European Patent Convention

Preamble

The Contracting States,

Desiring to strengthen co-operation between the States of Europe in respect of the protection of inventions,

Desiring that such protection may be obtained in those States by a single procedure for the grant of patents, and by the establishment of certain standard rules governing patents so granted,

Desiring, for this purpose, to conclude a Convention which establishes a European Patent Organisation and which constitutes a special agreement within the meaning of Article 19 of the Convention for the Protection of Industrial Property, signed in Paris on 20 March 1883 and last revised on 14 July 1967, and a regional patent treaty within the meaning of Article 45, paragraph 1, of the Patent Cooperation Treaty of 19 June 1970,

Within four months of filing the European patent application, the applicant shall file the certificate referred to in Article 55, paragraph 2, which:

    shall have the right to import duty-free their furniture and personal effects at the time of first taking up their post in the State concerned and the right on the termination of their functions in that State to export free of duty their furniture and personal effects, subject to the conditions considered necessary by the Government of the State in whose territory the right is exercised and with the exception of property acquired in that State which is subject to an export prohibition therein.

Experts performing functions on behalf of, or carrying out missions for, the Organisation shall enjoy the following privileges and immunities, to the extent that they are necessary for the carrying out of their functions, including during journeys made in carrying out their functions and in the course of such missions:

  • (a)

    immunity from jurisdiction in respect of acts done by them in the exercise of their functions, including words written or spoken, except in the case of a motor traffic offence committed by an expert or in the case of damage caused by a motor vehicle belonging to or driven by him; experts shall continue to enjoy this immunity after they have ceased to be employed by the Organisation;

    • a)

      Upon entry into force of the Convention, States parties thereto which are also members of the International Patent Institute set up by the Hague Agreement of 6 June 1947 shall take all necessary steps to ensure the transfer to the European Patent Office, no later than the date referred to in Article 162, paragraph 1, of the Convention, of all assets and liabilities and all staff members of the International Patent Institute. Such transfer shall be effected by an agreement between the International Patent Institute and the European Patent Organisation. The above States and the other States parties to the Convention shall take all necessary steps to ensure that that agreement shall be implemented no later than the date referred to in Article 162, paragraph 1, of the Convention. Upon implementation of the agreement, those Member States of the International Patent Institute which are also parties to the Convention further undertake to terminate their participation in the Hague Agreement.

    • b)

      The States parties to the Convention shall take all necessary steps to ensure that all the assets and liabilities and all the staff members of the International Patent Institute are taken into the European Patent Office in accordance with the agreement referred to in sub-paragraph (a). After the implementation of that agreement the tasks incumbent upon the International Patent Institute at the date on which the Convention is opened for signature, and in particular those carried out vis-à-vis its Member States, whether or not they become parties to the Convention, and such tasks as it has undertaken at the time of the entry into force of the Convention to carry out vis-à-vis States which, at that date, are both members of the International Patent Institute and parties to the Convention, shall be assumed by the European Patent Office. In addition, the Administrative Council of the European Patent Organisation may allocate further duties in the field of searching to the European Patent Office.

    • c)

      The above obligations shall also apply mutatis mutandis to the suboffice set up under the Hague Agreement under the conditions set out in the agreement between the International Patent Institute and the Government of the Contracting State concerned. This Government hereby undertakes to make a new agreement with the European Patent Organisation in place of the one already made with the International Patent Institute to harmonise the clauses concerning the organisation, operation and financing of the sub-office with the provisions of this Protocol.

  • 2.

    Subject to the provisions of Section III, the States parties to the Convention shall, on behalf of their central industrial property offices, renounce in favour of the European Patent Office any activities as International Searching Authorities under the Patent Cooperation Treaty as from the date referred to in Article 162, paragraph 1, of the Convention.

  • 3.
    • a)

      A sub-office of the European Patent Office shall be set up in Berlin as from the date referred to in Article 162, paragraph 1, of the Convention. It shall operate under the direction of the branch at The Hague.

    • b)

      The Administrative Council shall determine the duties to be allocated to the sub-office in Berlin in the light of general considerations and of the requirements of the European Patent Office.

    • c)

      At least at the beginning of the period following the progressive expansion of the field of activity of the European Patent Office, the amount of work assigned to that sub-office shall be sufficient to enable the examining staff of the Berlin Annex of the German Patent Office, as it stands at the date on which the Convention is opened for signature, to be fully employed.

    • d)

      The Federal Republic of Germany shall bear any additional costs incurred by the European Patent Organisation in setting up and maintaining the sub-office in Berlin.

SECTION

II

Subject to the provisions of Sections III and IV, the States parties to the Convention shall, on behalf of their central industrial property offices, renounce in favour of the European Patent Office any activities as International Preliminary Examining Authorities under the Patent Cooperation Treaty. This obligation shall apply only to the extent to which the European Patent Office may examine European patent applications in accordance with Article 162, paragraph 2, of the Convention and shall not apply until two years after the date on which the European Patent Office has begun examining activities in the areas of technology concerned, on the basis of a five-year plan which shall progressively extend the activities of the European Patent Office to all areas of technology and which may be amended only by decision of the Administrative Council. The procedures for implementing this obligation shall be determined by decision of the Administrative Council.

SECTION

III

  • 1.

