Protocol to the 1979 Convention on Long-Range Transboundary Air Pollution concerning the Control of Emissions of Nitrogen Oxides or their Transboundary Fluxes

The Parties,

Determined to implement the Convention on Long-range Transboundary Air Pollution,

Concerned that present emissions of air pollutants are causing damage, in exposed parts of Europe and North America, to natural resources of vital environmental and economic importance,

Recalling that the Executive Body for the Convention recognized at its second session the need to reduce effectively the total annual emissions of nitrogen oxides from stationary and mobile sources or their transboundary fluxes by 1995, and the need on the part of other States that had already made progress in reducing these emissions to maintain and review their emission standards for nitrogen oxides,

Taking into consideration existing scientific and technical data on emissions, atmospheric movements and effects on the environment of nitrogen oxides and their secondary products, as well as on control technologies,

Conscious that the adverse environmental effects of emissions of nitrogen oxides vary among countries,

Determined to take effective action to control and reduce national annual emissions of nitrogen oxides or their transboundary fluxes by, in particular, the application of appropriate national emission standards to new mobile and major new stationary sources and the retrofitting of existing major stationary sources,

Recognizing that scientific and technical knowledge of these matters is developing and that it will be necessary to take such developments into account when reviewing the operation of this Protocol and deciding on further action,

Noting that the elaboration of an approach based on critical loads is aimed at the establishment of an effect-oriented scientific basis to be taken into account when reviewing the operation of this Protocol and at deciding on further internationally agreed measures to limit and reduce emissions of nitrogen oxides or their transboundary fluxes,

Recognizing that the expeditious consideration of procedures to create more favourable conditions for exchange of technology will contribute to the effective reduction of emissions of nitrogen oxides in the region of the Commission,

Noting with appreciation the mutual commitment undertaken by several countries to implement immediate and substantial reductions of national annual emissions of nitrogen oxides,

Acknowledging the measures already taken by some countries which have had the effect of reducing emissions of nitrogen oxides,

Have agreed as follows:

Article

1 Definitions

For the purposes of the present Protocol,

1.
"Convention" means the Convention on Long-range Transboundary Air Pollution, adopted in Geneva on 13 November 1979;
2.
"EMEP" means the Co-operative Programme for Monitoring and Evaluation of the Long-range Transmission of Air Pollutants in Europe;
3.
"Executive Body" means the Executive Body for the Convention constituted under article 10, paragraph 1 of the Convention;
4.
"Geographical scope of EMEP" means the area defined in article 1, paragraph 4 of the Protocol to the 1979 Convention on Long-range Transboundary Air Pollution on Long-term Financing of the Co-operative Programme for Monitoring and Evaluation of the Long-range Transmission of Air Pollutants in Europe (EMEP), adopted in Geneva on 28 September 1984;
5.
"Parties" means, unless the context otherwise requires, the Parties to the present Protocol;
6.
"Commission" means the United Nations Economic Commission for Europe;
7.
"Critical load" means a quantitative estimate of the exposure to one or more pollutants below which significant harmful effects on specified sensitive elements of the environment do not occur according to present knowledge;
8.
"Major existing stationary source" means any existing stationary source the thermal input of which is at least 100 MW;
9.
"Major new stationary source" means any hew stationary source the thermal input of which is at least 50 MW;
10.
"Major source category" means any category of sources which emit or may emit air pollutants in the form of nitrogen oxides, including the categories described in the Technical Annex, and which contribute at least 10 per cent of the total national emissions of nitrogen oxides on an annual basis as measured or calculated in the first calendar year after the date of entry into force of the present Protocol, and every fourth year thereafter;
11.
"New stationary source" means any stationary source the construction or substantial modification of which is commenced after the expiration of two years from the date of entry into force of this Protocol;
12.
"New mobile source" means a motor vehicle or other mobile source which is manufactured after the expiration of two years from the date of entry into force of the present Protocol.

Article

2 Basic obligations

1

The Parties shall, as soon as possible and as a first step, take effective measures to control and/or reduce their national annual emissions of nitrogen oxides or their transboundary fluxes so that these, at the latest by 31 December 1994, do not exceed their national annual emissions of nitrogen oxides or transboundary fluxes of such emissions for the calendar year 1987 or any previous year to be specified upon signature of, or accession to, the Protocol, provided that in addition, with respect to any Party specifying such a previous year, its national average annual transboundary fluxes or national average annual emissions of nitrogen oxides for the period from 1 January 1987 to 1 January 1996 do not exceed its transboundary fluxes or national emissions for the calendar year 1987.

Furthermore, the Parties shall in particular, and no later than two years after the date of entry into force of the present Protocol:

(a)
Apply national emissions standards to major new stationary sources and/or source categories, and to substantially modified stationary sources in major source categories, based on the best available technologies which are economically feasible, taking into consideration the Technical Annex;
(b)
Apply national emission standards to new mobile sources in all major source categories based on the best available technologies which are economically feasible, taking into consideration the Technical Annex and the relevant decisions taken within the framework of the Inland Transport Committee of the Commission; and
(c)
Introduce pollution control measures for major existing stationary sources, taking into consideration the Technical Annex and the characteristics of the plant, its age and its rate of utilization and the need to avoid undue operational disruption.

(a)
The Parties shall, as a second step, commence negotiations, no later than six months after the date of entry into force of the present Protocol, on further steps to reduce national annual emissions of nitrogen oxides or transboundary fluxes of such emissions, taking into account the best available scientific and technological developments, internationally accepted critical loads and other elements resulting from the work programme undertaken under article 6.
(b)
To this end, the Parties shall co-operate in order to establish:
- (i)
  Critical loads;
- (ii)
  Reductions in national annual emissions of nitrogen oxides or transboundary fluxes of such emissions as required to achieve agreed objectives based on critical loads; and
- (iii)
  Measures and a time-table commencing no later than 1 January 1996 for achieving such reductions.

Parties may take more stringent measures than those required by the present article.

Article

3 Exchange of technology

1

The Parties shall, consistent with their national laws, regulations and practices, facilitate the exchange of technology to reduce emissions of nitrogen oxides, particularly through the promotion of:

(a)
Commercial exchange of available technology;
(b)
Direct industrial contacts and co-operation, including joint ventures;
(c)
Exchange of information and experience; and
(d)
Provision of technical assistance.

In promoting the activities specified in subparagraphs (a) to (d) above, the Parties shall create favourable conditions by facilitating contacts and co-operation among appropriate organizations and individuals in the private and public sectors that are capable of providing technology, design and engineering services, equipment or finance.

The Parties shall, no later than six months after the date of entry into force of the present Protocol, commence consideration of procedures to create more favourable conditions for the exchange of technology to reduce emissions of nitrogen oxides.

Article

4 Unleaded fuel

The Parties shall, as soon as possible and no later than two years after the date of entry into force of the present Protocol, make unleaded fuel sufficiently available, in particular cases as a minimum along main international transit routes, to facilitate the circulation of vehicles equipped with catalytic converters.

Article

5 Review process

The Parties shall regularly review the present Protocol, taking into account the best available secientific substantiation and technological development.

The first review shall take place no later than one year after the date of entry into force of the present Protocol.

Article

6 Work to be undertaken

The Parties shall give high priority to research and monitoring related to the development and application of an approach based on critical loads to determine, on a scientific basis, necessary reductions in emissions of nitrogen oxides. The Parties shall, in particular, through national research programmes, in the work plan of the Executive Body and through other co-operative programmes within the framework of the Convention, seek to:

(a)
Identify and quantify effects of emissions of nitrogen oxides on humans, plant and animal life, waters, soils and materials, taking into account the impact on these of nitrogen oxides from sources other than atmospheric deposition;
(b)
Determine the geographical distribution of sensitive areas;
(c)
Develop measurements and model calculations including harmonized methodologies for the calculation of emissions, to quantify the long-range transport of nitrogen oxides and related pollutants;
(d)
Improve estimates of the performance and costs of technologies for control of emissions of nitrogen oxides and record the development of improved and new technologies; and
(e)
Develop, in the context of an approach based on critical loads, methods to integrate scientific, technical and economic data in order to determine appropriate control strategies.

Article

7 National programmes, policies and strategies

The Parties shall develop without undue delay national programmes, policies and strategies to implement the obligations under the present Protocol that shall serve as a means of controlling and reducing emissions of nitrogen oxides or their transboundary fluxes.

Article

8 Information exchange and annual reporting

The Parties shall exchange information by notifying the Executive Body of the national programmes, policies and strategies that they develop in accordance with article 7 and by reporting to it annually on progress achieved under, and any changes to, those programmes, policies and strategies, and in particular on:

(a)
The levels of national annual emissions of nitrogen oxides and the basis upon which they have been calculated;
(b)
Progress in applying national emission standards required under article 2, subparagraphs 2 (a) and 2 (b), and the national emission standards applied or to be applied, and the sources and/or source categories concerned;
(c)
Progress in introducing the pollution control measures required under article 2, subparagraph 2 (c), the sources concerned and the measures introduced or to be introduced;
(d)
Progress in making unleaded fuel available;
(e)
Measures taken to facilitate the exchange of technology; and
(f)
Progress in establishing critical loads.

Such information shall, as far as possible, be submitted in accordance with a uniform reporting framework.

Article

9 Calculations

EMEP shall, utilizing appropriate models and in good time before the annual meetings of the Executive Body, provide to the Executive Body calculations of nitrogen budgets and also of transboundary fluxes and deposition of nitrogen oxides within the geographical scope of EMEP. In areas outside the geographical scope of EMEP, models appropriate to the particular circumstances of Parties to the Convention therein shall be used.

Article

10 Technical Annex

The Technical Annex to the present Protocol is recommendatory in character. It shall form an integral part of the Protocol.

Article

11 Amendments to the Protocol

Any Party may propose amendments to the present Protocol.

Proposed amendments shall be submitted in writing to the Executive Secretary of the Commission who shall communicate them to all Parties. The Executive Body shall discuss the proposed amendments at its next annual meeting provided that these proposals have been circulated by the Executive Secretary to the Parties at least ninety days in advance.

Amendments to the Protocol, other than amendments to its Technical Annex, shall be adopted by consensus of the Parties present at a meeting of the Executive Body, and shall enter into force for the Parties which have accepted them on the ninetieth day after the date on which two-thirds of the Parties have deposited their instruments of acceptance thereof. Amendments shall enter into force for any Party which has accepted them after two-thirds of the Parties have deposited their instruments of acceptance of the amendment, on the ninetieth day after the date on which that Party deposited its instrument of acceptance of the amendments.

Amendments to the Technical Annex shall be adopted by consensus of the Parties present at a meeting of the Executive Body and shall become effective thirty days after the date on which they have been communicated in accordance with paragraph 5 below.

