang van een juiste vaststelling van de douanerechten en van het waarborgen van een juiste handhaving door hun douaneadministraties van verboden, beperkingen en controlemaatregelen met betrekking tot bepaalde goederen;

Overwegend dat inbreuken op de douanewetgeving schadelijk zijn voor de economische, fiscale, sociale en culturele belangen en de belangen op het gebied van milieu, volksgezondheid, openbare orde en handel van de verdragsluitende partijen;

Overwegend dat de illegale grensoverschrijdende handel in wapens, explosieven, chemische, biologische en nucleaire stoffen, bedreigde dier- en plantensoorten, gevaarlijke stoffen alsmede in verdovende middelen, psychotrope stoffen en precursoren een gevaar voor de samenleving vormt;

Erkennend de noodzaak van internationale samenwerking ter zake van aangelegenheden die verband houden met de toepassing en handhaving van hun douanewetgeving;

Ervan overtuigd dat het optreden tegen inbreuken op de douanewetgeving doeltreffender kan worden door middel van nauwe samenwerking tussen hun douaneadministraties op basis van wederzijds overeengekomen wettelijke bepalingen;

Gelet op de relevante internationale verdragen en aanbevelingen van de Werelddouaneorganisatie waarin wederzijdse administratieve bijstand tussen douaneadministraties wordt aangemoedigd en de relevante artikelen van de Overeenkomst inzake handelsfacilitatie van de Wereldhandelsorganisatie;

Gelet op het brede scala aan internationale overeenkomsten die verboden, beperkingen en bijzondere controlemaatregelen met betrekking tot bepaalde goederen bevatten;

Zijn het volgende overeengekomen:

HOOFDSTUK

I

BEGRIPSOMSCHRIJVINGEN

Begripsomschrijvingen

Voor de toepassing van dit Verdrag wordt verstaan onder:

  • a.

    „douaneadministratie”:

    • wat het Koninkrijk der Nederlanden betreft, de centrale administratie die verantwoordelijk is voor de toepassing van de douanewetgeving;

    • wat de Republiek India betreft, de Central Board of Indirect Taxes and Customs (Centrale Raad voor indirecte belastingen en douane);

  • b.

    „douanerechten”: alle rechten, belastingen of heffingen die geheven worden alsmede elke restitutie van vergoedingen of exportsubsidies die gevorderd wordt op de grondgebieden van de verdragsluitende partijen bij toepassing van de douanewetgeving, maar met uitzondering van heffingen voor verleende diensten;

  • c.

    „douanewetgeving”: alle wettelijke en administratieve bepalingen die door een van de douaneadministraties worden toegepast of gehandhaafd in verband met de invoer, uitvoer, overslag, doorvoer, opslag en het vervoer van goederen, met inbegrip van wettelijke en administratieve bepalingen met betrekking tot verboden, beperkingen en controlemaatregelen met betrekking tot bepaalde goederen;

  • d.

    „inbreuk op de douanewetgeving”: elke schending of poging tot schending van de douanewetgeving;

  • e.

    „informatie”: alle gegevens, al dan niet bewerkt of geanalyseerd, en documenten, rapporten en andere mededelingen ongeacht in welke vorm, met inbegrip van de elektronische vorm, of gewaarmerkte of gelegaliseerde afschriften daarvan;

  • f.

    „internationale logistieke keten”: alle processen die van toepassing zijn bij het grensoverschrijdend verkeer van goederen van de plaats van herkomst naar de uiteindelijke plaats van bestemming;

  • g.

    „functionaris”: elke douaneambtenaar of andere regeringsambtenaar aangewezen door een van de douaneadministraties;

  • h.

    „persoon”: zowel natuurlijke als rechtspersonen, tenzij de context anders vereist;

  • i.

    „persoonsgegevens”: alle gegevens betreffende een geïdentificeerde of identificeerbare natuurlijke persoon;

  • j.

    „aangezochte administratie”: de douaneadministratie die om bijstand in douanezaken wordt verzocht;

  • k.

