Protocol van 1988 bij het Internationaal Verdrag voor de Beveiliging van Mensenlevens op zee, 1974

The Parties to the present Protocol undertake to give effect to the provisions of the present Protocol and the Annex hereto, which shall constitute an integral part of the present Protocol. Every reference to the present Protocol constitutes at the same time a reference to the Annex hereto.

As between the Parties to the present Protocol, the provisions of the International Convention for the Safety of Life at Sea, 1974, as amended, (hereinafter referred to as “the Convention”) shall apply subject to the modifications and additions set out in the present Protocol.

With respect to ships entitled to fly the flag of a State which is not a Party to the Convention and the present Protocol, the Parties to the present Protocol shall apply the requirements of the Convention and the present Protocol as may be necessary to ensure that no more favourable treatment is given to such ships.

As between the Parties to the present Protocol, the present Protocol replaces and abrogates the Protocol of 1978 relating to the Convention.

Notwithstanding any other provisions of the present Protocol, any certificate issued under, and in accordance with, the provisions of the Convention and any supplement to such certificate issued under, and in accordance with, the provisions of the Protocol of 1978 relating to the Convention which is current when the present Protocol enters into force in respect of the Party by which the certificate or supplement was issued, shall remain valid until it expires under the terms of the Convention or the Protocol of 1978 relating to the Convention, as the case may be.

A Party to the present Protocol shall not issue certificates under, and in accordance with, the provisions of the International Convention for the Safety of Life at Sea, 1974, as adopted on 1 November 1974.

The present Protocol shall be open for signature at the Headquarters of the Organization from 1 March 1989 to 28 February 1990 and shall thereafter remain open for accession. Subject to the provisions of paragraph 3, States may express their consent to be bound by the present Protocol by:

• a)

  signature without reservation as to ratification, acceptance or approval; or

• b)

  signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or

• c)

  accession.

Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General of the Organization.

The present Protocol may be signed without reservation, ratified, accepted, approved or acceded to only by States which have signed without reservation, ratified, accepted, approved or acceded to the Convention.

The present Protocol shal enter into force twelve months after the date on which both the following conditions have been met:

• a)

  not less than fifteen States, the combined merchant fleets of which constitute not less than fifty per cent of the gross tonnage of the world's merchant shipping, have expressed their consent to be bound by it in accordance with article IV, and

• b)

  the conditions for the entry into force of the Protocol of 1988 relating the International Convention on Load Lines, 1966, have been met,

  provided that the present Protocol shall not enter into force before 1 February 1992.

For States which have deposited and instrument of ratification, acceptance, approval or accession in respect of the present Protocol after the conditions for entry into force thereof have been met but prior to the date of entry into force, the ratification, acceptance, approval or accession shall take effect on the date of entry into force of the present Protocol or three months after the date of deposit of the instrument, whichever is the later date.

Any instrument of ratification, acceptance, approval or accession deposited after the date on which the present Protocol enters into force shall take effect three months after the date of deposit.

After the date on which an amendment to the present Protocol is deemed to have been accepted under article VI, any instrument of ratification, acceptance, approval or accession deposited shall apply to the present Protocol as amended.

The present Protocol may be denounced by any Party at any time after the expiry of five years from the date on which the present Protocol enters into force for that Party.

Denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary-General of the Organization.

A denunciation shall take effect one year, or such longer period as may be specified in the instrument of denunciation, after its receipt by the Secretary-General of the Organization.

A denunciation of the Convention by a Party shall be deemed to be a denunciation of the present Protocol by that Party. Such denunciation shall take effect on the same date as denunciation of the Convention takes effect according to paragraph c) of article XI of the Convention.

The present Protocol shall be deposited with the Secretary-General of the Organization (hereinafter referred to as 'the depositary').

The depositary shall:

• a)

  inform the Governments of all States which have signed the present Protocol or acceded thereto of:

  • (i)

    each new signature or deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof;

  • (ii)

    the date of entry into force of the present Protocol;

  • (iii)

    the deposit of any instrument of denunciation of the present Protocol together with the date on which it was received and the date on which the denunciation takes effect;

• b)

  transmit certified true copies of the present Protocol to the Governments of all States which have signed the present Protocol or acceded thereto.

As soon as the present Protocol enters into force, a certified true copy thereof shall be transmitted by the depositary to the Secretariat of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.

De Partijen bij dit Protocol verbinden zich ertoe uitvoering te geven aan de bepalingen van dit Protocol en van de Bijlage daarbij, die een integrerend deel van dit Protocol vormt. Elke verwijzing naar dit Protocol houdt tegelijkertijd een verwijzing naar de Bijlage in.

Tussen de Partijen bij dit Protocol zijn de bepalingen van het Internationaal Verdrag voor de Beveiliging van Mensenlevens op Zee, 1974, zoals gewijzigd, (hierna te noemen „het Verdrag”), van toepassing onder voorbehoud van de wijzigingen en aanvullingen vervat in dit Protocol.

Ten aanzien van schepen die zijn gerechtigd de vlag te voeren van een Staat die geen Partij bij het Verdrag en dit Protocol is, passen de Partijen bij dit Protocol de bepalingen van het Verdrag en dit Protocol toe voor zover nodig om te verzekeren dat zulke schepen geen gunstiger behandeling wordt toegekend.

Tussen de Partijen bij dit Protocol treedt dit Protocol in de plaats van het Protocol uit 1978 bij het Verdrag.