Amendments under paragraph 3 and 4 above shall, as soon as possible after their adoption, be communicated by the Executive Secretary to all Parties.

Article

12 Settlement of disputes

If a dispute arises between two or more Parties as to the interpretation or application of the present Protocol, they shall seek a solution by negotiation or by any other method of dispute settlement acceptable to the parties to the dispute.

Article

13 Signature

The present Protocol shall be open for signature at Sofia from 1 November 1988 until 4 November 1988 inclusive, then at the Headquarters of the United Nations in New York until 5 May 1989, by the member States of the Commission as well as States having consultative status with the Commission, pursuant to paragraph 8 of Economic and Social Council resolution 36 (IV) of 28 March 1947, and by regional economic integration organizations, constituted by sovereign States members of the Commission, which have competence in respect of the negotiation, conclusion and application of international agreements in matters covered by the Protocol, provided that the States and organizations concerned are Parties to the Convention.

In matters within their competence, such regional economic integration organizations shall, on their own behalf, exercise the rights and fulfil the responsibilities which the present Protocol attributes to their member States. In such cases, the member States of these organizations shall not be entitled to exercise such rights individually.

Article

14 Ratification, acceptance, approval and accession

1

The present Protocol shall be subject to ratification, acceptance or approval by Signatories.

2

The present Protocol shall be open for accession as from 6 May 1989 by the States and organizations referred to in article 13, paragraph 1.

A State or organization which accedes to the present Protocol after 31 December 1993 may implement articles 2 and 4 no later than 31 December 1995.

The instruments of ratification, acceptance, approval or accession shall be deposited with the Secretary-General of the United Nations, who will perform the functions of depositary.

Article

15 Entry into force

1

The present Protocol shall enter into force on the ninetieth day following the date on which the sixteenth instrument of ratification, acceptance, approval or accession has been deposited.

For each State and organization referred to in article 13, paragraph 1, which ratifies, accepts or approves the present Protocol or accedes thereto after the deposit of the sixteenth instrument of ratification, acceptance, approval, or accession, the Protocol shall enter into force on the ninetieth day following the date of deposit by such Party of its instrument or ratification, acceptance, approval, or accession.

Article

16 Withdrawal

At any time after five years from the date on which the present Protocol has come into force with respect to a Party, that Party may withdraw from it by giving written notification to the depositary. Any such withdrawal shall take effect on the ninetieth day following the date of its receipt by the depositary, or on such later date as may be specified in the notification of the withdrawal.

Article

17 Authentic texts

The original of the present Protocol, of which the English, French and Russian texts are equally authentic, shall be deposited with the Secretary-General of the United Nations.

IN WITNESS WHEREOF the undersigned, being duly authorized thereto, have signed the present Protocol.

DONE at Sofia this thirty-first day of October one thousand nine hundred and eighty-eight.

TECHNICAL ANNEX

1

The purpose of this annex is to provide guidance to the Parties to the Convention in identifying NO_x control options and techniques in the implementation of their obligations under the Protocol.

It is based on information on options and techniques for NO_x emission reduction and their performance and costs contained in official documentation of the Executive Body and its subsidiary bodies; and in documentation of the ECE Inland Transport Committee and its subsidiary bodies; and on supplementary information provided by governmentally designated experts.

The annex addresses the control of NO_x emissions considered as the sum of nitrogen oxide (NO) and nitrogen dioxide (NO₂) expressed as NO₂ and lists a number of NO_x reduction measures and techniques spanning a wide range of costs and efficiencies. Unless otherwise indicated these techniques are considered to be well established on the basis of substantial operating experience, which in most cases has been gained over five years or more. It cannot, however, be considered as an exhaustive statement of control options; its aim is to provide guidance to Parties in identifying best available technologies which are economically feasible as a basis for national emission standards and in the introduction of pollution control measures.

The choice of pollution control measures for any particular case will depend on a number of factors, including the relevant legislative and regulatory provisions, primary energy pattern, industrial infrastructure and economic circumstances of the Party concerned and, in the case of stationary sources, the specific circumstances of the plant. It should be borne in mind also that sources of NOx are often sources of other pollutants as well, such as sulphur oxides (SOx), volatile organic compounds (VOCs), and particulates. In the design of control options for such sources, all polluting emissions should be considered together in order to maximize the overall abatement effect and minimize the impact of the source on the environment.

The annex reflects the state of knowledge and experience of NO_x control measures, including retrofitting, which has been achieved by 1992, in the case of stationary sources, and by 1994 in the case of mobile sources. As this knowledge and this experience continuously expand, particularly with new vehicles incorporating low-emission technology and the development of alternative fuels, as well as with retrofitting and other strategies for existing vehicles, the annex needs to be updated and amended regularly.

I

CONTROL TECHNOLOGIES FOR NO_x EMISSIONS FROM STATIONARY SOURCES

Fossil fule combustion is the main source of anthropogenic NO_x emissions from stationary sources. In addition, some non-combustion processes may contribute considerably to the emissions. The major stationary source categories of NO_x emissions, based on EMEP/CORINAIR 90, include:

a)
Public power, cogeneration and district heating plants:
- (i)
  Boilers;
- (ii)
  Stationary combustion turbines and internal combustion engines;
b)
Commercial, institutional and residential combustion plants:
- (i)
  Commercial boilers;
- (ii)
  Domestic heaters;
c)
Industrial combustion plants and processes with combustion:
- (i)
  Boilers and process heaters (no direct contact between flue gas and products);
- (ii)
  Processes (direct contact); (e.g. calcination processes in rotary kilns, production of cement, lime, etc., glass production, metallurgical operation, pulp production);
d)
Non-combustion processes, e.g. nitric acid production;
e)
Extraction, processing and distribution of fossil fuels;
f)
Waste treatment and disposal, e.g. incineration of municipal and industrial waste.

For the ECE region, combustion processes (categories (a), (b), (c)), account for 85% of NO_x emissions from stationary sources. Noncombustion processes, e.q. production processes, account for 12%, and extraction, processing and distribution of fossil fuels for 3% of total NO_x emissions. Although in many ECE countries, power plants in category (a) are the largest stationary contributor to NO_x emissions, road traffic is usually the largest single overall source of NO_x emissions, but the distribution does vary between Parties to the Convention. Furthermore, industrial sources should be kept in mind.

GENERAL OPTIONS FOR REDUCING NO_x EMISSIONS FROM COMBUSTION

General options for NO_x reduction are:

a)
Energy management measures:¹⁾Options (a) (i) and (ii) are integrated in the energy structure/policy of a Party. Implementation status, efficiency and costs per sector are not considered here.
- i)
  Energy saving;
- ii)
  Energy mix;
b)
Technical options:
- (i)
  Fuel switching/cleaning;
- (ii)
  Other combustion technologies;
- (iii)
  Process and combustion modifications;
- (iv)
  Flue gas treatment.

To achieve the most efficient NO_x reduction programme, beyond the measures listed in (a), a combination of technical options identified in (b) should be considered. Furthermore, the combination of combustion modification and flue gas treatment needs site specific evaluation.

In some cases, options for reducing NO_x emissions may also result in the reduction of emissons of Co₂ and SO₂ and other pollutants.

Energy saving

The rational use of energy (improved energy efficiency/process operation, cogeneration and/or demand-side management) usually results in a reduction in NO_x emissions.

Energy mix

In general, NO_x emissions can be reduced by increasing the proportion of non-combustion energy sources (i.e. hydro, nuclear, wind, etc.) to the energy mix. However, further environmental impacts have to be considered.

Fuel switching/cleaning

Table 1 shows the uncontrolled NO_x emission levels to be expected during fossil fuel combustion for the different sectors.

Fuel switching (e.g. from high – to low-nitrogen fuels or from coal to gas) can lead to lower NO_x emissions but there may be certain restrictions, such as the availability of low NO_x emitting fuels (e.g. natural gas on plant level) and adaptability of existing furnaces to different fuels. In many ECE countries, some coal or oil combustion plants are being replaced by gas-fired combustion plants.

Fuel cleaning for fuel nitrogen removal is not a commercial option. Increasing the application of cracking technology in refineries, however, also brings about a reduction in the nitrogen content of the end-product.

Other combustion technologies

These are combustion technologies with improved thermal efficiency and reduced NO_x emissions. They include:

a)
Cogeneration using gas turbines and engines;
b)
Fluidized bed combustion (FBC): bubbling (BFBC) and circulating (CFBC);
c)
Integrated gasification combined cycle (IGCC);
d)
Combined cycle gas turbines (CCGT).

The emission levels for these techniques are summarized in table 1.

Stationary combustion turbines can also be integrated into existing conventional power plants (known as topping). The overall efficiency can increase by 5% tot 6%, but achievable NO_x reduction will depend on site and fuel specific conditions. Gas turbines and gas engines are widely applied in cogeneration applications. Typically some 30% energy saving can be attained. Both have made significant progress in reducing NO_x emissions through new concepts in combustion and system technology. However, major alterations to the existing boiler system become necessary.

FBC is a combustion technology for burning hard coal and brown coal but it can burn other solid fuels such as petroleum coke and lowgrade fuels such as waste, peat and wood. In addition, emissions can be reduced by integrated combustion control in the system. A newer concept of FBC is pressurized fluidized bed combustion (PFBC) presently being commercialized for the generation of electricity and heat. The total installed capacity of FBC has approached approximately 30.000 MW_th (250 to 350 plants), including 8,000 MW_th in the capacity range of > 50 MW_th.

The IGCC process incorporates coal gasification and combined cycle power generation, in a gas and steam turbine. The gasified coal is burned in the combustion chamber of the gas turbine. The technology also exists for heavy oil residue and bitumen emulsion. The installed capacity is presently about 1,000 MW_el (5 plants).

Combined cycle gas power stations using advanced gas turbines with an energy efficiency of 48%–52% and with reduced NO_x emissions are currently being planned.

Process and combustion modifications

These are measures applied during combustion to reduce the formation of NO_x. They include the control of combustion air ratio, flame temperature, fuel to air ratio, etc. The following combustion techniques, either singly or in combination, are available for new and existing installations. They are widely implemented in the power plant sector and in some areas of the industrial sector:

a)
Low excess air combustion (LEA);¹⁾Typical retrofit measures, with limited efficiency and applicability.
b)
Reduced air preheat (RAP);¹⁾Typical retrofit measures, with limited efficiency and applicability.
c)
Burner-out-of-service (BOOS);¹⁾Typical retrofit measures, with limited efficiency and applicability.
d)
Biased-burner-firing (BBF);¹⁾Typical retrofit measures, with limited efficiency and applicability.
e)
Low NO_x burners (LNB);¹⁾Typical retrofit measures, with limited efficiency and applicability. and²⁾State-of-the-art in new plants.
f)
Flue gas recirculation (FGR);³⁾Implemented in single large commercial plants; operational experience still limited.
g)
Over fire air combustion (OFA);¹⁾Typical retrofit measures, with limited efficiency and applicability. and²⁾State-of-the-art in new plants.
h)
In-furnace-NO_x-reduction reburning (IFNR);³⁾Implemented in single large commercial plants; operational experience still limited.
i)
Water/steam injection and lean/premixed combination.⁴⁾For combustion turbines.