    The central industrial property office of any State party to the Convention in which the official language is not one of the official languages of the European Patent Office, shall be authorised to act as an International Searching Authority and as an International Preliminary Examining Authority under the Patent Cooperation Treaty. Such authorisation shall be subject to an undertaking by the State concerned to restrict such activities to international applications filed by nationals or residents of such State and by nationals or residents of States parties to the Convention which are adjacent to that State. The Administrative Council may decide to authorise the central industrial property office of any State party to the Convention to extend such activities to cover such international applications as may be filed by nationals or residents of any non-Contracting State having the same official language as the Contracting State in question and drawn up in that language.

  • 2.

    For the purpose of harmonising search activities under the Patent Cooperation Treaty within the framework of the European system for the grant of patents, co-operation shall be established between the European Patent Office and any central industrial property office authorised under this Section. Such co-operation shall be based on a special agreement which may cover e.g. search procedures and methods, qualifications required for the recruitment and training of examiners, guidelines for the exchange of search and other services between the offices as well as other measures needed to establish the required control and supervision.

SECTION

IV

  • 1.
    • a)

      For the purpose of facilitating the adaptation of the national patent offices of the States parties to the Convention to the European patent system, the Administrative Council may, if it considers it desirable, and subject to the conditions set out below, entrust the central industrial property offices of such of those States in which it is possible to conduct the proceedings in one of the official languages of the European Patent Office with tasks concerning the examination of European patent applications drawn up in that language which, pursuant to Article 18, paragraph 2, of the Convention, shall, as a general rule, be entrusted to a member of the Examining Division. Such tasks shall be carried out within the framework of the proceedings for grant laid down in the Convention; decisions on such applications shall be taken by the Examining Division composed in accordance with Article 18, paragraph 2.

    • b)

      Tasks entrusted under subparagraph (a) shall not be in respect of more than 40% of the total number of European patent applications filed; tasks entrusted to any one State shall not be in respect of more than one third of the total number of European patent applications filed. These tasks shall be entrusted for a period of 15 years from the opening of the European Patent Office and shall be reduced progressively (in principle by 20% a year) to zero during the last 5 years of the period.

    • c)

      The Administrative Council shall decide, while taking into account the provisions of sub-paragraph (b), upon the nature, origin and number of the European patent applications in respect of which examining tasks may be entrusted to the central industrial property office of each of the Contracting States mentioned above.

    • d)

      The above implementing procedures shall be set out in a special agreement between the central industrial property office of the Contracting State concerned and the European Patent Organisation.

    • e)

      An office with which such a special agreement has been concluded may act as an International Preliminary Examining Authority under the Patent Cooperation Treaty, until the expiry of the period of 15 years.

  • 2.
    • a)

      If the Administrative Council considers that it is compatible with the proper functioning of the European Patent Office, and in order to alleviate the difficulties which may arise for certain Contracting States from the application of Section I, paragraph 2, it may entrust searching in respect of European patent applications to the central industrial property offices of those States in which the official language is one of the official languages of the European Patent Office, provided that these offices possess the necessary qualifications for appointment as an International Searching Authority in accordance with the conditions laid down in the Patent Cooperation Treaty.

    • b)

      In carrying out such work, undertaken under the responsibility of the European Patent Office, the central industrial property offices concerned shall adhere to the guidelines applicable to the drawing up of the European search report.

    • c)

      The provisions of paragraph 1(b), second sentence, and sub-paragraph d) of this Section shall apply to this paragraph.

SECTION

V

  • 1.

    The sub-office referred to in Section I, paragraph 1(c), shall be authorised to carry out searches, among the documentation which is at its disposal and which is in the official language of the State in which the sub-office is located, in respect of European patent applications filed by nationals and residents of that State. This authorisation shall be on the understanding that the procedure for the grant of European patents will not be delayed and that additional costs will not be incurred for the European Patent Organisation.

  • 2.

    The sub-office referred to in paragraph 1 shall be authorised to carry out, at the option of an applicant for a European patent and at his expense, a search on his patent application among the documentation referred to in paragraph 1. This authorization shall be effective until the search provided for in Article 92 of the Convention has been extended, in accordance with Section VI, to cover such documentation and shall be on the understanding that the procedure for the grant of European patents will not be delayed.

  • 3.

    The Administrative Council may also extend the authorisations provided for in paragraphs 1 and 2, under the conditions of those paragraphs, to the central industrial property office of a Contracting State which does not have as an official language one of the official languages of the European Patent Office.

VI

The search provided for in Article 92 of the Convention shall, in principle, be extended, in respect of all European patent applications, to published patents, published patent applications and other relevant documents of Contracting States not included in the search documentation of the European Patent Office on the date referred to in Article 162, paragraph 1, of the Convention. The extent, conditions and timing of any such extension shall be determined by the Administrative Council on the basis of a study concerning particularly the technical and financial aspects.

VII

The provisions of this Protocol shall prevail over any contradictory provisions of the Convention.

The decisions of the Administrative Council provided for in this Protocol shall require a three-quarters majority (Article 35, paragraph 2, of the Convention). The provisions governing the weighting of votes (Article 36 of the Convention) shall apply.

on the Interpretation of Article 69

1

General principles

Article 69 should not be interpreted as meaning that the extent of the protection conferred by a European patent is to be understood as that defined by the strict, literal meaning of the wording used in the claims, the description and drawings being employed only for the purpose of resolving an ambiguity found in the claims. Nor should it be taken to mean that the claims serve only as a guideline and that the actual protection conferred may extend to what, from a consideration of the description and drawings by a person skilled in the art, the patent proprietor has contemplated. On the contrary, it is to be interpreted as defining a position between these extremes which combines a fair protection for the patent proprietor with a reasonable degree of legal certainty for third parties.