    „verzoekende administratie”: de douaneadministratie die om bijstand in douanezaken verzoekt;

  • l.

    „aangezochte partij”: de verdragsluitende partij wier douaneadministratie om bijstand in douanezaken wordt verzocht;

  • m.

    „verzoekende partij”: de verdragsluitende partij wier douaneadministratie om bijstand in douanezaken verzoekt.

Op verzoek stelt de aangezochte administratie de verzoekende administratie op de hoogte van:

  • a.

    het feit of goederen die werden uitgevoerd uit het grondgebied van de verzoekende partij op rechtmatige wijze zijn ingevoerd in het grondgebied van de aangezochte partij en onder welke douaneregeling de goederen eventueel zijn geplaatst;

  • b.

    het feit of goederen die zijn ingevoerd in het grondgebied van de verzoekende partij op rechtmatige wijze werden uitgevoerd uit het grondgebied van de aangezochte partij.

Automatisch verstrekken van informatie

De douaneadministraties kunnen elkaar, door middel van een wederzijdse regeling overeenkomstig artikel 19 van dit Verdrag, automatisch informatie die onder dit Verdrag valt verstrekken.

De douaneadministraties kunnen elkaar, door middel van een wederzijdse regeling overeenkomstig artikel 19 van dit Verdrag, specifieke informatie verstrekken voorafgaand aan de aankomst van zendingen op het grondgebied van de andere verdragsluitende partij.

Aanwezigheid van functionarissen op het grondgebied van de andere verdragsluitende partij

Door de verzoekende administratie aangewezen functionarissen kunnen, met instemming van de aangezochte administratie en onder voorwaarden die laatstgenoemde hieraan kan verbinden, ten behoeve van onderzoek naar een inbreuk op de douanewetgeving, op verzoek:

  • a.

    ten kantore van de aangezochte administratie documenten en alle andere informatie met betrekking tot die inbreuk op de douanewetgeving onderzoeken en daarvan afschriften verkrijgen;

  • b.

    aanwezig zijn bij een door de aangezochte administratie geleid onderzoek op het grondgebied van de aangezochte partij dat van belang is voor de verzoekende administratie; deze functionarissen zullen uitsluitend een adviserende rol hebben.

Aanwezigheid van functionarissen van de verzoekende verdragsluitende partij op uitnodiging van de aangezochte administratie

Indien de aangezochte administratie het wenselijk acht dat functionarissen van de verzoekende partij aanwezig zijn wanneer, overeenkomstig een verzoek, bijstandsmaatregelen worden uitgevoerd, kan zij de verzoekende partij uitnodigen daartoe functionarissen ter beschikking te stellen, met inachtneming van alle door haar daaraan verbonden voorwaarden.

UITVOERING EN TOEPASSING VAN HET VERDRAG

Uitvoering en toepassing van het Verdrag

De verdragsluitende partijen zijn, via hun douaneadministraties, verantwoordelijk voor de uitvoering van het Verdrag. Zij zullen, onder andere:

  • a.

    contactpunten aanwijzen om de goede werking van het Verdrag te waarborgen;

  • b.

    de douaneambtenaren die belast zijn met het onderzoek of de bestrijding van inbreuken op de douanewetgeving in staat stellen rechtstreeks met elkaar te communiceren; en

  • c.

    gezamenlijk besluiten over nadere regelingen om de uitvoering van dit Verdrag te vergemakkelijken;

  • d.

    ernaar streven eventuele problemen of vragen naar aanleiding van de interpretatie of toepassing van dit Verdrag op te lossen.

Inwerkingtreding

Dit Verdrag treedt in werking op de eerste dag van de tweede maand na de datum waarop beide verdragsluitende partijen elkaar er langs diplomatieke weg schriftelijk van in kennis hebben gesteld dat hun respectieve grondwettelijke of nationale vereisten voor de inwerkingtreding van dit Verdrag zijn voltooid.