The emission levels due to the application of these techniques are summarized in table 1 (based mainly on experience in power plants).

Combustion modifications have been under continuous development and optimization. In-furnace-NO_x-reduction is being tested in some large-scale demonstration plants, whereas basic combustion modifications are incorporated mainly into boiler and burner design. For example, modern furnace designs incorporate OFA parts, and gas/oil burners are equipped for flue gas recirculation. The latest generation of LNBs combines both air-staging and fuel-staging. A remarkable increase in full-scale retrofit of combustion modifications in ECE member countries has been recorded in the last years. By 1992 a total of about 150,000 MW was installed.

Flue gas treatment processes

Flue gas treatment processes aim at removing already formed NO_x and are also referred to as secondary measures. Wherever possible it is usual to apply primary measures as a first stage of NO_x reduction before applying flue gas treatment processes. The state-of-the-art flue gas treatment processes are all based on the removal of NO_x by dry chemical processes.

They are the following:

a)
Selective Catalytic Reduction (SCR);
b)
Selective Non-catalytic Reduction (SNCR);
c)
Combined NO_x/SO_x removal processes:
- (i)
  Activated Carbon Process (AC);
- (ii)
  Combined catalytic NO_x/SO_x removal.

The emission levels for SCR and SNCR are summarized in table 1. Data are based on the practical experience gathered from a large number of implemented plants. By 1991 in the European part of the ECE about 130 SCR plants corresponding to 50,000 MW_el, 12 SNCR installations (2,000 MW_el), 1 AC plant (250 MW_el and 2 combined catalytic processes (400 MW_el) were erected. The NO_x removal efficiency of AC and combined catalytic processes are similar to SCR.

Table 1 also summarizes the costs of applying the NO_x abatement technologies.

CONTROL TECHNIQUES FOR OTHER SECTORS

Unlike most combustion processes, the application of combustion and/or process modifications in the industrial sector has many process specific limitations. In cement kilns or glass melting furnaces, for example, certain high temperatures are necessary to ensure the product quality. Typical combustion modifications being used are staged combustion/ low NO_x burners, flue gas recirculation and process optimization (e.g. precalcination in cement kilns).

Some examples are given in table 1.

SIDE-EFFECTS/BY-PRODUCTS

The following side-effects will not prevent the implementation of any technology or method, but should be considered when several NO_x abatement options are possible. However, in general, these side-effects can be limited by proper design and operation:

a)
Combustion modifications:
- Possible decrease in overall efficiency;
- Increased CO formation and hydrocarbon emissions;
- Corrosion due to reducing atmosphere;
- Possible N₂O formation in FBC systems;
- Possible increase of carbon fly ash;
b)
SCR:
- NH₃ in the fly ash;
- Formation of ammonium salts on downstream facilities;
- Deactivation of catalyst;
- Increased conversion of SO₂ to SO₃;
c)
SNCR:
- NH₃ in the fly ash;

In terms of by-products, deactivated catalysts from the SCR process are the only relevant products. Due to the classification as waste, a simple disposal is not possible, however recycling options exist.

The reagent production of ammonia and urea for flue gas treatment processes involves a number of separate steps which require energy and reactants. The storage systems for ammonia are subject to the relevant safety legislation and such systems are designed to operate as totally closed systems, with a resultant minimum of ammonia emissions. The use of NH₃ is, however, not jeopardized even when taking into account the indirect emissions related to the production and transportation of NH₃.

MONITORING AND REPORTING

The measures taken to carry out national strategies and policies for the abatement of air pollution include legislation and regulatory provisions, economic incentives and disincentives, as well as technological requirements (best available technology).

In general emission limiting standards may be set per emission source according to plant size, operating mode, combustion technology, fuel type and whether it is a new or existing plant. An alternative approach also used is to set a target for the reduction of total NO_x emissions from a group of existing sources and to allow the Parties to choose where to take action to reach this target (bubble concept).

The limiting of the NO_x emissions to the levels set out in the national framework legislation has to be controlled by a permanent monitoring and reporting system and reported to the supervising authorities.

Several monitoring systems, using both continuous and discontinuous measurement methods, are available. However quality requirements vary among Parties. Measurements are to be carried out by qualified instititutes and approved measuring/monitoring systems. To this end a certification system would provide the best assurance.

In the framework of modern automated monitoring systems and process control equipment, reporting creates no problems. The collection of data for further use is a state-of-the-art technique. However, data to be reported to competent authorities differ from Party to Party. To obtain better comparability, data sets and prescribing regulations should be harmonized. Harmonization is also desirable for quality assurance of measuring/monitoring systems. This should be taken into account when comparing data from different Parties.

To avoid discrepancies and inconsistencies, key issues and parameters including the following, must be well-defined:

Definition of the standards expressed as ppmv, mg/m³, g/GJ, kg/h or hg/t of products. Most of these units need to be calculated and need specification in terms of gas temperature, humidity, pressure, oxygen content or heat input value;
Definition of time over which standards may be averaged, expressed as hours, months or a year;
Definition of failure times and corresponding emergency regulations regarding bypass of monitoring systems or shut-down of the installation;
Definition of methods for backfilling or data missed or lost as a result of equipment failure;
Definition of the parameter set to be measured. Depending on the type of industrial process, the necessary information may differ. This also involves the location of the measurement point within the system.

Primary mobile sources of anthropogenic NO_x emissions include:

Non-road engine applications:

Agricultural, mobile industrial and construction machinery.

Other mobile sources:

Rail transport;
Ships and other marine craft;

Road transport is a major source of anthropogenic NO_x emission in many ECE countries, contributing up to two thirds of the total national emissions. Current petrol-fuelled vehicles contribute up to two thirds of total national road NO_x emissions. In a few cases, however, the NO_x emissions from HDV traffic will exceed the decreasing emissions from passenger cars.

Many countries have enacted regulations that limit the emission of pollutants from road vehicles. For non-road applications, emission standards including NO_x have been enacted by some ECE countries and are under preparation in the ECE itself. NO_x emissions from these other sources may be substantial.

It is important to ensure that new-vehicle emission standards are maintained in service. This can be done through inspection and maintenance programmes, ensuring conformity of production, full useful-life durability, warranty of emission-control components, and recall of defective vehicles.

Fiscal incentives can encourage the accelerated introduction of desirable technology. Retrofit is of limited benefit for NO_x reduction, and may be difficult to apply to more than a small percentage of the vehicle fleet.

Technologies that incorporate catalytic converters with sparkignited petrol engines require the use of unleaded fuel, which should be made generally available. The use of after-treatment technologies in diesel engines like oxidation catalysts or particulate traps requires the use of low-sulphur fuels (maximum 0,05% S content).

The management of urban and loog-distance traffic, though not elaborated in this annex, is important as an efficient additional approach to reducing emissions including NO_x. Measures to reduce NO_x emission and other air pollutants may include enforcement of speed limits and efficient traffic management. Key measures for traffic management aim at changing the modal split of public and long-range transport especially in sensitive areas like cities or the Alps by transferring transport from road to rail through tactical, structural, financial and restrictive elements and also by optimizing the logistics of the delivery systems. They will also be beneficial for other harmful effects of traffic expansion such as noise, congestion, etc.

A variety of technologies and design options are available making simultaneous control of different pollutants possible. For some applications reverse effects have been experienced when reducing NO_x emissions (e.g. non-catalyst petrol or diesel engines). This may change with the employment of new technologies (e.g. after-treatment cleaning devices and electronics). Reformulated diesel fuel and fuel containing post-combustion NO_x reducing additives may also have a role in a strategy to combat diesel vehicle NO_x.

The most efficient currently available technology for NO_x reduction is option E. This technology achieves large reductions of NO_x, volatile organic compounds (VOC), and CO emissions.

In response to regulatory programmes for further NO_x emission reductions (e.g. low-emission vehicles in California), advanced closedloop three-way catalyst systems are being developed (option F). These improvements will focus on engine management, very precise control of air-fuel ratio, heavier catalysts loading, on-board diagnostic systems (OBD) and other advanced control measures.

Motor cycles and mopeds

Although actual NO_x emissions of motor cycles and mopeds are very low (e.g. with two-stroke engines), their NO_x emissions should be considered. While VOC emissions of the vehicles are going to be limited by many Parties to the Convention, their NO_x emissions may increase (e.g. with four-stroke engines). Generally the same technology options as described for petrol-fuelled passenger cars are applicable. In Austria and Switzerland strict NO_x emission standards are already implemented.

Heavy-duty diesel-fuelled vehicles

In table 3 three technology options are summarized. The baseline engine configuration is the turbocharged diesel engine. The trend is towards turbocharged engines with intercooling, advanced fuel injection systems and electronic control. This trend may have the potential to improve baseline fuel consumption performance. Comparative etimates of fuel consumption are not included.

CONTROL TECHNIQUES FOR IN-USE VEHICLES

Full useful life, recall and warranties

To promote durable emission-control systems, consideration should be given to emission standards that may not be exceeded for the ‘‘full useful life’’ of the vehicle. Surveillance programmes are needed to enforce this requirement. Under such programmes, manufacturers are responsible for recalling vehicles that fail to meet the required standards. To ensure that the owner has no production-related problems, manufacturers should provide warranties for emission-control components.

There should not be any devices to reduce the efficiency or switch off the emission control systems during any operating conditions except conditions which are indispensable for trouble-free running (e.g. cold start).

Inspection and maintenance

The inspection and maintenance programme has an important secondary function. It may encourage regular maintenance and discourage vehicle owners from tampering with or disabling the emission controls, both through direct enforcement and public information. Inspection should verify that emission controls are in their original working order. It should also ensure that emission control systems have not been removed.

Improved monitoring of emission control performance can be achieved by on-board diagnostic systems (OBD) which monitor the functioning of emission control components, store fault codes for futher interrogation and call the attention of the driver to ensure the repair in case of malfunction.

Inspection and maintenance programmes can be beneficial for all types of control technology by ensuring that new-vehicle emission levels are maintained. For catalyst-controlled vehicles it is essential to ensure that the new-vehicle specifications and settings are maintained to avoid deterioration of all major pollutants, including NO_x.