Equivalents

For the purpose of determining the extent of protection conferred by a European patent, due account shall be taken of any element which is equivalent to an element specified in the claims.

Protocol

on the Staff Complement of the European Patent Office at The Hague (Protocol on Staff Complement)

The European Patent Organisation shall ensure that the proportion of European Patent Office posts assigned to the duty station at The Hague as defined under the 2000 establishment plan and table of posts remains substantially unchanged. Any change in the number of posts assigned to the duty station at The Hague resulting in a deviation of more than ten per cent of that proportion, which proves necessary for the proper functioning of the European Patent Office, shall be subject to a decision by the Administrative Council of the Organisation on a proposal from the President of the European Patent Office after consultation with the Governments of the Federal Republic of Germany and the Kingdom of the Netherlands.

Decision on Preparations for the Opening of the European Patent Office

The Conference for the setting up of a European System for the Grant of Patents, meeting at Munich on 5 October 1973,

Desiring to take all appropriate measures to enable the European Patent Office, in the interests of technical and economic development in Europe, to begin its activities as soon as possible,

Has adopted the following decision:

  • 1.

    Immediately after the conclusion of this Diplomatic Conference an Interim Committee comprising representatives of all the States which have signed the European Patent Convention shall be set up; Articles 26, 27, 31, 34 and 35, paragraphs 1 and 3, of the Convention shall apply mutatis mutandis to this Committee. The Interim Committee may draw up Rules of Procedure to supplement these provisions. The Interim Committee shall be disbanded when the Administrative Council meets pursuant to Article 159, paragraph 1, of the Convention.

  • 2.

    It shall be the duty of the Interim Committee to take all preparatory measures to enable the European Patent Office to begin its activities as soon as possible. For this purpose the Interim Committee shall be empowered to conclude provisional agreements with the Government of the Federal Republic of Germany and the Government of the Netherlands; such agreements shall require the subsequent approval of the Administrative Council. The Interim Committee shall also be empowered in particular to prepare the special agreements provided for in the Protocol on Centralisation, the five-year plan provided for in Section II of that Protocol and the study provided for in Section VI of that Protocol.

  • 3.

    The Interim Committee may set up an Executive Committee to be responsible for directing the preparations for setting up the European Patent Office, taking decisions in accordance with the Rules of Procedure of the Interim Committee and preparing the meetings of the Interim Committee.

  • 4.

    The preparations for the opening of the European Patent Office shall be carried out by Working Parties, each of which shall be composed, as a general rule, of no more than six delegations of the States represented on the Interim Committee. The delegations of the Federal Republic of Germany and the Netherlands may take part as observers in the meetings of Working Parties of which they are not members. The delegations of other States represented on the Interim Committee may be invited by Working Parties of which they are not members to take part as observers in meetings in which matters are discussed which are of particular interest to the States in question.

  • 5.

    The Interim Committee may invite inter-governmental and international non-governmental organisations to attend its meetings, those of the Executive Committee and those of the Working Parties as observers.

  • 6.

    The States, inter-governmental and international non-governmental organisations represented on the Interim Committee shall bear the costs of sending their delegates to meetings of the Interim Committee, the Executive Committee and the Working Parties.

  • 7.

    The Government of the Federal Republic of Germany shall issue the invitations to the inaugural meeting of the Interim Committee. It shall provide the premises and other facilities necessary for the interim work carried out at Munich and shall advance the amounts of the expenditure thus incurred. Such advances shall be refunded under the budget for the first accounting period of the European Patent Office as defined in Article 161 of the Convention.

Decision on Training Staff for the European Patent Office

The Conference for the setting up of a European System for the Grant of Patents, meeting at Munich on 5 October 1973,

Conscious that the efficient operation of the European Patent Office depends in large measure on the degree of preparation of the staff required for its various departments,

Having taken cognizance of the report drawn up by the Working Party on Training Staff for the European Patent Office, set up by the Inter-Governmental Conference for the setting up of a European System for the Grant of Patents,

Has adopted the following decision:

  • 1.

    The Interim Committee shall, as early as possible, establish guidelines for examining European patent applications.

  • 2.

    The Interim Committee shall draw up a plan for recruiting staff to the European Patent Office and shall establish the requirements to be satisfied by applicants.

  • 3.

    The Interim Committee shall draw up plans for centralised training and co-ordination of national training and shall establish a detailed programme. It shall in principle follow the guidelines set out in the report submitted to the Diplomatic Conference by the Working Party on Training Staff for the European Patent Office; in drawing up the detailed programme, it shall take as a basis for consideration the document annexed to the report.

  • 4.

    The Interim Committee shall be responsible for the co-ordination of the centralised and national training. It shall give directives to the bodies responsible for centralised training; it shall issue guidelines for national training.

  • 5.

    The signatory States shall, as far as practical, keep the Interim Committee informed of such action as they undertake at national level for the training of future applicants for posts at the European Patent Office.

  • 6.

    The signatory States, which are also Member States of the International Patent Institute, shall take the necessary steps to ensure that this decision is applied to the training activities of the Institute.

