The States Parties to this Protocol,
Being Parties to the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation,
Recognizing that the reasons for which the Convention was elaborated also apply to fixed platforms located on the continental shelf,
Taking account of the provisions of that Convention,
Affirming that matters not regulated by this Protocol continue to be governed by the rules and principles of general international law,
Have agreed as follows:
The provisions of articles 5 and 7 and of articles 10 to 16 of the Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation (hereinafter referred to as “the Convention”) shall also apply mutatis mutandis to the offences set forth in article 2 of this Protocol where such offences are committed on board or against fixed platforms located on the continental shelf.
Any person commits an offence if that person unlawfully and intentionally:
seizes or exercises control over a fixed platform by force or threat thereof or any other form of intimidation; or
performs an act of violence against a person on board a fixed platform if that act is likely to endanger its safety; or
destroys a fixed platform or causes damage to it which is likely to endanger its safety; or
places or causes to be placed on a fixed platform, by any means whatsoever, a device or substance which is likely to destroy that fixed platform or likely to endanger its safety; or
injures or kills any person in connection with the commission or the attempted commission of any of the offences set forth in subparagraphs (a) to (d).
Any person also commits an offence if that person:
attempts to commit any of the offences set forth in paragraph 1; or
abets the commission of any such offences perpetrated by any person or is otherwise an accomplice of a person who commits such an offence; or
threatens, with or without a condition, as is provided for under national law, aimed at compelling a physical or juridical person to do or refrain from doing any act, to commit any of the offences set forth in paragraph 1, subparagraphs (b) and (c), if that threat is likely to endanger the safety of the fixed platform.
Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 2 when the offence is committed:
against or on board a fixed platform while it is located on the continental shelf of that State; or
by a national of that State.
A State Party may also establish its jurisdiction over any such offence when:
it is committed by a stateless person whose habitual residence is in that State;
during its commission a national of that State is seized, threatened, injured or killed; or
it is committed in an attempt to compel that State to do or abstain from doing any act.
Any State Party which has established jurisdiction mentioned in paragraph 2 shall notify the Secretary-General of the International Maritime Organization (hereinafter referred to as “the Secretary-General”). If such State Party subsequently rescinds that jurisdiction, it shall notify the Secretary-General.
Each State Party shall take such measures as may be necessary to establish its jurisdiction over the offences set forth in article 2 in cases where the alleged offender is present in its territory and it does not extradite him to any of the States Parties which have established their jurisdiction in accordance with paragraphs 1 and 2 of this article.
Nothing in this Protocol shall affect in any way the rules of international law pertaining to fixed platforms located on the continental shelf.
This Protocol shall be open for signature at Rome on 10 March 1988 and at the Headquarters of the International Maritime Organization (hereinafter referred to as “the Organization”) from 14 March 1988 to 9 March 1989 by any State which has signed the Convention. It shall thereafter remain open for accession.
States may express their consent to be bound by this Protocol by:
signature without reservation as to ratification, acceptance or approval; or
signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or
accession.
Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General.
Only a State which has signed the Convention without reservation as to ratification, acceptance or approval, or has ratified, accepted, approved or acceded to the Convention may become a Party to this Protocol.
This Protocol shall enter into force ninety days following the date on which three States have either signed it without reservation as to ratification, acceptance or approval, or have deposited an instrument of ratification, acceptance, approval or accession in respect thereof. However, this Protocol shall not enter into force before the Convention has entered into force.
For a State which deposits an instrument of ratification, acceptance, approval or accession in respect of this Protocol after the conditions for entry into force thereof have been met, the ratification, acceptance, approval or accession shall take effect ninety days after the date of such deposit.
This Protocol may be denounced by any State Party at any time after the expiry of one year from the date on which this Protocol enters into force for that State.
Denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary-General.
A denunciation shall take effect one year, or such longer period as may be specified in the instrument of denunciation, after the receipt of the instrument of denunciation by the Secretary-General.
A denunciation of the Convention shall be deemed to be a denunciation of this Protocol by that Party.
A conference for the purpose of revising or amending this Protocol may be convened by the Organization.
The Secretary-General shall:
inform all States which have signed this Protocol or acceded thereto, and all Members of the Organization, of:
each new signature or deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof;
the date of entry into force of this Protocol;
the deposit of any instrument of denunciation of this Protocol together with the date on which it is received and the date on which the denunciation takes effect;
the receipt of any declaration or notification made under this Protocol or under the Convention, concerning this Protocol;
transmit certified true copies of this Protocol to all States which have signed this Protocol or acceded thereto.