Protocol bij het Verdrag van 1979 betreffende grensoverschrijdende luchtverontreiniging over lange afstand inzake de beheersing van emissies van stikstofoxiden of van de grensoverschrijdende stromen van deze stikstofverbindingen

De Partijen,

Vastbesloten het Verdrag betreffende grensoverschrijdende luchtverontreiniging over lange afstand uit te voeren,

Bevreesd dat de huidige emissies van luchtverontreinigende stoffen schade veroorzaken, in daaraan blootgestelde delen van Europa en Noord-Amerika, aan de natuurlijke hulpbronnen die van vitaal belang zijn voor het milieu en de economie,

In herinnering brengend dat het Uitvoerend Orgaan voor het Verdrag tijdens zijn tweede zitting de noodzaak heeft erkend van een doeltreffende vermindering in 1995 van de totale jaarlijkse emissies van stikstofoxiden uit stationaire en mobiele bronnen, of van de grensoverschrijdende stromen van deze verbindingen, alsmede de behoefte van andere Staten die reeds vooruitgang hadden geboekt bij de beperking van deze emissies, om hun emissienormen voor stikstofoxiden te handhaven en opnieuw te bezien,

In overweging nemend de bestaande wetenschappelijke en technische gegevens inzake emissies, atmosferische bewegingen en de gevolgen voor het milieu van stikstofoxiden en hun bijprodukten, alsook inzake technologieën voor de beheersing daarvan,

Zich ervan bewust dat de schadelijke gevolgen van emissies van stikstofoxiden voor het milieu van land tot land verschillen,

Vastbesloten doeltreffende maatregelen te nemen ter beheersing en vermindering van de nationale jaarlijkse emissies van stikstofoxiden of van grensoverschrijdende stromen van deze verbindingen door, in het bijzonder, de toepassing van passende nationale emissienormen op nieuwe mobiele en belangrijke nieuwe stationaire bronnen en de aanpassing van bestaande belangrijke stationaire bronnen,

Erkennend dat de wetenschappelijke en technische kennis van deze zaken zich steeds verder ontwikkelt en dat het nodig zal zijn met deze ontwikkelingen rekening te houden bij het toetsen van de werking van dit Protocol en het nemen van besluiten omtrent verdere maatregelen,

Erop wijzend dat met de uitwerking van een op kritische belasting gebaseerde aanpak wordt beoogd tot een doelgerichte wetenschappelijke grondslag te komen, waarmede rekening moet worden gehouden bij het toetsen van de werking van dit Protocol en het nemen van besluiten omtrent verdere internationaal overeen te komen maatregelen ter beperking en vermindering van emissies van stikstofoxiden of van de grensoverschrijdende stromen van deze verbindingen,

Erkennend dat de spoedige overweging van procedures voor het scheppen van gunstiger voorwaarden voor de uitwisseling van technologie zal bijdragen tot de doeltreffende vermindering van emissies van stikstofoxiden in het gebied van de Commissie,

Met waardering wijzend op de onderlinge verplichting die verscheidene landen op zich hebben genomen om over te gaan tot onmiddellijke en aanzienlijke verminderingen van de nationale jaarlijkse emissies van stikstofoxiden,

Erkennend de reeds door sommige landen genomen maatregelen die hebben geleid tot vermindering van de emissies van stikstofoxiden,

Zijn als volgt overeengekomen:

Artikel

1 Begripsomschrijvingen

Voor de toepassing van dit Protocol wordt verstaan onder:

1.
„Verdrag”: het Verdrag betreffende grensoverschrijdende luchtverontreiniging over lange afstand, aangenomen op 13 november 1979 in Genève;
2.
„EMEP”: het Programma voor samenwerking inzake de bewaking en evaluatie van het transport van luchtverontreinigende stoffen over lange afstand in Europa;
3.
„Uitvoerend Orgaan”: het Uitvoerend Orgaan voor het Verdrag, opgericht ingevolge het bepaalde in artikel 10, eerste lid, van het Verdrag;
4.
„Geografische reikwijdte van het EMEP”: het gebied, omschreven in artikel 1, vierde punt, van het Protocol bij het Verdrag van 1979 betreffende grensoverschrijdende luchtverontreiniging over lange afstand aangaande de langlopende financiering van het programma voor samenwerking inzake de bewaking en evaluatie van het transport van luchtverontreinigende stoffen over lange afstand in Europa (EMEP), aangenomen op 28 september 1984 in Genève;
5.
„Partijen”: tenzij de context anderszins vereist, de Partijen bij dit Protocol;
6.
„Commissie”: de Economische Commissie voor Europa van de Verenigde Naties;
7.
„Kritische belasting”: een kwantitatieve schatting van de blootstelling aan één of meer verontreinigende stoffen, beneden welke zich volgens de huidige kennis geen aanzienlijke schadelijke gevolgen voor nader omschreven gevoelige bestanddelen van het milieu voordoen;
8.
„Belangrijke bestaande stationaire bron”: elke bestaande stationaire bron met een thermisch vermogen van tenminste 100 MW;
9.
„Belangrijke nieuwe stationaire bron”: elke nieuwe stationaire bron met een thermisch vermogen van tenminste 50 MW;
10.
„Belangrijke categorie van bronnen”: elke categorie van bronnen die luchtverontreinigende stoffen in de vorm van stikstofoxiden uitstoot of kan uitstoten, met inbegrip van de categorieën beschreven in de Technische Bijlage, en die een bijdrage levert van tenminste 10 procent van de totale nationale emissies van stikstofoxiden op jaarbasis zoals gemeten of berekend in het eerste kalenderjaar na de datum van inwerkingtreding van dit Protocol en elk vierde jaar daarna;
11.
„Nieuwe stationaire bron”: elke stationaire bron met de bouw of ingrijpende wijziging waarvan een aanvang is gemaakt na het verstrijken van twee jaar na de datum van inwerkingtreding van dit Protocol; en
12.
„Nieuwe mobiele bron”: een motorvoertuig of andere mobiele bron vervaardigd na het verstrijken van twee jaar na de datum van inwerkingtreding van dit Protocol.

Artikel

2 Fundamentele verplichtingen

De Partijen nemen, zo spoedig mogelijk en als eerste stap, doeltreffende maatregelen ter beheersing en/of vermindering van hun nationale jaarlijkse emissies van stikstofoxiden of de grensoverschrijdende stromen van deze verbindingen zodat deze, uiterlijk op 31 december 1994, niet groter zijn dan hun nationale jaarlijkse emissies van stikstofoxiden of de grensoverschrijdende stromen van deze emissies in het kalenderjaar 1987 of een eerder jaar, aan te geven bij ondertekening van of toetreding tot het Protocol mits daarnaast, wat betreft een Partij die zulk een eerder jaar aangeeft, haar nationale gemiddelde jaarlijkse grensoverschrijdende stromen of nationale gemiddelde jaarlijkse emissies van stikstofoxiden in het tijdvak van 1 januari 1987 tot 1 januari 1996 niet groter zijn dan haar grensoverschrijdende stromen in het kalenderjaar 1987.

Bovendien zullen de Partijen in het bijzonder en uiterlijk twee jaar na de datum van inwerkingtreding van dit Protocol:

(a)
nationale emissienormen toepassen op belangrijke nieuwe stationaire bronnen en/of categorieën van bronnen, en op ingrijpend gewijzigde stationaire bronnen in belangrijke categorieën van bronnen, gebaseerd op de beste beschikbare technologieën die economisch uitvoerbaar zijn, in aanmerking nemend de Technische Bijlage;
(b)
nationale emissienormen toepassen op nieuwe mobiele bronnen in alle belangrijke categorieën van bronnen, gebaseerd op de beste beschikbare technologieën die economisch uitvoerbaar zijn, in aanmerking nemend de Technische Bijlage en de desbetreffende besluiten genomen in het kader van het Inland Transport Committee van de Commissie; en
(c)
maatregelen ter bestrijding van verontreiniging invoeren met betrekking tot belangrijke bestaande stationaire bronnen, in aanmerking nemend de Technische Bijlage en de kenmerken van de installatie, de ouderdom en de mate van gebruik daarvan en de noodzaak nodeloze verstoring van de exploitatie te vermijden.

(a)
De Partijen beginnen als tweede stap uiterlijk zes maanden na de datum van inwerkingtreding van dit Protocol onderhandelingen omtrent verdere stappen ter vermindering van de nationale jaarlijkse emissies van stikstofoxiden of de grensoverschrijdende stromen van zodanige emissies, rekening houdend met de beste beschikbare wetenschappelijke en technologische ontwikkelingen, internationaal aanvaarde kritische belastingen en andere gegevens voortvloeiend uit het ingevolge artikel 6 opgestelde werkprogramma.
(b)
Hiertoe werken de Partijen samen teneinde te komen tot vaststelling van:
- (i)
  Kritische belastingen;
- (ii)
  Verminderingen van nationale jaarlijkse emissies van stikstofoxiden of grensoverschrijdende stromen van zodanige emissies zoals vereist voor het verwezenlijken van de op kritische belastingen gebaseerde overeengekomen doelstellingen; en
- (iii)
  Maatregelen en een uiterlijk 1 januari 1996 aanvangend tijdschema om zodanige verminderingen te bereiken.

De Partijen kunnen stringentere maatregelen nemen dan die welke in dit artikel zijn voorgeschreven.

Artikel

3 Uitwisseling van technologie

De Partijen vergemakkelijken, in overeenstemming met hun nationale wetten, voorschriften en gewoonten, de uitwisseling van technologie ter vermindering van emissies van stikstofoxiden, met name door de bevordering van:

(a)
Commerciële uitwisseling van beschikbare technologie;
(b)
Rechtstreekse contacten en samenwerking tussen industrieën, met inbegrip van gezamenlijke ondernemingen;
(c)
Uitwisseling van informatie en ervaring; en
(d)
Verlening van technische bijstand.

Ter bevordering van de in letters (a) tot en met (d) hierboven genoemde activiteiten, scheppen de Partijen gunstige voorwaarden door contacten en samenwerking tussen daarvoor in aanmerking komende organisaties en personen in de particuliere en de openbare sector die technologie, ontwerp- en constructiediensten, apparatuur of financiering kunnen verschaffen, te vergemakkelijken.

De Partijen beginnen uiterlijk zes maanden na de datum van inwerkingtreding van dit Protocol procedures te bestuderen voor het scheppen van gunstiger voorwaarden voor de uitwisseling van technologie ter vermindering van emissies van stikstofoxiden.

Artikel

4 Loodvrije brandstof

De Partijen maken zo spoedig mogelijk en uiterlijk twee jaar na de datum van inwerkingtreding van dit Protocol in voldoende mate loodvrije brandstof verkrijgbaar, in bepaalde gevallen tenminste langs de internationale hoofdverkeerswegen, ter vergemakkelijking van het verkeer van voertuigen die zijn uitgerust met een katalysator.