Verdrag inzake de verlening van Europese octrooien (Europees Octrooiverdrag)

    methoden voor de behandeling van het menselijk of dierlijk lichaam door chirurgische ingrepen of geneeskundige behandeling en diagnosemethoden die worden toegepast op het menselijk of dierlijk lichaam; deze bepaling is niet van toepassing op producten, in het bijzonder stoffen of mengsels, voor toepassing bij een van deze methoden.

Een Europese octrooiaanvrage, waaraan een datum van indiening is toegekend, is in de aangewezen Verdragsluitende Staten gelijkwaardig aan een regelmatig ingediende nationale octrooiaanvrage, in voorkomend geval rekening houdend met het recht van voorrang waarop voor de Europese octrooiaanvrage een beroep wordt gedaan.

Kennisgeving

Tentoonstellingsbewijzen

De aanvrager dient binnen vier maanden na de indiening van de Europese octrooiaanvrage het in artikel 55, tweede lid, bedoelde bewijsstuk over te leggen:

  • a.

    dat tijdens de tentoonstelling is afgegeven door de autoriteit, verantwoordelijk voor de bescherming van de industriële eigendom op die tentoonstelling;

  • b.

    waaruit blijkt dat de uitvinding daar daadwerkelijk is tentoongesteld;

  • c.

    dat de datum vermeldt waarop de tentoonstelling is geopend en eventueel de datum waarop de uitvinding voor het eerst is geopenbaard indien dit na die datum heeft plaatsgevonden; en

  • d.

    vergezeld gaat van een omschrijving van de uitvinding die als authentiek is gewaarmerkt door bovengenoemde autoriteit.

Octrooieerbare biotechnologische uitvindingen

Biotechnologische uitvindingen zijn tevens octrooieerbaar indien zij betrekking hebben op:

  • a.

    biologisch materiaal welke met behulp van een technische werkwijze uit zijn natuurlijke milieu wordt geïsoleerd of wordt verkregen, ook wanneer het in de natuur reeds voorhanden is;

  • b.

Het Europees Octrooibureau verstrekt de aanvrager op verzoek een gewaarmerkt afschrift van de Europese octrooiaanvrage (voorrangsbewijs) onder door de President van het Europees Octrooibureau vast te stellen voorwaarden, met inbegrip van de vorm van het voorrangsbewijs en de gevallen waarin een administratieve taks dient te worden betaald.

Onderzoek bij indiening

Indien bij het onderzoek bedoeld in artikel 90, eerste lid, blijkt dat de aanvrage niet voldoet aan de vereisten vervat in regel 40, eerste lid, onderdeel a of c, tweede lid of derde lid, eerste volzin, deelt het Europees Octrooibureau de gebreken mede aan de aanvrager en bericht hem dat, indien hij deze gebreken niet binnen twee maanden opheft, de aanvrage niet als Europese octrooiaanvrage zal worden behandeld. Indien de aanvrager tijdig de vastgestelde gebreken opheft, ontvangt hij een kennisgeving van de door het Bureau toegekende datum van indiening.

Behoudens het bepaalde in de artikelen 4 en 5, wordt een rechtsvordering tegen de aanvrager van een Europees octrooi, die zijn woonplaats of zetel heeft in een van de Verdragsluitende Staten, ingesteld door de rechterlijke instanties van bedoelde Verdragsluitende Staat.

Behoudens het bepaalde in de artikelen 4 en 5 zijn, indien de aanvrager van een Europees octrooi noch zijn woonplaats noch zijn zetel in een van de Verdragsluitende Staten heeft en indien de persoon die de aanspraak op verlening van het Europees octrooi doet gelden zijn woonplaats of zetel wel in een van de Verdragsluitende Staten heeft, alleen de rechterlijke instanties van laatstbedoelde Staat bevoegd.

Indien de Europese octrooiaanvrage een uitvinding van een werknemer betreft, zijn voor rechtsvorderingen, waar de werkgever en de werknemer tegenover elkaar staan, behoudens het bepaalde in artikel 5, alleen de rechterlijke instanties van die Verdragsluitende Staat bevoegd, volgens het recht waarvan het recht op het Europees octrooi wordt bepaald overeenkomstig artikel 60, eerste lid, tweede volzin, van het Verdrag.

  • b)

    de aanvrager van een Europees octrooi bewijst dat de beslissing onverenigbaar is met een andere beslissing, genomen ten aanzien van een tussen dezelfde partijen in een Verdragsluitende Staat aanhangig gemaakte rechtsvordering, die eerder is ingesteld dan de rechtsvordering ten aanzien waarvan de beslissing, waarvoor erkenning wordt gevraagd, werd genomen.