Niettegenstaande andere bepalingen van dit Protocol, blijft ieder certificaat, afgegeven krachtens en in overeenstemming met de bepalingen van het Verdrag, alsmede iedere aanvulling op een zodanig certificaat, afgegeven krachtens en in overeenstemming met de bepalingen van het Protocol van 1978 bij het Verdrag, dat geldig is wanneer dit Protocol in werking treedt ten aanzien van de Partij die het certificaat of de aanvulling hierop heeft afgegeven, geldig totdat het komt te vervallen ingevolge de voorwaarden van het Verdrag of van het Protocol van 1978 bij het Verdrag, al naar gelang het geval.

Een Partij bij dit Protocol geeft geen certificaten af krachtens en in overeenstemming met de bepalingen van het Internationaal Verdrag voor de Beveiliging van Mensenlevens op Zee, 1974, zoals aangenomen op 1 november 1974.

Dit Protocol staat open voor ondertekening op de zetel van de Organisatie van 1 maart 1989 tot 28 februari 1990 en blijft daarna openstaan voor toetreding. Onder voorbehoud van het bepaalde in het derde lid kunnen Staten hun instemming door dit Protocol te zijn gebonden tot uitdrukking brengen door:

• a.

  ondertekening, zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring; of

• b.

  ondertekening onder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, gevolgd door bekrachtiging, aanvaarding of goedkeuring; of

• c.

  toetreding.

Bekrachtiging, aanvaarding, goedkeuring of toetreding geschiedt door de nederlegging van een daartoe strekkende akte bij de Secretaris-Generaal van de Organisatie.

Dit Protocol kan slechts zonder voorbehoud worden ondertekend, bekrachtigd, aanvaard of goedgekeurd, of daartoe kan slechts worden toegetreden door Staten die het Verdrag zonder voorbehoud hebben ondertekend, bekrachtigd, aanvaard, goedgekeurd, of daartoe zijn toegetreden.

Dit Protocol treedt in werking twaalf maanden na de datum waarop aan beide onderstaande voorwaarden is voldaan:

• a.

  ten minste vijftien Staten, waarvan de gecombineerde koopvaardijvloten ten minste vijftig procent van de bruto tonnage van de wereldkoopvaardijvloot vormen, overeenkomstig artikel IV hun instemming daardoor gebonden te worden tot uitdrukking hebben gebracht, en

• b.

  is voldaan aan de voorwaarden voor de inwerkingtreding van het Protocol van 1988 bij het Internationaal Verdrag betreffende de uitwatering van schepen, 1966,

  met dien verstande dat dit Protocol niet vóór 1 februari 1992 in werking zal treden.

Voor Staten die een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding met betrekking tot dit Protocol hebben nedergelegd nadat aan de voorwaarden voor de inwerkingtreding ervan is voldaan, doch vóór de datum van inwerkingtreding, wordt de bekrachtiging, aanvaarding, goedkeuring of toetreding van kracht met ingang van de datum van inwerkingtreding van dit Protocol of drie maanden na de datum van nederlegging van de akte, welke van beide data later valt.

Akten van bekrachtiging, aanvaarding, goedkeuring of toetreding nedergelegd na de datum waarop dit Protocol in werking treedt, worden van kracht drie maanden na de datum van nederlegging.

Een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding nedergelegd na de datum waarop een wijziging van dit Protocol wordt geacht te zijn aanvaard ingevolge artikel VI, is van toepassing op dit Protocol als gewijzigd.

Dit Protocol kan te allen tijde door een Partij worden opgezegd na afloop van een termijn van vijf jaar, te rekenen van de datum waarop dit Protocol voor die Partij in werking treedt.

Opzegging geschiedt door nederlegging van een akte van opzegging bij de Secretaris-Generaal van de Organisatie.

Een opzegging wordt van kracht een jaar na ontvangst door de Secretaris-Generaal van de Organisatie van de akte van opzegging of na een langere daarin vastgestelde periode.

Opzegging van het Verdrag door een Partij wordt geacht opzegging van dit Protocol door die Partij in te houden. Deze opzegging wordt van kracht op dezelfde datum als waarop de opzegging van het Verdrag van kracht wordt overeenkomstig artikel XI, letter (c) van het Verdrag.

Dit Protocol wordt nedergelegd bij de Secretaris-Generaal van de Organisatie (hierna te noemen „de depositaris”).

De depositaris:

• a.

  stelt de Regeringen van alle Staten die dit Protocol hebben ondertekend, of daartoe zijn toegetreden, in kennis van:

  • (i)

    elke nieuwe ondertekening of nederlegging van een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, alsmede van de datum daarvan;

  • (ii)

    de datum van inwerkingtreding van dit Protocol;

  • (iii)

    de nederlegging van een akte van opzegging van dit Protocol, alsmede de datum waarop deze werd ontvangen en de datum waarop de opzegging van kracht wordt;

• b.

  zendt voor eensluidend, gewaarmerkte afschriften van dit Protocol toe aan de Regeringen van alle Staten die dit Protocol hebben ondertekend of daartoe zijn toegetreden.

Zodra dit Protocol in werking treedt, wordt een voor eensluidend gewaarmerkt afschrift daarvan door de depositaris toegezonden aan het Secretariaat van de Verenigde Naties ter registratie en publikatie overeenkomstig artikel 102 van het Handvest der Verenigde Naties.