Artikel

5 Herziening

1

De Partijen onderwerpen dit Protocol regelmatig aan een toetsing, rekening houdend met de beste beschikbare wetenschappelijke verworvenheden en technologische ontwikkeling.

Het eerste onderzoek vindt plaats uiterlijk één jaar na de datum van inwerkingtreding van dit Protocol.

6 Te verrichten werkzaamheden

De Partijen kennen een hoge prioriteit toe aan onderzoek en observaties met betrekking tot de ontwikkeling en toepassing van een op kritische belastingen gebaseerde aanpak, teneinde op wetenschappelijke grondslag de noodzakelijke verminderingen van emissies van stikstofoxiden te bepalen. De Partijen streven er in het bijzonder naar, via nationale onderzoekprogramma's, in het werkplan van het Uitvoerend Orgaan en via andere samenwerkingsprogramma's in het kader van het Verdrag:

(a)
de gevolgen van emissies van stikstofoxiden voor de mens, flora en fauna, water, bodem en materialen na te gaan en te kwantificeren, rekening houdend met de invloed daarop van stikstofoxiden uit andere bronnen dan atmosferische neerslag;
(b)
de geografische spreiding van gevoelige gebieden te bepalen;
(c)
meetmethoden en modelberekeningen te ontwikkelen, met inbegrip van geharmoniseerde methoden voor de berekening van emissies, ter kwantificering van verplaatsing over lange afstand van stikstofoxiden en aanverwante verontreinigende stoffen;
(d)
de ramingen te verbeteren van het rendement en de kosten van technologieën ter beheersing van emissies van stikstofoxiden en de ontwikkeling van verbeterde en nieuwe technologieën te boekstaven; en
(e)
in het kader van een op kritische belastingen gebaseerde aanpak methoden te ontwikkelen om te komen tot een samenhangend geheel van wetenschappelijke, technische en economische gegevens teneinde passende beheersingsstrategieën te bepalen.

Artikel

7 Nationale programma 's, beleidslijnen en strategieën

Ter uitvoering van de verplichtingen ingevolge dit Protocol stellen de Partijen zonder onnodig uitstel nationale programma's, beleidslijnen en strategieën op, die dienen als middel om emissies van stikstofoxiden of de grensoverschrijdende stromen van deze verbindingen te beheersen en te verminderen.

Artikel

8 Uitwisseling van informatie en jaarlijkse verslaglegging

De Partijen wisselen informatie uit door middel van kennisgeving aan het Uitvoerend Orgaan van de nationale programma's, beleidslijnen en strategieën die zij overeenkomstig artikel 7 hebben opgesteld, en door jaarlijkse verslaglegging aan het Orgaan omtrent de vooruitgang die is geboekt in het kader van deze programma's, beleidslijnen en strategieën, alsmede omtrent veranderingen daarin, en in het bijzonder omtrent:

(a)
de niveaus van de nationale jaarlijkse emissies van stikstofoxiden en de daarvoor gehanteerde berekeningsgrondslag;
(b)
voortgang bij de toepassing van nationale emissienormen, vereist ingevolge artikel 2, tweede lid, letters (a) en (b), en de toegepaste of toe te passen nationale emissienormen, alsmede de betrokken bronnen en/of categorieën van bronnen;
(c)
voortgang bij de invoering van de ingevolge artikel 2, tweede lid, letter (c), vereiste maatregelen ter beheersing van de verontreiniging, de betrokken bronnen en de ingevoerde of in te voeren maatregelen;
(d)
voortgang bij het verkrijgbaar maken van loodvrije brandstof;
(e)
maatregelen genomen ter vergemakkelijking van de uitwisseling van technologie; en
(f)
voortgang bij de vaststelling van kritische belastingen.

Deze informatie wordt voor zover mogelijk overgelegd volgens een uniform verslagleggingsschema.

Artikel

9 Berekeningen

Het EMEP verstrekt het Uitvoerend Orgaan, met gebruikmaking van passende modellen en tijdig voor de jaarvergadering van het Uitvoerend Orgaan, berekeningen van stikstofbudgets en tevens van grensoverschrijdende stromen en depositie van stikstofoxiden binnen de geografische reikwijdte van het EMEP. In gebieden buiten de geografische reikwijdte van het EMEP worden modellen gebruikt passend bij de bijzondere omstandigheden van de Partijen bij het Verdrag in die gebieden.

Artikel

10 Technische Bijlage

De Technische Bijlage bij dit Protocol draagt het karakter van een aanbeveling. Zij vormt een integrerend deel van het Protocol.

Artikel

11 Wijzigingen op het Protocol

Elke Partij kan wijzigingen op dit Protocol voorstellen.

De voorgestelde wijzigingen dienen schriftelijk te worden voorgelegd aan de Uitvoerend Secretaris van de Commissie, die alle Partijen daarvan mededeling doet. Het Uitvoerend Orgaan bespreekt de voorgestelde wijzigingen tijdens zijn eerstvolgende jaarlijkse vergadering, mits deze voorstellen door de Uitvoerend Secretaris tenminste 90 dagen voordien onder de Partijen zijn verspreid.

Andere wijzigingen op dit Protocol dan wijzigingen op de Technische Bijlage daarbij dienen bij consensus door de tijdens een vergadering van het Uitvoerend Orgaan aanwezige Partijen te worden aangenomen en worden van kracht voor de Partijen die de wijzigingen hebben aanvaard, op de negentigste dag na de datum waarop tweederde van de Partijen een akte van aanvaarding heeft nedergelegd. Voor elke Partij die wijzigingen aanvaardt nadat tweederde van de Partijen een akte van aanvaarding van de wijzigingen heeft nedergelegd, treden de wijzigingen in werking op de negentigste dag na de datum waarop die Partij haar akte van aanvaarding van de wijzigingen heeft nedergelegd.

Wijzigingen op de Technische Bijlage dienen bij consensus door de tijdens een vergadering van het Uitvoerend Orgaan aanwezige Partijen te worden aangenomen en worden van kracht dertig dagen na de datum waarop zij overeenkomstig het vijfde lid zijn medegedeeld.

De in het derde en het vierde lid bedoelde wijzigingen dienen zo spoedig mogelijk na hun aanneming te worden medegedeeld aan alle Partijen door de Uitvoerend Secretaris.

Artikel

12 Regeling van geschillen

Indien een geschil ontstaat tussen twee of meer Partijen met betrekking tot de uitlegging of de toepassing van dit Protocol, trachten zij tot een oplossing te komen door middel van onderhandelingen of enige andere methode voor de regeling van geschillen die voor de partijen bij het geschil aanvaardbaar is.

Artikel

13 Ondertekening

Dit Protocol staat open voor ondertekening te Sofia van 1 november 1988 tot en met 4 november 1988 en daarna op de Zetel van de Verenigde Naties te New York tot 5 mei 1989 door de lidstaten van de Commissie, alsmede door de Staten die een raadgevende status bij de Commissie hebben krachtens het bepaalde in paragraaf 8 van Resolutie 36 (IV) van de Economische en Sociale Raad van 28 maart 1947, en door organisaties voor regionale economische integratie die door soevereine Staten die lid zijn van de Commissie zijn opgericht en die bevoegd zijn te onderhandelen over internationale overeenkomsten met betrekking tot de onder dit Protocol vallende aangelegenheden en zulke overeenkomsten te sluiten en toe te passen, mits de betrokken Staten en organisaties Partij bij het Verdrag zijn.

Deze organisaties voor regionale economische integratie oefenen, wanneer het aangelegenheden betreft die onder hun bevoegdheid vallen, zelfstandig de rechten uit en vervullen de taken die door dit Protocol aan hun lidstaten worden toegekend. In deze gevallen mogen de lidstaten van deze organisaties deze rechten niet individueel uitoefenen.

Artikel

14 Bekrachtiging, aanvaarding, goedkeuring en toetreding

Dit Protocol dient te worden bekrachtigd, aanvaard of goedgekeurd door de ondertekenaars.

Dit Protocol staat vanaf 6 mei 1989 open voor toetreding door de Staten en organisaties bedoeld in artikel 13, eerste lid.

Een Staat of organisatie die tot dit Protocol toetreedt na 31 december 1993 mag de artikelen 2 en 4 niet later ten uitvoer leggen dan op 31 december 1995.

De akten van bekrachtiging, aanvaarding, goedkeuring of toetreding worden nedergelegd bij de Secretaris-Generaal van de Verenigde Naties, die de functies van depositaris vervult.

Artikel

15 Inwerkingtreding

Dit Protocol treedt in werking op de negentigste dag na de datum waarop de zestiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding is nedergelegd.

Voor elke in artikel 13, eerste lid, bedoelde Staat en organisatie die dit Protocol bekrachtigt, aanvaardt of goedkeurt of daartoe toetreedt na de nederlegging van de zestiende akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, treedt dit Protocol in werking op de negentigste dag na de datum van nederlegging door deze Partij van haar akte van bekrachtiging, aanvaarding, goedkeuring of toetreding.

Artikel

16 Opzegging

Na vijf jaar, te rekenen van de datum waarop dit Protocol in werking is getreden voor een Partij, kan deze Partij te allen tijde dit Protocol opzeggen door middel van een aan de depositaris gerichte schriftelijke kennisgeving. Deze opzegging wordt van kracht op de negentigste dag na de datum waarop de depositaris deze kennisgeving heeft ontvangen of op een in de kennisgeving van opzegging aan te geven latere datum.

Artikel

17 Authentieke teksten

Het origineel van dit Protocol, waarvan de Engelse, de Franse en de Russische tekst gelijkelijk authentiek zijn, wordt nedergelegd bij de Secretaris-Generaal van de Verenigde Naties.

TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd, dit Protocol hebben ondertekend.

TECHNISCHE BIJLAGE

De bijlage heeft tot doel de Partijen bij het Verdrag een richtsnoer te bieden bij het zoeken naar mogelijkheden en technieken voor de beheersing van NO_x ter nakoming van hun verplichtingen ingevolge het Protocol.

Deze bijlage is gebaseerd op gegevens inzake mogelijkheden en technieken voor de vermindering van NO_x-emissies en de prestaties en kosten daarvan als vervat in officiële documentatie van het Uitvoerend Orgaan en de daaraan ondergeschikte lichamen en in documentatie van het Comité voor Binnenlands Vervoer van de ECE en de daaraan ondergeschikte organen, alsmede op aanvullende informatie, verstrekt door van regeringswege aangewezen deskundigen.