De personeelsleden van de Organisatie

  • a)

    genieten, ook nadat zij hun functies beëindigd hebben, vrijstelling van rechtsvervolging met betrekking tot handelingen, waaronder begrepen gesproken en geschreven woorden, door hen in de uitoefening van hun functie verricht; deze immuniteit geldt evenwel niet in geval van een verkeersovertreding begaan door een personeelslid van de Organisatie, noch in geval van schade die is veroorzaakt door een motorvoertuig dat toebehoort aan of bestuurd werd door een personeelslid;

  • b)

    zijn vrijgesteld van alle verplichtingen met betrekking tot de militaire dienst;

  • c)

    genieten onschendbaarheid met betrekking tot al hun officiële papieren en documenten;

  • d)

    genieten, evenals hun inwonende gezinsleden, dezelfde faciliteiten ten aanzien van vrijstelling van alle maatregelen die de immigratie beperken en de inschrijving van vreemdelingen regelen, als die welke in het algemeen worden toegekend aan personeelsleden van internationale organisaties;

  • e)

    genieten dezelfde voorrechten met betrekking tot deviezenregelingen als die welke in het algemeen worden toegekend aan de personeelsleden van internationale organisaties;

  • f)

    genieten bij een internationale crisis, wat terugkeer naar hun vaderland betreft, dezelfde faciliteiten als die welke diplomatieke vertegenwoordigers worden toegekend; hun inwonende gezinsleden genieten dezelfde faciliteiten;

  • g)

    hebben het recht, wanneer zij voor de eerste maal hun werkzaamheden in de betrokken Staat aanvangen, hun meubelen en persoonlijke bezittingen vrij van rechten in te voeren, en hebben, wanneer zij hun functie in die Staat beëindigen, het recht hun meubelen en persoonlijke bezittingen vrij van rechten uit te voeren, met inachtneming van de voorwaarden die de Regering van de Staat op het grondgebied waarvan dit recht wordt uitgeoefend noodzakelijk acht en met uitzondering van de goederen welke in die Staat zijn aangeschaft en waarvoor aldaar een uitvoerverbod bestaat.

Deskundigen genieten tijdens het uitoefenen van hun werkzaamheden voor de Organisatie of tijdens het uitvoeren van missies voor de Organisatie, alsook tijdens reizen die zij in verband daarmee maken, de volgende voorrechten en immuniteiten, voor zover deze noodzakelijk zijn voor de uitoefening van hun functie:

  • a)

    vrijstelling van rechtsvervolging met betrekking tot door hen tijdens de uitoefening van hun functie verrichte handelingen, waaronder begrepen geschreven of gesproken woorden, behoudens in geval van een door een deskundige begane verkeersovertreding, of in geval van schade veroorzaakt door een hem toebehorend of door hem bestuurd motorvoertuig; ook na beëindiging van hun functie bij de Organisatie genieten de deskundigen deze immuniteit;

  • b)

    onschendbaarheid ten aanzien van al hun officiële papieren en documenten;

  • c)

    deviezenfaciliteiten die nodig zijn voor het overmaken van hun vergoedingen.

De Raad van Bestuur bepaalt op welke categorieën personeelsleden het bepaalde in artikel 14, geheel of gedeeltelijk, en in artikel 16 van toepassing is, alsmede op welke categorieën deskundigen het bepaalde in artikel 15 van toepassing is. De namen, titels en adressen van de personeelsleden en deskundigen van die categorieën worden op gezette tijden ter kennis gebracht van de Verdragsluitende Staten.

Indien de Organisatie een eigen systeem voor sociale verzekering instelt, zijn de Organisatie en de personeelsleden van het Europees Octrooibureau vrijgesteld van alle verplichte bijdragen aan de nationale sociale verzekeringsorganen, met inachtneming van de overeenkomsten, die zij, overeenkomstig het bepaalde in artikel 25, met de Verdragsluitende Staten sluit.

Elke Verdragsluitende Staat behoudt zich het recht voor alle voorzorgen te treffen die nodig zijn in het belang van zijn veiligheid.

Geen enkele Verdragsluitende Staat is verplicht de in de artikelen 12, 13, 14, letters b), e) en g), en 15, letter c), bedoelde voorrechten en immuniteiten toe te kennen aan:

  • a)

    zijn eigen onderdanen;

  • b)

    personen die bij de aanvang van hun werkzaamheden bij de Organisatie hun vaste woonplaats in die Staat hebben en die niet behoren tot het personeel van een andere intergouvernementele organisatie dat overgaat naar de Organisatie.

De Organisatie kan, bij besluit van de Raad van Bestuur, met een of meer Verdragsluitende Staten aanvullende overeenkomsten aangaan ten einde uitvoering te geven aan de bepalingen van dit Protocol met betrekking tot die Staat of die Staten, alsmede andere regelingen treffen ter waarborging van een goede functionering van de Organisatie en ter beveiliging van haar belangen.

inzake de centralisatie en de invoering van het Europees octrooistelsel (Protocol inzake de centralisatie)

AFDELING

I

  • 1.
    • a.

      Op de datum van inwerkingtreding van het Verdrag nemen de Staten die partij zijn bij het Verdrag en die eveneens lid zijn van het Internationaal Octrooi Instituut, opgericht bij de Overeenkomst van 's-Gravenhage van 6 juni 1947, alle noodzakelijke maatregelen om de overgang te verzekeren van alle activa en alle passiva, alsmede het gehele personeel van het Internationaal Octrooi Instituut naar het Europees Octrooibureau, uiterlijk op de in artikel 162, eerste lid, van het Verdrag bedoelde datum. De wijze van overgang wordt vastgelegd in een overeenkomst tussen het Internationaal Octrooi Instituut en de Europese Octrooiorganisatie. De bovenbedoelde Staten, alsmede de andere Staten die partij zijn bij het Verdrag, nemen alle noodzakelijke maatregelen opdat deze overeenkomst uiterlijk op de in artikel 162, eerste lid, van het Verdrag bedoelde datum wordt toegepast. Op de datum waarop deze overeenkomst van toepassing wordt, verplichten de Staten, die lid zijn van het Internationaal Octrooi Instituut en die eveneens partij zijn bij het Verdrag, zich bovendien hun deelneming aan de Overeenkomst van ’s-Gravenhage te beëindigen.