As soon as this Protocol enters into force, a certified true copy thereof shall be transmitted by the Depositary to the Secretary-General of the United Nations for registration and publication in accordance with Article 102 of the Charter of the United Nations.
This Protocol is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic.
IN WITNESS WHEREOF the undersigned, being duly authorized by their respective Governments for that purpose, have signed this Protocol.

Als partijen bij het Verdrag tot bestrijding van wederrechtelijke gedragingen tegen de veiligheid van de zeevaart,
Erkennend dat de redenen waarom het Verdrag werd opgesteld ook gelden voor vaste platforms op het continentale plat,
Rekening houdend met de bepalingen van dat Verdrag,
Bevestigend dat aangelegenheden die niet door dit Protocol worden geregeld, beheerst blijven door de regelen en beginselen van algemeen internationaal recht,
Zijn als volgt overeengekomen:
De bepalingen van de artikelen 5 en 7 en van de artikelen 10 tot en met 16 van het Verdrag tot bestrijding van wederrechtelijke gedragingen gericht tegen de veiligheid van de zeevaart (hierna te noemen „het Verdrag”) zijn mutatis mutandis ook van toepassing op de strafbare feiten genoemd in artikel 2 van dit Protocol, indien bedoelde strafbare feiten worden gepleegd aan boord van of zijn gericht tegen vaste platforms op het continentale plat.
Ingeval dit Protocol niet van toepassing is op grond van het eerste lid, is het niettemin van toepassing indien de dader of de vermoedelijke dader wordt aangetroffen op het grondgebied van een andere Staat-Partij dan de Staat in de binnenwateren of de territoriale zee waarvan het vaste platform zich bevindt.
Aan een strafbaar feit maakt zich schuldig hij die wederrechtelijk en opzettelijk:
door geweld, bedreiging met geweld of enige andere vorm van vreesaanjaging een vast platform in zijn macht brengt of houdt; of
een daad van geweld begaat tegen een persoon aan boord van een vast platform, indien daardoor de veiligheid van dat platform in gevaar kan worden gebracht; of
een vast platform vernielt of daaraan schade toebrengt waardoor de veiligheid ervan in gevaar kan worden gebracht; of
op een vast platform, op welke wijze dan ook, een voorwerp of substantie plaatst of doet plaatsen waarmee het vaste platform kan worden vernield of de veiligheid ervan in gevaar kan worden gebracht; of
in verband met het plegen of de poging tot het plegen van één van de sub (a) tot en met (d) genoemde strafbare feiten een persoon verwondt of doodt.
Aan een strafbaar feit maakt zich eveneens schuldig hij die:
een poging doet een in het eerste lid genoemd strafbaar feit te plegen; of
een dergelijk strafbaar feit uitlokt of anderszins medeplichtige is van een persoon die zulk een strafbaar feit pleegt; of
dreigt één der in het eerste lid sub (b) en (c) genoemde strafbare feiten te plegen, indien door deze dreiging de veiligheid van het vaste platform in gevaar kan worden gebracht, al dan niet gepaard gaand met een voorwaarde zoals voorzien in de nationale wetgeving, teneinde een natuurlijke persoon of een rechtspersoon te dwingen tot het verrichten of het zich onthouden van een handeling.
Elke Staat-Partij neemt de maatregelen die nodig zijn om zijn rechtsmacht vast te leggen met betrekking tot de in artikel 2 genoemde strafbare feiten, wanneer het strafbare feit wordt gepleegd:
tegen of aan boord van een vast platform dat is gelegen op het continentale plat van die Staat; of
door een onderdaan van die Staat.
Een Staat-Partij kan eveneens zijn rechtsmacht met betrekking tot genoemde strafbare feiten vastleggen, wanneer:
het feit wordt gepleegd door een staatloze die in die Staat zijn gewone verblijfplaats heeft; of
tijdens het plegen van het feit een onderdaan van die Staat wordt vastgehouden, bedreigd, verwond of gedood; of
het feit wordt gepleegd in een poging die Staat te dwingen tot het verrichten of het zich onthouden van een handeling.