De bijlage is gericht op de beheersing van NO_x-emissies, beschouwd als de som van stikstofoxide (NO) en stikstofdioxide (NO₂), uitgedrukt als NO₂, en geeft een aantal maatregelen en technieken ter vermindering van NO_x die een breed scala van kosten en rendementen bestrijken. Tenzij anders is aangegeven, worden deze technieken geacht hun waarde terdege te hebben bewezen op grond van omvangrijke bedrijfservaring, die in de meeste gevallen werd opgedaan over een periode van ten minste vijf jaar. Deze bijlage kan echter niet als een uitputtende opsomming van beheersingsmogelijkheden worden beschouwd; zij heeft tot doel de Partijen een richtsnoer te bieden bij het zoeken naar de beste beschikbare technologieën die economisch haalbaar zijn als uitgangspunt voor nationale emissienormen en bij de invoering van maatregelen ter bestrijding van verontreiniging.

De keuze van maatregelen ter bestrijding van verontreiniging in een bepaald geval hangt af van een aantal factoren, waaronder de desbetreffende bepalingen van wetgevende en regelgevende aard, het verbruikspatroon van primaire energie, de industriële infrastructuur en de economische omstandigheden van de betrokken Partij en, in het geval van stationaire bronnen, de specifieke omstandigheden van de installatie. Tevens dient te worden beseft dat NO_x-bronnen vaak ook bronnen van andere verontreinigende stoffen zijn, zoals zwaveloxiden (SO_x), vluchtige organische verbindingen (VOC’s) en zwevende deeltjes. Bij het uitdenken van beheersingsmogelijkheden voor dergelijke bronnen moeten alle verontreinigende emissies gezamenlijk in aanmerking worden genomen, teneinde het totale bestrijdingseffect te maximaliseren en de inwerking op het milieu vanuit de desbetreffende bron tot een minimum te beperken.

De bijlage is een weergave van de stand van zaken met betrekking tot de kennis van en de ervaring met maatregelen ter beheersing van NO_x, inclusief aanpassing van bestaande bronnen, die was bereikt in 1992 wat stationaire bronnen betreft, en in 1994 wat mobiele bronnen betreft. Aangezien deze kennis en ervaring zich voortdurend ontwikkelen, met name door middel van achtereenvolgens nieuwe voertuigen waarin lage-emissie-technologie is verwerkt, de ontwikkeling van alternatieve brandstoffen door middel van achtereenvolgens aanpassing van en andere strategieën voor bestaande voertuigen, dient de bijlage regelmatig te worden bijgewerkt en gewijzigd.

I

TECHNOLOGIEEN VOOR BEHEERSING VAN NO_x-EMISSIES UIT STATIONAIRE BRONNEN

De verbranding van fossiele brandstoffen is de belangrijkste bron van antropogene NO_x-emissies uit stationaire bronnen. Daarnaast kunnen enkele processen waarbij geen verbranding optreedt in aanzienlijke mate aan deze emissies bijdragen. De belangrijkste categorieën stationaire bronnen van NO_x-emissies, gebaseerd op EMEP/CORINAIR ’90, omvatten:

a.
Openbare elektriciteits-, warmtekracht- en blokverwarmingscentrales:
- i.
  stoomketels;
- ii.
  stationaire verbrandingsturbines en inwendige-verbrandingsmotoren;
b.
Stookinstallaties in de sectoren bedrijven, diensten en huishoudens:
- i.
  bedrijfsketels;
- ii.
  huishoudelijke verwarmingsinstallaties;
c.
Industriële verbrandingsinstallaties en processen waarbij verbranding optreedt:
- i.
  stoomketels en procesfornuizen (geen direct contact tussen rookgas en produkten);
- ii.
  processen (direct contact) (bijvoorbeeld calcinatieprocessen in draaiovens, cement- en kalkproduktie enz., glasproduktie, metallurgische bewerking, pulpproduktie);
d.
Processen waarbij geen verbranding optreedt, (bijvoorbeeld de produktie van salpeterzuur);
e.
Winning, be-/verwerking en distributie van fossiele brandstoffen;
f.
Afvalbehandeling en -verwijdering, bijvoorbeeld verbranding van stedelijk en industrieel afval.

Wat het gebied van de ECE betreft, nemen verbrandingsprocessen (categorieën a, b, c en d) 85% van de NO_x-emissies uit stationaire bronnen voor hun rekening. Processen waarbij geen verbranding optreedt, bijvoorbeeld produktieprocessen, nemen 12% van de totale NO_x-emissies voor hun rekening en de winning, be/werking en distributie van fossiele brandstoffen 3%. Hoewel in veel ECE-landen elektriciteitscentrales in categorie a de grootste stationaire bron van NO_x-emissies zijn, is het wegverkeer in het algemeen de grootste afzonderlijke bron van NO_x- emissies, maar tussen de Partijen bij het Verdrag zijn er verschillen in de onderlinge verhouding van deze bronnen. Bovendien mogen industriële bronnen niet over het hoofd worden gezien.

ALGEMENE MOGELIJKHEDEN VOOR DE VERMINDERING VAN NO_x-EMISSIES UIT VERBRANDING

Algemene mogelijkheden voor NO_x-vermindering zijn:

a.
Maatregelen voor energiebeheer¹⁾Mogelijkheden a i) en ii) zijn verwerkt in de energiestructuur / het energiebeleid van een Partij. Uitvoeringsstadium, rendement en kosten per sector blijven buiten beschouwing.:
- i.
  energiebesparing;
- ii.
  samenstelling van het energiepakket;
b.
Technische mogelijkheden:
- i.
  overschakelen op andere brandstoffen/brandstofreiniging;
- ii.
  andere verbrandingstechnologieën;
- iii.
  wijzigingen in het verbrandingsproces en andere processen;
- iv.
  rookgasbehandeling.

Teneinde het meest efficiënte programma voor NO_x-vermindering te verkrijgen, naast de in letter a genoemde maatregelen, kan een combinatie van de in letter b gegeven technische mogelijkheden worden overwogen. Daarnaast behoeft de combinatie van wijzigingen in het verbrandingsproces en rookgasbehandeling een op de locatie toegesneden evaluatie.

In sommige gevallen kunnen mogelijkheden voor de vermindering van NO_x-emissies ook leiden tot een vermindering van de emissies van CO₂ en SO₂ en andere verontreinigende stoffen.

Energiebesparing

11

Verstandig gebruik van energie (verbetering van rendement en processen, warmtekrachtkoppeling en/of beheer van de vraag) leidt gewoonlijk tot een vermindering van NO_x-emissies.

Samenstelling van het energiepakket

In het algemeen kunnen de NO_x-emissies worden verminderd door het aandeel van de energiebronnen waarvoor geen verbranding nodig is (d.w.z. waterkracht, kern- en windenergie, enz.) in het energiepakket te vergroten. Verdere milieu-effecten moeten echter in beschouwing worden genomen.

Overschakelen op andere brandstoffen/brandstofreiniging

In Tabel 1 zijn de onbestreden NO_x-emissiewaarden weergegeven die voor de verschillende sectoren worden verwacht bij de verbranding van fossiele brandstoffen.

Overschakelen op andere brandstoffen (bijvoorbeeld van brandstoffen met hoog stikstofgehalte op brandstoffen met laag stikstofgehalte of van steenkool op gas) kan leiden tot lagere NO_x-emissies, maar er kan sprake zijn van bepaalde restricties, zoals de beschikbaarheid van brandstoffen waarbij weinig NO_x vrijkomt (bijvoorbeeld aardgas op bedrijfsniveau) en de mogelijkheden om bestaande ovens aan andere brandstoffen aan te passen. In veel ECE-landen worden sommige verbrandingsinstallaties op steenkool of olie vervangen door gasgestookte verbrandingsinstallaties.

Het verwijderen van stikstof uit brandstof is geen rendabele oplossing. Uitbreiding van de toepassing van de kraaktechnologie in raffinaderijen leidt echter ook tot een verlaging van het stikstofgehalte in het eindprodukt.

Andere verbrandingstechnologieën

Er zijn verbrandingstechnologieën met een beter thermisch rendement en minder NO_x-emissies. Dit zijn o.a.:

a.
warmtekrachtkoppeling met gebruikmaking van gasturbines en motoren;
b.
wervelbedverbranding (FBC): vast bed (BFBC) en circulerend bed (CFBC);
c.
stoom/gasturbine-cyclus met geı¨ntegreerde kolenvergassing (IGCC);
d.
stoom/gasturbine-cyclus (CCGT).

De emissiewaarden bij deze technieken zijn beknopt weergegeven in Tabel 1.

Stationaire verbrandingsturbines kunnen ook in bestaande conventionele elektriciteitscentrales worden geïntegreerd (zogeheten „topping”). Het totale rendement kan met 5 tot 6% toenemen, maar de bereikbare NO_x-vermindering is afhankelijk van de omstandigheden die worden bepaald door de locatie en de gebruikte brandstof. Gasturbines en -motoren worden op grote schaal toegepast bij warmtekrachtkoppeling. Doorgaans kan een energiebesparing van circa 30% worden bereikt. Bij beide technieken is aanzienlijke vooruitgang geboekt in het verminderen van NO_x-emissies door middel van vernieuwingen in de verbrandings- en systeemtechnologie. Hiervoor zijn echter ingrijpende veranderingen in het bestaande ketelsysteem noodzakelijk.

Wervelbedverbranding (FBC) is een verbrandingstechnologie voor het verbranden van steenkool en bruinkool, maar hiermee kunnen ook andere vaste brandstoffen worden verbrand, zoals petroleumcokes en laagwaardige brandstoffen, zoals afval, turf en hout. Bovendien kunnen de emissies worden verminderd door middel van een geïntegreerde verbrandingsregeling in het systeem. Een nieuwere vorm van wervelbedverbranding is wervelbedverbranding onder druk (PFBC), die thans op de markt wordt gebracht voor de opwekking van elektriciteit en warmte. De totale bestaande capaciteit van wervelbedverbranding bedraagt ca. 30.000 MW_th (250 tot 350 installaties), waaronder 8.000 MW_th in installaties met een capaciteit van > 50 MW_th.

Bij het IGCC-proces wordt kolenvergassing geïntegreerd met elektriciteitsopwekking in gecombineerde cyclus van gas- en stoomturbine. De vergaste kool wordt verbrand in de verbrandingskamer van de gasturbine. Deze technologie bestaat ook voor residuen van zware olie en bitumenemulsie. De bestaande capaciteit bedraagt thans ca. 1.000 MW_el (5 installaties).

Momenteel worden gasgestookte elektriciteitscentrales met een rendement van 48-52% en verlaagde NO_x-emissies gepland die gebruik maken van gecombineerde cyclus en geavanceerde gasturbines.