    • b.

      De Staten die partij zijn bij het Verdrag nemen alle noodzakelijke maatregelen opdat, overeenkomstig het bepaalde in de overeenkomst bedoeld onder onderdeel a, alle activa en alle passiva, alsmede het gehele personeel van het Internationaal Octrooi Instituut, opgaan in het Europees Octrooibureau. Zodra deze overeenkomst van toepassing wordt, zal het Europees Octrooibureau zich belasten met enerzijds de taken welke op het Internationaal Octrooi Instituut rusten op de datum waarop het Verdrag voor ondertekening wordt opengesteld en in het bijzonder die taken die het dan verricht voor de Staten, die lid van het Instituut zijn, ongeacht of zij partij worden bij het Verdrag, en anderzijds de taken die het bij de inwerkingtreding van het Verdrag op zich heeft genomen te vervullen voor die Staten die op die datum zowel lid zijn van het Internationaal Octrooi Instituut als partij bij het Verdrag. Bovendien kan de Raad van Bestuur van de Europese Octrooiorganisatie het Europees Octrooibureau andere taken op het gebied van het nieuwheidsonderzoek opdragen.

    • c.

      De bovenbedoelde verplichtingen gelden eveneens ten aanzien van het bijkantoor dat is opgericht op grond van de Overeenkomst van ’s-Gravenhage en onder de voorwaarden die zijn vastgelegd in de tussen het Internationaal Octrooi Instituut en de regering van de betrokken Verdragsluitende Staat gesloten overeenkomst. Deze regering verbindt zich met de Europese Octrooiorganisatie een nieuwe overeenkomst te sluiten, welke in de plaats treedt van de reeds met het Internationaal Octrooi Instituut gesloten overeenkomst, teneinde de bepalingen betreffende de organisatie, het functioneren en de financiering van het bijkantoor in overeenstemming te brengen met de bepalingen van dit Protocol.

  • 2.

    Behoudens het bepaalde in Afdeling III, zullen de Staten, die partij zijn bij het Verdrag, voor hun centrale diensten voor de industriële eigendom ten gunste van het Europees Octrooibureau, afzien van alle werkzaamheden in de hoedanigheid van Instantie voor Internationaal Nieuwheidsonderzoek in de zin van het Verdrag tot samenwerking inzake octrooien, en zulks vanaf de in artikel 162, eerste lid, van het Verdrag bedoelde datum.

  • 3.
    • a.

      Met ingang van de in artikel 162, eerste lid, van het Verdrag bedoelde datum wordt te Berlijn een bijkantoor van het Europees Octrooibureau opgericht. Het ressorteert onder het onderdeel te Den Haag.

    • b.

      De Raad van Bestuur stelt vast welke taken aan het bijkantoor te Berlijn worden toegekend, waarbij rekening wordt gehouden met algemene overwegingen en met de behoeften van het Europees Octrooibureau.

    • c.

      De omvang van de aan dit bijkantoor opgedragen werkzaamheden moet, ten minste aan het begin van de periode volgende op de periode van geleidelijke uitbreiding van het werkterrein van het Europees Octrooibureau, zodanig zijn dat volledige werkgelegenheid wordt geboden aan het met het onderzoek belaste personeel van het bijkantoor te Berlijn van het Duitse Octrooibureau, zoals dat in dienst is op de datum waarop het Verdrag ter ondertekening wordt opengesteld.

    • d.

      De Bondsrepubliek Duitsland draagt alle bijkomende kosten die voor de Europese Octrooiorganisatie voortvloeien uit de oprichting en het doen functioneren van het bijkantoor te Berlijn.

AFDELING

II

  • 2.

    Behoudens het bepaalde in de afdelingen III en IV, zullen de Staten die partij zijn bij het Verdrag, voor hun centrale diensten voor de industriële eigendom ten gunste van het Europees Octrooibureau, afzien van alle werkzaamheden in de hoedanigheid van Instantie voor Internationale Voorlopige Beoordeling in de zin van het Verdrag tot samenwerking inzake octrooien. Deze verplichting wordt slechts van kracht voor zover het Europees Octrooibureau Europese octrooiaanvragen op grond van artikel 162, tweede lid, van het Verdrag kan onderzoeken, en wel eerst twee jaar na de datum waarop het Europees Octrooibureau zijn onderzoekswerkzaamheden is begonnen op de desbetreffende technische gebieden, volgens een vijfjarenplan, waarbij de bevoegdheid van het Europees Octrooibureau geleidelijk wordt uitgebreid tot alle gebieden van de techniek en dat alleen kan worden gewijzigd door een besluit van de Raad van Bestuur. De wijze waarop deze verplichting dient te worden toegepast, wordt bepaald door een besluit van de Raad van Bestuur.

AFDELING

III

  • 1.