Elke Staat-Partij die de in het tweede lid bedoelde rechtsmacht heeft vastgelegd, stelt de Secretaris-Generaal van de Internationale Maritieme Organisatie (hierna te noemen „de Secretaris-Generaal”) daarvan in kennis. Indien een Staat-Partij daarna deze wetgeving intrekt, stelt hij de Secretaris-Generaal daarvan in kennis.
Elke Staat-Partij neemt de maatregelen die nodig zijn om zijn rechtsmacht vast te leggen met betrekking tot de in artikel 2 genoemde strafbare feiten ingeval de vermoedelijke dader zich op zijn grondgebied bevindt en hij deze niet uitlevert aan een Staat-Partij die zijn rechtsmacht heeft vastgelegd in overeenstemming met het eerste en het tweede lid van dit artikel.
De regelen van internationaal recht met betrekking tot vaste platforms gelegen op het continentale plat worden op generlei wijze door dit Protocol aangetast.
Dit Protocol staat voor ondertekening open te Rome op 10 maart 1988 en op de zetel van de Internationale Maritieme Organisatie (hierna te noemen „de Organisatie”) van 14 maart 1988 tot 9 maart 1989 door alle Staten die het Verdrag hebben ondertekend. Daarna blijft het openstaan voor toetreding.
Staten kunnen van hun instemming door dit Protocol te worden gebonden doen blijken door middel van:
ondertekening zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring; of
ondertekening onder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, gevolgd door bekrachtiging, aanvaarding of goedkeuring; of
toetreding.
Bekrachtiging, aanvaarding, goedkeuring of toetreding geschiedt door middel van nederlegging van een daartoe strekkende akte bij de Secretaris-Generaal.
Slechts een Staat die het Verdrag zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring heeft ondertekend, of het heeft bekrachtigd, aanvaard of goedgekeurd, dan wel daartoe is toegetreden, kan Partij bij dit Protocol worden.
Dit Protocol treedt in werking negentig dagen na de datum waarop drie Staten het hebben ondertekend zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, of een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding hebben nedergelegd. Dit Protocol treedt evenwel niet in werking voordat het Verdrag in werking is getreden.
Voor een Staat die een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding met betrekking tot dit Protocol heeft nedergelegd nadat aan de voorwaarden voor inwerkingtreding is voldaan, treedt de bekrachtiging, aanvaarding, goedkeuring of toetreding in werking negentig dagen na de datum van nederlegging.
Dit Protocol kan door elke Staat-Partij te allen tijde worden opgezegd na het verstrijken van een jaar na de datum waarop het Protocol voor die Staat in werking is getreden.
Opzegging geschiedt door middel van nederlegging van een akte van opzegging bij de Secretaris-Generaal.
Een opzegging wordt van kracht één jaar, of zoveel later als aangegeven in de akte van opzegging, na de ontvangst van de akte van opzegging door de Secretaris-Generaal.
Opzegging van het Verdrag door een Staat-Partij wordt beschouwd als opzegging van het Protocol door die Partij.
Door de Organisatie kan een conferentie worden belegd met het oog op herziening of wijziging van dit Protocol.
De Secretaris-Generaal:
doet alle Staten die dit Protocol hebben ondertekend of hiertoe zijn toegetreden en alle leden van de Organisatie mededeling van:
elke nieuwe ondertekening of nederlegging van een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, alsook de datum daarvan;
de datum van inwerkingtreding van dit Protocol;
de nederlegging van een akte van opzegging van dit Protocol, alsook de datum waarop deze werd ontvangen en de datum waarop de opzegging van kracht wordt;
de ontvangst van elke verklaring of kennisgeving uit hoofde van dit Protocol, of uit hoofde van het Verdrag met betrekking tot dit Protocol;
doet alle Staten die dit Protocol hebben ondertekend of ertoe zijn toegetreden voor eensluidend gewaarmerkte afschriften van dit Protocol toekomen.
Terstond na inwerkingtreding van dit Protocol zendt de Depositaris een voor eensluidend gewaarmerkt afschrift hiervan aan de Secretaris-Generaal van de Verenigde Naties ter registratie en publikatie overeenkomstig artikel 102 van het Handvest van de Verenigde Naties.
TEN BLIJKE WAARVAN de ondergetekenden, daartoe naar behoren gemachtigd door hun onderscheiden Regeringen, dit Protocol hebben ondertekend.
GEDAAN te Rome, de tiende maart negentienhonderd achtentachtig.