Wijzigingen in het verbrandingsproces en andere processen

Er worden maatregelen toegepast om de vorming van NO_x tijdens het verbrandingsproces te beperken. Deze omvatten regeling van de verbrandingsluchtverhouding, vlamtemperatuur, brandstof/lucht-verhouding, enz. De onderstaande verbrandingstechnieken zijn, hetzij afzonderlijk, hetzij in combinatie, beschikbaar voor nieuwe en bestaande installaties. Zij worden op grote schaal toegepast in de elektriciteitssector en op sommige gebieden van de industriesector:

a.
verbranding met geringe lucht-overmaat (LEA);¹⁾Gangbare aanpassingsmaatregelen, met beperkt rendement en beperkte toepassingsmogelijkheden.
b.
verminderde-lucht-voorverwarming (RAP);¹⁾Gangbare aanpassingsmaatregelen, met beperkt rendement en beperkte toepassingsmogelijkheden.
c.
brander uit bedrijf (getrapte luchtvervoer) (BOOS);¹⁾Gangbare aanpassingsmaatregelen, met beperkt rendement en beperkte toepassingsmogelijkheden.
d.
brander-onbalans (getrapte brandstoftoevoer) (BBF);¹⁾Gangbare aanpassingsmaatregelen, met beperkt rendement en beperkte toepassingsmogelijkheden.
e.
lage-NO_x-branders (LNB);¹⁾Gangbare aanpassingsmaatregelen, met beperkt rendement en beperkte toepassingsmogelijkheden. en ²⁾Geaccepteerde moderne techniek in nieuwe installaties.
f.
rookgasrecirculatie (FGR);²⁾Geaccepteerde moderne techniek in nieuwe installaties.
g.
getrapte verbranding/bovenluchtbedrijf (OFA);¹⁾Gangbare aanpassingsmaatregelen, met beperkt rendement en beperkte toepassingsmogelijkheden. en ²⁾Geaccepteerde moderne techniek in nieuwe installaties.
h.
in-vuurhaard-NO_x-reductie (IFNR);³⁾Uitgevoerd in op zichzelf staande grote installaties in de bedrijfssector; slechts beperkte praktijkervaring.
i.
water-/stoominjectie en arm-mengsel-stooktechniek met voormenging.⁴⁾Voor verbrandingsturbines.

De emissiewaarden dankzij de toepassing van deze technieken zijn beknopt weergegeven in Tabel 1 (hoofdzakelijk op basis van ervaring in elektriciteitscentrales).

Het verbrandingsproces wordt voortdurend verder ontwikkeld en verbeterd. In-vuurhaard-NO_x-reductie wordt getest in enkele grote demonstratie-installaties, terwijl fundamentele wijzigingen in het verbrandingsproces hoofdzakelijk worden doorgevoerd in het ontwerp van stoomketels en branders. De ontwerpen van moderne vuurhaarden omvatten bijvoorbeeld poorten voor bovenluchtverbranding en gas-/ oliebranders zijn geschikt gemaakt voor rookgasrecirculatie. De laatste generatie lage-NO_x-branders kent een combinatie van zowel getrapte luchttoevoer als getrapte brandstoftoevoer. In de afgelopen jaren is in lidstaten van de ECE sprake van een opmerkelijke toeneming van volledige aanpassing van bestaande installaties om wijzigingen in het verbrandingsproces te verwezenlijken. In 1992 was er in totaal ca. 150.000 MW geïnstalleerd.

Rookgasbehandeling

Rookgasbehandeling heeft tot doel reeds gevormde NO_x te verwijderen en wordt ook betiteld als secundaire maatregelen. Het is gebruikelijk om, waar mogelijk, primaire maatregelen toe te passen als eerste stap ter vermindering van NO_x alvorens tot rookgasbehandeling over te gaan. De geaccepteerde moderne methoden voor rookgasbehandeling zijn alle gebaseerd op de verwijdering van NO_x door middel van een droog chemisch proces.

Deze methoden zijn de volgende:

a.

De emissiewaarden voor SCR en SNCR zijn beknopt weergegeven in Tabel 1. De gegevens zijn gebaseerd op de praktijkervaring in een groot aantal installaties waar deze technieken zijn toegepast. In 1991 waren er in het Europese deel van de ECE ca. 130 SCR-installaties, overeenkomend met 50.000 MW_el, 12 SNCR-installaties (2.000 MW_el), 1 AC-installatie (250 MW_el) en 2 installaties met gecombineerde katalytische processen (400 MW_el) gebouwd. Het rendement van NO_x-verwijdering bij AC en gecombineerde katalytische processen is vergelijkbaar met dat van SCR.

BEHEERSINGSTECHNIEKEN VOOR ANDERE SECTOREN

Anders dan bij de meeste verbrandingsprocessen, heeft de toepassing van wijzigingen in het verbrandingsproces en/of andere processen in de industriesector vele procesgebonden beperkingen. In cementovens of glassmeltovens zijn bijvoorbeeld bepaalde hogere temperaturen noodzakelijk om de kwaliteit van het produkt te garanderen. Wijzigingen in het verbrandingsproces die doorgaans worden toegepast zijn getrapte verbranding/lage-NO_x-branders, rookgasrecirculatie en procesoptimalisatie (bijvoorbeeld precalcinatie in cementovens).

NEVENEFFECTEN / BIJPRODUKTEN

De onderstaande neveneffecten zullen geen beletsel vormen voor de toepassing van een technologie of methode, maar moeten in overweging worden genomen wanneer er verschillende mogelijkheden voor NO_x-vermindering zijn. Deze neveneffecten kunnen in het algemeen echter door een goed ontwerp en een goede bedrijfsvoering worden beperkt:

a.
wijzigingen in het verbrandingsproces:
- mogelijke daling van het totale rendement;
- toename van CO-vorming en koolwaterstofemissies;
- corrosie ten gevolge van reducerende atmosfeer;
- mogelijke N₂O-vorming in systemen met wervelbedverbranding;
- mogelijke toename van het koolstofgehalte in de vliegas;
b.
SCR:
- NH₃ in de vliegas;
- vorming van ammoniumzouten in installaties verderop in het proces;
- deactivering van de katalysator;
- toenemende omzetting van SO₂ in SO₃;
c.
SNCR:
- NH₃ in de vliegas;
- vorming van ammoniumzouten in installaties verderop in het proces;
- mogelijke vorming van N₂O.

Wat bijprodukten betreft, zijn gedeactiveerde katalysatoren bij het SCR-proces de enige produkten van belang. Omdat deze als afval worden aangemerkt, kunnen zij niet zonder meer worden verwijderd; er bestaan echter mogelijkheden voor hergebruik.

De produktie van de reagentia ammoniak en ureum voor rookgasbehandeling omvat een aantal afzonderlijke stadia waarvoor energie en grondstoffen nodig zijn. Opslagsystemen voor ammoniak vallen onder de desbetreffende veiligheidswetgeving en deze systemen zijn ontworpen als volledig gesloten systemen, met als resultaat een minimum aan ammoniakemissies. Het gebruik van NH₃ staat echter niet ter discussie, zelfs niet wanneer men de indirecte emissies verband houdend met de produktie en het vervoer van NH₃ in aanmerking neemt.

MONITORING EN RAPPORTAGE

De maatregelen genomen ter uitvoering van nationale strategieën en beleidslijnen ter bestrijding van luchtvervuiling omvatten voorschriften van wetgevende en regelgevende aard, economische prikkels en ontmoedigingsmaatregelen, alsmede technologische vereisten (beste beschikbare technologie).

In het algemeen kunnen emissiebeperkende normen per emissiebron worden opgesteld, naar gelang de grootte van de installatie, de werkwijze, de verbrandingstechnologie, het type brandstof en naar gelang het een nieuwe of een bestaande installatie betreft. Een andere benadering die ook wordt gehanteerd, is een doel vaststellen voor de vermindering van de totale NO_x-emissies uit een groep bestaande bronnen en de Partijen toestaan te kiezen waar maatregelen moeten worden genomen om dit doel te bereiken („bubble concept”).

Op het beperken van de NO_x-emissies tot de binnen het kader van de nationale wetgeving vastgestelde waarden dient te worden toegezien door middel van een permanent monitoring- en rapportagesysteem en hiervan dient verslag te worden gedaan aan de toezichthoudende autoriteiten.

Er zijn verscheidene monitoringsystemen beschikbaar, die werken met zowel continue als niet-continue meetmethoden. De kwaliteitseisen verschillen echter tussen de Partijen. De metingen dienen te worden verricht door gekwalificeerde instituten en met goedgekeurde meet-/ monitoringsystemen. Hiertoe zou een stelsel van certificering de beste garantie kunnen bieden.

In het kader van moderne geautomatiseerde monitoringsystemen en procesbesturingsapparatuur levert rapportage geen problemen op. Het verzamelen van gegevens voor verder gebruik is een geaccepteerde moderne techniek. De gegevens die aan de bevoegde autoriteiten moeten worden doorgegeven, verschillen echter van Partij tot Partij. Om deze beter te kunnen vergelijken, zouden de te rapporteren gegevens en voorschriften moeten worden geharmoniseerd. Harmonisatie is ook gewenst voor het waarborgen van de kwaliteit van meet-/monitoringsystemen. Dit moet in aanmerking worden genomen bij het vergelijken van gegevens afkomstig van verschillende Partijen.

Teneinde onderlinge afwijkingen en tegenstrijdigheden te vermijden, moeten belangrijke aangelegenheden en parameters, met inbegrip van de onderstaande, goed worden omschreven:

omschrijven van de normen uitgedrukt in ppmv, mg/m3, g/GJ, kg/h of kg/t van het produkt. De meeste van deze eenheden moeten worden berekend en nader worden gespecificeerd wat betreft gastemperatuur, vochtigheid, druk, zuurstofgehalte of thermische belasting;
omschrijven van het tijdvak waarover de normen kunnen worden gemiddeld, uitgedrukt in uren, maanden of een jaar;
omschrijven van de duur van storingen en de bijbehorende noodregelingen betreffende het overbruggen van monitoringsystemen of het buiten werking stellen van de installatie;
omschrijven van de methoden voor het achteraf aanvullen van gegevens die ontbreken of verloren zijn gegaan ten gevolge van een storing in de apparatuur;
omschrijven van de reeks parameters die moet worden gemeten. De noodzakelijke informatie kan variëren, afhankelijk van het soort industriële processen. Dit heeft tevens betrekking op de plaatsing van het meetpunt binnen het systeem.

II

TECHNOLOGIEEN VOOR BEHEERSING VAN NO_x-EMISSIES UIT MOBIELE BRONNEN

BELANGRIJKSTE MOBIELE BRONNEN VAN NO_x-EMISSIES

De voornaamste mobiele bronnen van antropogene NO_x-emissies omvatten:

Wegvoertuigen:

op benzine en op dieselolie rijdende personenauto’s;
lichte bedrijfswagens;
zware vrachtwagens;
motorfietsen en bromfietsen;
tractoren (land- en bosbouw).