    De centrale dienst voor de industriële eigendom van iedere Staat die partij is bij het Verdrag en waarvan de officiële taal niet een van de officiële talen van het Europees Octrooibureau is, is bevoegd tot het uitoefenen van werkzaamheden in de hoedanigheid van Instantie voor het Internationaal Nieuwheidsonderzoek en in de hoedanigheid van Instantie voor Internationale Voorlopige Beoordeling in de zin van het Verdrag tot samenwerking inzake octrooien. Aan deze bevoegdheid is voor de betrokken Staat de verplichting verbonden deze werkzaamheden te beperken tot de internationale aanvragen die worden ingediend door de onderdanen van die Staat of door personen die op het grondgebied van die Staat hun woonplaats of zetel hebben, alsmede door de personen die onderdaan zijn van of hun woonplaats of zetel hebben op het grondgebied van de Staten welke partij zijn bij het Verdrag en die aan deze Staat grenzen. De Raad van Bestuur kan besluiten de centrale dienst voor de industriële eigendom van een Staat die partij is bij het Verdrag toestemming te verlenen om bedoelde werkzaamheden uit te breiden tot de internationale aanvragen die worden ingediend door personen die onderdaan zijn van of hun woonplaats of zetel hebben op het grondgebied van een Staat die geen partij is bij het Verdrag en die dezelfde officiële taal heeft als de betrokken Verdragsluitende Staat, en welke aanvragen in die taal zijn opgesteld.

  • 2.

    Teneinde binnen het Europees stelsel van octrooiverlening de op het nieuwheidsonderzoek gerichte werkzaamheden in de zin van het Verdrag tot samenwerking inzake octrooien te harmoniseren, wordt samenwerking tot stand gebracht tussen het Europees Octrooibureau en iedere centrale dienst voor de industriële eigendom die op grond van deze afdeling bevoegd is tot het uitoefenen van dergelijke werkzaamheden. Deze samenwerking is gebaseerd op een bijzondere overeenkomst die bijvoorbeeld ook betrekking kan hebben op de procedures en methoden voor het nieuwheidsonderzoek, de vereisten ten aanzien van de werving en de opleiding van de onderzoekers, de richtlijnen voor het uitwisselen van gegevens omtrent het nieuwheidsonderzoek en van andere diensten tussen de autoriteiten, alsmede op andere maatregelen die noodzakelijk zijn in verband met de controle en het toezicht.

AFDELING

IV

  • 1.
    • a.

      Teneinde het voor de nationale octrooibureaus van de Staten die partij zijn bij het Verdrag te vergemakkelijken zich aan te passen aan het Europese octrooistelsel, kan de Raad van Bestuur, indien hij zulks wenselijk acht en onder de hierna omschreven voorwaarden, de centrale diensten voor de industriële eigendom van die Staten, waar de procedure in een van de officiële talen van het Europees Octrooibureau kan worden gevoerd, de behandeling opdragen van de in die taal gestelde octrooiaanvragen, welke behandeling, ingevolge artikel 18, tweede lid, van het Verdrag, in het algemeen wordt opgedragen aan een van de onderzoekers van de onderzoeksafdeling. Deze werkzaamheden worden uitgevoerd in het kader van de verleningsprocedure bedoeld in het Verdrag; de op deze aanvragen betrekking hebbende beslissingen worden genomen door de onderzoeksafdeling in de samenstelling bedoeld in artikel 18, tweede lid.

    • b.

      De op grond van het bepaalde in onderdeel a opgedragen werkzaamheden mogen niet meer dan 40% van het totaal van de ingediende Europese octrooiaanvragen omvatten; de aan een Staat opgedragen werkzaamheden mogen niet meer dan een derde van het totaal van de ingediende Europese octrooiaanvragen omvatten. Deze werkzaamheden worden opgedragen voor een tijdvak van vijftien jaar vanaf de datum waarop het Europees Octrooibureau wordt geopend en dienen gedurende de laatste vijf jaar van dat tijdvak (in beginsel met 20% per jaar) tot nul te worden teruggebracht.

    • c.

      Rekening houdend met het bepaalde in onderdeel b, besluit de Raad van Bestuur over de aard, de oorsprong en het aantal van de Europese octrooiaanvragen waarvan de behandeling kan worden opgedragen aan de centrale dienst voor de industriële eigendom van elk van de bovengenoemde Verdragsluitende Staten.

    • d.

      De wijze van toepassing wordt vastgesteld in een bijzondere overeenkomst tussen de centrale dienst voor de industriële eigendom van de betrokken Verdragsluitende Staat en de Europese Octrooiorganisatie.

    • e.

      Een octrooibureau waarmee een dergelijke bijzondere overeenkomst is gesloten, kan tot aan het einde van het tijdvak van vijftien jaar werkzaamheden uitoefenen in de hoedanigheid van Instantie voor Internationale Voorlopige Beoordeling in de zin van het Verdrag tot samenwerking inzake octrooien.

  • 2.
    • a.

      Indien de Raad van Bestuur van oordeel is dat zulks niet in strijd is met het goed functioneren van het Europees Octrooibureau, kan hij, ter ondervanging van de moeilijkheden die voor sommige Verdragsluitende Staten kunnen voortvloeien uit de toepassing van het bepaalde in Afdeling I, tweede lid, aan de centrale diensten voor de industriële eigendom van de Staten, waarvan de officiële taal een van de officiële talen van het Europees Octrooibureau is, op Europese octrooiaanvragen betrekking hebbende werkzaamheden op het gebied van het nieuwheidsonderzoek opdragen, mits deze diensten de vereiste bekwaamheid bezitten om te worden aangewezen als Instantie voor het Internationaal Nieuwheidsonderzoek onder de voorwaarden bedoeld in het Verdrag tot samenwerking inzake octrooien.

    • b.

      Bij de uitvoering van deze werkzaamheden, die worden verricht onder de verantwoordelijkheid van het Europees Octrooibureau, dienen de betrokken centrale diensten zich te houden aan de richtlijnen die van toepassing zijn op het opstellen van het verslag van het Europees nieuwheidsonderzoek.

    • c.

      De bepalingen van het eerste lid, onderdeel b, tweede volzin, en van onderdeel d van deze afdeling zijn op dit lid van toepassing.

AFDELING

V

  • 1.

    Het bijkantoor bedoeld in afdeling I, eerste lid, onderdeel c, is bevoegd om, voor de Europese octrooiaanvragen die zijn ingediend door de onderdanen van de Staat waarin dat bijkantoor is gevestigd en door personen die hun woonplaats of zetel op het grondgebied van die Staat hebben, nieuwheidsonderzoek te verrichten aan de hand van de documentatie waarover het beschikt en voor zover deze is gesteld in de officiële taal van die Staat. Deze bevoegdheid mag evenwel geen vertraging medebrengen in de Europese procedure en geen extra kosten voor de Europese Octrooiorganisatie.

  • 2.

    Het in het eerste lid bedoelde bijkantoor is bevoegd, indien de aanvrager van een Europees octrooi zulks verlangt en hiervan de kosten draagt, een nieuwheidsonderzoek uit te voeren dat betrekking heeft op zijn octrooiaanvrage aan de hand van de documentatie bedoeld in het eerste lid. Deze bevoegdheid geldt zolang het in artikel 92 van het Verdrag bedoelde nieuwheidsonderzoek niet overeenkomstig het bepaalde in afdeling VI is uitgebreid tot deze documentatie, en mits de procedure van octrooiverlening daardoor niet vertraagd wordt.

  • 3.

    De Raad van Bestuur kan de in het eerste en tweede lid bedoelde bevoegdheden onder de in die leden vastgestelde voorwaarden, uitbreiden tot de centrale diensten voor de industriële eigendom van de Verdragsluitende Staten die niet als officiële taal een van de officiële talen van het Europees Octrooibureau hebben.

AFDELING

VI

Het nieuwheidsonderzoek bedoeld in artikel 92 van het Verdrag wordt, in beginsel, voor alle Europese octrooiaanvragen uitgebreid tot gepubliceerde octrooien en octrooiaanvragen, alsmede tot de andere van belang zijnde documenten van Verdragsluitende Staten, die op de datum bedoeld in artikel 162, eerste lid, van het Verdrag niet in de op het nieuwheidsonderzoek betrekking hebbende documentatie van het Europees Octrooibureau voorkomen. De omvang, de voorwaarden en het tijdstip voor de toepassing van een dergelijke uitbreiding worden vastgesteld door de Raad van Bestuur op grond van een onderzoek dat voornamelijk zal zijn gericht op de technische en financiële aspecten.

Wanneer bepalingen van het Verdrag in strijd zijn met bepalingen van dit Protocol, hebben de bepalingen van dit Protocol voorrang.

De in dit Protocol bedoelde besluiten van de Raad van Bestuur worden genomen met een drie vierde meerderheid (artikel 35, tweede lid, van het Verdrag). De bepalingen inzake de weging van de stemmen (artikel 36 van het Verdrag) zijn van toepassing.

Algemene beginselen

Artikel 69 mag niet worden uitgelegd als zou de beschermingsomvang van het Europees octrooi strikt worden bepaald door de letterlijke tekst van de conclusies en als zouden de beschrijving en de tekeningen slechts mogen dienen om de onduidelijkheden, die in de conclusies zouden kunnen voorkomen, op te heffen. Artikel 69 mag evenmin worden uitgelegd als zouden de conclusies alleen als richtlijn dienen en als zou de beschermingsomvang zich ook uitstrekken tot hetgeen de octrooihouder, naar het oordeel van de vakman die de beschrijving en de tekeningen bestudeert, heeft willen beschermen. De uitleg dient daarentegen tussen deze twee uitersten het midden te houden, waarbij zowel een billijke bescherming aan de octrooihouder als een redelijke mate van rechtszekerheid aan derden wordt geboden.

Equivalenten

Bij het vaststellen van de beschermingsomvang van het Europees octrooi dient op passende wijze rekening te worden gehouden met elk element dat gelijkwaardig is aan een in de conclusies omschreven element.

inzake het personeelsbestand van het Europees Octrooibureau te Den Haag (Protocol inzake het personeelsbestand)

De Europese Octrooiorganisatie waarborgt dat het aandeel van de formatieplaatsen van het Europees Octrooibureau dat is toegewezen aan de vestiging te Den Haag, zoals dat is vastgelegd in het Organisatie- en Personeelsplan voor het jaar 2000, in essentie ongewijzigd blijft. Voor iedere verandering in het aandeel posten die zijn toegekend aan de vestiging te Den Haag, die leidt tot een afwijking van meer dan tien procent van dat aandeel, die noodzakelijk blijkt voor het naar behoren functioneren van het Europees Octrooibureau, is een besluit van de Raad van Bestuur van de Organisatie nodig op voorstel van de President van het Europees Octrooibureau, na overleg met de Regeringen van de Bondsrepubliek Duitsland en het Koninkrijk der Nederlanden.