Terreinvoertuigen:

machines voor de landbouw, de industrie en de bouwnijverheid.

Overige mobiele bronnen:

spoorwegmaterieel;
schepen en andere zeevaartuigen;
luchtvaartuigen.

In veel ECE-landen is het wegvervoer een belangrijke bron van antropogene NO_x-emissies, die tot tweederde van de totale nationale emissies voor haar rekening neemt. Huidige op benzine rijdende voertuigen nemen tot tweederde van de NO_x-emissies van het totale nationale wegvervoer voor hun rekening. In een aantal gevallen zullen de NO_x-emissies van het zware vrachtverkeer echter uitstijgen boven de afnemende emissies van personenauto’s.

In veel landen zijn wettelijke regelingen ingevoerd ter beperking van de emissie van verontreinigende stoffen uit wegvoertuigen. Voor terreinvoertuigen zijn in enkele ECE-landen emissienormen ingevoerd, mede voor NO_x; bij de ECE zelf zijn deze in voorbereiding. De NO_x- emissies uit deze overige bronnen kunnen aanzienlijk zijn.

Totdat andere gegevens beschikbaar zijn, worden in deze bijlage alleen wegvoertuigen behandeld.

ALGEMENE ASPECTEN VAN TECHNOLOGIEEN VOOR DE BEHEERSING VAN NO_x-EMISSIES VAN WEGVOERTUIGEN

In deze bijlage gaat het om personenauto’s, lichte bedrijfswagens, motorfietsen, bromfietsen en zware vrachtwagens.

In deze bijlage komen zowel nieuwe als in gebruik zijnde voertuigen aan de orde, waarbij de aandacht voornamelijk gericht is op NO_x-emissiebeheersing voor nieuwe typen voertuigen.

De cijfers betreffende de kosten voor de verschillende technologieën zijn geen detailhandelsprijzen, maar verwachte produktiekosten.

Het is van belang te verzekeren dat de emissienormen voor nieuwe voertuigen worden gehandhaafd wanneer zij in gebruik zijn genomen. Dit kan geschieden door middel van inspectie- en onderhoudsprogramma’s waarin gelijkvormigheid van de produktie, duurzaamheid voor de volledige gebruiksduur, garantie op emissiebeheersingsonderdelen en terugname van voertuigen die gebreken vertonen, worden verzekerd.

Fiscale voordelen kunnen de versnelde invoering van wenselijke technologie bevorderen. Aanpassing is van beperkt nut voor de vermindering van NO_x-emissies en is wellicht moeilijk te verwezenlijken voor meer dan een klein percentage van alle voertuigen.

Voor technologieën waarbij gebruik wordt gemaakt van katalysatoren bij benzinemotoren met vonkontsteking is loodvrije brandstof vereist, die algemeen verkrijgbaar dient te zijn. De toepassing van nabehandelingstechnologieën bij dieselmotoren, zoals driewegkatalysatoren of deeltjesvangers, vereist het gebruik van laagzwavelige brandstoffen (zwavelgehalte maximaal 0,05%).

De beheersing van stedelijk verkeer en verkeer over lange afstanden, die in deze bijlage niet nader wordt uitgewerkt, is niettemin van belang als doelmatige bijkomende aanpak ter vermindering van NO_x- emissies. Maatregelen ter vermindering van NO_x-emissies en andere luchtverontreinigende stoffen kunnen het opleggen van snelheidslimieten en doelmatige verkeersbeheersing omvatten. De belangrijkste maatregelen voor verkeersbeheersing zijn gericht op het veranderen van de vervoerswijzeverdeling (modal split) wat betreft het openbaar vervoer en het vervoer over lange afstanden, met name in gevoelige gebieden, zoals steden of de Alpen, door het vervoer over te hevelen van de weg naar het spoor door middel van tactische, structurele, financiële en beperkende elementen en tevens via optimalisering van de logistiek van de distributiesystemen. Zij zullen tevens bevorderlijk zijn voor het verminderen van de overige schadelijke gevolgen van de toename van het verkeer, zoals geluidsoverlast, verkeersopstoppingen, enz.

Er zijn verscheidene technologieën en keuzemogelijkheden m.b.t. het ontwerp beschikbaar die gelijktijdige beheersing van diverse verontreinigende stoffen mogelijk maken. Bij enkele toepassingen zijn tegengestelde effecten ondervonden bij de vermindering van NO_x-emissies (bijv. benzine- of dieselmotoren zonder katalysator). Dit kan veranderen met de toepassing van nieuwe technologieën (bijv. reinigende nabehandelingsvoorzieningen en elektronica. Dieselbrandstof met een vernieuwde samenstelling en brandstof die additieven bevat die de NO_x na de verbranding reduceren, zouden ook een rol kunnen spelen in een strategie om de emissie van NO_x uit dieselvoertuigen tegen te gaan.

De basis voor vergelijking in tabel 2 is technologie B, een nietkatalytische technologie, ontwikkeld om te voldoen aan de vereisten van de Verenigde Staten voor 1973-74 of van ECE-Reglement 15-04¹⁾Vervangen door Reglement nr. 83. ingevolge de Overeenkomst van 1958 betreffende het aannemen van eenvormige goedkeuringsvoorwaarden en de wederzijdse erkenning van goedkeuring van uitrustingsstukken en onderdelen van motorrijtuigen. De tabel geeft ook de karakteristieke emissieniveaus weer voor ongeregelde en geregelde katalysatoren, alsmede de kosten ervan.

Het niveau „zonder emissiebeheersing” (A) in tabel 2 verwijst naar de situatie in de ECE-regio in 1970, maar kan in bepaalde gebieden nog steeds voorkomen.

Het emissieniveau in tabel 2 geeft emissies weer die zijn gemeten door middel van standaard-beproevingsprocedures. Emissies uit voertuigen op de weg kunnen hiervan afwijken onder invloed van, onder meer, de omgevingstemperatuur, de rijomstandigheden (met name bij hogere snelheid), de brandstof en het onderhoud. Het in tabel 2 aangegeven verminderingspotentieel wordt echter als representatief beschouwd voor de verminderingen die in de praktijk haalbaar zijn.

De meest doelmatige momenteel beschikbare technologie voor de vermindering van NO_x-emissies is keuzemogelijkheid E. Deze technologie levert grote verminderingen op van emissies van NO_x, vluchtige organische verbindingen (VOC’s) en CO.

In reactie op regelgeving voor verdere vermindering van NO_x- emissies (bijv. voertuigen met lage emissieniveaus in Californië) zijn verbeterde geregelde drieweg-katalysatoren in ontwikkeling (keuzemogelijkheid F). De verbeteringen betreffen vooral motormanagement, zeer nauwkeurige beheersing van de verhouding lucht/brandstof, zwaardere belasting van de katalysator, ingebouwde diagnosesystemen (OBD’s) en andere moderne beheersingstechnieken.

Motorfietsen en bromfietsen

Hoewel de feitelijke NO_x-emissies van motorfietsen en bromfietsen zeer laag zijn (bijv. bij tweetaktmotoren), dienen ze toch in aanmerking te worden genomen. Terwijl de VOC-emissies van deze voertuigen door vele Partijen bij het Verdrag zullen worden beperkt, kunnen de NO_x-emissies toenemen (bijv. bij viertaktmotoren). In het algemeen zijn dezelfde technologische keuzemogelijkheden als beschreven voor op benzine rijdende personenauto’s van toepassing. In Oostenrijk en Zwitserland worden reeds strenge NO_x-emissienormen gehanteerd.

Zware, op dieselolie rijdende vrachtwagens

In tabel 3 zijn drie technologische keuzemogelijkheden beknopt weergegeven. De referentieconfiguratie van motoren is die van de drukgevulde dieselmotor. De tendens is dat deze worden vervangen door drukgevulde motoren met tussenkoeling, moderne brandstofinspuitsystemen en elektronische regeling. Deze tendens zou kunnen leiden tot verbetering van het referentiebrandstofverbruik. Vergelijkende schattingen van het brandstofverbruik zijn niet in de tabel opgenomen.

BEHEERSINGSTECHNIEKEN VOOR IN GEBRUIK ZIJNDE VOERTUIGEN

Volledige gebruiksduur, terugname en garantie

Ter bevordering van duurzame emissiebeheersingssystemen dient aandacht te worden geschonken aan emissienormen die niet mogen worden overschreden gedurende de „volledige gebruiksduur” van het voertuig. Er zijn toezichtprogramma’s nodig om zorg te dragen voor de naleving van dit vereiste. Dergelijke programma’s houden in dat fabrikanten voertuigen die niet aan de vereiste normen voldoen, moeten terugnemen. Om te verzekeren dat de eigenaar geen met de produktie verband houdende problemen ondervindt, dienen fabrikanten garanties te bieden voor emissiebeheersingsonderdelen.

Er mag geen sprake zijn van instrumenten die de doelmatigheid van emissiebeheersingssystemen verminderen of deze buiten werking stellen gedurende welke rijomstandigheden dan ook, behalve onder omstandigheden die noodzakelijk zijn voor probleemloos rijden (bijv. een koude start).

Inspectie en onderhoud

Het inspectie- en onderhoudsprogramma heeft een belangrijke bijkomende functie. Het kan eigenaren van voertuigen aanmoedigen tot regelmatig onderhoud, en ontmoedigen met de emissiebeheersingsonderdelen te knoeien of deze buiten werking te stellen, zowel door rechtstreeks toezicht als door voorlichting. Via inspectie dient te worden geverifieerd of de emissiebeheersingsonderdelen functioneren zoals zij oorspronkelijk werkten. Tevens dient hiermee te worden gewaarborgd dat de emissiebeheersingssystemen niet zijn verwijderd.

Betere monitoring van de emissiebeheersing kan worden bereikt met behulp van ingebouwde diagnosesystemen (OBD’s) die het functioneren van de emissiebeheersingsonderdelen controleren, foutcodes opslaan voor nader onderzoek en, in geval van een defect, de bestuurder hierop attenderen, teneinde het te doen repareren.

Inspectie- en onderhoudsprogramma’s kunnen gunstig zijn voor alle soorten technologie voor emissiebeheersing, door te waarborgen dat de emissieniveaus van nieuwe voertuigen worden gehandhaafd. Bij voertuigen met emissiebeheersing is het van wezenlijk belang ervoor te zorgen dat de technische normen en instellingen van nieuwe voertuigen worden gehandhaafd, teneinde verslechtering ten aanzien van alle belangrijke verontreinigende stoffen, met inbegrip van NO_x, te vermijden.
